RESOLUTION NO.

12-R-118 A RESOLUTION RECOMMENDING CHANGES TO CHAPTERS 1135 AND 1155 OF THE MENTOR MUNICIPAL ZONING CODE, AND DECLARING AN EMERGENCY WHEREAS, the City of Mentor currently does not permit the establishment of commercial firing ranges within city limits but desires to allow such use as a conditionally permitted activity in industrial zoned areas; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MENTOR, COUNTY OF LAKE, STATE OF OHIO: SECTION 1. The Mentor City Council hereby initiates an amendment to the Mentor Municipal Zoning Code by referring the following proposed changes to the Planning Commission for its recommendation on these or any additional changes relating to permitting commercial firing ranges in Industrial Districts: 1135.01 CONDITIONAL USE PERMITS REQUIRED. (a) As set forth in Chapter 1155, Conditional Use Permits shall be required as follows: C-1, R-1, R-2, R-3, R-4, R-5 Churches Recreational Uses Schools Public Facilities Agricultural and Horticultural Uses (except C-1, permitted per Chapter 1155) Cemeteries Home occupations Renting of Rooms Family Homes for Mentally Retarded/ Developmentally Disabled Children or Adults C-1 Heights over 35 feet. C-2 Heights over 50 feet Other similar uses R-10 Home occupations Private Schools Independent Living Development RVG Renting of Rooms Home occupation

Adult Group Home Licensed Residential Group Facility for mentally retarded/developmentally disabled children or adults

B-1 Neighborhood Convenience Retail and Services

(1) Airports, heliports and helistops. (2) (EDITORS NOTE: Subsection (2) was deleted by Ordinance 10O-68, passed September 21, 2010.) (3) Electric substations. (4) Telephone exchanges. (5) Water towers. (6) Pumping stations. (7) Installations for commercial transmission of radio or television or the placement of wireless telecommunication towers. (8) Gas regulation stations. (9) Oil and gas wells provided, however, that in Single Family, MultiFamily, Village Green and Mobile Home Districts said wells shall be used only for on-site residential use and shall not exceed 1,000 feet in depth. (10) Power lines in excess of 13,200 kv. (11) Temporary events unless in compliance with Section 1165.03, Temporary Events. (12) Railroad tracks and facilities. (13) Wastewater treatment facilities. Passed 9-21-10.) 1155.01 Schedule of District Regulations To include Commercial Indoor Firing Ranges as a conditionally permitted use in the Industrial Park (MIP) District, Light Manufacturing (M-1) District, and the Heavy Manufacturing (M-2) District. SECTION 2. That it is found and determined that all formal actions of this Council concerning and relating to the passage of this resultion were adopted in an open meeting of this Council and that, except as otherwise provided by Section 121.22 of the

Ohio Revised Code, all deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. SECTION 3. That this Resolution is hereby declared to be an emergency measure necessary for the preservation of the public peace, health, welfare and safety of the inhabitants of this city, and for the further reason to meet application deadlines; WHEREFORE, this ordinance shall take effect and be in force from and immediately upon its passage.
