WHEREAS the Landlord and Tenants entered into that certain residential Lease Agreement on May 25, 2012 for the premises located at 1253 Bayshore drive, Englewood, Fl, 34223 (hereinafter referred to as the “Lease”) for the period beginning the 1st day of July, 2012, and ending on the 30th day of June, 2013. WHEREAS the Landlord is holding that certain security deposit and advance rent for the benefit of Tenants pursuant to Section 83.49(1), Florida Statutes, in the amount of Three- Thousand Seven Hundred Dollars and 00/100 ($3,700.00), as provided for in the Lease. WHEREAS the Tenants have requested of Landlord that Tenants be released from any further obligations due and owing under the Lease. WHEREAS Landlord is agreeable to such early termination subject to the terms and conditions contained herein. NOW THEREFORE, for and in consideration of the covenants, terms and agreements contained herein, the parties mutually agree as follows: 1. The above recitations as contained herein are incorporated herein as if fully restated. 2. That Tenants hereby surrender, deliver, and forfeit, all of Tenants rights, title and interest in and to: a. one half of one-month’s rent and the cost of moving furniture in the amount of Six Hundred Thirty-Five and 00/100 Dollars ($635.00) if the Landlord does not relet the premises on or before July 1, 2012, and hereby waives any right to Notice pursuant to Section 83.4(3)(a). Such wavier and acknowledgment acting as an independent to Landlord to enter into this Agreement; or b. if the Landlord does relet the premises on or before July 1, 2012, the Landlord shall only be entitled to the cost of moving furniture in the amount of Sixty and 00/100 Dollars ($60.00); and c.
