Mr. Weiner: As legal counsel for www.thedirty.com, I receive a lot of letters from lawyers. Nearly all of these letters pompously “instruct” or “command” my client to cease and desist from publishing something. Nearly all of these letters contain needlessly long arguments and threats explaining why my client is not protected by the Communications Decency Act even though opposing counsel has never litigated a CDA case before (whereas I have personally litigated more than 40+ CDA cases). I find these letters depressing. I find them depressing because the attorneys who send them either do not understand the law (unacceptable) or they are willing to abandon their ethics and make false statements of fact and/or law in a desperate effort to help their clients (totally unacceptable). In either case, 99% of the time I respond by explaining my client will not agree to comply with the request. After all, my client is lawfully vested with sole editorial discretion in choosing which posts to keep and which to remove. As such, why would he exercise that discretion in favor of a dishonest and unethical bully? He would not and neither would I. Unlike the vast majority of letters I receive, yours was short and to the point. You made no threats. You made no false statements. Instead, you simply presented a request on behalf of your client in a professional and polite manner. In contrast to the endless stream of unprofessional and vitriolic letters I have received, this approach was much appreciated.
