Under Oregon's new Attorney General, Ellen F. Rosenblum, Oregonians no longer have Consumer Fraud Protection against major corporations; especially those buying elections.
Re: Oregon Department of Justice [ORDOJ] Unlawful Trade Practices Complaint [UTPA], Case file No. FF3523-12 against T-Mobile USA, Inc. Addendums below.
Attorney General, Ellen F. Rosenblum, is she the top law enforcement officer or a shield for major corporate brands committing frauds and other crimes in the State of Oregon? Rosenblum's mission statement should be changed to read, "responsive and committed to serving" too big to fail monopolies with corporate personhood through acts of unequal justice and duplicitous selective prosecution. With a chipmunk smile on her face, Oregon's new Attorney General has lowered the bar into the corporatist sewer and unlike her predecessors, appears will no longer investigate crystal clear cases of consumer fraud under the Oregon Unlawful Trade Practices Act; at least not against T-Mobile USA, Inc. As a consumer advocate it remains my continuing hope to work in parallel with the Oregon DOJ Consumer and Financial Fraud Division. However, Ms. Rosenblum seems intent on subverting the positive labors of consumer advocates like me who volunteer many hours towards the protection of Oregonians and the nation. Following my mustering out of national service after two traumas incurred in the line of duty and being left permanently disabled, I began to speak out against consumer fraud while continuing to serve the people. Additionally after recognizing a human need, I expanded my advocacy to include and support our newcomers with limited English language skills, the elderly, and those too exhausted from the day to rise and fight the culture of corruption that has converted the dream and promise of America into the guarantee of a virtual death camp environment. Attorney General, Ellen F. Rosenblum has failed in her mission statement to protect the public in Oregon. Rosenblum might investigate and track sex offenders, but in this matter she's wearing TMobile's corporate badge to shield that German corporation from investigative prosecution. As a consumer advocate in the State of Oregon, under Ted Kulongoski and Hardy Myers, consumer complaints found positive resolutions with no discernible difficulties. Then with the election of John Kroger, a trend towards selective prosecution became apparent after discovering a Kroger Inc. business utilizing cash-register scanning software that would process 80% of identical items at the sale price and 20% at the normal price. That complaint and several others were requested by various federal investigative agencies. In that previous matter and now with T-Mobile USA, Inc., both Attorney General, John Kroger and the current Attorney General, Ellen F. Rosenblum, mirrored the same excuse that "not enough citizens filed complaints" as a means of subverting an investigation. In each case multiple customers were observed having to challenge the receipts from the corrupted scanning software and a number of sources have communicated similar or identical fraudulent experiences with T-Mobile USA, Inc. The resulting harm leaves Oregonians deserving better from their Attorney Generals.
On Monday, July 16, 2012 a Consumer Complaint was filed with the Oregon Attorney General that later included addendums as shown below. This summary report was reduced from an eighty page consumer fraud complaint against T-Mobile USA, Inc. that has since filed for Bankruptcy. TMobile USA, Inc. has remained a corrupt business with a recent history that recognizes the SEC/USDOJ applying the federal antitrust laws against their corporation's failed monopoly merger with AT&T. My recommendation to Oregonians and all U.S. consumers is that you completely avoid T-Mobile USA, Inc. for the stated reason within this manifesto. For several weeks I requested an on camera interview with each of the local corporate media outlets to alert my fellow Oregonians that it appears our new Oregon Attorney General will no longer support the investigation and civil/criminal prosecutions of T-Mobile USA, Inc. under the guise that "not enough Oregonians have filed consumer complaints against this business." In all of this there is the color of a continuing corporate coup d'état against the dream and promise of America that seems treasonously supported throughout government. Never forget, never kneel and never surrender in your knowledge that I have remained standing for the American people as a consumer advocate and patriot. Throughout my previous career as a criminal investigator and now as a consumer advocate for over a decade, I have fought for genuine equal justice under the law on behalf of the people. Meanwhile and at the same time as a blacklisted FBI Whistleblower, Investigative Journalist and Consumer Advocate, I have endured being sanctioned at both the state and federal levels while told that I "will never again find employment in America." Beyond that and while still fighting for humanity, my personal existence has remained one of ongoing covert and overt acts of terrorism and torture by known government actors and entities in multiple violations under the same laws that applied in the Valerie Plame Wilson matter. In other words, a repeated frequency of occurrences ranging from insidious to blatant acts of depraved indifference under what some recognize as the principles supporting the CIA Torture Paradigm and the agenda of corporatism, which is to process the total aggregate of the world into a commodity. So my fellow Oregonians and American human brothers and sisters, if you have experienced a consumer fraud by T-Mobile USA, Inc., now is the time to immediately file your complaints with Oregon Attorney General, Ellen F. Rosenblum and the other Attorney Generals of our nation; ref: http://www.naag.org/current-attorneys-general.php In the face of Oregon Attorney General, Ellen F. Rosenblum's failure to investigate, because not enough citizens have complained, T-Mobile USA, Inc., a German corporation, has confirmed they are in total concurrence with the details found within my consumer complaint that outlines three telephonic contractual conversations. My Unlawful Trade Practices Act complaint that was under action by the State of Oregon has since been neutralized by Ms. Rosenblum's deliberate failure to perform. During the final three-way telephonic conference call lasting one hour with T-Mobile USA, Inc., we transferred the ownership responsibility for one of my three numbers with T-Mobile USA, Inc. to my son/stepson. Within that process, T-Mobile USA, Inc.'s customer service representative [CSR] and her supervisor negotiated and established the terms of a two year contract lock-in that was based on the two previous telephonic conversations with other T-Mobile USA, Inc.'s CSRs. My background tasks me to write down everything in a manner conducive for the eventuality that a business deal might end up in court. We agreed in good faith to the terms and quoted University of Washington student discount. Immediately thereafter with willful aforethought, Mens Rae, Actus Reus and a Resulting Harm, T-Mobile USA, Inc. knowingly committed a bait-and-switch fraud to dehorse my son/stepson from the terms of the contract by changing the agreed monthly fee to a significantly higher dollar amount than was quoted and converted the $15.00 a month student discount to a 15% a month student discount. Again, TMobile USA, Inc. is total concurrence of their commission of a fraud and still they have remained protected by Oregon Attorney General, Ellen F. Rosenblum. After filing the Oregon UTPA Consumer Fraud Complaint, T-Mobile USA, Inc.'s advanced escalation executive, contacted me telephonically and communicated that she had mailed a $40.00 refund check that was in my opinion an attempt to mitigate that business's culpability. In response I stated that the check would neither be accepted, nor negotiated and in fact just the
other day it found its way to my office shredder. Self-admittedly in all of this I was seething in anger that a corporation had attacked my child. It was also uncharacteristic of me to speak with a woman like the father "Lion of Judah" when informing that executive, it was my intention to destroy her company as a masked transnational continuing criminal enterprise. After Attorney General, Ellen F. Rosenblum remanded my complaint to the Oregon Public Utilities Commission [PUC], where it was sent to be expire, T-Mobile USA, Inc. responded to PUC with another offer of mitigative money while unable to even justify their own fees as described to the state investigator and I rejected their offer and the state requested a review of T-Mobile USA, Inc.'s transcripts. It was at that point when T-Mobile USA, Inc. responded by stating they concurred 100% with the verbiage in my consumer fraud complaint and offered two additional mitigative deals on either side of the contractual agreement with my son/stepson. Until Attorney General, Ellen F. Rosenblum demonstrated an act of illegal selective prosecution that should result in her disbarment as an attorney, I was neither compelled to decline or accept either mitigative offer. This matter was beyond ripe for a civil and criminal prosecution by Oregon's Attorney General, Ellen F. Rosenblum, but she has aligned herself with her support of corporate criminals through selective prosecution and unequal justice under the law. Since T-Mobile USA, Inc. agreed to their commission of a consumer fraud under the Oregon Unlawful Trade Practices Act [UTPA] and is therefore culpable under the law, but still refuses to honor their own contractual terms established by their representatives and while perpetuating another mitigative fraud by countering with two other offers on either side of the standing contractual terms, I opine this matter is the clear demonstration of a business operating a transnational continuing criminal enterprise within the State of Oregon. Corporate corruption and legalized criminality are running rampant throughout the total fabric of our national infrastructure and continues to erode the sovereignty of the United States like a terrorist cancer. Meanwhile the generational wealth of rank and file American citizens and Oregonians is being absorbed under the something cousin to the color of systematic systemic genocide for negative eugenics. In that regard, the dream and promise of America has become the guarantee of a virtual death camp environment that is eating the very soul of our futures in the present moment. Our citizens are being both victimized and unconscionably burdened to foot the bill for ongoing corporate welfare through $trillion dollar bailouts that are gifted by a feckless two party political system and orchestrated via the congressional capos of corporatist pimps who all drink from the same well. Flip that twofaced coin and no matter what side lands facing up, we the people still lose with the privatization of profits and the socializing of all public debts. It clearly is past the time where we should cut ourselves free from those two anchors that are dragging our nation to the bottom of oblivion and climb into the a Green or 3rd Party lifeboat with a rudder being steered of, for and by the people! Our nation will be destroyed on its current path towards tyranny and an end to liberty and freedom. So in light of all these factors, it appears that the new Oregon Attorney General, Ellen F. Rosenblum has and is unfortunately taking a passive stand towards consumer protection matters within the State of Oregon. That said, I'd like to give Ms. Rosenblum the benefit of the doubt and ask her to publically admit her failing in this matter and reaffirm her oath before the citizens of Oregon that she will support meaningful investigations of consumer fraud complaints through the Oregon DOJ's Consumer and Financial Fraud Division. In this matter, Oregon Attorney General, Ellen F. Rosenblum conferred with the investigators of the Oregon Public Utilities Commission [PUC] and paraphrasing her comments, it is my understanding that she will not civilly or criminally investigate or prosecute the crimes committed by T-Mobile USA, Inc., with the excuse that "not enough Oregonians have submitted complaints against T-Mobile USA, Inc. to the Oregon Department of Justice, Consumer and Financial Fraud Division." Over the past thirteen years I have volunteered my time as a consumer advocate while relying heavily on the Consumer and Financial Fraud Division to perform on behalf of all Oregonians. Therefore, I am disappointed in what appears to be the intended practice of illegal selective
enforcement and prosecutions by our new Oregon Attorney General, Ellen F. Rosenblum. For all of these reasons, the citizens of Oregon should be alerted to the new demeanor recognized within the Oregon Attorney General's Office as it relates to actionable consumer fraud complaints being held harmless with complicity. Additionally as stated above, I've requested on camera interviews with all of the local television news stations to discuss this matter against T-Mobile USA, Inc.; to date I have not received one response or invitation. Oregonians and the rest of our nation's citizens should never forget their civil servants, consumer advocates, activists, journalists, and whistleblower patriots who remaining standing for the people while often paying a horrific personal cost that goes unseen by too many. We have never forgotten you! Oregon Attorney General, Ellen F. Rosenblum does not seem willing to support the civil and criminal prosecution of T-Mobile USA, Inc. even after that German corporation has admitted culpability for their ongoing commission of consumer fraud under the Oregon Unlawful Trade Practices Act. Ms. Rosenblum also doesn't seem to appear very keen on supporting citizen partnerships in a state whose civil servants are working beyond capacity and furloughed to compensate for the state's operating budget while additionally compounded by the periodic erosions of their PERS retirement benefits. Even after the hell of the past twelve plus years as a politically sanctioned and blacklisted FBI Whistleblower, I have remained standing for the people and maintained my sources to keep a thumb on the pulse of government. It's chicken soup for Ms. Rosenblum to prosecute T-Mobile USA, Inc. for fraud and she should applaud the positive voluntary efforts of Consumer Advocates, especially when their backgrounds are mutually beneficial to the surgical eradication of corrupt businesses conducting unlawful trade practices within the State of Oregon and transnationally across the United States. We must all do our part to help keep the lid on the garbage can and be good neighbors to one another. Should Ms. Rosenblum remain unable to perform for Oregonians, then she should brand herself as a quitter like Sara Palin and abandoned her duty, oath and state. Most Oregonians do not have the energy at the end of the day with small children in tow to rise up against consumer fraud. However, unchallenged consumer fraud remains a metastasizing cancer within the already damaged body of our nation. Americans are human beings who must not be used as a means for control by depleting our citizens' energies into an exhaustive state that only has enough cognitive power left to operate the machines and obtain the basic animal needs for survival. That is the formula that kills a nation and for the Oregon Attorney General's Office to fail in the prosecution of this matter against T-Mobile USA, Inc., it has become the egregious statement of support for the slow-kill genocide of our citizens within the State of Oregon and elsewhere. Consider the immediate facts within this consumer fraud complaint and the nearly thirteen year history in this matter. Within that timeline is included the successful prosecution of T-Mobile USA, Inc.'s predecessor, VoiceStream Wireless, Inc. More recently as stated above, my account with T-Mobile USA, Inc., included three numbers that were divided with two numbers being ported at Sprint and one number remaining with T-Mobile USA, Inc., with the latter causing the transfer of ownership responsibility for that single number to my son/stepson. In 2003 I filed a consumer fraud complaint against T-Mobile USA, Inc.'s predecessor, VoiceStream Wireless, Inc. and the Oregon Attorney General at that time successfully prosecuted VoiceStream Wireless, Inc.; see the letter included immediately below that is dated May 23, 2003. The responsibility for following that judgment conveyed to T-Mobile USA, Inc. when that German corporation purchased VoiceStream Wireless, Inc., but T-Mobile USA, Inc. has continued to exhibited a repeated frequency of occurrences that does not represent a company acting in good faith under law within the State of Oregon and elsewhere. T-Mobile USA, Inc. acquired my account with their purchase of VoiceStream Wireless, Inc. and remains legally bound to perform as stated by the letter dated May 23, 2003 from the Oregon Department of Justice, Office of the Attorney General, in which they cite violation[s] of the
Oregon Unlawful Trade Practices Act [UTPA], DOJ File No.: 137420 FF3656-02. That action resulted in VoiceStream Wireless, Inc. receiving fines totaling $22,500.00 and a requirement to sign an Assurance of Voluntary Compliance [AVC] agreement that became a court order and public record. In other words, when T-Mobile USA. Inc., a German corporation, purchased VoiceStream Wireless, Inc., T-Mobile USA, Inc. accepted all previous binding legal orders and likewise any outstanding taxes owed by the other business. Please provide your letters of support or consumer fraud complaints against T-Mobile USA, Inc., as that relates to violations under the Oregon's Unlawful Trade Practices Act, to Oregon Department of Justice, Attorney General, Ellen F. Rosenblum, Consumer and Financial Fraud Division, 1162 Court Street NE, Salem, OR 97301-4096, 503-947-4333, 503-378-4732, 503-3788910 [fax], 503-378-4400 [A.G.], 503-378-4017 [fax]. On Monday, August 13, 2012 I filed an addendum, which read: For a number of weeks I have unsuccessfully made repeated requests for an on camera interview with each of the syndicated local news stations in the Portland, Oregon area; i.e., KGW-8, KOIN-6, KATU-2, KPTV/FOX12, NW32. Having asked the question directly and with silent answers, it has become clear that no consumer protection stories will be produced if the report involves one of local news stations' major corporate sponsors. So I am left trapped in the middle between the uncertainty of an investigation by the new Oregon Attorney General, Ellen F. Rosenblum and the blatant continuing consumer fraud of now bankrupt T-Mobile USA, Inc. that emulates the culture of corruption consuming the nation's economy along with the futures of the rank and file in the present moment. This is also the final straw for me as a television viewer and I'm dropping my Comcast television subscription this coming December. The bulk of the local news is mind-numbingpropaganda that wouldn't make a pimple on Edward R. Murrow's bottom. News Models mug to the camera with a story content that has become nothing more than forty-five percent regurgitated weather reporting, the names of our military service members who were murdered while used as security guards to secure oil and opium poppy fields for corporatist and the occasional "Breaking News" that Mrs. O'Leary's dairy cow got lose again and dropped a stack at 5th and Main with the state's road crews out on furlough, so Harley riders watch out cause it looks like a possible slider. America has become another name for a virtual death camp environment. On Wednesday, August 15, 2012 I filed an addendum, which read: Under the color of the crime of Selective Enforcement/Prosecution, Oregon Attorney General, Ellen F. Rosenblum refused to investigate T-Mobile USA, Inc. for a clear violation of the Oregon Unlawful Trade Practices Act and Conspiracy to Commit Fraud. In an email response, Sara Noble, Public Utility Commission, Consumer Services, Consumer Specialist became the instrument used by the new Oregon A.G. where valid cases are sent to die in stasis. This appears to be all that Oregonians have to look forward to under the political corporatist control Oregon Attorney General, Ellen F. Rosenblum. After receiving my email communication dated August 13, 2012, Sara Noble responded with her acknowledgement stating that I has indicating an acceptance of T-Mobile’s offer on my stepson's account and that she had forwarded my acceptance to T-Mobile. On August 14, 2012, T-Mobile USA, Inc. advised Sara Noble they had removed my stepson's account from the two-year contract. They applied a $120.00 credit to cover the $5.00 difference in the rate for the 5 GB data plan and added the $120.00 is a one-time credit that covers the billing for 24 months. T-Mobile USA, Inc. is a continuing criminal enterprise and outlaw German corporation conducting transnational business in the United States. T-Mobile USA, Inc. remains a clear and present economic danger to Oregon consumers and the citizens of the United States by the coconspiratorial complicity and unlawful duplicitous misconduct of any State's Attorney General who refuses to muster for genuine equal justice under the law on behalf of the citizens within their given state.
On Saturday, August 18, 2012, I filed an addendum, which read: On this date begins a series of non-responses if not outright omissions to journalistic inquiries into Oregon Attorney General, Ellen F. Rosenblum's personal and/or indirect involvement with T-Mobile USA, Inc. A questionnaire was communicated long-time reporter Jeff Manning who on or about August 9, 2012, became the Public Information Officer [PIO] for the Oregon Department of Justice. Re: Journalistic inquiry concerning Ellen F. Rosenblum, Attorney General. Dear Jeff: In full disclosure I am also a consumer advocate and FBI Whistleblower. Recently I was caused to settle a consumer complaint that was filed against T-Mobile USA, Inc. The matter possessed a previous history of successful prosecution by the state in 2003 when dba VoiceStream Wireless, Inc. and clearly demonstrated a fraud by the company under this complaint. In a separate matter filed as a formal complaint with the SEC Office of the Whistleblower, the company that has since filed for bankruptcy remains under federal investigation. I’m disappointed in Ms. Rosenblum’s reasoning for remanding the matter to PUC. My question of you is this, does Ms. Rosenblum, a member of her family, personal friends or associates have any direct or indirect professional or financial involvement with T-Mobile USA, Inc. or any of its business tentacles? If the answer is yes to any part thereof, please describe that involvement and name all parties involved. Please respond within ten business days and feel free to contact me with any questions or if I may be of some service to you. Thank you; Bob end *To date no response was given by Jeff Manning nor to a second closed system inquiry submitted as a follow up before leaving town on or about Friday, August 24, 2012. I'm fighting for my son's consumer rights and those of all Oregonians and American citizens. Please feel free to contact me with any questions or if I may be of some service to you.
