I find your response letter deficient on two central questions, and I request your response on them: a) Basis in the law of the State of Israel, if any, for conduct of Bank HaPoalim, BM, against me I am a resident of Jerusalem, and my bank accounts with Bank HaPoalim, BM, are in a Jerusalem branch of the Bank. Bank HaPoalim, BM, is an Israeli bank, established pursuant to the law of the State of Israel. My accounts with the Bank were opened through a Consumer's Agreement, based on the law of the State of Israel. For about half a year, ending January 2013, Bank HaPoalim, BM, engaged in demands and threats , including, but not limited to, attempts to force me to consent to "Waiver of Privacy" to the government of the United States. On or about January 1, 2013, Bank HaPoalim, BM, froze my bank accounts, and denied my access to my own funds. Such conduct lasted till about January 31, 2013. Conduct of Bank HaPoalim, BM, and its senior executives in this matter is allegedly criminal in nature, reflecting organized corporate crime by a financial institution. Your letter failed to address the question: Was there and is there any basis in the law of the State of Israel to conduct of Bank HaPoalim, BM, against my bank accounts in Jerusalem? b) Basis in the law of the State of Israel, if any, for conduct of Bank of Israel and its Governor Stanley Fischer in this matter Bank of Israel was established and operates pursuant to the law of the State of Israel – Bank of Israel Act (1954). Since Bank HaPoalim, BM, initiated its conduct, outlined
above, I filed with Bank of Israel and/or directly with your office three (3) Consumer's Complaints, pursuant to Bank of Israel Regulations. [3-6] In addition, I filed with Bank of Israel a request, pursuant to the Freedom of Information Act (1998) of the State of Israel (in an effort to decipher the disposition of my Consumer's Complaints, referenced above).  To this date, I have received neither a written confirmation of receipt and/or processing on any of the Complaints and the Request, nor a written response, pursuant to the law of the State of Israel. Instead, I received from Bank of Israel, on your behalf, the above referenced letter,  which fails to refer in any way to the law of the State of Israel. Instead, it provides information regarding the laws of the United States. Moreover, it explicitly states: "With all our sympathy for the inconvenience and trouble, caused to the customers by the FATCA instructions, we regretfully cannot help you beyond providing clarifications, as detailed above."  Therefore, your letter failed to address the question: Was there and is there any basis in the law of the State of Israel for your conduct, as Governor, and conduct of Bank of Israel in this matter? c) Conclusion Based on your letter,  a reasonable person would conclude that ending the alleged criminality by Bank HaPoalim and its executives against me was not the outcome of any actions by Bank of Israel. Therefore, your response on instant letter is sought in order to clarify, whether you, Bank of Israel, and Israeli financial institutions, under your tenure as Governor, hold themselves ruled by the law of the State of Israel.
