Streetlighting, Outdoor Area Lighting and Traffic Signal Incentives Program

The Streetlighting, Outdoor Area Lighting (OAL) and Traffic Signal Incentives Program from Met-Ed, Penelec, Penn Power and West Penn Power (FirstEnergy's Pennsylvania utilities) offers incentives and information to encourage participants to install high-efficiency streetlighting, outdoor area lighting and LED traffic signal lights. The program is funded by nonresidential Pennsylvania electric utility customers of FirstEnergy's Pennsylvania utilities in accordance with Pennsylvania Act 129 of 2008.
Effective Dates To qualify for incentives, equipment must have been purchased on or after October 28, 2009. Eligible Participants Streetlighting, OAL and Traffic Signal incentives are available to nonresidential retail Pennsylvania customers of FirstEnergy's utilities. Eligible Measures Streetlighting and OAL conversions that correspond to the pre- and postinstallation fixture types and wattages shown on page three are eligible under this program. Streetlights controlled by dusk-to-dawn photocell sensors are eligible. OAL controlled by dusk-to-dawn photocell sensors or timers are eligible. Light fixtures controlled by switches may be eligible under the Non-Standard Lighting for Business Program. Traffic signal conversions that correspond to the pre- and post-installation fixture types shown on page four are eligible under this program and may vary by operating company. For Met-Ed, Penelec, and Penn Power, yellow traffic signals and turn signals are not eligible for this program, but may be covered under the Non-Standard Lighting Incentives for Business program. West Penn Power customers are only eligible for measures on page five. Pre-Approval Requirements Program pre-approval is not required for projects purchased and installed before May 31, 2011. Customer-owned streetlighting, OAL and traffic signal projects completed (installed) after May 31, 2011, will require pre-approval before equipment is purchased or installed if the total incentive requested is greater than $3,000. All participants are encouraged to seek program approval for their equipment prior to purchase to ensure it meets program requirements and is eligible for incentives. Limitations All incentives available from any FirstEnergy utility business program are limited to the total equipment cost. Questions? Step 1: Step 2: Complete the program application and attach supporting technical documentation required to verify that proposed equipment meets program requirements, such as manufacturers specification (cut) sheets. Please note that the information requested on the form is state mandated documentation required before your application can be reviewed by the program. Sign the application form and submit a complete application package to the program for consideration, review and approval. Incomplete applications will not be considered and will be returned to the applicant for completion. A complete application package includes: A signed application form, listing the quantities of qualifying fixtures included in your project, A copy of IRS form W-9 for incentive payee, and Manufacturers specification (cut) sheets for each installed fixture type to verify that the equipment meets the program efficiency levels used in the calculations. Step 3: The program will notify the applicant via email when the pre-approval technical review is complete and funds have been reserved. Upon receipt of program pre-approval, participants may purchase and install their energy efficient equipment. Step 4: Once the project is complete, you should review your approved application for any changes to the project that occurred during installation and make the needed corrections. Resubmit the application, along with a dated proof of purchase, to the program for incentive payment. Applications and supporting technical documentation will be reviewed by program staff, and an onsite inspection to verify the installation may be conducted. Upon receipt and verification of all required documentation, the incentive check will be processed and mailed to the applicant or to an authorized representative, if requested on the application. To confirm tax status, all applicants (including tax exempt entities) must submit a W9 with Tax Identification associated with the incentive recipient to enable processing. Incentives will not be paid until W9s have been received.

Definitions FIRSTENERGYCOMPANIES(THECOMPANYORCOMPANIES)MetropolitanEdisonCompany,PennsylvaniaPowerCompany, Pennsylvania Electric Company, and West Pennsylvania Power Company. PROGRAMorPROGRAMSCompaniesprogramsapprovedbythePennsylvaniaPublicUtilityCommission(PUC)forimplementationunderPennsylvania Act129.ThisapplicationrelatestotheBusinessprogramssupportingenergyefficiencyintheCompaniesCommercialandIndustrialcustomerfacilities including,municipal,governmentandinstitutionalfacilities. PROGRAMMANAGERThepartycontractedbytheCompaniesformanagementofthePrograms. ENERGYEFFICIENCYMEASURESAnyequipmentoractioneligibletoreceiveaProgramIncentivepaymentundertheProgram. PARTICIPANT(orPARTICIPANTSorPARTICIPATINGCUSTOMERS)ThosenonresidentialretailelectricserviceeligiblecustomersoftheCompanieswho participateinthisProgram. PROGRAMINCENTIVESReferstothemonetaryincentive,rebateorservicethattheProgramprovidestoparticipatingcustomerspursuanttothe Program. CREDITSReferstotheenergy,capacityorenvironmentalattributesfromAlternativeEnergyPortfolioStandards(includingEnergyEfficiencyand DemandResponse)associatedwithmeasuresforwhichincentiveswereprovided,orPJMCapacityCredits. ParticipantorParticipantsasdefinedaboveandservedbyMetropolitanEdisonCompany,PennsylvaniaPowerCompany, Pennsylvania Electric Company, and West Pennsylvania Power Company. Residential customers are not eligible for incentives through the Commercial and Industrial Programs. Incentives are awarded only to Participants, or their assigned agents, for qualifying equipment (Energy Efficiency Measures) that is installed in the Commonwealth of Pennsylvania at the location identified in this Application, and such Participants are responsible for compliance with the Terms and Conditions set forth herein. TheParticipantisresponsibletocomplywithallapplicablelaws,rulesandregulations,andtocomplywithallfederal,state,andlocalcodes. WithParticipantswrittenpermission,theCompaniesmaypubliclyrecognizeparticipationintheProgramsanddiscloseinformationrelatingtothe Participantsparticipationintheprogram,includingsuchdataas:projectedprojectenergysavings,theincentiveamount,andothersimilarinformation.

ApplicationandEligibility TheProgramsprovideforpaymentofincentivesaftertheinstallationofqualifiedenergyefficiencymeasuresandreviewoffinaldocumentationfor compliancewithprogramrequirementsbytheProgramManager.Inordertobeeligibleforincentives,aParticipant,oranagent Process (contractor/vendor)authorizedbytheParticipant,mustsubmitaproperlycompletedpreinstallationapplicationpackage,includinganapplicationand technologyworksheets,totheProgramManagerbeforetheequipmentispurchased.Ifeligible,theParticipantwillreceiveanapprovalletterwiththe estimatedincentiveamountandthedatebywhichtheequipmentmustbepurchasedandinstalledfortheapprovaltoremainineffect. Afterinstallationiscompleted,theParticipantmustfinalizeandresubmitthecompletedequipmentapplicationreflectingtheasbuiltproject,alongwith theinvoice,themanufacturersequipmentperformancesheet,andanyotherrequireddocumentationasmaybespecifiedontheapplicationorinthe programsinitialapprovalletter.Applicationsmustbefilledoutcompletely,truthfullyandaccurately,andincludesignaturesoftheParticipantandits authorizedagents(asappropriate).Finalpaymentwillbebasedontheasbuiltdocumentationprovidedwiththefinalprojectapplication. Exceptions:Customer owned equipment purchased with a total incentive of less than $3,000, does not require preapproval from the ProgramManagerbeforethepurchaseorinstallationofequipment. DatesofProgram IncentivesareavailableforeligibleEnergyEfficiencyMeasuresforwhichequipmentispurchasedandinstalledonorafterOctober28,2009. DatedProofofPurchaseandcompletedocumentationwillberequiredwithfinalapplicationsfortheparticipanttobeeligibleforincentivepayment. TheprogramissubjecttorevisionorterminationatanytimebytheCompany. Preapprovedprojectswillreceiveapprovallettersdefiningtermsforpaymentandacommitmentexpirationdate.IftheParticipant:(1)hasnotengagedin installationofthepreapprovedproject;and(2)hasnotappliedtotheProgramManagerforaprojectextensionwithin90daysfromthedatetheProgram Managerpreapprovestheproject,theProgramManagermaycancelParticipantsapplicationwithoutliability. AcceptableformsofProofofPurchaseincludepaidinvoicesorreceipts.Thedocumentationmustshowitemnumbers,quantitiesanddescriptionsthatare ofsufficientdetailtoverifythattheinstalledequipmentmeetsefficiencyrequirements.Additionally,thepostinstallationdocumentationmustinclude manufacturers'specifications(cutsheets)thatlisttheefficiencyratingsoftheequipment.TheProgramManagermay,atitssolediscretion,acceptother formsofproofofpurchase.

InstallationSchedule Requirements AcceptableProofof Purchase

Evaluation,Measurement TheProgramManagermay,butisnotobligatedto,conductaninspectionofthefacilitytoverifypreandpostinstallationconditionsorverify documentationpriortoincentivepayment,atanytimeafterreceiptofapplicationsandupto5yearsafterpaymentofincentives.Inaddition,the andVerification PennsylvaniaPublicUtilityCommissionandtheCompanieshaveengagedEvaluationMeasurementandVerification(EM&V)contractorstoevaluate programperformancewhichmayinvolveadditionalvisits.Theapplicantmustprovidereasonableaccesstothefacility,theequipment,andrelated documentationanddata.TheCompaniesortheiragentsmayinstallsimple/standardmeteringdevicesonequipmentforprogramdatacollection, measurementandverificationpurposes.TheCompaniesandtheiragentsarenotobligatedtopayanyincentiveawardsuntilithasperformeda satisfactorypostinstallationverification,unlessithaswaivedthisrequirement.IftheProgramManagerdeterminesthattheequipmentwasnotinstalled inamannerconsistentwiththeapprovedapplication,orifnonqualifyingequipmentwasinstalled,itmayrequirechangesbeforemakingpayment. Assignment ParticipatingCustomer's Certification TheParticipantmayassignProgramIncentivestoaspecifiedthirdparty. Participantcertifiesthathe/shepurchasedandinstalledtheequipmentlistedinitsapplicationatitsdefinedPennsylvanialocationlistedtherein. Participantagreesthatallinformationistrueandthathe/shehasconformedtoalloftheprogramseligibilityrequirements,termsandconditions.

IncentiveAmounts

ProgramIncentiveswillequaleither:a)theapprovedProgramIncentiveamountreflectingincentivesineffectatthetimeofapproval,orb)theactual equipmentcostoftheEnergyEfficiencyMeasure,whicheverisless,asdeterminedbytheProgramManager.Pleaseallowninety(90)businessdaysfor deliveryoftheProgramIncentive.Applicationsrequiringpostinstallationinspectionsandunanticipatedhighvolumeofactivitiesmayrequireadditional time.Ifinformationismissingorincorrectontheapplication,processinganddeliveryoftheProgramIncentivemayalsorequireadditionaltime. IncentivesreceivedbytheParticipantunderthisApplicationmaybetaxablebythefederal,state,andlocalgovernment.TheParticipantisresponsiblefor declaringandpayingallsuchtaxes.Companiesshallhavenoliabilityorobligationforanytaxes. TheParticipantshallprotect,indemnify,andholdharmlesstheCompaniesandtheirparents,subsidiaries,affiliates,agents,contractors,employees, officers,anddirectorsfromandagainstallliabilities,losses,claimsofdeathorinjuryorotherdamages,judgments,penalties,causesofaction,costsand expenses(including,withoutlimitation,attorneysfeesandexpenses)incurredbyorassessedagainsttheCompaniesand their parents, subsidiaries,affiliates, agents,contractors,employees,officersanddirectorsarisingoutoforrelatingtotheperformanceofthisApplicationorarisingout of or relatingtotheinstallation,useandmaintenanceoftheequipment,designs,practicesormethodsinvolvedinthisParticipantsproject. Innoeventshallanyindemnifiedpartybeliableforanypunitive,exemplary,special,indirect,incidentalorconsequentialdamages(including,butnot limitedto,lostprofits,lostbusinessopportunities,lossofuseorequipmentdowntime,andlossoforcorruptiontodata)arisingoutoforrelatingtothis AgreementorProgram,regardlessofthelegaltheoryunderwhichsuchdamagesaresought. The Companies and their parents, subsidiaries, affiliates, agents, contractors, employees, officers and directors make no express or implied warranties regarding the performance of installed equipment, the quality of any contractors work, or that the equipment will result in any energy or cost savings. THE COMPANIES AND THEIR PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS, CONTRACTORS, EMPLOYEES, OFFICERS AND DIRECTORS DO NOT ENDORSE, GUARANTEE, OR WARRANT ANY PARTICULAR MANUFACTURER OR PRODUCT, AND THEY PROVIDE NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR IMPLIED WARRANTY OF FITNESS FOR ANY PRODUCT OR SERVICES. SubmissionofanyapplicationdoesnotgiverisetoanyobligationtomakeanyincentivepaymentbytheCompaniesandtheirparents,subsidiaries, affiliates,agents,contractors,employees,officers,anddirectors.

Participants in FirstEnergy utilities Energy Eciency and Conservation (EE&C) programs have the ability to take ownership of the Energy Eciency resource credits resulting from their project(s) and may be able to bid or sell - the Energy Eciency resource credits into the market operated by the grid operator, PJM Interconnection, Inc. (PJM), provided several prerequisites are met. For more information on bidding with PJM, please visit http://www.pjm.com/markets-and-operations/demand-response.aspx. Alternatively, a customer has the ability to allow their local utility (Met-Ed, Penelec, Penn Power, or West Penn Power) to take ownership of the Energy Eciency resource credits associated with their energy eciency project. Your local utility may then aggregate your credits with other similarly situated customers and then bid the credits into PJM as a group. Any proceeds from this bid will be used to oset the costs charged to the utilitys customers for compliance with state mandated EE&C requirements. Please indicate your preference as to the treatment of your Energy Eciency resource credits: I would like to retain ownership of my Energy Eciency resource credits. I assign ownership of my Energy Eciency resource credits to my local electric distribution utility for purposes of bidding these credits into PJM.
