***************************************************************************** * ORDER Considering the foregoing petition: IT IS HEREBY ORDERED that John Smith., respondent in the above captioned matter, be detained for treatment at ____________________________________________ from the signing of this Order, pending a hearing on whether he should be judicially committed to a long term facility, unless he is earlier discharged from the hospital.

IT IS FURTHER ORDERED that the Mental Health Advocacy, through its attorney ____________________, be and is hereby appointed to represent the respondent, John Smith.

IT IS FURTHER ORDERED that a Dr._____________________, a psychiatrist, be appointed to examine John Smith, that he report to the court as provided by law, and that his report be made available to counsel for John Smith, at least three days before the hearing is set herein.

IT IS FURTHER ORDERED that this matter be set for hearing on ________ day or _____________, 2012, at _____________ ____M. at the Orleans Parish Courthouse in room _______ and that John Smith, be ordered to show cause why he should not be interdicted and judicially committed to the long term care facility designated by this court for the duration of his mental illness or until he is discharged.

IT IS FURTHER ORDERED that the court effect notice of hearing on respondent, John Smith, at ______________________________ and upon his attorney or the Mental Health Advocacy Service, is so appointed, and that John Smith, and his attorney be notified they have a right to seek an additional medical opinion, if, in their discretion, such additional opinion is necessary.

IT IS FURTHER ORDERED that in accordance with Louisiana Revised Statute 28:54(c), respondent, John Smith, be notified he has the right to present at the hearing on the matter, that he has the right to counsel; that if indigent or otherwise qualified he has the right to counsel appointed to represent him by the Mental Health Advocacy Service; and that he has the right to cross examine witnesses testifying at any hearing on this matter.

IT IS FURTHER ORDERED that the Sheriff of Orleans Parish, State of Louisiana, or his authorized Deputy, transport John Smith, from _____________Hospital in New Orleans, La, to the Orleans Parish Courthouse for the hearing, remain with him during the hearing, and transport him back to ________________________________ after the hearing.
