Press Statement of Stop Lynas Coalition 26th February 2013

Stop Lynas Coalition (SLC) hereby notifies the Public and the Media of the progress of our anti-Lynas campaign with the coming Court Hearing at the Federal Court in Putrajaya, Reply from the Malaysian Ministry of Science, Technology and Innovation (MOSTI) to our Appeals dated 24/Sep/2012, Results of our Public Petition to Dissolve Atomic Energy Licensing Board (AELB), Huge Water Consumption by Lynas and our Support for Candidates and/or Parties who Have Committed to Stop Lynas. SLCs pro bono lawyers have applied to the Kuala Lumpur High Court on 17/Feb/2012 for Judicial Review (JR) to suspend the Temporary Operating Licence (TOL) approved by AELB on 30/Jan/2012 to Lynas until a Detailed Environmental Impact Assessment (DEIA) report is fulfilled within the Environmental Quality Act 1974. SLC was advised by lawyers that the mention in chambers on 17/Jan/2013 at the Federal Court in Putrajaya had fixed the date of hearing on 18/March/2013, which will be opened to public. Therefore, we sincerely urge all concern citizens, near and far, to be present at the Federal Court in Putrajaya at 9.00AM on 18/Mar/2013 (Monday) to show your determination to Stop Lynas. SLC will be arranging two (2) buses from Balok and Kuantan to Putrajaya. Please contact Encik Mahmud at 012-9571497 and Mdm Connie Chong at 016-9432232 respectively for seats reservations that is on a first-come- first-served basis. despite several reminders until 14/Feb/2013. Attached herewith a copy of the reply by registered mail from MOSTI dated 25/Jan/2013 which last paragraph stated, under sub-Section 32(5) Act 304, the Ministrys order is final and can not be subject to any appeals or reconsiderations in any court. Does this mean that the Ministrys order, MOSTI in this case, is ABOVE Court order? Further to the Public Petition To Dissolve AELB launched by SLC on 22/Nov/2012, we are pleased to announce the total signatures collected as at 31/Dec/2012 was 2,155 (Two Thousand One Hundred Fifty-Five only). We hereby THANK all who have participated in support, especially foreigners from other countries! The consumption of water by Lynass rare earth refinery in Gebeng is 500m3/hour = 12,000m3/day = 12,000,000 LITRES PER DAY! Average consumption of water by an individual is only 226 litres/day (Ref. link http://www.fomca.org.my/v2/index.php/fomca-di-pentas-media/fomca-dipentas-media-2010/318-malaysians-waste-a-lot-of-water-wat-er-waste) This means Lynas consumption of water is equivalent to that of 53,097 individuals PER DAY! Which is about 12% of Kuantan population of 450,211 persons as per attached extracted page 33 of Census 2010 by Department of Statistics, Malaysia:O!! Could this be the reason for water shortage and rationing in Kuantan, from 8.00pm of 7/Jan/2013 until 8.00pm of 8/Jan/2013 and 6.00pm of 9/Jan/2013 until 11.00pm of 11/Jan/2013, as per

SLC members have felt for victims in Bukit Merah on their unfortunate experience with Asian Rare Earth 30 years ago, organized signature campaigns & awareness campaigns, voiced our concerns at Forums organized by Malaysian authorities and IAEA, sent memorandums to the relevant Ministries and authorities, press releases and statements by professionals, namely The Malaysian Bar and the Malaysian Medical Association (MMA), gone through the legal framework, specially composed anti-Lynas songs by local performing artists, participated and supported in PEACEFUL Green assemblies and rallies, including Bersih rallies as we foresee Lynas would become a precedent door opening for many more hazardous toxic projects to land in Malaysia for profits where no other countries would permit! Despite all the above Journey of Peoples Struggle To Stop Lynas, Lynas has started its radioactive rare earth refinery operation with its first shipment of rare earth concentrates arriving at the shore of Kuantan Port on 22/Nov/2012 ! Online news reported on 15/Mar/2011 by AsiaNews. It on A kilometre from the lake and eight from Baotou lays the village of Dalahai. Five more villages are cluster nearby. They are all known as cancer villages because the local rate of cancer is many times the national verage. as per link http://www.asianews.it/news-en/China%E2%80%99s-dilemma:-how-tomine-rare-earths-whilst-protecting-reserves-and-the-environment21039.html and Baotou is a city sitting on rich deposits of rare earths, whose production has spelled death and destruction for so many of its residents. Our Prime Minister said in 8TV news reported on 26/Feb/2012 as per link http://www.youtube.com/watch?v=z90alvyzaEo (time 0:22 to 0:50 of YouTube) that licence will not be issued to Lynas unless they are satisfied that the local community can accept the safety of the plant, but if protests

were due to political agenda then they will not consider. Hasnt our Prime Minister learnt from Cancer Villages in China and seen from the 300km Green Walk from Kuantan to Kuala Lumpur as per link http://www.freemalaysiatoday.com/category/nation/2012/11/16/ green-walk-from-kuantan-to-kl-gains-pace/ that the people DO NOT ACCEPT the safety of the plant? As a result of what started as apolitical by anti-Lynas groups, have turned to political platform as per links to their press statements on i) Government has yet to wake up to #KL112 on Lynas dated 16/Jan/2013 at http://www.savemalaysia-stoplynas.blogspot.com/search?updatedmax=2013-01-22T01:03:00-08:00&max-results=20 and ii) Himpunan Hijau aims to oust BN in Pahang 'green corridor' dated 30/Jan/2012 at http://www.facebook.com/photo.php?fbid=337050099743059&set=a.158671 040914300.32666.156138757834195&type=1&theater ! And with the latest Manifesto Rakyat dated 25/Feb/2013, page 17 under Sustainable Economy as per link http://www.pakatanrakyat.my/files/ENGManifesto-BOOK.pdf, clearly stated that Pakatan Rakyat will halt operations of rare earth plant in Gebeng, Pahang, it leaves SLC no choice but to join the call to support candidates and/or parties who have committed to Stop Lynas. One of the sources of such candidates would be the list compiled by exChairman of Save Malaysia Mr Vincent Jiam in his book - Harvest of Hope For Malaysia where politicians HAVE signed their commitment to CANCEL Lynas project. On 9/Apr/2012, Prime Minister has said Interest of the people must come first. In other words, the health and the safety of the people must be upper most in our mind. recorded in PM Najib On Lynas issue @ NTV7 Chat with Najib (time 1:13 to 1:28 of YouTube) as per link http://www.youtube.com/watch?v=nQadcuCyFc0.

And the recent news reported by BBC online news dated 22/Feb/2013 on Cancer Villages in China which were due to widespread production and consumption of harmful chemicals forbidden in many developed nations which are still found in China. And the toxic chemicals have caused many environmental emergencies linked to WATER and AIR POLLUTION as per link http://www.bbc.co.uk/news/world-asia-china-21545868! We desparately seek justification for the fundamental human rights to live in a healthy and clean environment, away from threats of hazardous toxic pollution to our AIR, WATER and SOIL where survival of all living creatures depended on. Will our Prime Minister Walk His Talk dated 9/Apr/2012 in NTV7 Chat, to ensure Kuantan will not become a Cancer Town in Malaysia? We sincerely urge all concern citizens to exercise your rights to a government who will LISTEN to the VOICES OF PEOPLE and provide a SAFE and HARMONIOUS country for concern citizens, who LOVE MALAYSIA deeply, to live in! Thank you for your kind considerations and continuous support! Yours sincerely Amy Goh Honorary Secretary
