Onlypersonsauthorizedbytheemployertodosomay (a) gainaccesstoorattempttogainaccesstoexplosives (b) beinpossessionofexplosives,or (c) removeorattempttoremoveexplosivesfromamine.

(3)

Subjecttoregulation4.2(1)(d),nopersonmaybury,hide,submergeor abandonanyexplosives.

4.2

Receipt,storage,issuing,transportationanddestructionofexplosives (1) Theemployermustensurethat (a) explosivesthatarenotbeingtransportedorpreparedforuseare storedinexplosivestores,silosorcontainerswhichare,asfaras reasonablypracticable,designedandlocatedsoastofacilitatethe safeandsecurereceipt,storageandissuingofexplosivesbya competentperson (b) awrittenprocedureispreparedandimplemented,afterconsultation withtheexplosivemanufacturerorsupplier,topreventpersonsfrom beingexposedtothesignificantrisksassociatedwiththereceipt, storage,issuingandtransportationofexplosives,including associatedwiththeinadvertentinitiationandthedeteriorationof explosives (c) asfarasreasonablypracticable,explosivesareonlytransportedin vehiclesorconveyancesapprovedforthatpurposebytheemployer, afterconsultationwiththeexplosivemanufacturerorsupplierand (d) whenmineclosureisintended,orwhenamineisnotbeingworked ascontemplatedin section2(2),thePrincipalInspectorof Mines andtheChiefInspectorofExplosives(asdefinedintheExplosives Act,ActNo.15of2003)arenotifiedinwritingassoonas reasonablypracticable,ifanyexplosiveshavebeenleftbehindin themine,of (i) thetype,quantitiesandlocation ofsuchexplosivesand

(ii) themeasurestakentosafeguardpersonsfromanysignificant riskassociatedwithsuchexplosives. (2) Theemployermusttakereasonablemeasurestoensurethatonlythe competentpersoncontemplatedinregulation4.4(1) destroysexplosives. Inthecaseofundergroundcoalmines,explosivesmustbedestroyed onlyonsurface,andinaccordancewithawrittenprocedurepreparedfor

thatpurposebytheemployerafterconsultationwiththeexplosives manufacturerorsupplier. (4) TheemployermustinformtheChiefInspectorofExplosives(as definedintheExplosivesAct,ActNo.15of2003)inadvanceifmore than50kgofexplosivesaretobedestroyedatanyonetime. Theemployermusttakereasonablemeasurestoensurethataccurate records,coveringtheimmediateprecedingthreeyears,arekeptreadily availableatthemineofallexplosivesreceived,stored,issued,usedand destroyedatthemine.

4.3

Approvedexplosivesatmines (1) Theemployermusttakereasonablemeasurestoensurethat (a) onlyexplosivesapprovedbytheemployerareusedatthemine (b) theexplosivesareusedinaccordancewithawrittenprocedure preparedandimplementedforthatpurposeafterconsultationwith theexplosivemanufacturerorsupplier (c) noexplosivesareinitiatedwhereflammablegasorcoaldustmaybe presentinsufficientquantitiestocauseaflammablegasorcoaldust explosionortocauseflammablegastoburn (d) ifexplosivesaremanufacturedatthemine,itisdoneinaccordance withawrittenprocedurepreparedandimplementedforthatpurpose afterconsultationwiththeexplosivemanufacturerorsupplierand (e) explosivepoweredtoolsareusedandmaintainedinaccordancewith awrittenprocedurepreparedandimplementedforthatpurpose.

4.4

PrimaryandSecondaryblastingtobeperformedbycompetentpersons (1) Theemployermusttakereasonablemeasurestoensure,whereblasting takesplace,thatacompetentperson (a) exercisescontrolovertheexplosivestobeusedforsuchblasting (b) preparesprimers (c) testsforflammablegasinaccordancewithawrittenprocedure preparedandimplementedforthatpurposebytheemployer (d) examinesanydrilledholetobedeepenedtoensureitissafeto deepen

(e) examinesforanddealswithmisfires,sockets,oldanddamaged explosivesinaccordancewithawrittenprocedurepreparedforthat purposebytheemployer (f) marksorindicatesshotholesfordrillingorsanctionsthedrillingof shotholesmarkedorindicatedbyanotherperson

(g) exercisescontroloveranymanufacturingatthemineofexplosives tobeusedforsuchblasting (h) theconnectingupofblastingroundsorcircuits (i) (j) chargesshotholeswithexplosivesorplacesexplosivechargesand initiatesblasting.

(2) BlastingAssistants Acompetentpersonmay,withtheapprovaloftheemployer,assistthe competentpersonreferredtoinregulation4.4(1)withanyofthe followingactivities (a) exercisingcontrolovertheexplosivestobeusedforsuchblasting (b) thepreparationofprimers (c) thechargingofshotholeswithexplosivesortheplacingof explosivecharges (d) thetimingofblastingroundsorcircuitsand (e) initiatinganyblastingintheactualpresenceandunderthedirect supervisionofthecompetentpersonreferredtoinregulation4.4(1). 4.5 CertificationofInitiationApparatusandBlastingSystems (1) Theemployermustensurethatwhereinitiationofexplosivescharges takesplacebymeansofelectricity (a) apparatususedfortheinitiationofelectronicdetonatorscomplies withPart1ElectronicInitiationSystemsofSANS1717The designandapprovalofEEDinitiationsystemsforuseinminingand civilblasting (b) apparatususedfortheinitiationofelectricdetonatorscomplieswith Part2ElectricInitiationSystemShotExploderbasedofSANS 1717

(c) everyshotexploder,initiatororelectronicdelaydetonatorsystemis testedandcertifiedbyatestlaboratoryaccreditedforthispurpose bythegovernmentendorsednationalaccreditationbody (d) everyinherentlysafeapparatususedforthetestingofacircuit containinganelectricdetonator,electricorelectronicinitiator, electronicdelaydetonatororasimilardeviceistestedandcertified forthatpurposebyatestlaboratoryaccreditedforthatpurposeby thegovernmentendorsednationalaccreditationbodyand (e) allaspectspertainingtotheuseofelectricalblastingareexecuted safelywithspecificreferencetothefollowingSANSCodesof Practice10325:Thesafeapplicationofdetonatorsystemsforuse inminingandcivilblastingapplicationsPart1:Electronic DetonatorSystems(SABS103251:2000)andPart2:Electric DetonatorSystemsShotExploderbased.(SABS03252:2001). (2) ThenormativereferencesintheSABSStandardsreferredtoin4.5(1)(e) abovearenotapplicabletotheemployer. 4.6 Generalprecautionarymeasureswhenblasting Theemployermusttakereasonablemeasurestoensurethatwhenblastingtakes place,airandgroundvibrations,shockwavesorflymaterialarelimitedtosuch anextentandatsuchadistancefromanybuilding,publicthoroughfare,railway, powerlineoranyplacewherepersonscongregatetoensurethatthereisno significantrisktothehealthorsafetyofpersons. 4.7 Learners Learnerstobeassessedcompetentagainstanyofthequalificationsreferredto intheseregulationsmay,withtheapprovaloftheemployer,performanyofthe activitieslistedundertheseregulationsintheactualpresenceandunderthe directsupervisionoftherelevantcompetentperson(s). 4.8 Preventionofflammablegasandcoaldustexplosions Theemployermusttakereasonablemeasurestoensurethat: (a) ablowoutorignitionofflammablegasorinitiationofacoaldust explosiondoesnotoccurduetothedesignandpositioning oftheblast holesorduetothetypeofexplosivesthatareusedand (b) initiatingdevicesorsystemsusedinblastdesignsaredesignednotto causeamethaneorcoaldustexplosion. 4.9 ShotHolestobeStemmed Theemployermusttakereasonablemeasurestoensurethatnoexplosive charge,containedinashotholewherethereisasignificantriskofaflammable

gasorcoaldustexplosion,isinitiated,unlesstheexplosivesarecontainedina shotholeandthattheportionoftheholebetweentheexplosivesandthecollar isonlyfilledwithsand,clayornonflammablematerials,providedthatfinecoal maynotbeusedforstemming.

CHAPTER5 FIRESANDEXPLOSIONS 5.1 5.1 ReporttoEmployer ReporttoEmployer (1) Theemployermustensurethatacompetentpersonreportstothe employer,atappropriateintervalsdeterminedinaccordancewiththe minesriskassessment,on (a) theeffectivenessoftheprecautionarymeasurestakentopreventor suppressexplosionsofcoaldustorflammablegasand (b) theadequacyofmeasuresinplacetoprevent,detectandcombatthe startandspreadofminefires. (2) Whereatanyareaatamine,afirecouldposeasignificantrisktothe healthandsafetyofpersons,theemployermusttakereasonablemeasures toensurethatflammableliquids,gasesandmaterialsinuse,are transported,stored,deposited,usedanddisposedofinsuchawayasto preventthestartingorspreadingofafire.

(3) Theemployeratanymineatwhichafireoccursmust,assoonas practicable,notifytheemployerofanyothermineatwhichthespreadof suchfirecouldconstituteahazardshouldsuchfirenotbeimmediately extinguishable,oftheexistenceofthatfire

(4) Ifnoagreementisconcludedonthenumberoffulltimehealthandsafety representativeswithinthreemonthsofconsultationscommencinginterms ofregulation6.1(2),anypartytoadisputeintermsofsection26(8)(b) mayreferthedisputetotheCommission. 6.2 Applicationofregulations If a collective agreement dealing with the election of health and safety representatives, fulltime health and safety representatives or employee representatives on health and safety committees is concluded in terms of Chapter3ofthisAct,theregulationsinthisChapterdealingwithsuchelection donotapply. 6.3 Establishmentofelectioncommittee (1) Themanagermustestablishanelectioncommittee. (2) Theelectioncommittee (a) mustincludeanappropriatenumberofemployeerepresentatives and (b) mayincludeanumberofmanagementrepresentatives. (3) Iftheelectioncommitteeincludesmanagementrepresentatives,their numbermustbeequaltoorlessthanthenumberofemployee representatives. (4) Theemployeerepresentativesontheelectioncommitteemustbe appointed (a) bytherepresentativetradeunionatthemine (b) ifthereisnorepresentativetradeunionatthemine,bytheregistered tradeunionswithmembersatthemineor (c) ifthereisnoregisteredtradeunionwithmembersatthemine,by theemployeesatthemine. 6.4 Dutiesofelectioncommittee Theelectioncommitteemust (a) determinefairandreasonableproceduresforthenominationandelection ofhealthandsafetyrepresentatives (b) ensurethatelectionsareconductedintermsofsuchprocedures (c) appointanelectionofficerandoneormorecountingofficersforeach electionand

(d) afterconsultingthemanager,determinethedate,timeandplaceofeach election. 6.5 Dutiesofmanager (1) Themanagermust (a) asfaraspracticable,ensurethateveryemployeeismadefamiliar withthenomination andelectionprocedures (b) givereasonableandunderstandablenoticetotheemployeesofthe date,timeandplaceofeachelection (c) providethefacilitiesandassistancereasonablynecessaryforthe electioncommitteetoperformitsfunctions (d) providethefacilitiesreasonablynecessaryfor (i) theelectionofhealthandsafetyrepresentativesand

(ii) theappointmentofemployeerepresentativesonanyhealth andsafetycommitteeand (e) providereasonabletimeofffromwork,without lossof remuneration,foremployeestoparticipateintheelectionsofhealth andsafetyrepresentatives. (2) TheChiefInspectormayissueguidelinesregardingthefacilitiesand assistancetobeprovidedintermsofregulation6.5(1). 6.6 Nominationofhealthandsafetyrepresentatives (1) Everycandidateforelectionasahealthandsafetyrepresentativefora shiftanddesignatedworkingplacemustbenominatedforelectionbyan employeewhoworksonthesameshiftatthedesignatedworkingplace. (2) Everycandidateforelectionasfulltimehealthandsafetyrepresentative foraminemustbenominatedforelectionbyanemployee. 6.7 Proceduresfortheelectionofhealthandsafetyrepresentatives (1) (a) Ifonlyonecandidateisnominatedforelectionasahealthand safetyrepresentative for a shift at a designated working place, the election officer must declarethecandidateelected.

(b) Iftwoormorecandidatesarenominatedforelectionasahealthand safetyrepresentativeforashiftatadesignatedworkingplace,the electionofficermustholdanelection. (2) Everyelectionforahealthandsafetyrepresentative (a) mustbeunderthecontroloftheelectionofficerand (b) isonlyvalidif50%ormoreoftheemployeeswhoworkonthe sameshiftatthedesignatedworkingplaceconcernedvoteinthe election. (3) (a) Iflessthan50%oftheemployeeswhoworkonthesameshift atthedesignated working place concerned vote in an election, the election officer must,afterconsultingthemanager,determineadate,timeandplace forasubsequentelection. (b) Regulation6.7(2)(b) doesnotapplytosuchsubsequentelection. (4) Everyemployeeonashiftatadesignatedworkingplacehasonevotein theelectionofeveryhealthandsafetyrepresentativeforthatshiftand designatedworkingplace. (5) Thecountingofficersmust,underthesupervisionoftheelectionofficer, countallvalidvotes. (6) Theelectionofficermustannouncetheresultsofthecounttothe employeesconcerned. (7) Ifanelectionforanalternatehealthandsafetyrepresentativeisheld,it mustbeconductedinthesamemannerasanelectionforahealthand safetyrepresentative. 6.8 Proceduresfortheelectionoffulltimehealthandsafetyrepresentatives (1) Ifthenumberofcandidatesnominatedforelectionasfulltimehealthand safetyrepresentativesatamineis (a) notmorethanthenumberthatmustbeelected,theelectionofficer mustdeclarethecandidateselectedor (b) morethanthenumberthatmustbeelected,theelectionofficermust holdanelection. (2) Everyelectionforafulltimehealthandsafetyrepresentative (a) mustbeunderthecontroloftheelectionofficerand (b) isonlyvalidif50%ormoreoftheemployeesvoteintheelection.

(3) (a) Iflessthan50%oftheemployeesvoteinanelection,the electionofficermustafter consulting the manager, determine a date, time and place for a subsequentelection. (b) Regulation6.8(2)(b)doesnotapplytothesubsequentelection. (4) Everyemployeehasonevoteintheelectionofeveryfulltimehealthand safetyrepresentative. SURVEYPRACTICEONLAND(SURFACEANDUNDERGROUND)AND ATSEA (14) Theemployermusttakereasonablemeasurestoensurethatinall surveyingandmappingdoneandallplanspreparedforpurposesofthese regulationsbythecompetentpersonreferredtoinregulation17(2): SurveyStations (a) sufficientsurveystationsareestablished,sothatallsurfaceobjects andall workingscanbeaccuratelysurveyed.Eachsurveystation mustbeclearlymarkedwithauniquenumberandrecordedina register StandardsofAccuracy:SurfaceandUnderground (b) theminimumstandardofaccuracyandclassofsurveyforthefixing of surveystations onbothhorizontalandverticalplanesarein accordancewiththefollowingformula: S A=0,015+ 30000 whereSisthedistanceinmetresbetweentheknownandthe unknown surveystationprovidedthatinthecaseofatraverse,after

Accidentstobereported The employer must report to the Principal Inspector of Mines in the manner prescribedinthischapteranyaccidentattheminethatresultsin: (a) thedeathofanyemployee (b) aninjury,toanyemployee,likelytobefatal (c) unconsciousness,incapacitationfromheatstrokeorheatexhaustion, oxygendeficiency,theinhalationoffumesorpoisonousgas,orelectric shockorelectricbumaccidentsoforbyanyemployeeandwhichisnot reportableintermsofparagraph(d). (d) aninjurywhicheitherincapacitatestheinjuredemployeefromperforming thatemployeesnormalorasimilaroccupationforaperiodtotaling14 daysormore,orwhichcausestheinjuredemployeetosufferthelossofa joint,orapartofajoint,orsustain apermanentdisability, (e) aninjury,otherthaninjuriesreferredtoinparagraph(d),which incapacitatestheinjuredemployeefromperformingthatemployees tiormalorasimilaroccupationonthenextcalendarday.

23.2 (1) Anaccidentreferredtoinparagraph(a),(b)or(c)ofregulation 23.1mustbereported

immediatelybythequickestmeansavailableandmustbeconfirmed withoutdelayon FormsSAMRASS1and2 prescribedinChapter21. (2) Anaccidentreferredtoinparagraph(d)ofregulation23.1must,afterthe accidentbecomesreportable,bereportedwithinthreedayson Forms SAMRASS1 and 2prescribedinChapter21. (3) TheForm SAMRASS9mustbesubmittedonamonthlybasisforall personsnothavingreturnedtoworkatthetimeofsubmitting SAMRASS 2 onamonthlybasis. (4) Anaccidentreferredtoinparagraph(e)ofregulation23.1mustbe reportedwithoutdelayonamonthlybasis,onFormSAMRASS4 prescribedinChapter21 23.3 (1) Wherethedeathofan employee,referredtoinregulation 23.1(a)isrelatedtoarockburst orfallofground,thedulycompletedForm SAMRASS3,prescribedin Chapter21,forsuchrockburstorfallofgroundmustbe forwarded bytheemployertothePrincipalInspectorofMineswithin14daysofsuch death. (2) Whenaninjuryresultsinthedeathoftheinjuredemployeeafterthereport intermsofregulation23.1(b),(c),(d)or(e)hasbeengivenorwhena slightinjury,whichwasnotreportable,resultsinthedeathoftheinjured employee,orwhengeneralsepsisortetanusdevelopsasaresultofan injury,theemployermustimmediatelyreportittothePrincipalInspectorof MinesandwithoutdelaysubmitamendedForm SAMRASS1 prescribed inChapter21. (3) Wheretheinjuryofapersonreferredtoinregulation23(1)ora dangerousoccurrencereferredtoinregulation23.4(o),isrelatedtothe useofexplosives,inadditiontoForm SAMRASS1,thedulycompleted FormSAMRASS5,prescribedinChapter21,mustbeforwardedbythe employertothePrincipalInspectorofMineswithin14daysofsuch occurrence. (4) Wheretheinjuryofapersonreferredtoinregulation23(1)ora dangerousoccurrencereferredtoinregulation23.4(f)isrelatedtofires, inadditiontoFormSAMRASS1,thedulycompletedForm SAMRASS 6,prescribedinChapter21,mustbeforwardedbytheemployertothe PrincipalInspectorofMineswithin14daysofsuchoccurrence. (5) Wheretheinjuryofapersonreferredtoinregulation23(1)ora dangerousoccurrencereferredtoin regulation23.4(b)isrelatedtoa subsidenceinacoalmine,inadditiontoForm SAMRASS1,theduly completedForm SAMRASS7,prescribedinChapter21,mustbe forwardedbytheemployer tothePrincipalInspectorofMineswithin 14daysofsuchoccurrence.

(6) Wheretheinjuryofapersonreferredtoinregulation23(1)isrelatedto heatstrokeorheatexhaustion,inadditiontoForm SAMRASS1,theduly completedForm SAMRASS8,prescribedinChapter21,mustbe forwardedbytheemployertothePrincipalInspectorofMineswithin14 daysofsuch occurrence. 23.4 Dangerousoccurrencestobereported The employer must report to the Principal Inspector of Mines in the manner prescribed in this Chapter any of the following dangerous occurrences at the
mine

(a) ROCKBURSTSANDFALLSOFGROUND An extensive rockburst or fall of ground causing the following damage underground (i) Atleast10linearmetresofworkingfacehasbeenseverelydamaged andchokedandwillrequirereestablishmentandresupporting,or beabandoned

2 (ii) Atleast25m ofworkingareahasbeenseverelydamagedand chokedrenderingsupportunitsineffectualandwillhavetobere establishedandresupportedorbeabandoned

(iii) Atleast10linearmetresofgullyhasbeenrestrictedwithrock clearlyrecently displacedfromthehangingwallandgully sidewalls (iv) Atleast10linearmetrescontinuousor30linearmetrescumulative ofaccesswaysoftunnelortravellingwayhasbeenseverely damagedandwillrequirerehabilitationorbeabandoned


2 3 (v) Atleast10m ofroofor5m ofrockhasbeendisplacedfromthe roofoftheminingcavityorexcavation 3 (vi) Atleast10m ofrockhasbeenfreshlydisplacedfrompillarsor tunnelsidewalls.

(b) CAVING Any unplanned or uncontrolled caving, side wall or slope failure or subsidence in the ground or workings, causing damage to the surface, whichmayposeasignificantrisktothesafetyofpersonsatamine. (c) FLOWOFWATER,BROKENROCK,MUDORSLIMES Anyunplannedoruncontrolledflowofwater,brokenrock,mudorslimes attheminewhichmayposeasignificantrisktothesafetyofpersons.

(d) BREAKDOWNOFMAINVENTILATIONFAN Breakdownofanymainventilationfan. (e) POWERFAILURE Any power failure occurring in the underground workings of a mine, whichposesasignificantrisktothehealth,orsafetyofpersonsatamine. (f) FIRESANDEXPLOSIONS Any ignition or explosion of gas or dust, or any fire related to mining activities or any indication or recrudescence of fire or spontaneous combustionatorinamine. (g) FLAMMABLEGAS The presence of flammable gas exceeding one comma four parts per hundredbyvolumeinthegeneralatmosphereatamine,oranyportionof amine: (i) ifsuchflammablegasisdetectedforthefirsttimeor

(ii) thefirsttimesuchflammablegasisagaindetectedafternothaving beendetectedthereinforacontinuousperiodofthreemonths. (h) WINDINGPLANTS (i) Runningoutofcontrolofwindingengine,windingdrumor conveyance

(ii) Fractureorfailureofanyessentialpartofthewindingengine, fractureorfailureofanysafetydeviceusedinconnectionwiththe windingequipment (iii) Fracture,failureorseriousdistortionofwindingrope,fracture, failureorseriousdistortionofanyconnectionbetweenthewinding ropeandthedrumorbetweenthewindingropeandtheconveyance andanyotherloadsuspendedfromorattachedtosuchrope fracture,failureorfailureorseriousdistortionofanyconnection betweenconveyancesorbetweenaconveyanceandanysuspended orattachedload,fractureofguideropeoritsconnections,fracture ofbalanceortailropeoritsconnections

(ii) Fractureordistortionoftheliftorelevatorrope,fractureorfailure ofattachmentsofsuchrope. (iii) Fractureorfailureofanysheaveoroftheshaftorshaftbearingof suchsheave. (iv) Jammingofcarorcounterpoise. (v) Fractureorfailureofbrakingsystemorofanycriticalparts thereof

(vi) Failuretoactivatewhenrequiredofanysafetycatchesand/or arrestingdevicesoractivationofanysafetycatchesand/orarresting deviceswhennotrequired. (j) OBJECTSFALLINGDOWNSHAFTS Anyobjectfallingdowntheshaftoranyotherincidentwhichnecessitates theinspectionoftheshaft. (k) EMERGENCYORRESCUEPROCEDURES

(i)

Anyfailureofbreathingapparatuswhilstdeployed.

(ii) Theuseofemergencyescapeapparatus,proceduresorrescue mechanisms,ortherescuefromentrapment,associatedwithmining orrelatedactivities,ofany employee. (l) SELFPROPELLEDMOBILEMACHINERY Anyselfpropelledmobilemachinerunningoutofcontrolwhichmay posesignificantrisktothesafetyofpersonsatamine. (m) BOILERSANDPRESSUREVESSELS Fracture or failure of any part of a boiler or safety device of a boiler or pressurevesselwhichmayhaveendangeredpersons. (n) CHAIRLIFTS (i) Fractureorfailureofanypartorsafetydeviceofachairlift installationwhichmayhaveendangeredpersonsormayhave causeddamagetosuchchairliftinstallation.

(ii) Fractureorfailure ofanyessentialpartofthedrivingmachinery. (iii) Fracturefailureorseriousdistortionofanyropeorchainforming partofachairliftinstallation. (o) EXPLOSIVES (i) Anyunauthorisedoraccidentalignitionordetonationof explosives.

(ii) Anyexposureofpersonstoblastingfumeswhichisnotreportable intermsofregulation23.1. (iii) Anydetonationofexplosiveswhichmayposeasignificantriskto thesafetyofpersons. 23.5 A dangerous occurrence referred to in regulation 23.4 must be reported immediately by the quickest means available and must be confirmed without delayonForm SAMRASS1 prescribedinChapter21. 23.6 Everyemployermustensurethatasystemisinplacewherebytheemployeris informed, as soon as is practicable after its occurrence, of any accident or dangerousoccurrence,whichisreportableintermsofthisChapter. 23.7 (i) particularsofall Everyemployermustkeepandmaintainarecordinwhichthe

accidentsanddangerousoccurrences,whicharerequiredtobereportedin termsofthisChapter,mustberecordedwithoutdelay. (ii) TherecordcontemplatedinRegulation23.7(i)inrespectofallaccidents ordangerousoccurrencesmustbekeptandmaintainedfortwoyearsfrom thetimethattheaccidentordangerousoccurrencebecomesreportable.
