ACTIVISION’S UNOPPOSED MOTION TO ENLARGE THE PAGE LIMIT FOR THE PRELIMINARY CLAIM CONSTRUCTION BRIEFS Defendants Activision Blizzard, Inc., Blizzard Entertainment, Inc. and Activision Publishing, Inc. (collectively “Activision”) respectfully move the Court for an enlargement of the page limit for the Preliminary Claim Construction Briefs, which the parties will simultaneously exchange and file on April 22, 2013. Under the current Scheduling Order, Activision and Plaintiff Worlds, Inc. (“Worlds”) are each permitted to file a Preliminary Claim Construction Brief of up to 25 pages in length. Activision respectfully requests that the Court enlarge the page limit for the Preliminary Claim Construction Briefs to 40 pages in length. Activision has conferred with counsel for Worlds, and Worlds does not oppose this Motion. In support of this Motion, Activision respectfully submits the following: 1. This is a patent infringement lawsuit involving five patents: U.S. Patent Nos.

7,181,690, 7,493,558, 7,945,856, 8,082,501, and 8,145,998 (collectively the “patents-in-suit”). 2. The parties have collectively identified 19 claim terms for construction. On

April 8, 2013, the parties met-and-conferred in an attempt to narrow the disputed claim terms for 1

construction but have not yet been able to reach agreement on any of the disputed terms. The parties plan to meet-and-confer again this week regarding the disputed claim terms. 3. The Court’s August 13, 2012 Scheduling Order (D.I.29) adopting and modifying

the August 6, 2012 Joint Scheduling Statement (D.I. 27), and the Court’s April 2, 2013 Order (D.I. 56) amending the Scheduling Order currently provide that the parties will simultaneously exchange and file Preliminary Claim Construction Briefs of up to 25 pages in length on April 22, 2013. 4. Activision believes that 40 pages are necessary for the Preliminary Claim

Construction Brief to fully address the claim construction issues. Accordingly, Activision submits that the relief requested herein is for good cause. 5. Worlds does not oppose this motion.

WHEREFORE, Activision respectfully requests that the Court grant its Motion and permit each party to submit a Preliminary Claim Construction Brief of up to 40 pages.
