Village seeks summary judgment in hotel lawsuit


BY THOMAS J. MC KILLEN MANAGING EDITOR The village of Menomonee Falls is seeking a summary judgment against the defendants in an ongoing lawsuit involving the Radisson Hotel in the village. As part of a tax incremental finance (TIF) district that included the hotel, in April 2010 the village provided a $17.6 million loan to Lodging Investors of Menomonee Falls, LLC, the ownership group that was to construct and manage the hotel. The ownership group defaulted on the loan and the village is currently owed approximately $14 million. The hotel is currently operating under a receivership following a motion by the village of Menomonee Falls in Waukesha County Circuit Court that was granted in November 2011. In February, Judge James R. Kieffer granted a motion giving receiver Seth Dizard additional powers and duties over the hotel operations. On April 15, the village filed a motion seeking a summary judgment against defendants James Heyden, Constance L. OMara Heyden and L.A.C. Concepts, the remaining partners in the Lodging Investors group. There are no issues of material fact in dispute and, therefore, summary judgment should be entered in favor of the village, Randall Crocker, an attorney representing the village in the proceedings, stated in the April 15 filing.

Volunteers needed for Youth Futures lock-in May 10


Area volunteers are needed for the annual Germantown Youth Futures Lock-in set for Friday, May 10, 6 to 11 p.m., at Kennedy Middle School. The eventwhich has a theme of Outer Spacewill include carnival games, laser tag, bungee basketball, dance, open gym and more. A minimum of 25 chaperones are needed for both shifts5:30 to 8:30 p.m. and 8 to 11 p.m. Those who are interested can choose one or both shifts. Chaperones should be at least 18 years old and out of high school. High school volunteers are also needed to run games, collects tickets, sell concessions and oversee events, as well as for set up from 3:30 to 6:30 p.m. Interested teens should stop by the high schools Youth Futures during lunch April 29 and May 1. Assignments will be given on a first-come, first-served basis, but an effort will be made to accommodate requests. A maximum of 60 volunteers will be selected; no walk-ins the day of the event. The lock-in is the major fundraiser for the youth organization that promotes substancefree living among teens. For more information, call the Germantown Rec. Hospitals spring fundraising event offering variety of prizes A $2,000 cash prize and an assortment of $100 gift certificates for 10 of southeastern Wisconsins most notable restaurants are the top prizes in the 2013 Spring Splendor raffles, coordinated by Community Memorial Foundation. Kids Fishing Derby set for May 11 The Kids Fishing Derby sponsored by the Optimist Club of Menomonee Falls will be held at the Mill Pond Shelter Saturday, May 11 from 9 a.m. to 1 p.m. Free registration will take place from 9 to 10 a.m. This will include a T-shirt and chance to win a door prize. This catch-and-release contest is free for all children ages 3-16 who reside or attend school in the village or outlying areas. Children under 9 must be accompanied by an adult. Trophies will be awarded in five age divisions. Participants should bring their own fishing equipment. There will be a limited supply of bait. Food, sponsored by the Menomonee Falls Neighborhood Watch, will be sold at the pavilion. The Mill Pond Shelter is located north of the Main Street bridge between Water Street and Grand Avenue.

Local doctors recognized with Spirit of Caring Awards


Froedtert Health Community Memorial Hospital has named Dennis Shepherd, MD, and Laurie Amundsen, MD, as the recipients of the 2013 Spirit of Caring Awards. The Spirit of Caring-Excellence in the Medical Profession Award was awarded to Dr. Shepherd, of Elm Grove. The Spirit of CaringCommunity Service Award was awarded to Dr. Amundsen, of Menomonee Falls. The recipients were notified in late March, prior to National Doctors Day, which was March 30. Dr. Shepherd was selected as the 2013 Spirit of Caring-Excellence in the Medical Profession Award winner. His professionalism and dedication to the medical profession is evident from his past leadership role of the medical staff to the realignment of the Clinical Service Units, his contributions to Community Memorial Hospital have been invaluable. Dr. Shepherd is a longtime member of the medical staff, consistently receives high patient satisfaction scores and currently serves as the director of the Emergency and Critical Care Services CSU. His involvement and support of the firefighters, EMTs and paramedics in the hospitals service area are important local contributions to the medical profession. Dr. Shepherds roles as physician, leader and mentor made him most deserving of this years award. The Spirit of Caring-Excellence in the Medical Profession Award recognizes members of the Community Memorial Hospital medical staff who have displayed extraordinary professionalism or compassion through interaction with peers and patients and who embody excellence through service, innovation, technical skill, leadership or practice. Dr. Amundsen was selected as the 2013 Spirit of Caring-Community Service Award winner. She has taken medical mission trips to Honduras to provide care to individuals in need; demonstrating her commitment to volunteerism and human compassion. Dr. Amundsen organized and attended the mission trips as well as supervised the efforts of 14 nurse practitioner students on one of the trips. Closer to home, her dedication to service continues as an active church member where she serves as friend, confidant and mentor. She has also been a past Community Memorial Foundations Wheeling for Healing participant. Investing time in volunteer activities as well as delivering exceptional patient care every time makes Dr. Amundsen a worthy award recipient. The Spirit of Caring-Community Service Award recognizes members of the Community Memorial Hospital medical staff who invest in their community through volunteer activities not directly related to the hospital or the doctors primary practice. The Spirit of Caring Awards were established in 2000 to recognize the contributions of Community Memorial Hospital medical

Village Board approves rezoning requests


BY THOMAS J. MC KILLEN MANAGING EDITOR The Menomonee Falls Village Board approved a rezoning of land near the northwest corner of Lisbon and Pilgrim roads that will allow for the development of a senior housing complex. The board approved the rezoning of three parcels from the C-3 Commercial Residential Development District and Planned Development District to the P-2 Institutional District. According to information from the village staff report, Presbyterian Homes & Services is planning on developing a senior housing campus with a continuum of care that will include senior apartments, assisted living, memory care and skilled nursing care. A site plan submitted to the village shows four buildings constructed over three phases. Once completed, there will be 350 units at the development. Director of Community Development Matt Carran said that if the rezoning is approved, the company will come back to the village with specific plans for lighting and buildings. Carran noted that the land was originally zoned for Medium Density Urban Residential Development, which would have allowed for up to six units per acre. In 2008, the village Comprehensive Plan was changed so that the two western parcels were classified as mixed use while the east parcel was classified for commercial use. Village President Randy Newman said that concerns about drainage were raised during the Plan Commission meeting and said that would be addressed as part of the future development of the project. The board supported the rezoning and a change in the Comprehensive Plan to allow the proposal to proceed. During board discussion, Trustee Michael McDonald noted that previous plans for site included a subdivision or a grocery store. McDonald also noted the development serves as a doorstep in the community. I just hope like heck youre able to put in the type of development that weve seen in other neighborhoods like this, that youve done such a great job, McDonald said. Newman added the proposal will be great for the neighborhood. It will certainly take some angst and anguish theyve had over the years over the many things that have been proposed there. Rezoning approved for land near future road The board approved a rezoning of land north of Roosevelt Drive from the RM-2 MultiFamily Resident District to the Planned Development District. The land is located between Roosevelt Drive and a future road that will go from the current Richfield Way at Water Street to just north of Roosevelt Drive. Carran said the apartment complex that will be proposed for the area will connected to the future road. Carran said the rezoning is requested because the developer preferred moving forward with the project through the Planned Development District. As part of future proposals, plans will be submitted to the Community Development Authority and Architectural Control Board before building permits are issued. No one spoke on a public hearing regarding the request. Newman abstained from discussion and voting on the matter. The board later approved a name change for the expanded road, changing the name of Richfield Way to Falls Parkway. The road currently goes from County Line Road to Water Street. As part of a new development, the road will be extended to a point just north of Roosevelt Drive. Trustee Steve Raymonds said nobody really knows why the road is called Richfield Way even though its in Menomonee Falls. With the road being expanded and new development coming forward, the Community Development Authority was seeking a new name. Raymonds said several existing businesses who didnt like the current name of the road. Were ready to go with this, Raymonds said. Newman said the new name is reflective of Menomonee Falls instead of the village to the north.

...Heydens to challenge village motion

A hearing on the villages request is scheduled for June 10. The summary judgment request followed a March 15 motion filed by the village against the Heydens and L.A.C. Concepts. The village has determined that Lodging Investors has insufficient funds to pay for the completion of construction, Crocker stated in the March 15 filing. Crocker stated that Lodging Investors was insolvent in 2010 and 2011. Lynne Mueller, an attorney representing the Heydens and L.A.C., filed a response April 5, alleging the loan guaranty was drafted by the village and is unconscionable and commercially unreasonable. Mueller stated that James Heyden was not the manager of Lodging Investors and did not participate in the creation of the loan documents. Mueller also alleged that the village violated its duty of good faith and fair dealing by failing to complete the proper due diligence when it issued the loan for the construction of the hotel property, failing to verify the value of the proposed construction and preparing loan documents that it knew or should have known were technically in default from the moment the loan transaction was prepared by the plaintiff (village). Crocker dismissed those allegations in his April 15 request for the summary judgment. James Heyden, a sophisticated commercial developer, is asking this court to excuse him from the contractual obligation which he freely and knowingly assumed as part of a multi-million deal negotiated with the assistance of counsel. There is no basis in contract or Wisconsin law for any such argument, Crocker stated in his April 15 response. When reached for comment last week, Lynne Mueller, an attorney representing the Heydens and L.A.C., said a response to the villages motion for summary judgment will be filed by May 27. Our response is in part that the Village has not acted in good faith in this matter and should not be able to seek recovery from either Lodging Investors or Mr. Heyden since its actions caused the failure of the hotel operations. We believe the filing itself shows the continued lack of good faith of the village toward Mr. Heyden as he is the only guarantor the Village is pursuing despite the fact that as their own motion indicates they claim all of the guarantors are in default, Mueller stated. The Radisson Hotel issue was raised during the citizen comment portion of the Village Board meeting April 15, hours after the request for summary judgment was filed. Whats the endgame for the Village Board with this Radisson hotel mess? former Menomonee Falls Village President Jefferson Davis asked. Davis said that what makes sense to me is you sit down with the only viable hotel owner that we have left, you cut a deal, you minimize our losses and we get the stink out of the newspapers, off the front page of talk radio and TV and move on. Davis also referenced contractors who havent been paid for work done on the facility. Please pay these guys, theyve been waiting for over two years now. This is getting ridiculous, Davis said. When reached for comment later in the week, Crocker said, The village has worked diligently to reach a resolution with the owners and with the subcontractors, but no agreement has been concluded. Any such agreement would require an orderly process where the village would realize the best return on the sale or refinancing of the hotel with the help and assistance of the owners. Crocker said that no agreement has been reached and the village is proceeding with its rights and remedies under the loan documents. Those rights and remedies include a judgment of foreclosure and a sheriffs sale. The village retains the right to credit bid at that sale, or allow the property to be sold to a third party. The owner retains the right to repay the village the debt and redeem the property at any time prior to confirmation of the sheriffs sale, Crocker said. A settlement can be reached at any time before sheriffs sale. Absent such a settlement it is likely the sale will proceed.

Jackson hosting Youth Battle of the Bands June 15


The first annual Jackson Parks & Recreation/STAND/Boys & Girls Clubs of Washington County Battle of the Bands will be held on Saturday, June 15 from 5 to 9 p.m. at the Jackson Community Center, N165 W20330 Hickory Lane in Jackson. First, second and third place winners will be selected. Guidelines are as follows: The majority of the bands members must be between the ages of 14-20. There will be an entry fee of $10 for all bands selected to perform. At least one member of the band must attend a mandatory meeting in late May or early June. Participants must arrive prior to the start of the event and stay at the Community Center for the entire event. Bands will be notified of the exact times prior to June 8. The program will follow a strict schedule so bands must be ready to perform at their set time. Bands will have approximately 15 to 20 minutes to perform. The sound will be donated and run by DJ Dylan Moore. Music selected must be appropriate for an all ages type of showno profanity, and no references to drugs, alcohol or violence. Any band that ignores this rule forfeits the contest. Also, all clothing must be free from tobacco, alcohol and drug references.

Falls HS student finalist for Spirit of Community award


Menomonee Falls High School student Julie Schweiss was named one finalists in the state Prudential Spirit of Community Awards. Schweiss was formally recognized during a presentation at the March 25 Menomonee Falls School Board meeting. High School Principal Corey Golla said Schweiss is consistently engaged in helping others through a variety of service efforts as well as serving her school by being very outspoken and coming to me with ideas to improve. Patrick Maddox of Prudential Financial said that in 2010 Schweiss, through the schools Key Club, helped organize a community Relay for Life event to benefit the American Cancer Society. The following year, Julie and Key Club organized their own Relay for Life event raising over $7,500 for cancer research. In 2012 Julie assumed the position of event chair, and that years event generated over $19,000 in pledges, Maddox said. Its the willingness to lead and to motivate that we feel truly embodies the spirit of community. Schweiss was presented with a bronze medallion for outstanding community service. Schweiss noted there were long hours put into the Relay for Life events by her and the rest of the organizing committee. Im glad to have dedicated myself to this cause because it affects so many people and I feel every dollar we raise and every person we get involved in relay is one step

The Germantown Water Utility will be performing its annual water main flushing on April 22 through May 24, 2013. The flushing process will be executed during the day between the hours of 9:00 AM and 3:00 PM. The water main flushing will remove most of the naturally occurring minerals which are harmless, but at the same time may discolor the water. Should you observe Water Utility personnel working in your neighborhood, please limit your usage of the water for 30 to 45 minutes after the flushing has occurred, to insure the water is clear of discoloration before it is drawn into your water system. MFTA to board: Listen to our concerns


The next Menomonee Falls Village Board meeting will be the first for Bonnie Lemmer and Jeremy Walz, who were elected to the board April 2. Both candidates were endorsed by the Menomonee Falls Taxpayers Association (MFTA). Association President Steve Welcenbach, who spoke at during the citizen comment portion of the April 15 Village Board meeting, said the organization supported the challengers due to concerns the MFTA had with the current board They (Lemmer and Walz) told us that they agreed with a lot of the positions we had in that our village has not been embracing the elements of free enterprise as it should be doing, Welcenbach said. Welcenbach cited the ongoing litigation between the village and remaining owners of the Radisson Hotel partnership group and the use of tax incremental finance (TIF) districts, which Welcenbach took issue with for shifting the tax base from corporations to existing small businesses and individuals that were here prior to the creation of the TIF districts. We are going to support these newly elected officials and their challenge to find out information about things, and we hope that the rest of the board along with the other members take into consideration viewpoints that theyre bringing here and take seriously the idea of what the proper function of our board is here, Welcenbach said. Hamilton AD summarizes positions on WIAA proposals


The Hamilton School District representative to the WIAA will be voting against a proposal to allow basketball and volleyball coaches to have unlimited contact with their players over the summer. During a brief presentation to the School Board April 9, District Athletic Director Michael Gosz summarized several items that will be discussed at the WIAA annual meeting on April 24. Basketball and volleyball coaches are limited in the number of days during the offseason where they have contact with their athletes, and one proposal would end those limits. Out of season contact is just another thing to put on our coaches, which burns them out, Gosz said. Its another burden on our families and our kids, another expectation they have to do something. Gosz added that I dont believe thats in the best interests of our student-athletes and families in our communities. The district will support other proposed measures, including: Allowing softball and baseball coaches to issue protective equipment for open gyms and leagues during the school year; Allowing cross country athletes to delay reporting for non-school training or competition until the first competition; and, Would make an athlete who appears in a commercial or advertisement ineligible until the violation has been rectified. Girls soccer: Germantown 1-1 after first two games


The Germantown girls soccer team opened the season with a 4-0 win over Madison West April 12 and then tied Madison Memorial the next day. Both games were played at the Whitefish Bay Lubar Stadium. Germatown's first two scheduled games against Oconomowoc and Whitefish Bay were postponed. Menomonee Falls won its first game of the season April 16, beating Brookfield Central 1-0, with Rachel Clayton scoring the winning goal in overtime for Menomonee Falls. Menomonee Falls scheduled season opener against Racine Horlick was cancelled. Hamilton opened the season with a 4-0 loss to Divine Savior Holy Angels April 9. The Chargers rebounded with a 7-0 win over West Allis Central April 16. Kettle Moraine Lutheran had a 1-1 record following a 2-0 win over Central Wisconsin Christian April 16. The Chargers got goals from Mackenzie Rabas and Megan Henning against Central. After the scheduled opener against West Bend West was postponed, Kettle Moraine Lutheran opened the season with a 1-0 loss to Slinger April 12.

Jessica Rupnow, a 2012 graduate of Hamilton High School, is also running in sprint events for the Bluegolds. Menomonee Falls High School graduate Conor Rafferty is a junior at UW-Eau Claire, running distance events for mens track team. Germantown High School graduate Matthew Felten is a senior at UW-Platteville and is a pole vaulter on the mens track and field team. Hamilton High School graduate Stephanie Kirchner is a junior at UW-Platteville, and was middle hitter on the womens volleyball team last fall. Troy Kenkel, a 2012 graduate of Menomonee Falls High School, is a pitcher for the UW-LaCrosse baseball team. Sean Royer, a Menomonee Falls resident and Marquette University High School graduate, is a junior at UW-LaCrosse and is running middle distance events for the mens track team.
