CLASSIFICATIONS
MId-RANGE HoMES

Western standards, with good quality fnishing. Western kitchens, hardwood
foors, good quality close-grained doors and window frames, large ensuite
bathrooms are the norm. Often with private or shared pools. Dramatic price
diferentials according to location. Price guide: 10m to 20m Baht.
WESTERN SPEC HoMES

Western standards with western kitchens, more electrical sockets, higher spec
fnishings, including foorings and bathroom fttings. These homes may be
found all over the island, individually or within estates. Many condominium
developments fall into this category. Price guide: 5m to 10m Baht.
ENTRY LEvEL HouSING

Properties aimed at both the local Thai market and expatriates seeking
a modest family home. Basic fnish, but usually have (or provision for
installation of ) western style kitchens and bathrooms. More electrical
provision than local market housing. Price guide: 3m to 5m Baht.
LoCAL MARKET HouSING

Mostly single storey, simple properties aimed at the local market and
expatriates on a limited budget. Usually in housing estates.

The aim of Exclusive Homes on Phuket is to give information that
allows you to appreciate what is available in the market. We have separated
homes listed into 6 broad categories. The classifcations refect factors such
as location, materials, living space and free space, density of development,
facilities and price bands. Check the descriptions below, then look for the


symbol in the listing. Bear in mind that a small condominium apartment may
be in the upper range as far as quality is concerned, but a lower price band.
HIGH ENd PRoPERTIES
+
Latest western build techniques, high quality and often high tech. Proximity
to the ocean is important. Most such homes are substantial, built on upwards
of 1600 sqm of land (1 Rai), often in managed developments of a limited
number of homes. Price guide: from 40m Baht up.
uPPER RANGE HoMES

Top quality build and fnishing. Usually with private pools. Teak wood is often
used in this range for foors, doors and windows. Land plot size is important
but the main examples of such homes are defned by their ocean views and
proximity to the water. Price guide: 20m to 40m Baht.

SHOPPING
Shopping for furniture, kitchens, artefacts,
soft-furnishings & everything else for the home – as well as everyday
provisioning needs – has come a long way in recent years & Phuket now
boasts “big-city”standards.
The arrival of Tesco-Lotus & Big C several years ago, changed the face of
Phuket residents’“weekly shopping”expedition, both in terms of convenience
& choice. Central Festival has further opened up shopping ventures, ofering
a more cosmopolitan boutique store approach, and Jungceylon, a frst of its
kind lifestyle centre – shopping, dining, entertainment & ftness – is open.
The daily markets are still there for the adventurous.
On the more signifcant question of furnishing your home, convenience is less
of a factor. Five years ago Phuket boasted perhaps just one quality furniture
outlet. Today there are many. It is more of a buyer’s market than ever before.
Similarly for home furnishings, décor & those all-important signature pieces
that distinguish your home from everyone else’s.
When it comes to furnishing your home, it is well worth the time & efort
to shop around. One-stop shopping is a good place to start, but is not the
complete answer in today’s Phuket when it comes to expressions of your
style. Antique & reproduction antique shops abound; some good, some less
good. Take the time to fnd out which is which; there should be no rush. The
same goes for soft furnishings, ftted kitchens… in fact everything. There are
choices in every feld. Take advantage of them.

It’s been suggested to me that I consider setting up a British
Virgin Islands company to own the lease of the property I’m
interested in buying. However, I don’t know anything about
owning a BVI company such as what administrative duties I
would have and how much work would be involved in running
it. What would my duties be and why is it suggested the
company is set up in the BVI?
“There are very few administrative duties required under BVI law for
companies. Beyond the appointment of at least one director there is no need
to appoint a general manager or other personnel. There is also no need to fle
accounts with the authorities. The main responsibility is to pay the annual
maintenance fee and failure to do so will result in the company being struck-
of so it is extremely important to ensure that your contact details are kept
up to date on the company register. Otherwise there are few responsibilities
which is why, if the intention is that the company will just own a property
and not engage in another business or trading, it is an ideal choice. A BVI
company may also have been suggested to you because many investors are
familiar and comfortable with companies incorporated there which may
facilitate the sale of a lease owned by a BVI”.

II had understood that in Thailand the two contractual options
to renew a 30 year lease were just options which weren’t 100%
defnite renewal rights. However, somebody has told me that
you can have automatic renewal rights. Is this correct?
“The 2 further 30 year period are just options and not automatic renewal rights.
What may have been referred to are the many mechanisms that can be put in
place to make the renewal as robust and certain as possible. If it is possible to
acquire a share in the lessor company then the renewal can be made automatic
in the sense that the constitution of the company can be changed to provide
that any decision not to renew the lease must be approved by 100% of the
shareholders. Whilst you remain a shareholder you have the certainty that your
vote is vital in any decision not to renew the lease. There are also various other
mechanisms available to provide an investor with comfort on the renewal”.

I’m buying a leasehold unit in the same development where
my friend purchased a unit. My friend said the transaction
process was all very straight-forward as the contracts were
the developer’s standard contracts and so did not need to be
negotiated. If this is so why would I need to instruct a lawyer to
act on my purchase?

“If the contracts are in the developer’s standard form there will be some
provisions that are non-negotiable which are key to the developer or essential
for the running of the development. However, there will be other provisions
where there is room for maneuver and the developer will be open to the
contracts being amended to make the provisions more balanced and/or
‘buyer-friendly’. By instructing a lawyer you will know the contracts are as
favourable to you as possible. A lawyer will also investigate the title to the
land to ensure there are no issues”.

I’m about to buy a condominium unit. My contract says that
I will have to pay the registration charges but could you tell
me how much they will be as I’ve heard the reduced rate is
about to expire which I’m concerned about as I budgeted
according to the reduced rate.
“The reduced registration fees introduced last year were initially frozen at the
lower rate for a period of one year ending on 28 March 2009. However, this
period has recently been extended for another year until 28 March 2010 so if
you complete your purchase soon you’ll beneft from the reduced rate”.
