The 3rd TCC and 4th NER Power Committee meeting(s) were held on 20th and 21st August, 2007 respectively at Banquet Hall of Itanagar, Arunachal Pradesh. The meetings were hosted by Department of Power, Govt. of Arunachal Pradesh. The list of participants is enclosed at Annexure-I & II.

Proceedings of the 3rd TCC meeting


The meeting started with opening address by Shri B.P. Singh, Chief Engineer, Power Department, Arunachal Pradesh. In his brief address, he conveyed his sincere concern in case of any inconvenience to the participants during their stay at Itanagar. He assured that best efforts will be made by Department of Power to make the stay comfortable. He also conveyed that during the meeting some very important issues shall be deliberated upon and all the participants should contribute in the right spirit. After this Shri B. P. Singh asked Member Secretary, NERPC to conduct the meeting. Member Secretary welcomed the participants to the 3rd TCC meeting and appreciated the efforts made by Department of Power, Arunachal Pradesh in hosting the meeting at such a short notice and lots of pains taken by the officials. He further added that the constraints of hosting the meeting in such a short time have been overcome by sheer piece of hard work, dedication and devotion by the officials from Department of Power, Arunachal Pradesh and making the meeting a success. He conveyed heartiest thanks to Shri Pulak Deb ji, Shri B.P. Singh ji, Shri A. Perme ji, Shri Bartakum ji, Shri Tasso Hinda ji, Shri T.K. Tara ji and other team members. He conveyed special thanks to Shri Mihir Kanti Chakroborty, GM (Technical), TSECL, Tripura for his initiatives and valuable support provided to NERPC during the last one year (April06 to March07) of his tenure as Chairman, TCC. He further welcomed the new Chairman Shri Pulak Deb ji, Adviser Power, Govt. of Arunachal Pradesh and on behalf of NERPC, conveyed thanks for accepting the charge of Chairman, TCC. He also thanked all the participants for participating in the meeting.

He briefed the members regarding the salient points of the region. Thereafter he informed the members regarding the important issues pertaining to the region. Shri C.M. Bhogal, MS NERPC after his welcome address, requested Shri Pulak Deb, Advisor (Power), Arunachal Pradesh to Chair the meeting. The 3rd TCC meeting of NERPC was addressed by Chairman, TCC. He, on behalf of NERPC welcomes the delegates to the 3rd TCC meeting of NERPC. He expressed that its a great privilege in Chairing the session of TCC meeting. He assured all that the responsibility of Chairman, TCC given to him shall be well taken care of by him. He added that this Technical formation will remain the most appropriate forum to discuss and resolve the technical and commercial issues of the region. He strongly felt that the constructive deliberations and decisions will continue irrespective of any changes and scenarios and all will continue to resolve most of the issues through mutual discussion. He mentioned about the sincere efforts made by NERPC Secretariat in association with Department of Power, Arunachal Pradesh in coordinating and organizing the meeting. Also on behalf of the TCC members he placed on record sincere appreciation to Sh. C.M. Bhogal, Member Secretary, NERPC in resolving most of the issues of NER and dynamic & friendly approach in office matters and conveyed his sincere thanks and best wishes for his new assignment in CEA Headquarters on his transfer. He expressed his concern regarding a number of problems including frequent Grid Disturbances, High System losses due to transmission constraints faced by North Eastern Region. He observed that the missing links scheme to be commissioned by POWERGRID will bring stability and enhanced capacity in the NER Grid. He informed the members that the allocations from Subansiri (2000 MW) and Kameng ( 600 MW ) HEPs have been finalized after in principle agreement from the NER beneficiaries. He further added that this additional generation can not be consumed in our region and needs to be exported to other regions with shared benefits. He further asked for making sincere efforts in sharing the surplus power with the other states of the region and other regions as the region has got a better monsoon this year and hydro generation has reached to an enhanced limit. He conveyed thanks to NERPC secretariat and NERLDC in helping the constituents through their active participation and coordination. He felt that the region will continue to gain more and more with their support and expert advice. He then requested Member Secretary, NERPC to continue the meeting. After this Member Secretary took up the agenda items.

Proceedings of the 4th NER Power Committee meeting


The 4th NERPC meeting started with welcome address by Arunachal Pradesh and followed by lighting of lamp and presentation of flower bouquets to the Honble Power Ministers. Shri. T. Norbu, Secretary (Power), Govt. of Arunachal Pradesh welcomed the participants and conveyed sincere thanks for attending the meeting. He conveyed his serious concern over zero percentage of allocation to Arunachal Pradesh from the un-allocated quota of NER. He strongly recommended the need of review of allocation of power from the unallocated quota. He further added that the allocation of free power should not be considered as allocation to the state when a decision on firm allocation is taken as free power is a compensation given for the losses and problems the state and the people of the state have to bear due to commissioning of such projects. He then requested Member Secretary, NERPC to conduct the meeting. Member Secretary welcomed the participants and requested Honble Power Minister, Assam to address the delegates. Honble Power Minister, Assam, congratulated the State of Arunachal Pradesh and NERPC Secretariat for their concerted efforts towards the integrated functioning of the NER power system. He emphasized the need of continuation of Look East policy as adopted by the Central Government. Honble Minister expressed his willingness to share the power from Lower Subansiri and Kameng HEPs on 50:50 basis with other regions keeping into the interest of Nation even when State of Assam has already signed PPA/ MOU for 300 & 600 MW from Kameng and Subansiri HEPs respectively. However he further reiterated the need of building up of transmission corridor from the pooling station to other region at the cost 100% shared by the other regions only. He asked for finalization of allocation of power from the stations at the earliest. He expressed concern over the problems faced by the people of Assam as the State falls under the downstream of all these hydro projects including that of Bhutan. The people are badly affected of their livelihood, biodiversity including flush floods and displacement. He strongly recommended for allocation of atleast free power of 6% to the State of Assam. He also emphasized the need of allocating power to NER from the thermal generating stations of other regions in lieu to sharing of power of NER HEPs with other regions. He strongly voted in favour of allocation of power to NER from the Hydro Stations of Bhutan and Sikkim as State of Assam is not only facing the problems of being in the downstream of Bhutan HEPs but also that the DONER funds are provided to Sikkim making it an integral part of NER. Thereafter, Member Secretary requested Honble Power Minister, Manipur to address the August forum. Honble Power Minister, Manipur in his brief address expressed concern over billing mechanism where central sector allocations to a state include allocation from the ISGS of other regions. He further added that the present allocation from the ISGS in the region is not sufficient to meet the unrestricted demand of the North Eastern States. He emphasized the need of firm allocation to the state of Manipur from the Central Thermal Power of the other regions. Honble Minister asked for commissioning of 220KV sub-station in Imphal, the state capital so as to meet the growing power drawl demand of around 200 MW in next two years. He also suggested that all the state capitals of the region should be connected through 220KV network under Central funding. The address of Honble Power Minister, Manipur is placed at Exhibit-II. Member Secretary requested Honble Chief Minister, Govt. of Arunachal Pradesh and Chairman, NERPC to address the distinguished delegates. Chairman, NERPC welcomed the participants. He conveyed sincere thanks to Shri Manik Dey ji, Honble Power Minister, Tripura for his valuable contribution made for the NER Power Committee as Chairman of the NERPC. He also asked the members to learn more from him and requested Shri Manik Dey ji to continue advising and helping NERPC in tackling various issues and problems of the region. He also conveyed his gratitude to CEA, CERC, Ministry of Power in advising us on various technical matters and helping us in resolving many issues which could not have been solved without their help. He thanked the Department of Power, Arunachal Pradesh for working day and night in hosting and making this meeting as a success. He further conveyed special thanks to Shri Pulak Deb, Shri B.P. Singh, Shri Perme, Shri Bar Takum, Shri Tasso Hinda and Shri T. K. Tara. He emphasized that it is very important to tap the big potentials of the region especially the Hydro Electric potential and its utilization to its maximum Capacity. He appreciated that it is not only the generation of power in the region but its evacuation also needs to be explored so that during the surplus power season, power can be evacuated to other regions. He suggested that building the infrastructure for evacuating such a large power to other deficit regions requires very high cost and thus needs to be shared on National basis. He further appreciated the efforts made by CEA in finalising the allocation from Subasiri and Kameng HEPs and approval by Ministry of Power for allocating 50% of the total power to NE Region. He appreciated the efforts made by the State of Assam and NERPC secretariat resulting in firm power allocation made by Ministry of Power to NER from the ER region power stations. P - 4 / 59

He further asked the members to deliberate and take a consensus decision on the review of Allocation of power from un-allocated quota of the region and power allocation from other regions, honoring Bi-lateral trading contracts in case of low generation availability without affecting state's share and funding of schemes in totality by the DONER for technically cleared schemes by CEA. He expressed gratitude to NERPC Secretariat for their active role and participation. He also conveyed thanks to NERLDC for successful operation of the regional grid and helping the region in the most secured manner. He informed the members regarding the initiatives taken by the State of Arunachal Pradesh for the commissioning of Hydro Power Projects in the state in line with the Honble Prime Minister of India initiative of 50000MW hydro power potential. He informed that implementation of 10,230 MW through CPSUs and 9,482 MW through Private Power Developers is under process. He suggested that in parallel to this power generation initiative, POWERGRID should take up planning and development of Ultra High Capacity transmission line for evacuation of this power to other regions of the country. He also expressed the need of allocation of power from the Thermal ISGS of the other regions to meet the acute shortfall of power in the NER during low hydro season. He conveyed best wishes to Shri C.M. Bhogal, Member Secretary for his new assignment on his transfer to CEA Headquarters. He expressed that the region will be missing the services of a dynamic, dedicated and friendly officer. The address of Honble Chief Minister & Power Minister, Arunachal Pradesh is placed at Exhibit-III. The address of Shri Zoramthanga, Honble Chief Minister, Mizoram was taken as read. The address is placed at Exhibit-IV. After this, Chairman,NERPC asked Member Secretary, NERPC to conduct the meeting. Shri C.M. Bhogal, Member Secretary requested Shri Dorjee Khandu ji, Honble Chief Minister and Minister of Power, Arunachal Pradesh & Chairman, NERPC to Chair the session and to allow him to further continue with the proceedings. Member Secretary placed on record sincere thanks and appreciation to Govt. of Arunachal Pradesh and Department of Power, Arunachal Pradesh for the pains taken by them in hosting the meeting in Itanagar. He conveyed special thanks to Shri Pulak Deb, Shri B.P. Singh, Shri Anong Perme, Shri Bar Takum, Shri Tasso Hinda, Shri. T.K. Tara and other team members of Department of Power, Arunachal Pradesh. He also appreciated the efforts made by the officers of Department of Power, AP in making the meeting a success by sheer dedication and devotion to work. All members highly appreciated the thrilling performance of the people of Arunachal Pradesh family during the cultural evening program organized after the NER Power Committee meeting on 21st August, 2007 with special note of appreciation for the performers and artists. The thrilling performance by the artist(s) was appreciated by one and all. The
cultural evening after such hectic and brain storming sessions gave relaxing time

ITEM NO. 1 Confirmation of the minutes of the 2nd TCC meeting held on 12th September, 2006 Confirmation of the minutes of 3rd NER Power Committee meeting held on 13th September, 2006 Deliberation of TCC The minutes of the 2nd TCC meeting of NERPC and 3rd North Eastern Regional Power Committee (NERPC) meeting held on 12th September & 13th September, 2006 respectively at Secretariat Conference Hall of Tripura in Agartala were circulated vide letter no. 101/1/NERPC/ Committee/2006/2078-150 dated 5th October, 2006. As there were no observations from the constituent members, the minutes were taken as confirmed. Deliberation of the Committee The minutes of the 3rd NER Power Committee meeting was agreed by the Committee.

2.0 Follow up action


ITEM NO. 2 Follow up action on the discussions of the last Committee meeting.

Deliberation of TCC Member Secretary briefed the forum regarding the follow up action taken by NERPC Secretariat regarding the last meeting. The details are as follows: Item 2.1 (Sharing of revised UCPTT charges by the Constituents of NERPC as per CERC order dated 9th May, 2006 in petition No.3/2005) : As directed by CERC vide order dated 21st August 2006 on the hearing held on 10th August 2006 on the Commissions order dated 9.5.2006 on petition 3/2005, the NER Power Committee meeting was convened on 13th September 2006 preceded by a TCC meeting on 12th September 2006. The meeting was specifically called to discuss the issue of UCPTT in NER as directed by CERC. The Committee resolved unanimously and the resolution for kind consideration of Honble Commission was sent vide letter no. 110/1/NERPC/2006/2151-81 dated 5th October 2006, after the approval of Chairman NERPC.

Item 2.2 (Reimbursement of establishment expenditure of the NERPC Secretariat by the constituents) : Draft was prepared by the Secretariat considering the discussion of the Committee meeting and forwarded to the Office of Chairman NERPC for submission to the Honble Union Minister of Power i.e. .. It is to bring to your kind notice that the Honble Prime Minister of India assured the delegation of North East MPs Forum on 25th August 2006 for the continuation of uniform funding of all packages and schemes of NER with 90:10 (Grant:Loan) pattern and accordingly it was unanimously resolved in the NER Power Committee meeting that the NERPC Secretariat funding should be provided in the same pattern i.e. 90% grant by Govt. of India and 10% to be borne by the Constituents of NE Region. . Assam in the 3rd TCC meeting again reiterated that the ratio of 90:10 should be pursued with Govt. of India. Member Secretary NERPC informed that the ratio of funding was taken based on the logic of funding of other schemes in the NER. Item from the 2nd NERPC meeting: AGM, NERLDC informed that the Manager, SBI, Shillong has assured of taking the matter with the SBI headquarters for the waivel of various service charges for making payments through the bank and added that the details as may be conveyed by SBI shall be brought to the committee for deliberations. Assam asked for some alternative solution where zero service charges have to be paid for all such operations. AGM, NERLDC informed that in Southern Region the accounts are operated through ICICI banks and transfer of money amongst ICICI banks is totally free. Assam added that, as a first step, one account can be opened in such banks like UTI and after going through the performance, other accounts can also be maintained in the bank. AGM, NERLDC agreed with the suggestion of Assam, however, asked for 1 to 2 months time for SBI to respond. Shri A. Perme, C.E., AP asked whether the SBI bank is giving interest on the money deposited in the bank. AGM, NERLDC informed that the bank account is CURRENT A/C and no interest is given on such accounts. Chief Manager, NERLDC added that the option of Systematic Investment Plan (SIP) can be explored. He further informed that UTI bank has offered free service on all matters and the option of SIP will be available there. He also suggested that the suggestion of Assam for transferring the Reactive Energy Account, being a small amount, can be transferred in the first instance.

It was concluded that the decision of transferring of account can be taken up after confirming from SBI and the decision shall be taken in 1-2 months time as suggested by AGM, NERLDC.

Deliberation of the Committee Member secretary NERPC briefed the Committee about the TCC deliberation. All Committee members agreed.

3.0 Agenda Items from Nagaland ITEM NO. 3.1 Upgradation of SLDC, Dimapur, Nagaland

Deliberation of TCC MS briefed the members that the matter is regarding the upgradation of the SLDC systems by the respective constituent states so as to enable the States to perform Load Dispatch function with more efficiency in the benefit of the State. This was discussed in the last Commercial Committee meeting of NERPC and it was informed by NERLDC that the budgetary details and the technical specifications required by Nagaland have been given to the Power Department, Nagaland for taking financial decision and procurement. During the above meeting representative from Mizoram also requested for including their state in the upgradation of the SLDC system. Shri A. Perme informed that the SLDC system is the nervous system of Power Sector and the region is badly suffering due to State of Art SLDC systems not being available in the region. He further added that the region should have proper SLDCs and the DONER may be urged to fund the establishment of SLDCs under 90:10 (Grant: Loan) scheme. Shri A.K. Bora, Member(T), Assam asked for examining the existing SLDCs from expert bodies and their recommendations for upgradation / replacement of existing SLDCs. He also suggested for simulation systems to be available in the region for use by the constituents. Shri A.Perme also endorsed the views of Member(T), Assam for the provision of Simulator in the region. He asked for putting up the matter before the NER Power Committee. Shri A.K. Bora asked to go for system which can study the NER system simulated with ER system and suggested that all the states should send their engineers to POWERGRID for discussion.

Member Secretary NERPC suggested that the details for the upgradation of the SLDCs for all the NER States may be prepared by POWERGRID and composite proposal will be submitted to GOI for approval and funding. He further asked the member states to discuss with POWERGRID for the upgradation of the respective SLDCs and formulate a composite proposal to be sent to GOI. Deliberation of the Committee Member Secretary NERPC briefed the forum regarding the deliberations and decision taken by the TCC. ED, POWERGRID asked for slight modifications in the minutes of the TCC. He requested that the decision of TCC may be read as : Member Secretary NERPC suggested that the details may be prepared by the respective states in consultation with POWERGRID for the upgradation of the respective SLDCs and then a composite proposal can be sent to GOI for approval and funding. Members agreed to the decision of TCC with slight modification. ITEM NO. 3.2 Commercial billing of 66 KV Bokajan Line

Deliberation of TCC The item could not be deliberated upon due to non-representation from Nagaland and nonavailability of the details regarding the agenda. Deliberation of the Committee Member Secretary NERPC informed that it was for information only. 4.0 Agenda Items from Manipur: ITEM NO. 4.1 Agreement for National Load Dispatch Centre (NLDC) Scheme

Deliberation of TCC PGCIL informed that the NLDC Scheme agreement with Manipur has been signed. Deliberation of the Committee Member Secretary NERPC informed that it was for information only.

ITEM NO. 4.2

Discontinuation of UCPTT

Deliberation of TCC MS briefed that w.e.f. 1st April 2007, as per CERC order, UCPTT is discontinued and CERC has fixed provisionally the Annual Fixed charges (AFC) to be paid to the CTU i.e. PGCIL. The states lines which were included in the UCPTT are now to be dealt differently as per CERC guidelines. MS added that in the Northern Region the states lines which are used for evacuation of the Central Sector power for majority of the states, the annual fixed charges of these states lines is additionally added in the AFC of CTU and the total AFC is borne by the constituents in the ratio of total weighted average of allocations. Additionally, if any other state line is used by the other state, then wheeling charges are paid for by the other state. MS added that similar philosophy could be decided by NER constituents. Manipur raised the issue of deducting the energy being transmitted through States own line (132 KV Loktak-Imphal) which was given concession in the earlier transmission tariff based on UCPTT. Manipur impressed upon the calculation/ billing on weighted average entitlement of the constituents for the purpose of distribution of transmission charges. Further added that the energy transmitted through States own line i.e., evacuation from the Bus Bar of NHPCs Loktak HEP and delivered to the State point directly should be deducted by adding a column in the REA. This will increase the weighted average entitlement of the other constituents as these states are using additional capacity of NER transmission system. Manipur further informed that all the constituents have to pay transmission charges calculated as per the total weighted average entitlement i.e. the total weighted average entitlement of ISGS of NER plus ISGS outside NER. In case of Manipur, the energy transmitted through the State owned line i.e. Loktak-Imphal line should be deducted while calculating the total weighted average entitlement by adding appropriate column in the REA. Member Secretary informed that the billing shall be made on total weighted average considering the allocations from ISGS in NER and the NER allocation from outside the region. However, utilization of States owned lines shall be discussed as part of agenda item no. 6.2 Deliberation of the Committee Member Secretary briefed the members about the UCPTT concept and the revised transmission tariff abolishing UCPTT. Shri V.Ramakrishna, Member (PS), CEA advised the committee to resolve on the lines on which other regions have also taken consensus decision. He informed the members regarding the methodology adopted by SR and WR regions where State as well as POWERGRID lines are used for evacuation of Central Sector Power. He also briefed the members regarding the tariff calculations for Goa, Dadra & Nagar Haveli for which transmission lines of the State of Gujarat and Maharashtra are also used. He suggested that the transmission lines under the state sector can be pooled for calculating the wheeling charges. Member Secretary informed the forum that the methodology adopted and in practice for the calculation of REA is based on the NET WEIGHTED AVERAGE only.

Assam informed that CERC regulations issued in June06 regarding calculation of REA clarifies the methodology to be adopted. Any change in this regard will contradict the guidelines. Assam again reiterated that this may not be in line with CERC regulations. Assam further added that the energy exported/ imported on long term basis only has to be adjusted for the calculation of REA. Shri V. Ramakrishna suggested that the practice adopted by other regions should be adopted and will be in line with the CERC regulations. Assam stated that the practice adopted in the other regions is agreeable to them. Mizoram, NERLDC and POWERGRID also endorsed the views of Manipur in this regard and added that the extra power drawn by the other states have to be taken into consideration. Shri D. Ganguly, CMD, TSECL suggested that the matter needs to be discussed first in the TCC meeting in detail and then the outcome should be brought to the notice of the committee for deliberation and approval. He suggested that a Special TCC meeting be called and the matter be discussed in detail. The outcome of the meeting then be submitted to the NER Power Committee. Members agreed and asked Member Secretary NERPC to call a special TCC meeting at the earliest to resolve the matter.

5.0 Agenda Items from Mizoram: ITEM NO. 5.1 Missing link Scheme by PGCIL in NER

Deliberation of TCC POWERGRID informed that post tender negotiation is under process and the scheme shall be commissioned in 18 months time from clear placement of order. The scheme is expected to be completed by 2009. Deliberation of the Committee Member Secretary NERPC informed that it was for information only.

6.0 Agenda Items from Assam ITEM NO. 6.1 Recommendation of CEA on power allocation from Subansiri HEP (2000MW) and Kameng HEP (600MW)

Deliberation of TCC Member Secretary informed the committee that during the meeting taken by the Ministry of Power, Govt. of India after deliberations agreed to allocate 50% power to NE States including 15% unallocated share exclusively for NER States. Shri A. Perme asked whether NERPC has agreed for 50:50 sharing of Subansiri and Kameng HEPs generation. NERPC Secretariat read out the decision of NERPC taken during the 2nd NER Power Committee meeting held on 29th July, 2007 at Aizawl where the Committee agreed for 50:50 sharing of power and also bearing the cost of transmission system as per CERC guidelines. Shri A. Perme suggested that the matter has the approval of the NER Power Committee and TCC should not deliberate on the issue. However, he reiterated for the implementation of Single National Transmission Tariff across the country. Mizoram submitted that some projects are being taken up under Central Sector like Subansiri HEP (2000MW) and Kameng HEP(600MW). While setting up Central Sector generating stations in the NER, the requisition from the constituent states should be first considered instead of proposing to export all the power to outside the region. However as per the proposed allocation from the hydel projects, firm allocation for Mizoram is only 1.49% each from Kameng and Subansiri lower HEPs totaling 38.7 MW and the total firm allocation for NE Region is 50% each, including 12 % free share. When large and cheaper hydel project are coming up in the region, it is duly reasonable to give more power from these projects to the states within the region on priority. This is required not only for meeting the peak power demand within the region but also for the economic upliftment of the states. Higher firm allocation from these two projects may be favourably considered for Mizoram. In case of Mizoram and may be other States also we have had no choice but to absorb whatever is allocated from the existing central sector generation, irrespective of the cost. Also while considering the existing thermal power capacity available 22.92 MW HFO plant is included which is mostly run in stand by mode whenever there is shortfall in power. Instead of giving more power to us from the costlier Thermal projects like Bongaigoan TPS etc. (6 %) we should get more allocation from ultra thermal and super thermal projects whose tariffs are less costlier. Shri A.K. Bora asked whether the revised allocations agreed by GOI include cost sharing on transmission system as the minutes are silent in the subject.

Member Secretary briefed that transmission system from these HEPs to Pooling Station shall be borne in the 50:50 ratio and from Pooling Station to other regions shall be borne by other region in total as per the earlier decision and recommendation of CEA. Assam asked for share of power on time frame basis for 5/ 10 years and thereafter review by the NERPC after completion of time frame. Members did not agree to the suggestion. Member Secretary suggested that the sharing of power and the decision taken earlier should not have any tags now. Meghalaya asked for finalization of allocations under revised decision at the earliest. Meghalaya also asked for higher allocation from Palatana Project as the transmission corridor is given space from the State of Meghalaya. Member Secretary asked Meghalaya to furnish a request in the matter so that the same can be taken up with CEA/ Ministry of Power. Manipur asked for thermal power from other regions in lieu of hydro power from the Subansiri & Kameng HEP allocated to other regions. The Committee concluded that the region should be given: i. Thermal Power allocation from the Power Stations of other regions to compensate power shortages during Low Hydro Season. ii. Allocation of at least 50 % from the Subansiri & Kameng HEPs

Deliberation of the Committee Member Secretary informed the forum regarding the decision of TCC. Shri T. Norbu, Secretary(Power), Arunachal Pradesh informed that during the meeting he had with Union Secretary(Power), Govt. of India in the month of May07, the issue of allocation of only 0.49% of power allocated to Arunachal Pradesh was discussed and assurance was given that the matter will be considered favourably. He informed that from RHEP only around 6% of share has been given to Arunachal Pradesh where as the project has been commissioned in Arunachal Pradesh. He reiterated that there is no justification of adjusting free power given to a state against its firm power entitlements. He also informed that Arunachal Pradesh has not been given any allocation from Un-allocated share of NER. He asked for proper justification to be done to Arunachal Pradesh and asked for the review of allocations from Firm Power of the region and especially from the Un-allocated Power of NER.

Shri Ramakrishna, Member (PS), CEA explained to the member the method adopted in finalizing the allocations from Subansiri and Kameng HEPs keeping the interest of NER to the maximum. He informed that six conditions have been considered i.e. Peak and Off-peak conditions during Monsoon, Winter & Summer periods in addition to the growth pattern in Demand and Energy generated. The Firm Allocation was based on the Gadgil formula as agreed by Planning Commission and shortfall conditions to be met from Firm Power allocations from the Thermal Power Stations of other regions. He asked NER States to precisely swap surplus hydro power of NER with thermal power of other region(s) to meet the shortfall conditions and accrue commercial benefits. Shri T. Norbu submitted that Arunachal Pradesh has appreciated the efforts made by CEA, however, the state is under serious stress as is not able to supply power to the industries already commissioned in the state. He also requested that the Central agencies should appreciate this fact and provide relief to the state. He again requested for the review of allocations. Shri Ramakrishna further suggested that the NER States should tie up at the earliest for long term power agreements from outside the regions including agencies like DVC etc. for cheap power. Shri Anong Perme also asked for the review of the allocations as the Demand Growth (touching to 100 MW) of Arunachal Pradesh is almost three times compared to previous three years. He also voted for National Transmission Tariff Policy. Shri Ramakrishna further informed the members that the National Transmission Tariff Policy has been finalized and CERC has been asked to implement the policy. CEA has made some suggestions as part of the Policy based on distance & directional flow of power and sharing of losses. However, as we know CERC only has to implement the National Transmission Tariff Policy. He further observed with surprise that NER States are not attending important CERC hearings where they can easily submit their view points for favourable decisions. Assam insisted on not going ahead with Single National Transmission Tariff as it may be against the interest of NER. Shri D. Ganguli asked the forum that the matter has been discussed many a times and every time the forum decided in favour of Single National Transmission Tariff. It is not clear how the issue is opened again. Honble Power Minister, Assam asked for preparation of detailed note from the Assam representative and to be discussed by TCC before submitting to the NERP Committee. Members accepted the decision of Honble Power Minister, Assam and decided to form a committee to resolve the issue and firming up recommendations for NERPC. Honble Power Minister, Assam suggested that the Gadgil formula was applied where disputes are there and should not be considered for NER. He asked for compensation of 50% of Subansiri & Kameng HEP Power with thermal power from outside the region. P - 15 / 59

Shri Ramakrishna informed that 50% of Power has been given to NER from the two HEPs and equivalent power has also been given from the thermal stations outside the region. He added that the power of the region has to travel a distance of more that 2000 kms. and can only be managed by high transmission corridors to be build at a cost of around Rs. 10,000/crores. CEA has formulated the sharing scheme considering all these aspects and have kept in mind that the generation does not get stranded in NER. Shri D. Ganguly expressed concern about the 15% Un-allocated share as its allocation is always dicey and creates disputes amongst the beneficiaries. He asked for the Firm Allocation of the total 50% power from the Subansiri and Kameng HEP and keeping NIL under un-allocated quota. Shri T. Norbu, Secretary(Power), Arunachal Pradesh strongly asked for some share in the Un-allocated power as the State has been deprived of any share from the projects in NER. The Committee resolved that : i. Thermal Power allocation from the Thermal Power Stations of other regions to compensate power shortages during Low Hydro Season ii. iii. iv. Allocation of atleast 50 % from the Subansiri & Kameng HEPs Allocation of Total Power of Subansiri & Kameng HEPs on Firm Allocation basis keeping the un-allocated share as NIL. Formation of a Committee to look into the implementation of Single Uniform National Transmission Tariff in NER. Shri Ramakrishna submitted that CEA can make a presentation on National Transmission Tariff Policy and the pros & cons of the policy shall be clarified in the presentation. He also informed that CEA will prepare a base paper for the knowledge of NER members and will send to all constituents well before the presentation. ITEM NO. 6.2 Discontinuation of UCPTT

Deliberation of TCC Member Secretary informed the members that CERC has provisionally announced the transmission tariff for the NER asset of Power Grid w.e.f. 1st April 2007. As a result the earlier UCPTT, covering Power Grid and State Utilities transmission network is now defunct. Therefore, when any state uses network of other NER State over and above Power Grid network in wheeling Central Sector energy, the former State requires to pay transmission charges and transmission losses to the other State whose State network are used.

He briefed the members regarding transmission tariff methodology of Northern Region for sharing of State owned transmission system utilized for evacuation of Central Sector power to other States and transfer of power from one state to other state. Manipur insisted on compensation for drawl of Central Sector Power by State owned line i.e Loktak-Imphal line directly from the Loktak HEP in line with the concession given under UCPTT. NERPC Secretariat brought to the notice of members that under such condition many State owned line utilized by the concerned state for drawal of power directly from the Generating station and utilized only for state may have to be included like Assams KathalguriTinsukhia, APs Kathalguri-Deomali and Tripuras RC Nagar-Agartala lines. The Base paper prepared by Assam for sharing of their States owned lines used for inter state transfer of power could not be deliberated upon as it was circulated during the meeting. Member Secretary asked Assam whether the decision of AERC in the matter was taken during the presence of other constituent states as it has direct financial implication for the other states. Assam informed that the other states were not called during the hearing. Shri A Perme informed that when UCPTT was implemented in the region, the constituent members suggested for the exclusion of 11/33 KV lines used for transfer of power from one state to the other and was agreed by NERE Board. He further added that net flow of power between AP and Assam through 11/33 KV line is very small and should be ignored. However, if Assam wants, the matter can be resolved mutually and need not be discussed in the forum, and in case of dispute, CERC can be approached by the affected state. MS, NERPC informed that CERC during telephonic discussion has asked for resolving such matters in the NERPC forum. The matter was pertaining to States of Meghalaya and Assam. Also CERC is finalizing guidelines for sharing of transmission system and losses. Assam submitted that the matter is of commercial importance and 11Kv/33Kv lines which were not included under UCPTT have now to be considered. Shri A Perme informed that AP agrees for making such payments and the issue shall be resolved by discussion between the concerned states. Mizoram asked for relief package from GOI for compensating the revised Transmission charges of CTU to be paid by the states. Shri A.K. Bora reiterated for earlier decision in the matter of bilateral 90:10 (Grants:Loan) payment of transmission charges by the states, is pending since long time. MS said that the request in this regard can be submitted for consideration to Ministry of Power.

Deliberation of the Committee Member Secretary informed the forum regarding the decision of TCC. Shri Ramakrishna, Member(PS) informed the forum that the schemes in NER are funded under 90:10 (Grant:Loan) pattern and CEA is preparing a long term plan for NER to be implemented under the same pattern of 90:10 (Grant:Loan). Any investment shall be made under 90:10 (Grant:Loan). The Committee members strongly supported the views of Member (PS) and resolved to recommend the decision to Honble Union Power Minister. Manipur and Assam wanted an early decision. Assam further added that any decision should be made in the NERPC forum only and asked for its implementation from 1.4.2007. Committee asked for the formation of a sub-committee and early calling of a meeting to resolve the issue.

ITEM NO. 6.3

Outstanding receivable by ASEB

Deliberation of TCC Manipur submitted that the surcharge payments should not be made within the region. Assam reiterated that the states should first make the principal amount and the matter can be put up to senior authorities for the waiver of surcharge. Shri A. Perme informed that AP is exporting power to Assam in the month of July, 2007 and thus the payments within the region should not be linked with surcharge payment under mutual trading. He further added that the principal amount will be paid by AP after finalizing the transmission tariff proposed under item 6.2 above. Shri B.P. Singh asked Assam to provide complete commercial data in this regard. It was concluded that the matter will be resolved mutually by the concerned states only. Deliberation of the Committee Member Secretary briefed the committee members regarding the deliberation of the TCC. Members agreed to the decision of TCC.

Wheeling of Kurichhu Power through Assam

Deliberation of TCC Assam briefed the members regarding the transmission system utilized for evacuation of Bhutans power to ER through Assam network and submitted that the State is entitled for wheeling charges. MS, NERPC asked Assam to furnish the complete data so that the matter can be taken up with ER. Deliberation of the Committee Shri Ramakrishna informed the Committee that CEA has already asked the Project Authorities, Govt. of Bhutan to pay the wheeling charges to Assam and the matter is required to be resolved with Bhutan through Ministry of Economic & Foreign Affairs. As per CEA recommendations Power is required to flow through the Assam network only after the signing of MOU. Members agreed to the proposal of Shri V. Ramakrishna, Member(PS)

Share from Kurichu HEP and Tala HEP

Deliberation of TCC Assam informed that the physical area of Assam falls under the downstreams of the HEPs and the transmission system is commissioned through the state of Assam. Further submitted that the Committee should resolve for allocation of power from the HEPs to Assam. Deliberation of the Committee Members recommended for inclusion of the submission of Assam in the resolution to be adopted by NERPC. ITEM NO. 6.6 Share of Allocation of power from Projects of Sikkim

Deliberation of TCC The matter was deliberated upon and members opined that the matter be recommended for the consideration of NERPC for inclusion in the final resolution to be taken on 21st August by the Committee. Members also opined that the allocations from the new Projects should only be considered.

UI Payment

Deliberation of TCC Member Secretary informed the members that large amount of UI payments is pending for settlement due to non-payment by some States, mainly, State of Meghalaya. He further added that CERC in the past has imposed heavy penalties for the defaulting states in the other region and therefore UI payments should not be delayed. Meghalaya has defaulted even after ASEB has released the payment as agreed in the last Commercial Committee meeting that Meghalaya will release the payments as soon as getting outstanding payment of around Rs. 24 crores from ASEB. Assam therefore insisted on taking up the matter with CERC. AGM, NERLDC informed that they have already written to CERC for advising in the matter.

Deliberation of TCC POWERGRID informed that generators will not be required to open the LC. However insisted that Meghalaya should be impressed upon to enhance the LC. Meghalaya informed that they have enhanced the LC to Rs. 0.80 crores and further enhancement will be done after getting approval from the higher authorities. MS requested Meghalaya to take immediate corrective measures. Deliberation of the Committee Member Secretary NERPC informed that it was for information only. ITEM NO. 8.3 Re-imbursement of Income Tax

Deliberation of TCC Manipur submitted that in case surcharge is to be paid by the States then the states should also get the incentive for timely payments on Income Tax. POWERGRID informed that incentive cannot be given on IT payments as it is reimbursement only. Manipur reiterated that when POWERGRID is not paying surcharge on IT then they should not ask for surcharge payments under billing to states. Shri A. Perme also endorsed the views of Manipur that surcharge should not be asked due to delay on various issues whether due to decisions pending in the NERPC. MS, NERPC asked POWERGRID to take up the matter with their corporate office. Shri A. Perme submitted that forum is supporting the views of Manipur on the condition that the principal amount shall be paid in time. ITEM NO. 8.4

Import of power by overdrawing states through STOA

Deliberation of TCC AGM, NERLDC suggested that UI drawls by the states during lean hydro period (i.e. from October to April) need to be compensated by entering into bilateral agreement on priority for purchase of power through STOA to mitigate their imposed demand and avert any over drawal under UI mechanism from the grid. Timely action in the matter would be appreciated in the overall interest of Grid Security. MS, NERPC requested all States to adhere to the schedules and have proper bilateral agreements in place to avoid UI flows. GM, Assam and Meghalaya asked for tentative generation data for the ISGS of the region for the month of Oct2007 - March2008. NEEPCO and NHPC were requested to furnish the data. Deliberation of the Committee Member Secretary NERPC informed that it was for information only.

ITEM NO. 8.5

Low Generation availability of AGBPP

Deliberation of TCC Member Secretary briefed that agenda is on the low generation of around 200 MW only whereas the installed capacity of AGBPP station of NEEPCO is 291 MW. Earlier the station had been generating around 270 MW on regular basis. However, due to reported gas shortage/ its low calorific value, the availability from the station has come down. He further briefed regarding follow up action(s) taken in the past as matter had come up many a times in the previous meetings. MS stated that as per the latest correspondence with M/s OIL, they have informed that exploration in NER for Gas are under way and they would be in a position to supply more gas later on. However, with the present oil fields they can not supply more gas for power generation. Copy of letter from M/s Oil India Ltd. is enclosed at Annexure-III. NEEPCO informed that they are also pursuing the matter and requested the forum to take up with GOI. MS, NERPC suggested for inclusion of the item in the resolution to be adopted by NERPC. Deliberation of the Committee Member Secretary briefed the members regarding the issue.

Shri D. Ganguli expressed that the matter is of grave concern as the region has abundant gas and still not getting it. Also the cost of supplied gas, in addition to its availability, needs to be looked into seriously and he opined that gas should be supplied at APM prices (concessional rate) for NE Region. He added that it has come to the notice that ONGC is hiking the prices which will go against the NE States. The committee should resolve against it. Member Secretary asked the members, if agreed, to pass a resolution. NEEPCO requested Honble Power Minister Assam to impress upon Ministry of Petroleum & Natural Gas to provide the required quantum of Gas to Power Projects in the region. Honble Power Minister, Assam informed that Govt. of Assam has already taken up the matter with Union Govt. He also endorsed the view point of Tripura regarding Cost and quantity of gas supplied to power projects. He also asked that the supply of gas to different organizations should be treated at par and with appropriate quantity. Members agreed to pass the resolution as follows:

To approach Ministry of Petroleum & Gas, Govt. of India for supplying gas to Gas Based Generating Stations in NER at APM (concessional) price as applicable to NE States. And availability of gas as per sanctioned quantum.

ITEM NO. 8.6

Early completion of the work of 132 KV Sarusajai (ASEB) StageIV (MeSEB) line

Deliberation of TCC Assam informed that the transmission line is ready and Meghalaya has to sign the agreement. Meghalaya informed that the agreement shall be signed shortly for the operation of the line. Deliberation of the Committee Member Secretary NERPC informed that it was for information only. ITEM NO. 8.7 Requirement of SEM/ DCD up to 2008

Deliberation of TCC MS briefed that PGCIL has proposed to procure 45 nos. of SEMs from M/s L&T. The estimated financial involvement for the procurement & installation of 45 meters is Rs. 13.5 lakhs excluding taxes & duties. The 5th Commercial Committee meeting held on 9th April 2007 approved the above proposal.

Deliberation of TCC MS briefed that this is to fulfill the CERC requirement and the 4th & 5th Commercial Committee meeting (CCM) held on 9th January 2007 and 9th April 2007 at Shillong agreed to the proposal of PGCIL. PGCIL informed that the meters are proposed to be tested at ETDC, Guwahati (a Govt. of India organization) for which the estimated financial involvement shall be 1.2 lakhs @ Rs. 1600/- per meter (excluding service tax) for 75 nos. meters which are at present due for testing. In addition, some cost shall be incurred for dismantling/ installation & transportation of meters to & from ETDC Lab at Guwahati. The cost shall be shared by states in proportion to the allocation of Central Sector Power in the NE Region. The proposal of PGCIL was agreed by the members in the last Commercial Committee Meeting. The issue was deliberated upon and members recommended for the approval of NERPC. Deliberation of the Committee Member Secretary informed the members regarding the decision of TCC. Committee also approved the proposal. ITEM NO. 8.9 Renewal of AMC of Secure Meters make

Deliberation of TCC MS briefed that the AMC of meters of Secure Meters make has expired in December 2006. The matter was discussed in the 5th CCM held on 9th April 2007 and agreed to renew the AMC for 25 nos. Premier brand meters. PGCIL has indicated the financial involvement for the AMC as per offer of M/s Secure Meters is Rs. 1,01,250 for one year @ Rs. 4050/- per meter per year excluding service tax. As per the constituents request in the 5th CCM Secure Meters was requested to quote for the period of 5 years but M/s Secure Meters have confirmed that the rate per year shall remain unchanged. It is therefore, proposed to take AMC for 25 meters for 5 years at Rs. 5, 06,250/-. The annual AMC charges shall be payable

each year. The cost of AMC shall be shared in proportion to the allocation of Central Sector Power in the NE Region. The issue was deliberated upon and members recommended for the approval of NERPC. Outstanding UI Payments

Deliberation of TCC The issue was deliberated upon and members recommended for early payments by the constituent members for keeping the system healthy. Deliberation of the Committee Member Secretary NERPC informed that it was for information only. ITEM NO. 8.12 Combined Comprehensive Annual Maintenance Contract (AMC) of EMS/SCADA package installed in NER

Deliberation of TCC PGCIL submitted as follows: The EMS/SCADA package installed under the NEULDC scheme has been working without any major problems since its commissioning in May-03. The system was maintained through the original system integrator, namely M/s AREVA (earlier M/s Alstom) through provisions provided in the supply and erection contracts. The period of maintenance through M/s AREVA as per the original contracts has expired on 3103-07. It was decided in the 2nd and 3rd Coordination Committee meeting of NEULDC O&M held at SLDC, Kahilipara on 31-01-07 and at MeSEB, Shillong on 10-07-07 to go for a Combined Comprehensive AMC for EMS/SCADA under NEULDC from M/s AREVA the original supplier in view of the obvious advantages and to put up the matter in the forthcoming NER Power Committee meeting for in principal approval. In line with the above decisions, NERLDC has requested M/s AREVA, the original supplier of the EMS/SCADA packages for budgetary offer which is expected shortly. The actual financial implication will however be known only after the price is finally negotiated and frozen. Shri A. Perme raised certain query regarding negotiation with only one vendor, nonavailability of budgetary details, ratio of proprietary items under the contract etc. He insisted that the matter needs to be considered strictly under the corporate policy and no different action to be taken based on approval from the committee. He added that the contract should be placed after inviting letter of interest from various vendors and then negotiating in the benefit of NER. Members in general agreed for a comprehensive package.

The committee after detailed deliberation suggested that the contract should be awarded only under the conditions at par with other regions in commercial and technical terms. ADDITIONAL ITEM Revision of Allocation from ISGS in NER

Deliberation of TCC Shri A. Perme, Aunachal Pradesh asked for the review of firm allocation from ISGS in NER including unallocated share for the state as the demand growth of the State has increased by 3 folds in the last four years. He asked NERPC Secretariat/ NERLDC to examine and prepare a proposal for the consideration of CEA/ Ministry of Power. He further reiterated that Arunachal Pradesh has not been given any allocation from the Unallocated quota and the forum should recommend and pursue with CEA/ Ministry of Power for share allocation for Arunachal Pradesh from the Un-allocated quota. Deliberation of the Committee Member Secretary informed the members regarding the decision of TCC. Members decided in making the decision of TCC as the resolution of the meeting and asked Member Secretary, NERPC to take up the matter with CEA/ MOP for allocation of power to Arunachal Pradesh from the Un-allocated Power of NER.

RESOLUTION of NERPC for forwarding to GOI

Deliberation of the Committee The Committee hereby unanimously resolved as follows:

That this Committee strongly urges upon Ministries of Government of India concerned for the following:
1. To approach Govt. of India for allocation of power from Kurichu and

Tala HEP to Assam on long term basis as Assam being located at the down stream of Bhutan, faces all the burden of flood on sudden flush of water, deleterious effect of biodiversity, lost of livelihood of people displaced due to commissioning of such Hydro stations. Moreover for evacuation of above power, Assam is arranging special bays and Right of Way for above transmission network of Kurichu HEP. Also Assam should be given atleast 6% of free power from these Hydro Electric Projects in Bhutan.
2. To approach Ministry of Power, Govt. of India for allocation of share

from Power Projects of Sikkim to NE States in general and Assam in particular because Sikkim is a constituent state of NEC and all the development fund allocated to NEC is being shared by Sikkim also with all other NE States. Resource of Sikkim now becomes part of NER Resource.
3. To approach Ministry of Power, Govt. of India for enhancement of firm

allocation (at least 60%) to Assam from Generating Power of upcoming 750 MW Bongaigaon TPS and 700 MW Palatana Tripura Gas Based Project as Assam is providing free land and infrastructure to NTPC for Bongaigaon TPS.
4. To approach Govt. of India for treating transmission network (existing

and upcoming) of 400 kV and above for NER as National Asset.


5. To approach Ministry of Power, Govt. of India for Firm Power Allocation

from Thermal Power Stations of other regions in lieu of Hydro Power Allocated to other regions from NER Power Projects.
6. To approach Min. of Power, Govt. of India for Firm Allocation of at least

500 MW from upcoming Ultra Mega Power Projects.

7. To approach Ministry of Power, Govt. of India to allocate power on Firm

Allocation basis from total (i.e. 50%) Allocation reserved exclusively for NER from Subansiri & Kameng HEPs.
8. To approach Govt. of India for providing 90:10 (Grant:Loan) for the

Transmission Charges paid by the North Eastern States to CTU.


9. To approach Ministry of Petroleum & Gas, Govt. of India for supplying

gas to Gas Based Generating Stations in NER at APM (concessional) price as applicable to NE States and availability of gas as per sanctioned quantum. This committee further resolves that this resolution may also be sent to the Honble Prime Minister seeking his kind intervention for an early and favourable decision on the above issues.

RESOLUTION Member Secretary, NERPC informed that as per the decision of 1st NERP Committee meeting held on 4th March 2006 for the finalisation of NERPC members (list of members to NERP Committee forwarded to Min. of Power, Govt. of India vide letter no. No. 121/2/NERPC/2006/ dated 16th March 2006) Honble Minister of Power of seven states of North Eastern Region shall be the Chairman of NERPC for a period of one year each by rotation in alphabetical order. Honble Power Minister of Tripura was holding the charge of Chairman, NERPC and completed his term on 31.03.2007. The post is now taken over by the Honble Chief Minister Arunachal Pradesh. Member Secretary, NERPC on behalf of NERP Committee members propose to thank the outgoing Chairman, Shri Manik Dey, the Honble Power Minister of Tripura for his valuable contribution, full support, active participation and guidance. His contribution in taking up the NER Resolution in regard to (i) high transmission cost, (ii) funding of NER with 90% grant from GOI and (iii) taking up of Dimapur Thermal, Monarchak & Baramura gas based projects with Honble Prime Minister and Honble Union Minister of Power is appreciated by all. This forum hopes that he will continue advising and helping NERP Committee in tackling various issues and problems of the region.
