BOND ORDINANCE AMENDING SECTION 3 OF BOND ORDINANCE NO.

1245 ADOPTED SEPTEMBER 15, 2008 AS AMENDED BY BOND ORDINANCE NO. 1246 ADOPTED JULY 20, 2009 TO AMEND THE PROJECT DESCRIPTION FOR SAID PURPOSE TO BE UNDERTAKEN IN AND BY THE CITY OF PLAINFIELD, IN THE COUNTY OF UNION, STATE OF NEW JERSEY. B.O. 1254 BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF PLAINFIELD, IN THE COUNTY OF UNION, NEW JERSEY (not less than twothirds of all the members thereof affirmatively concurring), AS FOLLOWS: SECTION 1. Section 3 of Bond Ordinance No. 1245 Adopted September 15, 2008 as amended and supplemented by Bond Ordinance No. 1246, adopted July 20, 2009 be and is hereby amended in its entirety to read as follows: Section 3. The improvement hereby authorized and the purpose for the financing of which said obligations is to be issued is as follows:
Down Payment (Capital Improvement Fund) $315,000 Estimated Maximum Amount of Bonds & Notes $5,985,000

Estimated Cost $6,300,000

Period of Usefulness (years) 10

2008 Road Program to include, but not limited to the milling, resurfacing, reconstruction and improvement of the following streets: Woodbine Ave., from Kensington Ave to Stilford Ave., Somert Street from City Limit to W. Front St., Geraud Ave. From Bridge to W. Front St., Whittingham Terrace from Salem Rd. to Cul-De-Sac, Brookside Place from Dead End to Geraud Ave., Remingotn Ave. From Kenyon Ave. to Lakeview Terr., Florence Ave from Moffett Ave. to S. End Pkwy, Moffett Ave from Park Ave. to Florence Ave., Oak Lane from Watchung Ave. to Sleepy Hollow Ln., Cedar Brook Rod. From Watchung Ave. to Prospect Ave., Thornton Ave. From Park Ave. to Hillside Ave., Compton Ave-Sect. 1 from Myrtle Ave to W. Front St., Central St. From S. Ave. to Woodland Ave., Carnegie Ave. From Watchung Ave. to Prospect Ave., Highland Ave. From Hillside Ave. to Woodland Ave., Myrtle Ave. From Rock Ave. to Albert St., Faragaut Rd. From City Line to E. Front Street, Richmond Street from E. Front St to Watchung Ave., Richmond Street from E. Front St to Watchung Ave., South Avenue, Hartridge Place from Stillman Avenue to Plainfield Avenue, Birch Avenue from the Watchung border to East Front Street, Farragut Road from North Plainfield border to East Front Street, Fredrick Street from Columbia Avenue to North Avenue, Beechwood Court from Randolph Road to cul de sac, Belleview Court from Belleview Avenue to cul de sac, Atlantic Street from South Avenue to Pacific Street and Pacific Street from dead en to dead end, to include all equipment, fixtures, furniture, costs, improvements and appurtenances necessary therefore or related thereto.

SECTION 2. To the extent that any previous Bond Ordinance or resolution is inconsistent with or contradictory hereto, said Bond Ordinance or resolution is hereby repealed or amended to the extent necessary to make it consistent herewith. SECTION 3. The provisions of this Bond Ordinance are severable. To the extent any clause, phrase, sentence, paragraph or provision of this Ordinance shall be declared invalid, illegal, or unconstitutional, the remaining provisions shall continue in full force and effect. SECTION 4. This Bond Ordinance shall take effect twenty (20) days after the first publication thereof after final adoption, as provided by said Local Bond Law.

I HEREBY CERTIFY that this is a true copy of Ordinance captioned: BOND ORDINANCE CANCELING APPROPRIATIONS IN THE AMOUNT OF $2,674,182.70 FROM PREVIOUSLY ADOPTED BOND ORDINANCES AND DETERMINING THAT SAID APPROPRIATIONS, INCLUDING BOND PROCEEDS, ARE NO LONGER NEEDED FOR THE PURPOSES SET FORTH IN SAID ORDINANCE AND TRANSFERRING SAID AMOUNT TO THE CAPITAL SURPLUS FUND AND APPROPRIATING THE SUM OF $2,674,182.70 TO FUND THE COST OF CERTAIN ROAD IMPROVEMENTS TO BE UNDERTAKEN IN AND BY THE CITY OF PLAINFIELD, IN THE COUNTY OF UNION, NEW JERSEY which was introduced at a duly convened meeting of the City Council on April 9, 2012, and finally adopted at a duly convened meeting on September 10, 2012 IN WITNESS WHEREOF, I hereby set my hand and the seal of the City this 11th day of September, 2012. ______________________________________ ABUBAKAR JALLOH, R.M.C., City Clerk (SEAL)
