This Act may be cited as the ‘‘Oversight of Sensitive

SEC. 2. CONGRESSIONAL NOTIFICATION OF SENSITIVE MILITARY OPERATIONS.

(a) NOTIFICATION REQUIRED.— (1) IN
GENERAL.—Chapter

3 of title 10, United

States Code, is amended by adding at the end the following new section:

7 ‘‘§ 130f. Congressional notification of sensitive mili8 9
tary operations

‘‘(a) IN GENERAL.—The Secretary of Defense shall

10 promptly submit to the congressional defense committees 11 notice in writing of any sensitive military operation fol12 lowing such operation. 13 ‘‘(b) PROCEDURES.—(1) The Secretary of Defense

14 shall establish and submit to the congressional defense 15 committees procedures for complying with the require16 ments of subsection (a) consistent with the national secu17 rity of the United States and the protection of operational 18 integrity. 19 ‘‘(2) The congressional defense committees shall en-

20 sure that committee procedures designed to protect from 21 unauthorized disclosure classified information relating to 22 national security of the United States are sufficient to pro23 tect the information that is submitted to the committees 24 pursuant to this section. 25 ‘‘(c) SENSITIVE MILITARY OPERATION DEFINED.—

3 1 eration or capture operation conducted by the armed 2 forces outside the United States pursuant to— 3 4 5 6 7 8 9 10 11 ‘‘(1) the Authorization for Use of Military Force (Public Law 107–40; 50 U.S.C. 1541 note); or ‘‘(2) any other authority except— ‘‘(A) a declaration of war; or ‘‘(B) a specific authorization for the use of force other than the authorization referred to in paragraph (1). ‘‘(d) EXCEPTION.—The notification requirement

12 under subsection (a) shall not apply with respect to a sen13 sitive military operation executed within the territory of 14 Afghanistan pursuant to the Authorization for Use of 15 Military Force (Public Law 107–40; 50 U.S.C. 1541 16 note). 17 ‘‘(e) RULE

CONSTRUCTION.—Nothing in this sec-

18 tion shall be construed to provide any new authority or 19 to alter or otherwise affect the War Powers Resolution (50 20 U.S.C. 1541 et seq.) or the Authorization for Use of Mili21 tary Force (Public Law 107–40; 50 U.S.C. 1541 note).’’. 22 23 24 25 (2) CLERICAL

4 1 (b) EFFECTIVE DATE.—Section 130f of title 10,

2 United States Code, as added by subsection (a), shall 3 apply with respect to any sensitive military operation (as 4 defined in subsection (c) of such section) executed on or 5 after the date of the enactment of this Act. 6 (c) DEADLINE

7 The Secretary of Defense shall submit to the congressional 8 defense committees the procedures required under section 9 130f(b) of title 10, United States Code, as added by sub10 section (a), by not later than 60 days after the date of 11 the enactment of this Act. 12 13 14
SEC. 3. REPORT ON PROCESS FOR DETERMINING TARGETS OF LETHAL OPERATIONS.

(a) REPORT REQUIRED.—Not later than 60 days

15 after the date of the enactment of this Act, the Secretary 16 of Defense shall submit to the congressional defense com17 mittees a report containing an explanation of the legal and 18 policy considerations and approval processes used in deter19 mining whether an individual or group of individuals could 20 be the target of a lethal operation or capture operation 21 conducted by the Armed Forces of the United States out22 side the United States. 23 24 (b) CONGRESSIONAL DEFENSE COMMITTEES DEFINED.—In

this section, the term ‘‘congressional defense

25 committees’’ means—

SEC. 4. COUNTERTERRORISM OPERATIONAL BRIEFINGS.

(a) BRIEFINGS REQUIRED.—Chapter 23 of title 10,

ations

‘‘(a) BRIEFINGS REQUIRED.—The Secretary of De-

13 fense shall provide to the congressional defense commit14 tees quarterly briefings outlining Department of Defense 15 counterterrorism operations and related activities involv16 ing special operations forces. 17 ‘‘(b) ELEMENTS.—Each briefing under subsection

18 (a) shall include each of the following: 19 20 21 22 23 24 ‘‘(1) A global update on activity within each geographic combatant command. ‘‘(2) An overview of authorities and legal issues including limitations. ‘‘(3) An outline of interagency activities and initiatives.
