262/07 LORD CARTER REVIEW OF PRISONS

A review by Lord Carter of prisons published 5 December 2007 and is available on Epic

Lord Carter was asked to undertake a review of the Prison Service, including how to balance the supply of prison
places with the demand for them in the short, medium and longer term. The report looks at:

• The operation of the prison service, including how efficient prisons are
• The prison estate
• Demand for prison places over the long and medium term
• Ways in which a better balance could be achieved between the supply of prison places and the demand for
them, sentencing and the use of non-custodial penalties, such as fines and community sentences

263/07 CONSULTATION ON MAGISTRATES SENTENCING GUIDELINES BY THE SGC

Consultation by the Sentencing Guidelines Council on revised Magistrates’ Court Sentencing Guidelines has started.
This follows a review of the Magistrates’ Association guidelines published in 2003. The revised guidelines address a
greater number of offences, incorporate relevant guidelines issued by the Council and Court of Appeal and provide
new guidance on matters such as compensation and racial aggravation. The Council has identified the assessment
of fines as a key issue for consultation.

A response on behalf of NOMS is being co-ordinated by Mark May. The necessary (250 page) document is available

Probation Circulars 2007:

PC39 Throughput of offenders on unpaid work Issued 7 December

The revised template is designed to aid completion, capture an accurate picture of


the timely commencement of unpaid work requirements and to monitor throughput.
The ‘days lost’ calculation is also revised. In respect of data collected from
January 2008 onwards this will be expressed as a percentage of the unpaid work
days planned. This brings the metric and its measurement into line with the targets
set by Regional Offender Managers. Areas are also asked to provide an end of
reporting period figure of the number of offenders, who are not being provided with
work instructions in accordance with National Standards, for operational reasons.

PC38 Introduction of a New Memorandum for Community Service Volunteers (CSV) Issued 30 November
Pre Release Placements

The purpose of the Memorandum of Understanding is to ensure that all those who
are a party to it are aware of and understand the arrangements under which the
volunteer placement takes place. The parties are: the prisoner, the placement

organisation, Community Service Volunteers (CSV), the offender manager and the
prison establishment.

PC37 Revised procedures for Monitoring Deaths Under Supervision Issued 23 November

Returns from 2006-07 have been analysed by NOMS. NOMS has revised and
simplified the returns needed for 2007-08. This circular advises probation areas of
the new arrangements.

Areas should refer to PC60/2005 for original guidance and for Annexes B and C.
