DoD DOCUMENT REQUEST NO. 4 The National Commission on Terrorist Attacks Upon the United States (the "Commission") requests that the Department of Defense (DoD or the "respondent") provide the Commission with copies of the following documents no later than June 30, 2003 (the "production date"): 1. All transcripts, tapes and other documents related to any Significant Event Conference, or any other interagency phone conference, on 9/11/01. 2. All documents related to the C-130 aircraft that departed Andrews AFB shortly after 0930 on 9/11/01, including the crew list and their current locations. Include the flight plan, the mission and the controller logs/tapes. Include any debriefings, after action reports or other inquiry into the actions of that plane on that day. 3. All transcripts, tapes and other documents related to any interagency phone conference that NORAD (including all of its components) conducted or participated in on 9/11 related to the hijackings of 9/11 and NORAD's response thereto. 4. All transcripts, tapes and other documents related tcfany internal NORAD phone conferences or communications on 9/11 related to the hijackings of 9/11 and NORAD's response thereto. 5. Transcripts of all communications and orders conveyed to pilots scrambled in support of the North East Air Defense Sector's (NEADS) response to the hijackings of 9/11. 6. All transcripts, tapes and other documents of the parent wings of aircraft scrambled in support of NEADS' response on 9/11, related to the response of such aircraft to the hijackings of 9/11. 7. All transcripts, tapes and other documents of the Air Force Bases from which aircraft were scrambled in support of NEADS's response on 9/11, related to the response of such aircraft to the hijackings of 9/11. 8. The pilot logs for each pilot that was scrambled in support of NEADS' response to the hijackings on 9/11, including but not limited to the pilots that scrambled out of Otis Air Force Base, Langley Air Force Base, Andrews Air Force Base, Toledo Air Force Base and Selfridge Air Force Base.

The Air Traffic Control Logs for each base from which fighters were scrambled in support of NEADS' response on 9/11, including but not limited to: Otis Air Force Base, Langley Air Force Base, Andrews Air Force Base, Toledo Air Force Base and Selfridge Air Force Base. 10. All NORAD logs related to the exercise VIGILANT GUARDIAN, beginning with the morning shift change on 9/11 and for the 24-hour period thereafter. 11. Intelligence scenarios and briefing papers for all national military exercises, since January 1993, in which a plane was hijacked and/or used as a weapon and which involved any of the following DoD entities: NORAD, JCS, and Special Operations Command (SOCOM).

12. The final briefing and intelligence scenarios for NORAD Exercises AMALGAM VIRGO 01 and 02. With regard to AMALGAM VIRGO 02, please provide documentation of the scenario as it existed prior to 9/11 as well as the version used in the actual exercise. 13. All documents of the Office of the Assistant Secretary of Defense (Special Operations/LowIntensity Conflict) prepared for or signed out by the Assistant Secretary, that address the mission of NORAD. 14. Portions of the following Office of the Secretary of Defense (OSD) documents that relate to NORAD: (a) Defense Planning Guidance (b) Contingency Planning Guidelines This request includes current versions of the aforementioned documents, and those versions that were in effect on 9/11/01. 15. Portions of the following Joint Chief of Staff (JCS) documents that relate to NORAD: (a) Joint Strategic Capabilities Plan (b) Joint Strategic Review .., (c) Joint Warfighting Capabilities Assessment (JWCA) for Combating Terrorism •i« This request includes current versions of the aforementioned documents, and those versions that were in effect on 9/11/01. With respect to those documents that were in effect on 9/11, please provide the staffing package that accompanied the documents when submitted for approval by the Director of the Joint Staff. 16. Portions of the following NORAD documents that relate to domestic air defense and/or combating terrorism: (a) Integrated Priority List (b) Requirements Review Report This request includes current versions of the aforementioned documents, and those versions that were in effect on 9/11/01.

18. Documents that establish the universe of military aircraft, other than air defense aircraft, that were airborne within 150 nautical miles of the New York City and Washington D.C. areas, anytime from 0800 to 1030 hours on the morning of 9/11/01. The documents should include the takeoff time, flight plan, and ordnance load of such aircraft. 19. An Information Paper or fact sheet that establishes how clocks were synchronized and to what standard on 9/11/01 for the following: the Joint Surveillance System radar tapes, the National Military Command Center logs, the Cheyenne Mountain Operations Center logs, the Northeast Air Defense Sector logs, and the First Air Force/Continental Air Defense Region logs. 20. The final briefing and intelligence scenario for the National Reconnaissance Office (NRO) exercise scheduled on 9/11 concerning a plane crash into NRO headquarters. 21. The final briefing and intelligence scenario for the October 24-26,2000 emergency drill based upon the crashing of an airliner into the Pentagon. 22. The final briefing and intelligence scenario for the May 2001 DoD training of medical personnel to respond to a guided missile in the form of a hijacked 757 airliner crashing into the Pentagon. ;.--..•

23. All files of Lt. Col. Dawne Deskins, USAF, Northeast Air Defense Sector, related to the hijackings of 9/11. 24. There are conflicting accounts of when NORAD first received notification from the FAA that American Airlines Flight 11 had been hijacked. Please provide all documents relating to the FAA's notification to NORAD of the hijacking of Flight 11. 25. The National Military Joint Intelligence Center (NMJIC) Senior Duty Officer log for the 24hour period beginning with the morning shift change on 9/11, and for any subordinate desks that recorded events related to the hijackings on 9/11. 26. The National SIGINT Operations Center (NSOC) Senior Duty Officer logs for the 24-hour period beginning with the morning shift change on 9/11, and for any subordinate desks that recorded events related to the hijackings on 9/11. 27. The National Imagery and Mapping Agency (NIMA) logs that document imagery requests and responses for the 24-hour period beginning with the morning shift change on 9/11. 28. The Alternate National Military Command Center (ANMCC) Senior Duty Officer log for the 24-hour period beginning with the morning shift change on 9/11, and for any subordinate desks that recorded events related to the hijackings on 9/11. 29. The National Emergency Airborne Command Post (NEACAP) Senior Duty Officer log for the 24-hour period following activation of the Command Post.

The Transportation Command (TRANSCOM) Operations Center Senior Duty Officer log for the 24-hour period beginning with the morning shift change on 9/11, and for any subordinate desks that recorded events related to the hijackings of 9/11. 31. The Air Combat Command (ACC) Senior Duty Officer log for the 24-hour period beginning with the morning shift change on 9/11, and for any subordinate desks that recorded events related to the hijackings of 9/11. 32. NORAD regulation 55-11, entitled "Air Defense Fighter Alert (U)." 33. Schedules of the SECDEF, DEPSECDEF, and USD(P) as maintained and revised on 9/11. 34. Final data from the Defense Special Missile and Astronautics Center (DfiFSMAC) that establishes the time of impact for each of the hijacked aircraft. 35. Copies of the JCS/DoD message to commanders, worldwide, raising the threat level to "Delta." 36. Copies of the JCS/DoD Order raising the defense condition to DefCon 3. The Commission requests that the documents requested above be provided as soon as they are available, even though all requested documents may not be provided at the same time, through means of a "rolling" production. The Commission further requests that the respondent provide an index of all documents produced, indicating which documents are responsive to what requests. If any requested documents are withheld from production, even temporarily, based on an alleged claim of privilege or for any other reason, the Commission requests that the respondent, as soon as possible and in no event later than the production date, identify and describe each such document or class of documents, as well as the alleged basis for not producing it, with sufficient specificity to allow a meaningful challenge to any such withholding.

If the respondent does not have possession, custody or control of any requested documents but has information about where such documents may be located, the Commission requests that the respondent provide such information as soon as possible and in no event later than the production date. If the respondent has any questions or concerns about the interpretation or scope of these document requests, the Commission requests that any such questions or concerns be raised with the Commission as soon as possible so that any such issues can be addressed and resolved prior to the production date.
