Office of Rural CommunityAffairs Attention: Mark Wyatt P.O.Box 12877 Texas 87II-2877 7 Austin, RE: City of PelicanBay TCDP Application

Dear Mr. Wyatt:

an The City of PelicanBay respectfullyrequests appealregardingthe disqualification Community DevelopmentBlock Grant Program. of the city's applicationto the 200712008 The City offers the following information in supportof this appeal.

The City will show that the Office of Rural Community Affairs' websiteprovided and misleadinginformation relativeto the applicationrequiredfor the 200712008 inaccurate Community DevelopmentBlock Grant Programfunding cycle. The City will show that a requestwas made for a current applicationto be mailed to the city's grant administrator. of Finally, the City will arguethat the applications the previousand current funding cyclesare different and, therefore, shouldbe allowed under thesespecific not substantively circumstances.

for with Lawrence& Associates many yearsto The City of PelicanBay has contracted compile applicationsto the Texas Community DevelopmentProgramand when funded,to with the projects. During this past funding cycle, the administerthe grant funds associated to Kaltenbachwith Lawrence& Associates of the City againrequested assistance Ms. Jessica application. Ms. Kaltenbachwas not able to assistin the compilation of their 200712008 attend the workshop that was held closestto the DFW region due to a conflict with a

previously scheduled(and publicized) public hearing in another client city which was on the opposite side of the Metroplex. However, when Ms. Kaltenbachrealized the conflict between the two scheduledevents, she called an ORCA representative obtain advice on the matter. to The ORCA representative,Ms. Julie Hartley, statedthat workshops were recommendedsince changeswere being made to the application; however, that the applications would be made theseworkshopsare not mandatoryand Ms. Kaltenbachhad a availableonline. Because previously publicized engagement, requested copy of the applicationin eitherpaper she a copy or electronicformat to be sent. Ms. Hartley explainedthat they could not do that. Ms. the Hartley reiteratedthat the applicationswould be availableonline. Because public hearing had beenadvertisedand there was no one elseto attendin the absence Ms. Kaltenbach,Ms. of at Kaltenbachdecidedto attendher prior engagement which precludedher attendance the applicationworkshop.

Based on the information sharedduring the phone conversationbetween Ms. Kaltenbachand Ms. Hartley, when Ms. Kaltenbachbeganto preparethe city's application, shevisited the ORCA website online to be surethat shewas utilizing the correctapplication form. The Office of Rural Community Affairs websitepage http://www.orca.state.tx.us/index.php/Community+Development/Grants+o226*Fundine provides information regardingthe variousprograms, including the Community Development Fund programs. Next to theseprogramsis listed and Community DevelopmentSupplemental and the availability date of the application(6130106) the applicationdeadlinedate(8/31/06), as well as a link to connectto the applicationform itself. This link directly opensan applicationform; however, the applicationform that is openedis the form that has beenused link was a principle reasonthat Ms. in the previousfunding cycle. This erroneous applicationformat. Kaltenbachcompiled her applicationbasedupon the previously accepted

application, the City would contendthat After careful review of the new (200712008) this application has changedprimarily in format rather than in required content. There is only one section that was specifically addedto the current application which is not explicitly required in the previous application. The Project Impact Scoring section requires information

pertainingto supportdocumentationfor the proposedproject including TCEQ notices,EPA notices, etc. Arguably, the City of PelicanBay's proposedstreetimprovementsproject does uphold the City's not and would noi have this type of information. Shouldthe department appeal, the City would be happy to transfer the information currently provided in the application submitted to ORCA to the new application format. No changesto the original information would be made.

You may or may not have alreadyreceiveda notice from the Office of Rural Community Affairs regardingthe disqualificationof your 200712008 TCDP application. I would like to take a moment to explain what hashappened and why. As part of eachbi-annualapplicationprocess, ORCA holds several applicationworkshopsacrossthe state. This year was the first year that I was not able to attendthe workshop that was held closestto the DFW region (and publicized)public due to a conflict with a previously scheduled hearingin a client city which was on the oppositeside of the Metroplex. However, when I realizedthe conflict betweenthe two scheduled events,I called an ORCA representative obtain advice on the matter. The ORCA to representative, Julie Hartley, statedthat workshopswere recommended Ms. sincechanges were being madeto the application;however, that the applicationswould be made availableonline. Because theseworkshopsare not mandatoryand I had a previously publicizedengagement, requested I a copy of the applicationin either paper copy or electronicformat be sent. Ms. Hartley explainedthat they could not do that. Ms. Hartley reiterated that the applicationswould be availableonline. Because public hearing the had beenadvertised and there was no one elseto attendin my absence, I decidedto attendthe public hearingwhich precludedmy attendance the at applicationworkshop. Basedon the information sharedduring the phoneconversation betweenMs. Hartley and myself, when I beganto preparethe city's application,I visited the ORCA websiteonline to be surethat I was utilizing the correct applicationform. I would like to file an appeal with ORCA on behalf of the City and present thesearguments causefor consideration. An appealletter is attached as your consideration for and review. Pleaselet me know how you would like to proceed.

I would also like to expressmy deepest and most humble apologiesfor this problem. I assure you that I will do everythingin my power to recti$r the situation,if at all possible. Regards,

Dear MayorReed: The Officeof RuralCommunity you thatthe application Affairsregrets inform to submitted the city of Pelican by Bay to the Texas Community DevelopmentBlock Grant Program (TxCDBG)for funding under the 200712008 Community Development Fund/Community Development Supplemental Fundhas beendisqualified the following for reason. The city of Pelican Bay did not use the 200712008 CommunityDevelopmentFund/ Community Development jupplemental Fund (CD/CDS)application guide and forms. There were significant changes in the 200712008 CD/CDS application cycle and the new procedures superseded thosepublished all previous guides(page 1 of the in application 200712008 CD/CDS Application Guide). The new application containsnew sectionsand forms including the Project lmpactInformation whichspecifically addresses scoring the criteria and the Objectives and Outcomes section which is a new requirement from the U,S.Department Housing of and UrbanDevelopment. Withoutthis information, application the is considered substantially incomplete. ORCA will not considerapplications that are incomplete, receivedafter the deadline,or that lack information neededby TxCDBG staff to make determinations concerning the eligibility each of (page3 of the 200712008 application activity TxCDBGCD/CDSFundApplication Guide). It is unfortunate that the city and the city'sapplication preparer were unaware the application of changes. ORCA made every effort to inform all partiesinvolvedin the TxCDBG programabout the changes. The noticeof the application workshopswas sent to all TxCDBG eligibleapplicants and the notice informedthe public about the new electronic application format. Five application workshops were held in June 2006 at variouslocations throughout state. The the changesin the 2007nA08 CDICDSapplication was also discussed each of the 2OO72OA8 at Or'ganizational Regional Review Committeemeetings. Additionally, two meetingswere held with interested parties(eligibleentities, consultants, engineers, COGs)in May 2006 to offera preview and get feedback the new application on format. RE:

Cify of PelicanBay TCDP Application

Dear Mr. Wyatt:

The City of Pelican Bay respectfullyrequests appealregardingthe disqualification an of the city's applicationto the 2007/2008CommunityDevelopmentBlock Grant Program. The City offers the following information in supportof this appeal.

The City will show that the Office of Rural Community Affairs' website provided inaccurateand misleadinginformation relativeto the applicationrequiredfor the 200712008 Community Development Block Grant Program funding cycle. The City will show that a requestwas made for a current application to be mailed to the city's grant administrator. Finally, the City will argue that the applications of the previous and current funding cycles are not substantively different and, therefore, shouldbe allowed under thesespecific circumstances.

The City of Pelican Bay has contracted with Lawrence& Associatesfor many yearsto compile applications to the Texas Community Development Program and when funded, to administer the grant funds associatedwith the projects. During this past funding cycle, the City againrequested assistance Ms. Jessica the of Kaltenbachwith Lawrence& Associates to assistin the compilation of their 200712008 application. Ms. Kaltenbachwas not ableto attend the workshop that was held closestto the DFW region due to a conflict with a

previously scheduled(and publicized) public hearing in another client city which was on the oppositeside of the Metroplex. However, when Ms. Kaltenbachrealized conflict between the the two scheduleci events, she called an ORCA representative obtain advice on the matter. to The ORCA representative, Ms. Julie Hartley, statedthat workshopswere recommended since changeswere being made to the application; however, that the applications would be made availableonline, Becausetheseworkshopsare not mandatoryand Ms. Kaltenbachhad a previously publicized engagement, requested copy of the applicationin eitherpaper a she copy or electronicformat to be sent. Ms. Hartley explainedthat they could not do that. Ms, Hartley reiteratedthat the applicationswould be availableonline. Becausethe public hearing had beenadvertisedand there was no one elseto attendin the absence Ms. Kaltenbach,Ms. of Kaltenbach decided to attend her prior engagement which precluded her attendanceat the applicationworkshop.

Based on the information sharedduring the phone conversationbetween Ms. Kaltenbachand Ms. Hartley, when Ms. Kaltenbachbeganto preparethe city's application, shevisited the ORCA website online to be surethat shewas utilizing the correctapplication form. The Office of Rural Community Affairs website page http://www.orca.state.tx.us/index.php/Communit]'+Development/Grants+o%26+Fundine provides information regardingthe variousprograms, including the Community Development and Community Development SupplementalFund programs. Next to theseprograms is listed the availability date of the application(6130106) the applicationdeadline date(8131/06), and as well as a link to connect to the application form itself. This link directly opensan applicationform; however, the applicationform that is openedis the form that has beenused in the previous funding cycle. This erroneouslink was a principle reasonthat Ms. Kaltenbachcompiled her applicationbasedupon the previously accepted applicationformat.

After careful review of the new (200712008) application, the City would contendthat this application has changedprimarily in format rather than in required content. There is only one sectionthat was specifically addedto the currentapplicationwhich is not explicitly requiredin the previous application. The ProjectImpact Scoringsectionrequiresinformation

pertaining supportdocumentation the proposed to for projectincludingTCEe notices, EpA notices, etc. Arguably, the City of PelicanBay's proposed streetimprovements projectdoes not *d would noi havethis type of information. Shouldthe department upholdthe City,s appeal, City would be happyto transfer informationcurrentlyprovidedin the the the application submitted ORCA to the new application to format. No changes the original to informationwould be made. Please contact or Ms. Jessica me Kaltenbach (9721442-6578)you haveany if questions concerns or regarding appeal.I request the City be informedasquickly as this that possible regarding dispositionof this matter. the

Sincerely,

fto rEw
