The City Secretaryshall be appointedby the City Council, and shall have
those dutiesprovided by statelaw and any othersspecificallyprovided for by
ordinance,policy or resolutionof the City Council. The City Secretarymay
delegate to an assistant the authority to perform the duties of the City
Secretary in the absenceof the City Secretary. The City Secretary shall be
responsiblefor the following:

1. Posting notices of City Council and City Board and Commission


meetingsas requiredby statelaw (Chapter551, Tpx. Gov'rCooe).

2. Notification of membersof the City Council and City Attorney at


leasttwo hoursbeforeemergencymeetings.

3. Notification of City officers of appointment to such offices and


requestwritten acknowledgment.

4. All other duties prescribedby state law and City ordinances,City


Council direction,and policy.

Section2: Agendas.

1. Agendasrequiredby statelaw (Chapter551, TBx. Gov'r Cooe) shall


be preparedand postedby the City Secretary.

2. Any item requested,by the Mayor, a Council member,or an officer of


the City, by 5:00 p.m., on the fourth working day before a Council
meeting, shall be included on the posted agenda. Such requestneed
not be in writine.

Section3: SpecialMeetingt

A special meeting may be called by the Mayor or by any three city council
members. A quorum for a special meeting is 213 of the number of
councilpersonsserving. If 5 are serving,a quorum is 4. If, due to a vacancy,
there are 4 membersthen serving,a quorum is 3. The Mayor is not counted
for the purposeof determininga quorum

Section4: It is hereby declaredto be the intention of the City Council of the City of
Pelican Bay that the sections,paragraphs,sentences,clauses,and phrasesof
this ordinance are severable, and if any part of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any court of
competentjurisdiction, such unconstitutionalityshall not affect any of the
remainingparts of this ordinance,sincethe samewould have beenenactedby
the City Council without the incorporation in this ordinance of any
unconstitutionalpart.

Section5: This ordinance shall be and is hereby declared to prevail over all other
ordinancesof Pelican Bay affecting the subject matter herein, but shall not
operateto repealor affect any suchordinanceor ordinances,exceptinsofar as
the provisions of such ordinanceor ordinancesare inconsistentor in conflict
with the provisions of this ordinance in which instanceor instancesthose
provisions shall be and they are herebyrepealed.

Section6: This ordinanbeshall be in full force and effect immediately upon passage.

WHEREAS, the PelicanBay City Council finds that the efficient and orderly
functioningof the city would be promotedby the limitationof access

to suchoffibesto the City Secretaryand any Clerksdesignatedby the
City Secretaly;NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PELICAN


BAY, TEXAS:

Sectionl: The City secretaryand the Clerks designatedby the City Secretaryshall
be the only.personswho shall have the combination to the safe in the
City's administrativeoffi ces.

Section2: The regular hours for the city's administrativeoffices shall be Monday
through Friday between the hours of o'clock A.M. and
o'clock P.M. except on weekendsand legal holidays, when the
office shall be closed.

Section3. No person other than the City Secretaryand any Clerks designatedby
the City Secretaryshall enter or remain in the city's administrative
offices exceptduring regularhoursor during city council meetings,

Section4. The City Secretaryis authorizedand directedto causethe locks on the


doors of the City's administrativeoffices and combinationof the safeto
be changedor replacedat city expenseto ensuresecurity.

Section5. Any person violating Section 3. of this ordinanceshall be deemed


guilty of a misdemeanorand fined in an amount not to exceed$500.00.
It shall be a defenseto prosecutionhereunderif the personchargedwas
at the time a fire fighter engagedin responding to an emergencywithin
such offices.

Section6. The City Secretary is directed to cause publication of the descriptive

providedby law.
Section7. This ordinanceshallbe effectiveimmediatelyuponpassage.

WHEREAS, the PelicanBay City Council finds that the efficient and orderly
functioningof the city would be promotedby the limitation of access
to funds, records and the combination of the safe within the
administrativeoffices of the city to the City Secretaryand any clerks
designatedby the City Secretaryby a limitation of after hoursaccess
to suchofficesto the City Secretaryand any Clerksdesignatedby the
City Secretary;NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PELICAN


BAY, TEXAS:

Sectionl: The City secretaryand the Clerks designatedby the City Secretaryshall
be the only personswho shall have the combination to the safe in the
City's administrativeoffices.

Section2: The regular hours for the city's administrative offices shall be Monday
through Friday between the hours of _o'clock A.M. and
_o'clock P.M. except on weekends and legal holidays, when the
office shall be closed.

Section3. No person oiher than the City Secretaryand any Clerks designatedby
the City Secretary shall enter or remain in the city's administrative
offices except during regular hours or during city council meetings,

Section4. The City Secretaryis authorized and directed to causethe locks on the
doors of the City's administrativeoffices and combinationof the safeto
be changedor replacedat city expenseto ensuresecurity.

Section5. Any person violating Section 3. of this ordinance shall be deemed


guilty of a misdemeanorand fined in an amount not to exceed$500.00.
It shall be a defenseto prosecutionhereunderif the person chargedwas
at the time a fire fighter engagedin responding to an emergencywithin
such offices.

Section6. The City Secretary is directed to cause publication of the descriptive

providedby law.
Section7. This ordinanceshallbe effectiveimmediatelyuponpassage.
