* IMPORTANT! Please ensure that all adults participating have read & understand the terms of this agreement EXCITING FREE SEED OFFER: We will be providing garden plot keepers with five (5) packets of Non-GMO/100% Organic seeds at no cost to get you started!

This agreement is between MARK Project and the Garden Plot Keeper named above for the 2013 season: Summer 2013-Fall 2013. Available Plot Sizes: > 2' x 5' = $10.00 is due immediately upon approval of Application > 2' x 10' = $20.00 is due immediately upon approval of Application Only one plot per person and/or organization. No garden plot will be gardened until payment of fees and a signed application is received, approved and a garden plot number has been assigned. The garden will be accessible during daylight hours only. Sunrise to sunset. Any necessary garden tools, seeds (except for initial FREE seed offer), organic fertilizers, containers, waterer(s), buckets, etc. must be provided by the gardener. A drum of water will be available on site for watering purposes only. Gardeners must be at least eighteen (18) years of age or be accompanied by an adult who is eighteen (18) years of age or older. Garden plots will be plowed under following the close of the season. Garden plots that have not been maintained for two (2) weeks or longer and/or have noxious weeds may be tilled under. A new Application will need to be submitted for the 2014 season, when made available to the community.

Application & Guideline Agreement
Each Garden Plot Keeper must agree to the following Guidelines & Rules:
I. Maintain a neat garden plot throughout the growing season, harvest produce & flowers when mature, remove plants when they have ceased to bear, and keep it from weeds. This includes area immediately surrounding my plot. Grow only legal plants. I understand that there is NO SMOKING in the garden area. Refrain from using any synthetic pesticides (including but not limited to herbicides, insecticides, fungicides, rodenticides, miticides) unless reviewed and approved by the Garden Coordinator prior to use. I will report any pest infestation. I will not plant any invasive species in the garden or surrounding areas. If questionable, please contact Garden Coordinator for identification. I will plot tall plants where they will not shade any neighboring plots. If planting vine plants I will keep them contained within my plots and not entering any walkway or neighboring plot. I will deposit all litter into trash barrels and vegetative matter into designated compost bin. I understand that use of any garden equipment or tools, both non-motorized & motorized comes at my own risk. I will report any concerns, conflicts, or damage promptly to the Garden Coordinator. Keep pets out of the garden area. Supervise any children brought into the garden area. Never drive or park on the grass, only in designated areas. Never apply anything to or pick anything from another individual's garden plot without their approval. Inform the Garden Coordinator when finished gardening before the end of the season. I agree to participate in fall cleanup at the end of the season. If I abandon my plot for any reason, I will notify the Garden Coordinator. I agree to acknowledge quiet times set aside during Congregation B'nai Israels' Saturday morning services.

I understand that neither MARK Project, Fleischmanns First nor owners of the land are not responsible for my actions. I THEREFORE AGREE TO HOLD HARLMESS FLEISCHMANNS' COMMUNITY GARDEN, ITS MEMBERS, FLEISCHMANNS FIRST, THE VILLAGE OF FLEISCHMANNS, THE MARK PROJECT, AGRIFORAGING, THE GARDEN COORDINATOR FOR ANY LIABILITY, DAMAGE, LOSS OR CLAIM THAT OCCURS IN CONNECTION WITH THE USE OF THE GARDEN BY ME OR BY MY GUESTS.
