KNOW ALL MEN BY THESE PRESENTS: This CONTRACT OF LEASE is made and entered into at Daet, Camarines Norte, by and between the following parties, to wit: LINDA A. DELICA, of legal age, Filipino citizen, and a resident of South Poblacion, Jose Panganiban, Camarines Norte, hereinafter called the LESSOR; -and_____________________________, of legal age, Filipino citizen, and a resident of ________________ ______________________________, hereinafter called the LESSEE;

WHEREAS, the LESSOR is the owner of that residential property (house and lot) situated at Brgy. South Poblacion, Jose Panganiban, Camarines Norte covered and embraced by OCT/TCT No. _________________; That the herein LESSEE desires to occupy and rent the above-described property hereinafter known as the leased premises, and the LESSOR hereby agrees to lease the same; NOW, THEREFORE, for and in consideration of the foregoing premises, the LESSOR hereby let and leases the same unto the LESSEE, subject to the following terms and conditions, to wit: 1. The term of this lease shall be for a period of ___________ (____) MONTHS/years deemed to have commenced on ______________________ and to expire automatically without need of further notice or demand after the lapse of said period. It is understood and provided that unless granted an extension of the lease by the LESSOR, the premises shall be deemed vacant subject to the free disposal of and occupancy by the LESSOR and/or her representatives. 2. Rental shall be ____________________________________________________PESOS (Php______________), Philippine currency, to be paid in advance. However, upon signing of this contract, the LESSEE shall have paid to the LESSOR ____ (___) months’ worth of rent as SECURITY DEPOSIT aside from the _____ (___) month’s worth of rent as ADVANCED PAYMENT; 3. The leased premises shall be used exclusively for residential purposes by the LESSEE and her family not exceeding _____________ (____) persons; That the guests of the LESSEE are not allowed to stay in the leased premises overnight; That any and all illegal things or acts are prohibited within the leased premises and in case of violation hereof, the LESSEE shall be solely responsible for the consequences; 4. The LESSEE hereby acknowledges that the premises subject of this lease is in good and tenantable condition. They likewise agree to keep the cleanliness and sanitation of the leased premises during her occupancy thereat. 5. The LESSEE shall pay for the expenses such as electricity and water bills and for other services or utilities installed and/or used in the leased premises; 6. The LESSEE shall not introduce and/or put up any structure or improvements in the leased premises without prior written consent and approval of the LESSOR. But such consent or approval notwithstanding, however, any structure or improvements made, put up and introduced in the premises which when removed shall cause damage or destruction on the leased premises or portions thereof shall all become property of the LESSOR who shall have no obligation to pay for the value thereof; 7. Cooking food using wood, charcoal, and other means of cooking that produce excessive smoke is not allowed. Pets and any other kind of animals are likewise not allowed to be brought or raised within the leased premises; 8. The LESSEE shall have no right to sublease the premises subject of this lease or any part or portion thereof to anybody, nor shall have the right to sell, convey, transfer, or assign the rights hereto acquired to others without prior written consent and approval of the LESSOR. Violation of this provision shall cause automatic cancellation of this contract and gives the LESSOR and/or representative an authority to occupy the premises without need of court action or order;


9. If the leased premises or portion thereof be damaged or destroyed through the fault or negligence of the LESSEE and/or his family, guests, friends, visitors, helpers, or employees, such damage or destruction shall be the responsibility of the LESSEE who shall pay the value thereof to the LESSOR; 10. The term of the lease agreed by both parties is for the benefit of the LESSOR, and hence, in case of pretermination by the LESSEE, one month’s worth of security deposit shall be forfeited in favor of the LESSOR as damages and/or penalty; 11. In case of the last month of the agreed period of rental, the one month’s worth of security deposit shall be used as payment for the said month. The remaining ________ (___) month’s worth of security deposit cannot be used as rental fee as the same is allotted after the expiration of the contract for the payment of any outstanding bills payable by the LESSEE and for the restoration of the leased premises for damages arising from the negligence or fault of the LESSEE to prepare the same for the next occupant. Any remaining amount therefrom shall be refunded to the LESSEE; 12. If the leased premises be not surrendered upon termination of this lease or cancellation thereof, the LESSEE shall be liable for any and all damages which the LESSOR may suffer by reason whereof, and shall also indemnify him of any and all claims of succeeding tenants resulting from such delay in the surrender of the premises; 13. Any and all stipulations, agreements and/or understanding, verbal or in writing, priorly or subsequently made and entered into by the parties inconsistent with, or not incorporated to this contract are all disregarded and cancelled. And any change, addition, alteration and/or modification/s of any of the terms and conditions set forth shall not be binding unless put in writing and signed by both parties; IN WITNESS WHEREOF, the parties have hereunto set their hands this _____________________, in Daet, Camarines Norte, Philippines.

BEFORE ME, a Notary Public for and in the Province of Camarines Norte, this ___________________, personally appeared the above-named persons with their IDs indicated above, known to me, and to me known to be the same persons who executed the foregoing instrument which they acknowledged before me as their free and voluntary act and deed.
