A yacht racing and social extravaganza that comprises four days of international standard yacht racing and four nights of beachside parties, the regatta welcomes serious racers and laid-back cruisers. More than 35 boats and 400 participants are expected to take part in the 2013 event. Taking place during the windy southwest monsoon season off Phuket's southeast coast, challenging and scenic conditions set the stage for an action packed, fun race.

Poomiphat 'Tom' Navanukroh (Group Director – Travel lndustry, Kasemkij Hotels) reveals why, out of all the Kasmkij properties, the acclaimed Cape Panwa Hotel holds a special place in his heart. He also tells how events like the Cape Panwa Hotel Phuket Raceweek benefit the Phuket community far beyond the pleasure of sailing.
Where were you born and where are you living now? I was born in Bangkok and I still live there. How much of your time do you spend in Phuket? I travel to Phuket every month to audit the standard of services and product of our properties, normally for between five and seven days. Are you involved in any charities, clubs or associations? I am a member of TSPCA (Thai Society for the Prevention of Cruelty to Animals) and assisting Kasemkij Hotels in organising its annual charity activity for the SOS Children’s Villages in Thailand. Could you tell us a bit about your family life? My two children (a daughter and a son) are in university. I travel quite extensively and my wife is also in the hotel industry, so we do not get the chance to be together much. However, we try to have a meal together at least once a week and one long vacation together once a year. What made you decide to enter the hospitality/hotel field? I guess because of my desire to meet a lot of people from around the world, and in my earlier years it was quite a prestigious and difficult field to enter. How long have you been working with Kasemkij hotels? I have been with Kasemkij Hotels for 22 years, but actually with Cape Panwa for 24 years as I started working with the hotel when it was under the management of Sheraton during 1989-1991. Could you tell us more about Cape Panwa Hotel and the work you do with this and other Kasemkij hotels? My first position at the Cape Panwa Hotel was the Director of Sales in 1991. I was based in Bangkok and worked as the General Manager for Cape House, Cape Panwa and Cape Racha Hotel before being promoted to the Group Director – Travel Industry in 2008. I'm responsible for the sales and marketing for the leisure market for the 17 properties owned by Kasemkij Hotels and for the operations of five Cape and Kantary properties in major leisure destinations: Cape Panwa Hotel-Phuket, Kantary Bay-Phuket, Kantary Beach-Khao Lak, Cape Nidhra Hotel-Hua Hin and Cape House-Bangkok. Out of 17 properties, the Cape Panwa Hotel has always been more than a hotel for me, as it has everything that a holiday-maker could wishe for: spacious rooms, secluded beach, natural tropical garden, plenty of restaurants and bars, spa, private jetty, tours, water sport facilities including a yacht and speedboats. It really is a dream holiday destination. Cape Panwa Hotel is set to be the Title Sponsor for the Cape Panwa Hotel Phuket Raceweek regatta again this year. What made you decide to continue the hotel’s involvement with this event? Initially we signed a contract to be the title sponsor for Cape Panwa Hotel Phuket Raceweek for two years during 2012-13. The feedback we received from those who attended last year's event was overwhelming. We found that sports tourism activities such as this help to create awareness as well as economic benefits for the hotel and the Cape Panwa area. To our surprise, a lot of people who attended Phuket Raceweek last year said that they previously didn't know that Cape Panwa Hotel had such a beautiful beach and that the location was ideal for yacht racing at this time of the year. It's the only area in Phuket where the sea is calm and safe for any water sport activities during the southwest monsoon. We're aiming to make the event recognised as one of the best regattas in Asia and eventually the best in the world. For this reason, we've decided that we will continue to be the Title Sponsor for at least another two years, until 2015, as we believe that a long-term commitment will be required to achieve our goal. How important are these events in helping to market a hotel and destination? Do you see any areas where Phuket could improve as an events destination? Events can certainly deliver key messages about a hotel, a destination and a community’s positive image to the world. The events may be in the form of MICE (meetings, incentives, conventions and exhibitions), sporting events, cultural events or they may be award functions like the Thailand Film Festival. In other words, an event acts as an attraction for people from outside the local community to visit the location and spend money on accommodation, food and leisure activities at the destination. Events also help to build an image in the minds of tourists who have never visited the place before. I think that if the Phuket Convention Centre can ever be built, it will bring a lot of quality travellers and income to the island. I’m hoping that it will be better organised than the Chiang Mai Convention Centre, which was open just for the 2nd Asia Pacific Water Summit in May 2013. With its dramatic landscape of steep karsts rising out of a calm, jewel-toned sea, Phang Nga Bay is the one place that no visitor to the Andaman region should miss. But what’s the best way to see it?

Many tourists set off every day on packaged tours to the bay and sadly – especially in the peak season months – there are often scenes of hundreds of people spilling off tour boats and crowding out the bay’s beautiful beaches and caves. A savvy traveller knows that to see a sight in its full glory, it’s better to chart your own path. And in Phang Nga Bay this is easily achieved. You could charter a luxury yacht and explore in sumptuous style and comfort, but for those lacking the budget or looking for a more traditional way to venture into the bay, there’s the mighty long-tail boat.
The Hongs

The long-tail boat is a true symbol of coastal Thailand. Every travel book, article and video about Thailand’s beaches and islands will include images of this colourful vessel. These hand-crafted boats travel along smoothly, albeit loudly, most adorned with garlands and scarves around the curved bow as an offering to the sea spirits for protection. Its swiveling rear engine with a propeller at the end of a long shaft is the ‘tail’ that gives the boat its name. Long-tails are generally owned or operated by local men who are also fishermen or otherwise well-versed in the sea and sights in the area. You can catch a long-tail boat from several departure points in Phang Nga province, just over the bridge from Phuket. There are several signs along the road for ‘James Bond Island’ tours, but probably the best touring boats are found at Surakul Pier in Takua Thung about 12 kilometres west of Phang Nga Town. They’re large, well maintained and have a canopy roof for shade. Plus there’s attention to safety with all passengers given life jackets before they board the boat, including child-sized jackets for children. The price is 2,500 baht for the boat for the day, which could seat a dozen passengers comfortably. They will depart as soon as your group is ready, ideal if you wish to avoid the crowds and go in the early morning hours or afternoon. The first part of the journey is more like a jungle tour as the boat glides through an inlet flanked by mangrove forest. After about 20 minutes the water opens up to the sea and – behold! – you’re treated to your first sight of the bay’s famed karsts. From here there are several places to explore, but the following describes a typical journey.

The Hongs. A hong, or room, is a cave found inside some of the karsts, formed when the middle of the peak collapses into the sea. Though these little oases have become a popular and sometimes crowded sight, it’s still worth venturing in to see these true wonders of nature up close. Narrow access means that the only way in is by sea kayak, which can be hired at one of the floating barges just outside the hong entrance. The caves are a challenge to navigate, meaning that your kayak will be paddled by a guide, and there’s an extra cost for this at 400 baht per person. The guide takes you through a series of caves, some with only a sliver of space between the water and cave walls, meaning you have to get cosy with your boat-mates and lie back flat on the kayak to get through. As you squeeze through, be sure to look up at the cave walls around you to catch a sight of the sparkling stalactites: nature’s bling. If you’re keen to do more ‘honging around’, try booking a separate trip with John Gray’s Sea Canoe, eco-conscious kayak experts who will take you to lesser-known, less crowded caves.

Bond, James Bond. Love it or hate it, there’s no denying that Koh Khao Phing Kan – better known as James Bond Island – has some of the most beautiful topographical features in the world. A popular destination since it was made famous as the island hideaway of the criminal Scaramanga in the 1974 film The Man With the Golden Gun, it’s now often decried as a tourist trap. But arriving here via your own chartered boat gives you the chance to visit during the island’s quieter hours and explore without any time pressure. The small island with tall cliffs rising straight up from the sea has a perfect little beach that offers a view of Koh Tapu, or Nail Island: yes, that’s the one in all the postcards. But the fact that millions of people have seen it makes it no less stunning.

Koh Panyee. To see the best of Koh Panyee, this Muslim floating village attached to the base of a towering karst island, be sure to get there either early in the morning or in the late afternoon outside of the tour group hours. The front of the village is lined with scenic yet unremarkable restaurants and many souvenir stalls. Sneak down the narrow walkways to the other side where the village’s community life is better revealed. Here’s where you’ll see the local villagers simply leading their lives: washing clothes, preparing meals, praying, seemingly oblivious to the spectacular Andaman scenery around them. Take a look at the village football pitch and you’ll soon understand why this tiny town is home to some regional champion teams. The pitch is built on a floating raft with all four sides open to the water. Having good ball control means avoiding a splashy fall into the sea. From here, it’s a just short return trip through the mangroves and back to the pier. All in all, this do-ityourself long-tail tour offers a low-key yet fun way to putter around Phang Nga Bay and take in its magnificent sights at your own pace.

Canadian Lobster Cocktail
in glass with Vanilla
1 main lobster (about 700gm) 1 tomato 1 small ripe mango 1 green Granny Smith apple Peel of 1 cucumber 1 vanilla stick from Madagascar 100 ml fresh cream 100 ml Chardonnay wine Lemongrass leaf for decoration

Cook a main Lobster of 750 gm for 10 minutes in “Court-Bouillon” (water flavoured with vegetables and aromatic herbs). Keep lobster cool in fridge. Cut cubes of tomato, cucumber peel, mango and apple. Vanilla Sauce: reduce to 50% while slowly cooking 100 ml of cream and 100 ml white wine together with one Madagascar vanilla stick.

Take a large cocktail glass and fill to a level of 2 fingers with vanilla sauce followed by one tablespoon of vegetable mix. Slice the lobster and place on top the meat of a half lobster. Use the head and claws for decoration. Serve chilled with a rich, fat dry white Bourgogne wine.

About Chef Marc De Schrijver Chef Marc, comes from Aalst in Belgium,a city and municipality on the Dender River, 19 miles northwest from Brussels. He studied at the hotel school in Brugges and started his training as a kitchen help at 15yrs old in the 2 Michelin stars restaurant “De Bellemolen”. Following this, he worked in different Michelin star kitchens all over Belgium, until finally working with Master Chef Eddie Van Maele , one of the 'Top of the Top Chefs'. Working with such a great chef changed his professional life and vision! How long have you been with Boathouse and what attracted you to the job? I started 10 months ago as Director of Sales. I was attracted to the job because it's an iconic hotel in Phuket, with a long history. I knew of the takeover and was very interested in working on the rebranding of the resort along with the new owners and management team. Where were you working before? I used to work at The Royal Phuket Yacht Club, Naiharn, as Assistant Director of Sales Where are you from? I come from Phattalung, which is where I was born and went to school. What’s unique about Boathouse? Boathouse is an iconic, long established resort property. Its unique points are its location directly on Kata Beach, its boutique size with only 38 rooms and its awardwining food and beverage facilities. The famed cuisine, awardwinning wine cellar and attentive service at Boathouse Wine & Grill are well known and now, with the impressive RE KÁ TA beach club next door, we really have a winning combination. The fact that in this day and age, everything is evolving so fast... the online world (which we're all learning about every day) makes my role a very challenging one. What is your main target market? For high season it still remains Europeans and Scandinavians, whereas in low season Australians and Asians. Marketing is obviously an important part of every business – what is your approach to marketing Boathouse to your target? We spend a lot of time researching the best marketing strategies and tactics. Online marketing is critical these days, but the most important thing is to get the marketing mix right, taking into account every type of media. What do you like most about what you do now? Doing what I do in a stunning environment right on the beach. And what do you like least…? Sometimes there is just not enough time to enjoy our excellent facilities, especially a Martini in the pool on the bean bag at RE KÁ TA. What do you see as your biggest successes to date? I have just graduated with a Masters Degree in Marketing, which will help a lot to my job and develop our business. To what extent does the current global financial mess affect your business? It does affect us, of course, but we are finding other ways to sustain our business and we're lucky to be in the middle of Asia which is a great source of business, especially for low season. Is Boathouse involved in any CSR (Corporate Social Responsibility) programmes? Yes we are and we've just joined Kata Green Club, an association trying to look at the important issues to be improved upon, such as beach cleaning, treatment of rubbish, etc. Please give us an overview of your typical day ‘at work’. What tools (if any) do you use to schedule your time? It’s hard to manage my time as, in the sales field, there is always something unexpected that pops up. But I do have to prioritise, so whilst I know when I will start work each day, I never know when I finish!!! How would you describe your leadership style? Role Model / Coaching. What is your over-riding ambition at this stage in your life? To own my own business, probably a small hotel. What started, several years ago, as a modest enterprise has blossomed into a successful operation offering over 90 oils and a wide range of body care products through many outlets, as well as supplying many of Thailand’s top resorts and spas with aromatherapy oils. “Our advantage is that we produce the freshest spa products and our stock is never kept longer than three months; using fresh spa products can be likened to eating fresh food rather than processed food.” Based on his years of experiences at some of the top spas in Southeast Asia, Bobby has developed a full line of healthy skin care products. For example, his hydrating face and body creams have

A variety of 40 spa treatments – prepared by Sukko's certified Thai Herbalist and based on ancient Thai medical theory – is offered at Sukko, in packages lasting from 2 to 4 hours. Each package has a specific purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukko’s own herb garden and picked just for your treatment, ensuring they are as fresh as can be. I was pampered with the “Be Balanced” package; a 3-hour experience that left me feeling relaxed and refreshed. This 3-treatment combination began with 30 minutes in the steam room and the Jacuzzi, followed by a Thai Turmeric Body Scrub designed to soften your skin and awaken your senses. The scrub was followed by Sukko Synergy Body Massage (see description opposite). “Is this pressure okay? Too strong? How are you feeling?” my therapist asked me from time to time. “Mmm…perfect…” were the only responses that seemed to suit how I felt. Termination Provisions in Lease Agreements
One of the major challenges for international investors in property in Thailand, as there is generally no right for foreigners to directly own land here, is how best to secure a long-term lease investment in land. Certainly, a number of elegant and complex investment structures and contractual provisions have been devised by developers, lawyers and property professionals to attempt to ensure that leases are 'protected' – particularly long term 30-year leases with contractual ‘renewal rights’. However, often overlooked are termination provisions in lease agreements which, in theory, could substantially impact the overall value and security of a lease, even where a lease has been lawfully registered at the Land Office. This article provides a brief overview of lease termination clauses as they are typically found in long-term lease agreements in Thailand. Termination Clauses – Two Types Generally, lease agreements for a long-term lease of land in Thailand contain provisions about the length of the term of a lease, the rental price, registration requirements and other matters such as lessor and lessee obligations. Many obligations are ‘ongoing,’ even past the lease registration date at the Land Office. A commonly found ‘ongoing’ clause in a lease agreement is a termination right. Simply stated, a lease termination right is a contractual provision whereby a party to the lease agreement has a right to serve a notice notifying the other party that the lease agreement has been terminated for some default or breach of contract. The default or breach could be related to failure to pay the rental amount, or another matter such as failure to pay common areas fees in a residential estate for an extended period of time. Often, the right is favourable to the lessor, and limited in scope for the lessee, as the lessee would in most cases obviously not seek to terminate a lease which he has paid for. The question legal professionals often get from investors in Thailand is, "How can my lease be terminated after I have paid for it?" A question that prudent investors should explore carefully with their advisors if they are seriously considering acquiring a long term lease to property in Thailand. It is also an important issue because a properly structured long-term leasehold of property in a residential villa development in Thailand should be as close to obtaining the freehold as possible, which is often the cited goal of elegant and complex leasehold ownership structures. A plausible argument can therefore be made that a long term lease with a lessor’s lease termination right has less commercial and re-sale value than a lease agreement without such provisions. However, this argument is often countered by developers, and even by owners in collectively managed estates, stating that termination provisions are necessary to ensure orderly conduct in the estate, and are meant only for extreme cases where a villa owner continues to be in severe breach of his duties. Notwithstanding the above, lease termination provisions should be separated into two categories before opinions are made holistically on all termination provisions: (1) Pre-registration termination and (2) Post-registration termination. Pre-Registration termination (1) relates to the period of time between the entering into the lease agreement and the time at which the lease is formally registered at the Land Office. Typically, during such time, the lessee is paying the purchase price for the villa and for the lease-term (and waiting for the villa to be constructed if the purchase is ‘off-plan’). As such, termination provisions are arguably necessary for both parties as this period is the highest risk for default by a developer-seller or by a lessee-buyer. For example, a lessee-buyer would wish to terminate a lease agreement if the developer-seller was unable to complete the construction of the villa or subsequently to properly register the lease to the lesseebuyer at the Land Office. Conversely, a developer-seller should arguably have a right to terminate a lease agreement where a lessee-buyer fails to pay the purchase price as agreed. Post-registration termination (2) refers to the period of time after the lease-term under the lease agreement has been formally registered by the parties at the Land Office. Post-registration termination rights are often lessor-only (with few exceptions) and are designed to regulate and penalize a lessee in serious breach of his lease agreement obligations. For example, a lessee could have completely abandoned the property for an extended period of time (usually more than a year) and failed to maintain and upkeep the premises and contribute to common area fees (should the villa be part of a regulated estate). In such case, termination may be a suitable and proportionate remedy for the lessor in a regulated estate with dozens of other villa owners contributing as required under the lease agreements. However, a post-registration termination clause should be carefully scrutinized by an investor because such a clause could be used improperly and could threaten the value of the investor’s purchase in the long term. To be acceptable at all, a post-registration termination clause should require extensive legal notification procedure (i.e. notices of default) and be narrowly-tailored to balance rights of the lessee, the lessor and the other lessee owners in a regulated estate. Moreover, such a clause should probably require that the lessor seek a Thai Court of Law order requiring the lease to be terminated at the Land Office, which would almost certainly be required under law anyway. Any post-termination clause that is over-broad (that is to say without proper procedure and reference for a petition) has the potential, in a number of respects, to be misused by the lessor and, in the worst cases, could be used as a harassment tool by empowered owners in a collective regulated estate. It is therefore recommended that investors be wary of such clauses and carefully review them. Summary Lease termination provisions are prevalent in lease agreements in Thailand. Such clauses should be separated into two time periods – the pre- and post-lease registration periods. Pre-registration termination is generally a necessary remedy for both lessors and lessees, as this period represents the period of highest legal risk for both parties and termination does provide a quick contractual remedy for a breached-against party. On the other hand, postregistration termination clauses should be carefully considered by investors and scrutinized for being over-broad, which can threaten the long-term value of lease. Only a narrowly-tailored post-registration termination clause, balancing the interests of the parties, should be acceptable to investors.

The best time of the year to visit Phuket for bird watching is from about the middle of October through April. At this time, many species of migratory birds will be present.
