Subject: Unfair means case framed during Screening Test for the posts of Superintendent ITI in Technical Education Department.

Whereas, the J&K Public Service Commission vide notification No. 06-PSC(DR_P) of 2013 dated: 14.03.2013 invited applications for the posts of Superintendent ITI in Technical Education Department; and Whereas, among others you also submitted your application form for the posts of Superintendent ITI in Technical Education Department; and Whereas, vide notification No. PSC/Ex-13/38 Dated: 20.05.2013, the Screening Test for the above posts was held on 06.07.2013 at Public Service Commission Office Complex, Resham Ghar Colony, Bakhshi Nagar Jammu and Amar Singh College, Gogji Bagh, Srinagar, consequently, Roll No. 3800301 was allotted to you; and Whereas, on the day of Screening Test, prior warnings were issued by the supervisors against resorting to any type of unfair means covered in J&K Public Service Commission (Conduct of Examination) Rules 2005; and Whereas, during the course of examination you were found resorting to unfair means as reported by the supervisory staff, details whereof is given as under:S.No. Name Yasir Arfat Roll No. 3800301 Date of Examination 06.07.2013 Nature of unfair means. You had incriminating material written on your Admit Card, which was seized from you during the course of examination.

Whereas the incriminating material found in your possession falls within the definition of unfair means under Rule 20 of J&K Public Service Commission (Conduct of Examination) Rules, 2005; and Whereas, you are prima facie found guilty of resorting to unfair means and are liable to punishment under Rule 25 of J&K Public Service Commission (Conduct of Examination) Rules, 2005; and Whereas the case was placed before the Controller of Examinations in terms of Rule 23 of the J&K Public Service Commission (Conduct of Examination) Rules, 2005 for consideration, who being satisfied that prima facie case of unfair means exists against you has decided to serve a show cause notice upon you, as to way action under Rule, 25 of J&K Public Service Commission (Conduct of Examination) Rules, 2005 be not taken against you; and Now, therefore, before imposing appropriate punishments under rules upon you, you are directed to Show Cause within 05 days from the date of issuance of this notice as to why action in terms of above quoted rule may not be taken against you. Failure to show cause within the stipulated time, action as warranted under rules shall follow, without any further notice. However, in case you want to appear in person to produce any evidence or record your statement, you may appear before the Secretary & Controller of Examinations, J&K Public Service Commission, Polo Ground, Srinagar on 17.07.2013 at 11:00 A.M for the purpose.
