Personal Leave Policy

Eligibility In an effort to recognize the need of Associates who may require additional time, the Company at its discretion, may consider a personal leave of absence without pay for up to a maximum of 30 days. Full time Associates who have attained 30 days of continuous service may be eligible to apply for an unpaid personal leave of absence once per rolling 12-month period. Job performance, absenteeism and departmental requirements will all be taken into consideration before a request is approved. Requests for unpaid personal leave may be denied or granted by the Company for any or no reason and are within the sole discretion of the Company. Approvals of the immediate Supervisor, department Director and Human Resources are required. Requests must be due to a compelling reason and will be considered on a case by case basis. Permissible Reasons for Leave If eligible, leave may be taken under this policy for the following reasons: Birth of the Associates or the Associates spouses child, in order to care for the newborn child. Placement of a son or daughter for adoption or foster care. When needed to care for an immediate family member (i.e., spouse, child, or parent) with a serious health condition. When unable to perform at least one of the essential functions of the Associates position because of the Associates own serious health condition. To care for a qualified ill or injured family member when deployed in military and seriously injured or made ill during deployment; or circumstances. Requesting an Unpaid Personal Leave: Associate An eligible Associate should submit an Employee Request for Leave form to their immediate Supervisor or Manager noting on the form if the personal leave is covered by FMLA.

Supervisor The immediate Supervisor will review the request, taking workload scheduling and departmental requirements into consideration and will return a decision to the Associate as soon as feasibly possible after receipt of the Employee Request for Leave form. Once the supervisor approves the request, the form must be submitted to Human Resources for further approval and payroll processing.

Returning to Work or Leave Extension: Associate An Associate is required to return from the unpaid personal leave on the originally scheduled return date. If the Associate is unable to return, he/she must request an extension of the leave in writing to Human Resources. Extensions of leave will be considered on a case-by-case basis. If Mattress Firm, Inc. does not extend the leave, the Associate must return to work on the originally scheduled date or be considered to have voluntarily resigned from his or her employment.
