Tony, as a CONSTITUTIONALIST, my primary concern is what the true meaning and application of the constitution is about. 10 For example the Framers of the Constitution stated:

What we therefore must be clear about is that the Commonwealth can only legislate for “peace, 40 order, and good government of the community” and “But that money could not be spent upon any object the Federal Parliament thought fit. ” and “The money must be expended with regard to "the peace, order, and good government of the Commonwealth," not of the states.”. As such it would be sheer and utter nonsense for anyone to argue that heaps and heaps of moneys can be spend on Indonesia for education facilities, or other issues. Nothing to do with “peace, order, and good government of the 45 community”. Likewise, if moneys cannot be spend for the good of the States then certainly neither for heaps of other countries. S96 only facilitates for loans to the States. If therefore the Commonwealth can’t give away monies to the States then certainly not to foreign countries. But the laws that can be legislated for can be only for “peace, order, and good government of the community” and as such the Iraq and Afghanistan invasions were unconstitutional without any 50 proclamation having been Gazetted by the Governor-General to declare those countries enemies.

As such we invaded “friendly” countries and as I understand it s24AA of the Crimes Act (Cth) deals with that.

Therefore, whatever may be the internal; affairs in Syria we have no business to invade this country . We have seen how in Afghanistan our soldiers risking and even losing their lives where they essentially are protecting many poppy plantages (drugs). May hold that their lives are not any better after more than 10 years of war (Iraq) or even 12 years in Afghanistan.

While much may be claimed about Syria having used chemical weapons against its own 35 population, we must never forget that much is claimed about how Australians in effect decimated much of the Aboriginal population in then past. This may not be any excuse to ignore the plight of others but let’s not be claiming high standards but, so to say, look into our own backyard first. Our lack of intelligence with our intelligence services proved with the Weapons of Mass 40 Destruction Iraq was claimed to have had. Syria has as I understood it accepted the advise of President Vladimir Puttin to allow full inspection and also retrospective allow application of chemical usage, if any. My wife gained her Russian language linguistics qualification at university some 55 years ago, and now to refresh it is reading Russian news. She alerted me to certain items, which I have 45 quoted below. I wonder if perhaps Great Britain or the U.S.A provided chemical weapons, not just to the Syrian Government but also to the Rebels and the U.S.A. wants to avoid exposure of any involvement it may have in this, if any, and so like in Iraq seek to create a big issue out of what may be totally 50 nothing. If indeed so many civilians were killed by the use of chemical weapons and it were to turn out that the U.S.A (as with Iraq) provided them then are you contemplating to have the Minister of Defence requesting the Governor-General to publish in the Gazette a DECLARATION OF WAR against the U.S.A, so you want to punish it for it culpability? I do not think so. Nor would this be constitutionally appropriate.

The first matter always to be considered whenever you or any other min ister desires something is to ask the question: “Is it permissible withion the true meaning and application of the constitution?’ Obviously yoyu do not ask a lawyer this questuion because by now you ought to be old enough to know that when there are 100 cases to be adjudicated between warring parties by a Court, where all parties are represented by their team of lawyers, then 100 team of lawyers will be found to be in the wrong and 100 teams to be found in the rights. As such a 50% chance your team of lawyers know what they are taklking about. if doctors had a 50% deasth rate in 10 operations they be called charletans! Anyhow, the following should be considerted also:

Now consider this, you have a lawyer attending g to court on your behalf, as your agent, and then 20 he obtains some legal advice of a barrister and you pay for this obviously, and then he tells you he isn’t going to tell you what that legal advice was. Now, surely you would hold that you are entitled to the legal advice you are paying for? Well, the taxpayers are paying for the legal advice the government may seek as to certain legal issues and it is a rot, very politely stated, then to tell the people they are not allowed to know 25 what the legal advice was. As long as a Government acts in the capacity of an agent for the people, and they are paying for the legal advice from Consolidated Revenue Funds, then all such legal advice should be disclosed to the public.

And, if you desire to go to war in regard of Syria, it is ultimately up to the Governor-General to decide is the Governor-General publish in the Gazette a DECLARATION OF WAR or not against the particular country you may desire to invade. Do keep in mind that not Mr John Howard but also anyone who supported him to unconstitutionally invade Afghasnistan and Iraq may still face serious criminal charges. And as you stated to govern for ALL people, then I request you to ensure a ROYAL COMMISSION investigate all matters regarding the Afghanistan and Iraq invasions. It would be totally absurd to hold ROYAL COMMISSIONS into numerous things but in regard of an unconstitutional war mongering, where we basically bombed Iraq back into the Stone Age. Perhaps your taste buds may not now like to think about warmongering in regard of Syria, as after all, we may not like chemical weapons or other kind of weapons being used in mass murder but if other countries had to invade us for wrongdoings against the Aborigines then I expect you would not approve of this! . And Indonesia reportedly now of the side of Syria, we may be very cautious about getting an armed conflict that may include Indonesia. Our past funding for education in Indonesia may be monies they saved to now educate us to not interfere in other countries domestic matters. For sure, you may desire a trade ban, and compensate companies who suffer as result, but to enter into an armed conflict for the sake of the U.S.A, to so to say “teach” Syria something, then we better first teach ourselves reality of Iraq’s Weapons of Mass Destruction that never existed, but you participated in this invasion with supporting it at the time. I am in no position to make a fact finding decision as to if the Syrian Governmenrt or the rebels used chemical weapons. I am well aware that our so called Intelligence Services were not up to standards with the Iraq WMD and as such I for one wouldn’t want to rely upon them and their

sheer incompetence proven in the past. As such, reading the articles (quoted below) it appears to me that there is currently no proven facts of Syrian Government having used chemical weapons and the inspections may very well result that the rebels actually had been using it. The U.S.A and other countries used the so called FALSE FLAG situations, where they are 5 willing to sacrifice the lives of many for their own sake. As such, if the rebels used the chemical weapons as a FALSE FLAG then fool those who fall for it. The U.S.A is notably refusing to have the Criminal Court dealing with criminal offences committed by U.S.A army and other contractors, and this may underlines it is two faced. It is alight for the U.S.A to used torture but not for anyone else. 10 It is all right for the U.S.A. to use drones to specifically kill American citizens, but not for others to do so. . As I have alluded to before we have got ample enough constitutional problem ourselves, and let first attend to this. 15 The Framers of the Constitution made the following statements as legal principles embedded in the constitution:

As such, why do we need lawyers to explain to us what the legislation is about as an y legislation within the ambit of the constitution likewise must be “which the unlettered people of the community ought to be able to understand”. Meaning, you do not really need “legal advice’ as to constitutional powers because lawyers are more then likely most unsuitable for this, as it requires a competent CONSTITUTIONALIST. 35 If an ordinary person cannot understand the legal issues of the legislation then clearly the legislation is not within the context of the constitution. Where the governing principle law, the constitution, must be “which the unlettered people of the community ought to be able to understand” then any legislation subordinate to is must likewise be so!

So instead of considering to go to war better address the issue to rewrite every law so that no longer lawyers are needed, to rightly or wrongly, explain matters. Considering the huge savings the government may make by cutting any litigation to the bone. The taxpayers will be happy as monies then can be funnelled into much more needed area’s. so instead of candidates talking about health, education, etc, as a mere token slogan for elections we 45 actually will see the results, and the benefits!

He said Syrian President Bashar al-Assad had signed the relevant decree. Russian Foreign Minister Sergei Lavrov also confirmed that Damascus had officially submitted documents regarding its accession to the OPCW. “Damascus officially submitted such documents to appropriate organisations,” Lavrov said in his opening remarks 10 ahead of his talks with U.S. Secretary of State John Kerry in Geneva. “We should think, together with experts, how to act further so that to prevent the process from becoming protracted,” Kerry said.
