Thi's'is a follow-up .letter to you‘regarding‘the Division of Corrective Actions investigation of serious injuriesassociated with water balloon sling shots. Sling'King is one of three manufacturers who since 1985 have sold these types of products, designed with tubing and pouches to launch water-filled balloons,

-At present the Commission is aware of 24 injuries from water balloon sling shots. Those incidents that were investigated showed serious injuries: 17 eye injuries that included fractured facial bones, tearing of the retina or iris or permanent loss of vision; a cardiac arrest o-f a 9 year old; and paralysis of a 13 year old hit in the neck/spine area. There is no reason to believe that these types,of injuries will not continue,. unless some action is taken,to address the serious _ hazard that exists during the use of these sling shots_

Our data includes bne report of.injury with a Sling King that occurred in Lincoln Park, MI to a "girl who was struck by aballoon shot from the water balloon launcher." Your report to Investigator Claude Tolbert indicated that'your firm had no

claims or suits involving the sling shots. We request that you immediately provide any claims or suits that you have now, and that you also provide reports of incidents or injuries that did not result in claims or suits. The Division of Corrective Actions has the responsibility to determine preliminarily whether a defect is present in a product and, if so, whether that defect rises to the level of a substantial product hazard as defined by section 15(a) of the Consumer Product Safety Act (CPSA), 15 U.S.C. 52064(a). Enclosed for your information are the Consumer Product Safety Act and the Commission's regulation entitled, "Substantial Product Hazard Reports, II16 C.F.R. Part 1115. These documents explain the Commission's authority,and policy with regard to products which may present substantial product hazards and also explain the .firm's rights and obligations under the Act to furnish information to the U;S. Consumer Product Safety Commission, While no defect exists with these sling shots, the staff has determined, based on the reported incidents, that they present a risk of injury that is serious and a risk that is Users who shoot at largely unknown.to the using public. bystanders and the bystanders themselves do not perceive that a water-filled balloon can seriously injure them. Section 6(b) (5) of the CPSA, 15 U.S.C. § 2055(b) (S), prohibits the release of such information unless a remedial action plan has been accepted in writing, a complaint has been issued or a firm consents to such release. This inspection was conducted according to programassignment dated May 16, 1995 (Kkhibit #I). The Division of Regulatory Management recently received information about the distribution of water balloons sold without the benefit of the required CSPA warning labeling. They were also advised that this firm felt that their product(s) were not subject to the CSPA. .
Specific instructions were to collect an official sampIe (3 units) of the product and after collection, distribute two units to GRM and one unit to FGW? Senior Compliance Officer. Samples of any o.ther suspect balloon products or toys intended for use by children were also requested to be- sampled. Other than CSPA suspect violations, 14 units were to be collected and distributed for compliance analysis to LSEL through the sample custodian,

Additional instructions were to obtain a copy of the firms current catalog (if available) and review' the firms complaint file to decide if the-y received any complaints regarding safety issued, The firm was inspected on May' 18, 1995 and found 'to be a manufacturer of. four types of water balloon sling shots, The balloons used in (and sold with) the product are not manufactured . by the firm. They are purchased from a vender located in the State of California, which are also sold separately in two'different sizes. While conducting the inspection and manufacturing facilities of the' firm, a total of six samples were collected for compliance testing 'and analysis. The, samples -were distributed as requested via Federal Express to CFW and FOWR-SF-. Upon reviewing the balloon packaging within the product sets, and the two sold separately, no violations were noted. .during field screening, The balloons appeared to be in compliance with.the CPSA for latex balloons, and the proper affixed labeling was attached to each package, -

Three catalogs were collected which contain the products and price list of the products (E&&it #X3). Although the firm's financial statements were not available for review, Mr. Ford said that the ye'arly gross dollar volume .of all products produced was approximately $300,000.00, which is the same amount for volume of regulated products produced. The number of volume units'sold in 19!34-is approximately 25;i)OO. Theo percentage .of'interstate sales of products was reported as 1 beling; 30% within the .st&e of Texas, 60% within-the other fifty states and territories of the United 'States and. 10% exported to either Canada or Mexico. The rubber pouches are manufactured by Rmpaques Hidraulicos Del Norte, S.A. de C.V. in Monterrey, Mexico, A COPY of an invoice of sale was obtained and attached as (Akhibit #II), The firm's latex slings are manufactured by Primeline Industries located in Akron, Ohio. The balloons are manufactured/Imported by American Imports, Inc,, located in Irvine, California. This firm is responsible for proper labeling and quality control. Copies of three invoices were obtained and submitted as (6xhibit9 #4, #5 and #6)_ The balloon packages were found to be in compliance with the CSPA during f&ld testing, and no other violations were noted,

The firm has no formal type of complaint file and reports that they haven't received any complaints, except for an environmental concern from a lady in the U.S. Virgin Islands. Reportedly, she was concerned that the balloons used on the beaches, may present a danger to fish life. Other than that, the President reports that no other type of complaints have been made, The firm also reports that no liability claims have been filed and therefore no claims have ever been paid.

The firm promotes and advertises its products through trade shows, magazines and toy shows around the United States. The area of distribution is within all 50 States of the U.S., and it's Territories, Canada and Mexico. -The method of shipment is usually in small quantities and handled mainly by United Parcel Service,

The firm reported that no costs have been expended in any type of retrofitting of it's products. The balloons used in the packaging are labeled by its supplier at no cost. Advertising costs were reported at approximately $lO,OOO.OO yearly and loss of business revenue was approximately $ZO,OOO.OO in 1990 and reduced to $lO,OOO.OO now, with approximately #300,000.00 in sales. The firm purchased two rubber molds in 1991 at the cost of $38,000.00 for both. It employees two full time epployees and one part time employee.

The testing of its balloon products is conducted by its supplier and checked for proper labeling upon arrival at the firm. There are no raw materials used .in the manufacturing process at the firm's location. Instead, the firm assembles the finished products into it's own products at the consumer level. The firm does not belong to any type of trade associations. c+-

Although no CSPA regulations were available for direct distribution to firms' regulated under this law, a copy of the FederaL Register was copied and given'to the President, Mr. Jack Ford.

On May 18, 1995, I showed my CPSC credentials and issued a Notice of.Inspection to Mr. Jack Ford, President of the firm (Exhibit #Z), Mr. Ford showed his responsibilities by accepting the Notice of Inspection and supplying all requested information. This firm, althoughnoted as amanufacturer, would be considered an assembler of already finished products. All of the materials used.. in the assembly of products are manufactured by other firms. Mr. Ford escorted me through the assembly process, which is located in the rear of the firm's small office space. It consists of an assembly table and two workers putting together already manufactured products into the firm's finished products.

Page 5 During the inspection, I observed numerous cases containing the materials used in the products assembled by the firm, including the I checked all of the boxes, along with Mr. Ford and balloons. found that all of the required labeling under the CSPA was affixed No violations were noted. on all of the balloon packages. After reviewing the firm's records and obtaining the ones required to complete this report, and obtained a background of the firm's history, '1. collected three sub-samples of all of the firms. This includes two types of balloons. it sales for products. ,replacements. These samples were sent to CRM and FOWR-SF Senior Compliance Officer via Federal Express as requested for analytical I gave Mr. Ford a receipt for samples (&Mbit #14) and. review. obtained an Affidavit (Exhibit #21) before my departure. The economic status of the firm relating to the cost of compliance with CPSC laws and regulations, labeling expenses and quality control were discussed. Mr. Ford said that these cost were covered I thanked Mr. Ford for his by his suppliers at no cost to him. cooperation,and departed the firm.
