Dear Richard: I \vrite on behalf of WMA concerning the production of WMA's tapes containing e-mail communications. To expedite WMA's production, we suggest that wc proceed as follows: 1. Consistent with Magistrate Judge Francis' January 15, 2002 Order providing that "[djefendants' counsel may object to any search proposed by plaintiff^" I have enclosed a Ust, based upon the hsl you sent us, of the search terms to wliich we do not object. As we have disctissed, before any searches arc conducted wc will need to see a list of the African American promoters and the racial slurs you intend to use as search terms. 2. The only e-mail boxes you will search are those of Peter Grosslight, Cara Lewis, Richard Rosenberg, Jeff Frasco, and Shelly Shultz. 3. As we have previously advised you, we do not consent in advance to the use by you or your experts of any additional search terms without our prior knowledge and consent. We therefore ask that you provide us with any additional terms you or your experts intend to employ in advance of their actual use. In light of the protocol estabhshed by Magistrate Judge Francis, the use of any additional search terms to which WMA has not been apprised or to which it has not consented would be in violation of this Order.

Additionally, we need you to clarify the intent of the statement in your e-mail that the search terms may require "adjustment" depending on tlie results of the searches before we can comment, As written, the proposal is not at all definitive; as a practical matter, the proposal appears to give plaintiffs the ability to alter the search terms imder the gtiise of "adjustment." We cannot agree to such an open-ended approach. Finally, some of the search terms you have included in the proposal would yield documents that would not be responsive to any of plaintiffs' document requests. Specifically, none of plaintiffs' requests calls for documents containing the terms "protests, complaints, demonstration, lawstiit, etc, w/ black, Negro, AfiicanAmerican, etc" and "Blackmail, Hold up." Richard: I am in receipt of your response to our proposal and I believe we should b > e able to agree upon a reasonable stipulation. (1) It appears you are willing to agree not to seek to delay the dispositive motion deadlines based on a need to continue or finish email discovery; (2) With respect to 56(f), as I have stated previously. CAA is not willing to jeopardize the timing of the summary judgment motions due to email discovery. We are willing to consent to your request for a 90 day extension as long as you agree not to use email discovery as a basis for a 56(f) motion. If you are not Willing to stipulate to this, we can only consent to a 45 day extension. You have had CAA's tapes for over a month at this point and we see no reason why email discovery should interfere with the dispositive motion schedule. Dear Ricliard: I have received your e-mail concerning my letter of yesterday addressing production of WMA's e-mail. We respond as follows. 1. Responsiveness Revieyv: We will not waive our right to review and withhold documents based on responsiveness. As my letter stated, we will address the issue to the Court i f it becomes necessary. Privilege: In light of your agreement that we will review the retrieved e-mail for all applicable privileges before plaintiffs and their attorneys receive them, wc will agree ttiat the experts do not need to exclude documents to, from, or concerning the attorneys or paralegals. 2. Additional Search Terms: We do not agree to an open-ended search term proposal. The Covut's protocol permits us to consent to any search term you intend to use and directs that you comply. Your experts may search only on the basis of the terms provided thus far. I f necessary, we will resolve this issue with the Court. 3. Wlien you provide me with alternative dates, we will provide those tapes to you subject to the same conditions set forth in my letter of yesterday and this letter. 4, Extension: WMA does not agree to the extension, It is our position that it is inappropriate to discuss an extension in the abstract; when we are told how long it will take to restore WMA's tapes, we can discuss an appropriate extension. We do not believe that 90 days is necessary as you have assured me on numerous occasions that your expert does not expect to encounter difficulties in restoring WMA's tapes. In any event, we are not amenable to any extertsion that will extend tlie time for dispositive motions. However, please note that the following Bates numbers were not used by EED and, therefore, do not appear on the CD: 0132 - 0135, 0146-0149, 0945-0949, 0998-1000, 1044-1054, and 1077. We have not heard from you with respect to the Macintosh e-mails. hence we have not given EED any instructions.
