The IPRED2 would turn all intentional, commercial scale infringements of all IP rights into a criminal offence. It is the first time that the European Parliament is co-legislating criminal law in the EU . Inciting an IPR Infringement will be a criminal act.Will this threaten digital rights and freedom? The " inciting clause" is similar to the Induce Act, which threatened to make MP3 players such as the iPod illegal.

The TRIPS gives governments a large amount of freedom to bypass patents on drugs if they face any kind of health crisis. The Doha Declaration allows derogation from patents for a public interest purpose affecting public health. The drug companies have always assumed that the Trips exception would only be used for a dire emergency, like HIV/Aids or avian flu. However, some governments have chosen to bypass the patents to offer drugs and issued a compulsory license. Pharmaceutical companies claim this violate the WTO Agreement. Ex. Thailand’s decision to issue what is known as a compulsory licence to manufacture low-cost versions of the HIV drug Efavirenz.
