ThisConsentAgreementisenteredintobyandbetweenPeterFragatos,M.D., [Dr. Fragatos],
andtheStateMedicalBoardofOhio[Board],astateagencychargedwithenforcingChapter
4731.,OhioRevisedCode.
Dr. FragatosentersintothisConsentAgreementbeingfully infonnedofhisrightsunderChapter
119.,OhioRevisedCode,includingtherighttorepresentationbycounselandtherighttoa
fonnal adjudicativehearingontheissuesconsideredherein.
BASISFORACTION
ThisConsentAgreementisenteredintoonthebasisofthefollowingstipulations,admissions
andunderstandings:
A. TheBoardisempoweredbySection4731.22(B),OhioRevisedCode,tolimit,
revoke,suspendacertificate,refusetoregisterorreinstateanapplicant,orreprimand
orplaceonprobationtheholderof acertificatefor violationofSection
4731.22(BX19),OhioRevisedCode,"[i]nabilitytopracticeaccordingtoacceptable
andprevailingstandardsofcarebyreasonofmentalillnessorphysicalillness,
including,butnotlimitedto,physicaldeteriorationthatadverselyaffectscognitive,
motor,orperceptiveskills;"and/orSection4731.22(B)(26),OhioRevisedCode,for
"impainnentofabilitytopracticeaccordingtoacceptableandprevailingstandardsof
carebecauseofhabitualorexcessiveuseorabuseofdrugs,alcohol,orother
substancesthatimpairabilitytopractice."
B. TheBoardentersintothisConsentAgreementinlieuoffonnal proceedingsbased
upontheviolationofSections4731.22(B)(19)and(B)(26),OhioRevisedCode,asset
forth inParagraphsEthroughH, below,andexpresslyreservestherighttoinstitute
fonnal proceedingsbaseduponanyotherviolationsofChapter4731.oftheRevised
Code,whetheroccurringbeforeoraftertheeffectivedateofthisConsentAgreement.
C. Dr. Fragatosisseekingreinstatementofhiscertificatetopracticemedicineand
surgery,licensemunber35.083165,whichwasindefinitelysuspended,butnotless
than90days,pursuanttotheStepIConsentAgreementBetweenPeterFragatos,
M.D., andtheStateMedical BoardofOhio[March2010StepIConsentAgreement],
effectiveMarch 10,20 I0,acopyof whichisattachedheretoandincorporatedherein.

D. Dr. Fragatosstatesthatheis alsolicensedtopracticemedicineandsurgeryinthe
StatesofMichigan(active),NewYork(active)andtheCommonwealthof
Pennsylvania(lapsed).
E. Dr.Fragatosadmitsthathe enteredtreatmentforAlcoholDependence,Cognitive
Inefficiencies,OccupationalProblemandBipolarDisorderatTalbottRecovery
Center[Talbott],aBoard-approvedtreatmentproviderinAtlanta,Georgia,onor
aboutDecember28,2009,andthathewasdischargedtreatmentcompletefollowing
completion of a residential progrwn on or about April 17, 20IO.
F. Dr. Fragatosstatesandthe Boardacknowledgesreceiptofinfonnationtosupportthat
hehasremainedcompliantwiththetennsofhisAftercareContractwithThe
ClevelandClinicFoundation[TheClevelandClinic],aBoard-approvedtreatment
providerinCleveland,Ohio,whichiseffectivefrom onoraboutJuly8,2010,toJuly
8,2012.
G. Dr.FragatosstatesandtheBoardacknowledgesthatGregoryCollins,M.D.,ofThe
ClevelandClinic,andChrisAdelman,M.D.,ofRosaryHallChemicalDependency
Center,St. VincentCharityHospitalandHealthCenter,aBoard-approvedtreatment
providerinCleveland,Ohio,haveprovidedwrittenreportsindicatingthatDr.
Fragatos'sabilitytopracticehasbeenassessedrelatedtohischemicaldependency
andthathehasbeenfoundcapableofpracticingmedicineandsurgeryaccordingto
acceptableandprevailingstandardsofcare,so longascertaintreatmentand
monitoringrequirementsareinplace.
Dr.FragatosstatesandtheBoardacknowledgesthatPatrickEnders,M.D.,whowas
approvedbytheBoardforthepurposeofconductionapsychiatricevaluationofDr.
Fragatospursuanttotherequirementsofparagraph 15.b.iv.oftheabove-referenced
March2010StepIConsentAgreement,providedawrittenreportindicatingthatDr.
Fragatos'sabilitytopracticehasbeenassessedrelatedtohisbipolardisorderandthat
hehasbeenfoundcapableofpracticingmedicineandsurgeryaccordingtoacceptable
andprevailingstandardsofcare,so longascertaintreatmentandmonitoring
requirementsareinplace,includingthathereceivetreatmentfrom apsychiatristat
leastmonthlyandindividualpsychotherapyatleasttwiceamonth.
Dr. FragatosstatesandtheBoardacknowledgesthatDavidPrewett,Psy. D.,whowas
approvedbytheBoardforthepurposeof conductionaneuropsychologicalevaluation
ofDr. Fragatospursuanttotherequirementsofparagraph 15.b.iv.oftheabove-
referencedMarch2010StepIConsentAgreement,providedawrittenreport
indicatingthatDr.Fragatos'sabilitytopracticehasbeenassessedrelatedtohis
cognitivestatusandthathehasbeenfoundcapableofpracticingmedicineand
surgeryaccordingtoacceptableandprevailingstandardsofcare.

Dr. FragatosstatesandtheBoardacknowledgesthatRaymondKobus,M.D.,atHand
andMicrosurgery,inColumbus,Ohio,whowasapprovedbytheBoardforthe
purposeof conductionofanassessmentofDr.Fragatosrelatedtohisprevious
condition of Dupuytren'sContracture pursuanttotherequirementsof paragraph
15.b.iv.oftheabove-referencedMarch2010StepIConsentAgreement,provideda
writtenreportindicatingthatDr. Fragatos'sabilitytopracticehasbeenassessedand
thathehasbeenfoundcapableofpracticingmedicineandsurgeryaccordingto
acceptableandprevailingstandardsofcare.
H. Dr. FragatosstatesandtheBoardacknowledgesreceiptofinformationtosupportthat
Dr. Fragatoshasfulfilled theconditionsforreinstatementofhiscertificatetopractice
medicineandsurgeryintheStateofOhio,asestablishedintheabove-referenced
March2010StepIConsentAgreementbetweenDr. FragatosandtheBoard.
AGREED CONDITIONS
Wherefore,inconsiderationoftheforegoingandmutualpromiseshereinaftersetforth, andin
lieuof anyformalproceedingsatthistime,thecertificateofDr. Fragatostopracticemedicine
andsurgeryinthe StateofOhioshallbeREINSTATED,andDr. Fragatosknowinglyand
voluntarilyagreeswiththeBoardtothefollowingPROBATIONARYterms,conditionsand
limitations:
I. Dr. Fragatosshallobeyallfederal, state,andlocal laws,andallrulesgoverningthe
practiceofmedicineinOhio.
2. Dr. FragatosshallsubmitquarterlydeclarationsunderpenaltyofBoarddisciplinary
actionand/orcriminalprosecution,statingwhethertherehasbeencompliancewithall
theconditionsofthisConsentAgreement. Thefirstquarterlydeclarationmustbe
receivedintheBoard'sofficesonthedatehisquarterlydeclarationwouldhavebeen
duepursuanttohisMarch2010ConsentAgreementwiththeBoard,orasotherwise
requestedbytheBoard. Subsequentquarterlydeclarationsmustbereceivedinthe
Board'sofficesonorbeforethefirstdayof everythirdmonth.
3. Dr. Fragatosshallappearinpersonforaninterviewbeforethefull Boardorits
designatedrepresentative. Thefirst suchappearanceshalltakeplaceonthedatehis
appearancewouldhavebeenscheduledpursuanttohisMarch2010StepIConsent
AgreementwiththeBoard. Subsequentpersonalappearancesmustoccureverythree
monthsthereafter,and/orasotherwiserequestedbytheBoard. If anappearanceis
missedorisrescheduledforanyreason,ensuingappearancesshallbescheduled
basedontheappearancedateasoriginallyscheduled.
4. Dr. FragatosshallobtainpermissionfromtheBoardfordeparturesorabsencesfrom
Ohio. Suchperiodsof absenceshallnotreducetheprobationaryterm,unless
otherwisedeterminedbymotionoftheBoardforabsencesofthreemonthsorlonger,

orbytheSecretaryortheSupervisingMemberoftheBoardforabsencesoflessthan
threemonths,ininstanceswheretheBoardcanbeassuredthatprobationary
monitoringisotherwisebeingperformed. Further,theSecretaryandSupervising
Memberof theBoardshallhavethediscretiontogranta waiverof partorallof the
probationarytennssetforthinthisConsentAgreementforoccasionalperiodsof
absenceoffourteendaysorless. IntheeventthatDr. Fragatosresidesand/oris
employedatalocationthatiswithinfiftymilesof thegeographicborderof Ohioand
anyof itscontiguousstates,Dr. FragatosmaytravelbetweenOhioandthat
contiguousstatewithoutseekingpriorapprovalof theSecretaryorSupervising
MemberprovidedthatDr. Fragatosisabletootherwisemaintainfull compliancewith
allothertenns,conditionsandlimitationssetforth inthisConsentAgreement.
5. IntheeventDr. FragatosisfoundbytheSecretaryof theBoardtohavefailedto
complywithanyprovisionof thisConsentAgreement,andisso notifiedof that
deficiencyinwriting,suchperiod(s)of noncompliancewillnotapplytothereduction
of theprobationaryperiodunderthisConsentAgreement.
MONITORINGOFREHABILITATIONANDTREATMENT
DrugAssociatedRestrictions
6. Dr. Fragatosshallkeepalogof allcontrolledsubstancesprescribed. Suchlogshall
besubmitted,inthefonnatapprovedbytheBoard,onthedateuponwhich
Dr. Fragatos'squarterlydeclarationisdue,orasotherwisedirectedbytheBoard.
Further,Dr. Fragatosshallmakehispatientrecordswithregardtosuchprescribing
availableforreviewbyanagentoftheBoardimmediatelyuponrequest.
7. Dr. Fragatosshallnot,withoutpriorBoardapproval,administer,personallyfurnish.
orpossess(exceptasallowedunderParagraph8 below)anycontrolledsubstancesas
definedbystateorfederal law. IntheeventthattheBoardagreesatafuturedateto
modifythisConsentAgreementtoallowDr. Fragatostoadministerorpersonally
furnishcontrolledsubstances,Dr. Fragatosshallkeepalogofallcontrolled
substancesprescribed,administeredorpersonallyfurnished. Suchlogshallbe
submittedinthefonnatapprovedbytheBoardandshallbesubmittedtotheBoardno
laterthanthedateuponwhichDr. Fragatos'squarterlydeclarationisdue,oras
otherwisedirectedbytheBoard. Further,Dr. Fragatosshallmakehispatientrecords
withregardtosuchprescribing,administering,orpersonallyfurnishingavailablefor
reviewbyanagentof theBoardimmediatelyuponrequest.
Sobriety
8. Dr. Fragatosshallabstaincompletelyfromthepersonaluseorpersonalpossessionof
drugs,exceptthoseprescribed,dispensedoradministeredtohimbyanotherso
authorized by law who has full knowledgeof Dr. Fragatos's historyofchemical

dependencyandpsychiatrichistory. Further,intheeventthatDr. Fragatosisso
prescribed,dispensedoradministeredanycontrolledsubstance,carisoprodol,or
trarnadol, Dr. FragatosshallnotifytheBoardinwritingwithinsevendays,providing
the Board with theidentityof the prescriber;the nameof the drug Dr. Fragatos
received;themedicalpurposeforwhichhereceivedsaiddrug;thedatesuchdrugwas
initiallyreceived;andthedosage,amount,numberofrefills,anddirectionsforuse.
Further,withinthirtydaysof thedatesaiddrugissoprescribed,dispensed,or
administeredtohim,Dr. FragatosshallprovidetheBoardwitheitheracopyof the
writtenprescriptionorotherwrittenverificationfromtheprescriber,includingthe
dosage,amount,numberofrefills,anddirectionsforuse.
9. Dr. Fragatosshallabstaincompletelyfromtheuse of alcohol.
DrugandAlcoholScreensIDrugTestingFacilityandCollectionSite
10. Dr.Fragatosshallsubmittorandomurinescreeningsfordrugsandalcohol atleast
twotimespermonth,orasotherwisedirectedbytheBoard. Dr.Fragatosshallensure
thatallscreeningreportsareforwardeddirectlytotheBoardonaquarterlybasis. The
drugtestingpanelutilizedmustbeacceptabletothe Secretaryof theBoard,andshall
includeDr. Fragatos'sdrug(s)ofchoice.
Dr. Fragatosshallabstainfromtheuseofanysubstanceandtheconsumptionof
poppyseedsoranyotherfood orliquidthatmayproducealowlevelpositiveresultin
atoxicologyscreen. Dr.Fragatosacknowledgesthatheunderstandsthatthe
consumptionoruseofsuchsubstances,includingbutnotlimitedtosubstancessuch
asmouthwashorhandcleaninggel, maycauseapositivedrugscreenthatmaynotbe
abletobedifferentiatedfrom intentionalingestion,andthereforesuchconsumptionor
useisprohibitedunderthisConsentAgreement.
AllsuchurinescreeningsfordrugsandalcoholshallbeconductedthroughaBoard-
approveddrugtestingfacilityandcollectionsitepursuanttotheglobalcontract
betweensaidfacilityandtheBoard,thatprovidesfortheBoardto maintainultimate
controlovertheurinescreeningprocessandtopreservetheconfidentialityof all
positivescreeningresultsinaccordancewithSection4731.22(F)(5),OhioRevised
Code,andthescreeningprocessshallrequireadailycall-inprocedure. Further, inthe
eventthattheBoardexercisesitsdiscretion,asprovidedinParagraph 11 below,to
approveurinescreeningstobeconductedatanalternativedrugtestingfacilityand/or
collectionsiteorasupervisingphysician,suchapprovalshallbeexpresslycontingent
upontheBoardretainingultimatecontrolovertheurinescreeningprocessina
mannerthatpreservestheaforementionedconfidentialityofallpositivescreening
results.
Dr. Fragatosshallsubmit,athisexpenseandonthedayselected,urinespecimensfor
drugand/oralcoholanalysis. All specimenssubmittedbyDr. Fragatosshallbe

negative, except for those substances prescribed, administered, or dispensed to him in
confonnance with the tenns, conditions and limitations set forth in this Consent
Agreement. Refusal to submit such specimen, or failure to submit such specimen on
the day he is selected or in such manner as the Board may request, shall constitute a
violation of this Consent Agreement.
Further, within thirty days of the effective date of this Consent Agreement, Dr.
Fragatos shall enter into the necessary financial and/or contractual arrangements with
the Board-approved drug testing facility and/or collection site in order to facilitate the
urine screening process in the manner required by this Consent Agreement. Further,
Dr. Fragatos shall promptly provide to the Board written docwnentation of
completion of such arrangements, including a copy of any contract entered into
between Dr. Fragatos and the Board-approved drug testing facility and/or collection
site. Dr. Fragatos's failure to timely complete such arrangements, or failure to timely
provide written docwnentation to the Board of completion of such arrangements, shall
constitute a violation of this Consent Agreement. However, Dr. Fragatos and the
Board further agree that in the event Dr. Fragatos previously entered into the
aforementioned fmancial and contractual agreements pursuant to the requirements of
a prior consent agreement with the Board under which Dr. Fragatos is currently
participating in an ongoing urine screening process, then this requirement shall be
waived under the instant consent agreement.
Dr. Fragatos shall ensure that the urine screening process perfonned through the
Board-approVed drug testing facility and/or collection site requires a daily call-in
procedure; that the urine specimens are obtained on a random basis; and that the
giving of the specimen is witnessed by a reliable person. In addition, Dr. Fragatos
and the Board-approved drug testing facility and collection site shall assure that
appropriate control over the specimen is maintained and shall immediately infonn the
Board of any positive screening results.
Dr. Fragatos shall ensure that the Board-approved drug testing facility and/or
collection site provides quarterly reports to the Board, in a fonnat acceptable to the
Board, verifying whether all urine screens have been conducted in compliance with
this Consent Agreement, and whether all urine screens have been negative.
In the event that the Board-approved drug testing facility and/or collection site
becomes unable or unwilling to serve as required by this Consent Agreement, Dr.
Fragatos must immediately notify the Board in writing, and make arrangements
acceptable to the Board pursuant to Paragraph II below, as soon as practicable. Dr.
Fragatos shall further ensure that the Board-approved drug testing facility and/or
collection site also notifies the Board directly of its inability to continue to serve and
the reasons therefore.

Dr. FragatosacknowledgesthattheBoardexpresslyreservestherighttowithdrawits
approvalofanydrugtestingfacilityand/orcollectionsiteintheeventthatthe
SecretaryandSupervisingMemberoftheBoarddeterminethatthedrugtesting
facilityand/orcollectionsitehas demonstratedalackofcooperationinproviding
informationtotheBoardorforanyotherreason.
11. Dr. Fragatosandthe BoardagreethatitistheintentofthisConsentAgreementthat
Dr. FragatosshallsubmithisurinespecimenstotheBoard-approveddrugtesting
facilityandcollectionsitechosenbytheBoard. However,intheeventthatutilizing
saidBoard-approveddrugtestingfacilityand/orcollectionsitecreatesan
extraordinaryhardshipuponDr.Fragatos,asdeterminedinthesolediscretionofthe
Board,thensubjecttothefollowingrequirements,theBoardmayapproveanalternate
drugtestingfacilityand/orcollectionsite,orasupervisingphysician,tofacilitatethe
urinescreeningprocessforDr. Fragatos:
a. WithinthirtydaysofthedateuponwhichDr. FragatosisnotifiedoftheBoard's
determinationthatutilizingtheBoard-approveddrugtestingfacilityand/or
collectionsiteconstitutesanextraordinaryhardshipuponDr. Fragatos,heshall
submittotheBoardinwritingforitspriorapprovaltheidentityof eitheran
alternatedrugtestingfacilityandcollectionsite,orthenameofaproposed
supervisingphysician,towhomDr. Fragatosshallsubmittherequiredurine
specimens. In approvingafacility, entity,oranindividualto serveinthis
capacity,theBoardwillgivepreferencetoafacilitylocatednearDr. Fragatos's
residenceoremploymentlocation,ortoaphysicianwhopracticesinthesame
localeasDr. Fragatos. Dr. Fragatosshallensurethattheurinescreeningprocess
performedthroughthealternatedrugtestingfacilityand/orcollectionsite,or
throughthesupervisingphysician,requiresadailycall-inprocedure;thatthe
urinespecimensareobtainedonarandombasis;andthatthegivingofthe
specimeniswitnessedbyareliableperson. In addition,Dr. Fragatos
acknowledgesthatthealternatedrugtestingfacilityandcollectionsite,orthe
supervisingphysician,shallassurethatappropriatecontroloverthespecimenis
maintainedandshallimmediatelyinformtheBoardof anypositivescreening
results.
b. Dr. Fragatosshallensurethatthealternatedrugtestingfacilityand/orcollection
site,orthesupervisingphysician,providesquarterlyreportstotheBoard,ina
formatacceptabletotheBoard,verifyingwhetherallurinescreenshavebeen
conductedincompliancewiththisConsentAgreement,andwhetherall urine
screenshavebeennegative.
c. In theeventthatthedesignatedalternatedrugtestingfacilityand/orcollection
site,orthesupervisingphysician,becomesunableorunwillingtososerve,Dr.
FragatosmustimmediatelynotifytheBoardinwriting. Dr. Fragatosshall
furtherensurethatthepreviouslydesignatedalternatedrugtestingfacilityand

collectionsite,orthesupervisingphysician,alsonotifiestheBoarddirectlyof
the inabilitytocontinuetoserveandthereasonstherefore. Further,inorderto
ensurethattherewillbenointerruptioninhisurinescreeningprocess,uponthe
previouslyapprovedalternatedrugtestingfacility,collectionsite,orsupervising
physicianbecomingunabletoserve,Dr. Fragatosshallimmediatelycommence
urinescreeningattheBoard-approveddrugtestingfacilityandcollectionsite
chosenbytheBoard,untilsuchtime,if any,thattheBoardapprovesa
subsequentalternatedrugtestingfacility,collectionsite,orsupervising
physician,ifrequestedbyDr. Fragatos.
d. TheBoardexpresslyreservestherighttodisapproveanyentityorfacility
proposedtoserveasDr.Fragatos'sdesignatedalternatedrugtestingfacility
and/orcollectionsite,oranypersonproposedtoserveashissupervising
physician,ortowithdrawapprovalof anyentity,facilityorpersonpreviously
approvedtososerveintheeventthattheSecretaryand SupervisingMemberof
theBoarddeterminethatanysuchentity,facilityorpersonhasdemonstrateda
lackofcooperationinprovidinginfonnationtotheBoardorforanyother
reason.
e. In theeventthattheBoardapprovedanalternatedrugtestingfacilityand/or
collectionsite,orasupervisingphysician,pursuanttotheMarch2010StepI
ConsentAgreementbetweenDr. FragatosandtheBoard,Dr. Fragatosandthe
Boardagreethattheentity,facilityorpersonpreviouslyapprovedbytheBoard
to soservepursuanttotheMarch20I 0StepIConsentAgreementis hereby
approvedtocontinueasDr.Fragatos'sdesignatedalternatedrugtestingfacility
andcollectionsiteorashissupervisingphysicianunderthisConsent
Agreement.
12. AllscreeningreportsrequiredunderthisConsentAgreementfromtheBoard-
approveddrugtestingfacilityand/orcollectionsite,orfromthealternatedrugtesting
facilityand/orcollectionsiteorsupervisingphysician,mustbereceivedinthe
Board'sofficesno laterthantheduedateforDr. Fragatos'squarterlydeclaration. It
isDr. Fragatos'sresponsibilitytoensurethatreportsaretimelysubmitted.
13. TheBoardretainstherighttorequire,andDr. Fragatosagreestosubmit,blood,urine,
breath,salivaand/orhairspecimensforscreeningfordrugsandalcohol,foranalysis
of therapeuticlevelsof medicationsthatmaybeprescribedforDr. Fragatos,orfor
anyotherpurpose,atDr. Fragatos'sexpenseupontheBoard'srequestandwithout
priornotice. Dr. Fragatos'srefusaltosubmitaspecimenuponrequestof theBoard
shallresultinaminimwnof oneyearof actuallicensesuspension. Further,the
collection of such specimens shall be witnessed by a representativeof theBoard,or
anotherpersonacceptabletotheSecretaryorSupervisingMemberof theBoard.

14. Withinthirtydaysoftheeffectivedateof thisConsentAgreement,Dr.Fragatosshall
submittotheBoardforitspriorapprovalthenameandqualificationsofapsychiatrist
ofhischoice. UponapprovalbytheBoard,Dr.Fragatosshallundergoandcontinue
psychiatrictreatmentatleastmonthly,coupledwithindividualpsychotherapy,atleast
onceeverytwoweeks,orasotherwisedirectedbytheBoard. Dr.Fragatosshall
complywithhispsychiatrictreatmentplan,includingtakingmedicationsas
prescribedand/orordered. Dr. Fragatosshallensurethatpsychiatricreportsare
forwarded byhistreatingpsychiatristtothe Boardonaquarterlybasis,oras
otherwisedirectedbytheBoard. Thepsychiatricreportsshallcontaininformation
describingDr. Fragatos'scurrenttreatmentplanandanychangesthathavebeenmade

responsibilitytoensurethatquarterlyreportsarereceivedintheBoard'sofficesno
laterthantheduedateforDr. Fragatos'squarterlydeclaration.
Thepsychotherapyrequiredaspartof Dr. Fragatos'spsychiatrictreatmentpursuantto
thisparagraphmaybedelegatedbyDr.Fragatos'streatingpsychiatristtoan
appropriatelylicensedmentalhealthprofessionalapprovedin advancebytheBoard,
solongasDr. Fragatos'streatingpsychiatristoversees/supervisessuch
psychotherapy; includesinformationconcerningDr. Fragatos'sparticipationand
progressinpsychotherapyinhisorherquarterlyreports;andcontinuestomeet
personallywithDr. Fragatosatleastonceeverymonth. Shouldthepsychotherapy
requiredpursuanttothisprovisionbedelegatedtoalicensedmentalhealth
professional,Dr. Fragatosshallensurethatpsychotherapyreportsareforwardedby
hislhertreatinglicensedmentalhealthprofessionaltotheBoardonaquarterlybasis,
orasotherwisedirectedbytheBoard. Thepsychotherapyreportsshallcontain
informationdescribingDr.Fragatos'scurrenttreatmentplanandanychangesthat
havebeenmadetothetreatmentplansincethepriorreport;Dr. Fragatos's
compliancewithhistreatmentplan; Dr. Fragatos'smentalstatus;Dr.Fragatos's
progressintreatment;andresultsof anylaboratorystudiesthathavebeenconducted
sincethepriorreport. Dr. Fragatosshallensurethathistreatinglicensedmental

serveasDr.Fragatos'sdesignatedtreatingpsychiatristorlicensedmentalhealth
professional,intheeventthattheSecretaryandSupervisingMemberofthe
Boarddeterminethatanysuchpsychiatristorlicensedmentalhealth
professionalhasdemonstratedalackofcooperationinprovidinginformationto
theBoardorforanyotherreason.
MonitoringPhysician
15. Beforeengaginginanymedicalpractice,Dr. FragatosshallsubmittotheBoardin
writingthenameandcurriculwnvitaeof amonitoringphysicianforpriorwritten
approvalbytheSecretaryorSupervisingMemberof theBoard. In approvingan
individualtoserveinthiscapacity,theSecretaryandSupervisingMemberwillgive
preferencetoaphysicianwhopracticesinthesamelocaleasDr. Fragatosandwhois
engagedinthesameorsimilarpracticespecialty.
ThemonitoringphysicianshallmonitorDr. Fragatosandhismedicalpractice,and
shallreviewDr.Fragatos'spatientcharts. Thechartreviewmaybedoneonarandom
basis,withthefrequencyandnwnberof chartsreviewedto bedeterminedbythe
Board.
Further,themonitoringphysicianshallprovidetheBoardwithreportsonthe
monitoringofDr.Fragatosandhismedicalpractice,andonthereviewof
Dr. Fragatos'spatientcharts. Dr. Fragatosshallensurethatthereportsareforwarded
totheBoardonaquarterlybasisandarereceivedintheBoard'sofficesnolaterthan
theduedateforDr. Fragatos'squarterlydeclaration.
In theeventthatthedesignatedmonitoringphysicianbecomesunableorunwillingto
serveinthiscapacity,Dr. FragatosmustimmediatelysonotifYtheBoardinwriting.

Inaddition,Dr. FragatosshallmakearrangementsacceptabletotheBoardforanother

Board. Furthermore,Dr.Fragatosshallensurethatthepreviouslydesignated
monitoringphysicianalsonotifiestheBoarddirectlyof hisorherinabilitytocontinue

TheBoardexpresslyreservestherighttodisapproveanypersonproposedto
serveasDr. Fragatos'sdesignatedmonitoringphysician,ortowithdraw
approvalofanypersonpreviouslyapprovedtoserveasDr. Fragatos's
designatedmonitoringphysician,intheeventthattheSecretaryandSupervising
Memberof theBoarddeterminethatanysuchmonitoringphysicianhas
demonstrateda lackof cooperationinprovidinginformationtotheBoardorfor
anyotherreason.
RehabilitationProgram
16. Dr. Fragatosshallmaintainparticipationinanalcoholanddrugrehabilitation
program,suchasAA,N.A,C.A,orCaduceus,nolessthanthreetimesperweek.
SubstitutionofanyotherspecificprogrammustreceivepriorBoardapproval.
Dr.Fragatosshallsubmitacceptabledocumentaryevidenceof continuingcompliance
withthisprogram,includingsubmissiontotheBoardofmeetingattendancelogs,
whichmustbereceivedintheBoard'sofficesnolaterthantheduedatefor
Dr.Fragatos'squarterlydeclarations.
Aftercare
17. Dr. Fragatosshallcontactanappropriateimpairedphysicianscommittee,approvedby
theBoard,toarrangeforassistanceinrecoveryoraftercare.
18. Dr. Fragatosshallmaintaincontinuedcompliancewiththetermsof theaftercare
contractenteredintowithaBoard-approvedtreatmentprovider,providedthat,where
termsof theaftercarecontractconflictwithtermsof thisConsentAgreement,the
termsofthisConsentAgreementshall control.
Releases
19. Dr.Fragatosshallprovideauthorization,throughappropriatewrittenconsentforms,
fordisclosureofevaluativereports,summaries,andrecords,of whatevernature,by
anyandallpartiesthatprovidetreatmentorevaluationforDr.Fragatos'schemical
dependency,psychiatriccondition,cognitivefunction,Dupuytren'sContracture,
and/oranyrelatedconditions,orforpurposesofcomplyingwiththisConsent
Agreement,whethersuchtreatmentorevaluationoccurredbeforeorafterthe

effectivedateofthisConsentAgreement. Totheextentpennittedbylaw,theabove-
mentionedevaluativereports,summaries,and recordsareconsideredmedicalrecords

pursuanttostatute. Dr. Fragatosfurtheragreesto providethe Boardwrittenconsent
permittinganytreatmentproviderfrom whomheobtainstreatmentto notifythe
Boardintheeventhefailstoagreetoorcomplywithanytreatmentplan,treatment
contractoraftercarecontract. Failuretoprovidesuchconsent,orrevocationof such
consent,shallconstituteaviolationofthisConsentAgreement.
RequiredReportingbyLicensee
20. WithinthirtydaysoftheeffectivedateofthisConsentAgreement,Dr.Fragatosshall
provideacopyofthisConsentAgreementtoallemployersorentitieswithwhichhe
isundercontracttoprovidehealthcareservices(includingbutnotlimitedtothird
partypayors)orisreceivingtraining,andtheChief of Staff ateachhospitalwherehe
hasprivilegesorappointments. Further,Dr. Fragatosshallpromptlyprovideacopy
ofthisConsentAgreementtoallemployersorentitieswithwhichhecontractsto
providehealthcareservices,orappliesfororreceivestraining,andtheChiefofStaff
ateachhospitalwhereheappliesfororobtainsprivilegesorappointments. Inthe
eventthatDr.Fragatosprovidesanyhealthcareservicesorhealthcaredirectionor
medical oversightto anyemergencymedicalservicesorganizationoremergency
medicalservicesprovider,withinthirtydaysoftheeffectivedateofthisConsent
AgreementDr. FragatosshallprovideacopyofthisConsentAgreementtotheOhio
DepartmentofPublicSafety,Divisionof EmergencyMedical Services. Further,Dr.
FragatosshallprovidetheBoardwithoneofthefollowingdocumentsasproofof
eachrequired notificationwithinthirtydaysof thedateof eachsuchnotification: (I)
thereturnreceiptof certifiedmailwithinthirtydaysofreceivingthatreturnreceipt,
(2)anacknowledgementofdeliverybearingthe original inksignatureofthepersonto
whomacopyoftheConsentAgreementwashanddelivered,(3)theoriginal
facsimile-generated reportcontinuingsuccessfultransmissionofacopyofthe

21. WithinthirtydaysoftheeffectivedateofthisConsentAgreement,Dr. Fragatosshall
provideacopyofthisConsentAgreementtotheproperlicensingauthorityofany
stateorjurisdictioninwhichhecurrentlyholdsany professionallicense,as wellas
anyfederal agencyorentity,includingbutnotlimitedto theDrugEnforcement
Agency,throughwhichhecurrentlyholdsanylicenseorcertificate. Dr.Fragatos
furtheragreestoprovideacopyofthisConsentAgreementattimeofapplicationto

Contracture,and/oranyrelatedconditons. Further, Dr. Fragatosshallprovidethe

withinthirtydaysof thedateofeachsuchnotification: (1)thereturnreceiptof

23. Dr. FragatosshallnotifytheBoardinwritingof anychangeofprincipalpractice
addressorresidenceaddresswithinthirtydaysof suchchange.
FAILURETOCOMPLY
If, inthediscretionof theSecretaryandSupervisingMemberof theBoard,Dr. Fragatosappears
tohaveviolatedorbreachedanytermorconditionofthisConsentAgreement,theBoard
reservestherightto instituteformaldisciplinaryproceedingsforanyandallpossibleviolations
orbreaches,including,butnotlimitedto,allegedviolationsof thelawsofOhiooccurringbefore
theeffectivedateofthisConsentAgreement.
If the SecretaryandSupervisingMemberof theBoarddeterminethatthereisclearand
convincingevidencethatDr. Fragatoshasviolatedanyterm,conditionorlimitationof this
ConsentAgreement,Dr. Fragatosagreesthattheviolation,asalleged,alsoconstitutesclearand
convincingevidencethathiscontinuedpracticepresentsadangerof immediateandseriousharm

to the public for purposes of initiating a summary suspension pursuant to Section 4731.22(G),
Ohio Revised Code.
DURATIONIMODIFICATION OF TERMS
Dr. Fragatos shall not request tennination of this Consent Agreement for a minimum of five
years. In addition, Dr. Fragatos shall not request modification to the probationary tenns,
limitations, and conditions contained herein for at least one year, except that Dr. Fragatos may
make such request with the mutual approval and joint recommendation of the Secretary and
Supervising Member. Otherwise, the above-described tenns, limitations and conditions may be
amended or tenninated in writing at any time upon the agreement of both parties.
In the event that the Board initiates future fonnal proceedings against Dr. Fragatos, including but
not limited to issuance of a Notice of Opportunity for Hearing, this Consent Agreement shall
continue in full force and effect until such time that it is superseded by ratification by the Board
of a subsequent Consent Agreement or issuance by the Board of a final Board Order.
In the event that any tenn, limitation, or condition contained in this Consent Agreement is
detennined to be invalid by a court of competent jurisdiction, Dr. Fragatos and the Board agree
that all other tenns, limitations, and conditions contained in this Consent Agreement shall be
unaffected.
ACKNOWLEDGMENTSILIABILITY RELEASE
Dr. Fragatos acknowledges that he has had an opportunity to ask questions concerning the tenns
of this Consent Agreement and that all questions asked have been answered in a satisfactory
manner.
Any action initiated by the Board based on alleged violations of this Consent Agreement shall
comply with the Administrative Procedure Act, Chapter 119., Ohio Revised Code.
Dr. Fragatos hereby releases the Board, its members, employees, agents, officers and
representatives jointly and severally from any and all liability arising from the within matter.
This Consent Agreement shall be considered a public record as that tenn is used in Section
149.43, Ohio Revised Code. Further, this infonnation may be reported to appropriate
organizations, data banks and governmental bodies. Dr. Fragatos acknowledges that his social
security number will be used if this infonnation is so reported and agrees to provide his social
security number to the Board for such purposes.

E. Dr.Fragatos admits thathepreviouslyenteredintoaConsent Agreement BetweenPeter
Fragatos,M.D., andtheStateMedical BoardofOhio,effective August 15,2003,related
tohishistory ofchemical dependency,hisdiagnosis ofbipolardisorder, hisfailureto
disclose certaininformationinhisinitialapplicationforlicensure, hisdiagnosisof
Dupuytren'sContracture,andevaluation relatedtohiscognitive status. Dr.Fragatos
admitsthatherequestedreleasefromthetermsoftheAugust 15,2003Consent
Agreement; andbyvote,theBoardgrantedhimrelease, effective August 13,2008.
F. Dr.Fragatos admits that inoraboutDecember2008,herelapsed onalcohol,butdidnot
self-reporttotheBoard asrequireduntilonoraboutJanuary 8,2010. Dr.Fragatos
furtheradmits that inoraboutJanuary2009,hewasinvolved inasinglecaraccident
wherehesufferedathoracicfractureandconcussion, andsubsequentlyreceived
rehabilitationandtreatmentfortheseinjuriesfortwomonths, althoughhedidnot
receive anyformaltreatmentrelatedtohisrelapse. Dr.Fragatos furtheradmitsthat
duringthistreatmentforhisinjuries, heintermittently ceased consuming alcohol,butin
oraboutSeptember2009,heresumedconsumingalcohol onafrequentbasis,
specifically Vodkawithincreased tolerance. Dr.Fragatosfurtheradmitsthatinorabout
December2009, hisfamily,friendsandanAAsponsor intervenedbasedonhishealth
andconsumptionofalcohol. Dr.Fragatosfurtheradmitsthat asaconsequence, he
enteredTalbottRecovery Center,aBoard-approvedtreatmentprovider inAtlanta,
Georgia,andheremains intreatment atthiscentertodate. Dr.Fragatosfurtheradmits
thathisinitial diagnosesincludeAlcohol Dependence, Cognitive Inefficiencies,
OccupationalProblem andBipolarDisorder.
Dr.Fragatos statesthathehasnotbeenengagedintheactive practiceofmedicine and
surgerysinceonoraboutJanuary22,2009.
AGREED CONDITIONS
Wherefore, inconsiderationoftheforegoingandmutualpromises hereinaftersetforth,andinlieu
ofanyformalproceedingsatthistime,Dr.Fragatosknowingly andvoluntarilyagreeswiththe
Boardtothefollowing terms, conditionsandlimitations:

authorizedby lawwhohas full knowledgeof Dr.Fragatos' historyof chemical
dependencyand psychiatriccondition. Further,inthe eventthatDr. Fragatosisso
prescribed,dispensedoradministeredanycontrolledsubstance,carisoprodol,or
tramadol,Dr. Fragatosshall notifythe Boardinwritingwithinsevendays, providingthe
Boardwith the identityofthe prescriber;the nameof the drugDr. Fragatosreceived;the
medicalpurposefor whichhe receivedsaiddrug; thedatesuchdrugwas initially
received; and the dosage,amount,numberof refills,and directionsfor use. Further,
withinthirtydaysof the datesaiddrugissoprescribed,dispensed,oradministeredto
him, Dr. FragatosshallprovidetheBoardwith eitheracopyofthe writtenprescription
or otherwrittenverificationfrom theprescriber,includingthe dosage,amount,number
ofrefills,and directionsforuse.
4. Dr. Fragatosshallabstaincompletelyfrom the use of alcohol.

Secretaryor the SupervisingMemberof the Boardforabsencesoflessthan three
months,in instanceswherethe Boardcan beassuredthatprobationarymonitoringis
otherwisebeingperformed. Further,the Secretaryand SupervisingMemberofthe Board
shallhavethe discretionto grantawaiverof partor all of the monitoringtermsset forth
inthisConsentAgreementfor occasionalperiodsofabsenceof fourteendaysorless. In
the eventthatDr. Fragatosresidesand/orisemployedatalocationthatiswithinfifty
milesof the geographicborderof Ohioand anyof its contiguousstates,Dr. Fragatosmay
travelbetweenOhioandthatcontiguousstatewithoutseekingpriorapprovalof the
Secretaryor SupervisingMemberprovidedthatDr. Fragatosis able to otherwise
maintainfull compliancewithallotherterms,conditionsand limitationssetforth inthis
ConsentAgreement.
Releases:QuarterlyDeclarationsand Appearances
6. Dr. Fragatosshall provideauthorization,throughappropriatewrittenconsentforms, for
disclosureof evaluativereports,summaries,and records,ofwhatevernature,byany and
allpartiesthatprovidetreatmentorevaluationfor Dr. Fragatos'chemicaldependency
and psychiatricconditionorrelatedconditions,orforpurposesofcomplyingwiththis
ConsentAgreement,whethersuch treatmentorevaluationoccurredbeforeorafter the
effectivedateof thisConsentAgreement. Tothe extentpermittedbylaw, the above-

mentionedevaluativereports,summaries,and recordsareconsideredmedicalrecordsfor
purposesofSection149.43 ofthe Ohio RevisedCodeand are confidentialpursuantto
statute. Dr. Fragatosfurtheragreesto providethe Boardwrittenconsentpermittingany
treatmentproviderfrom whomheobtainstreatmentto notifythe Boardintheeventhe
fails toagreeto orcomplywithanytreatmentcontractor aftercarecontract. Failureto
providesuchconsent,or revocationofsuchconsent,shallconstituteaviolationofthis
ConsentAgreement.
7. Dr. Fragatosshall submitquarterlydeclarationsunderpenaltyofBoarddisciplinary
actionand/orcriminalprosecution,statingwhetherthere has beencompliancewithall
theconditionsofthis ConsentAgreement. The first quarterlydeclarationmustbe
receivedin the Board'sofficeson thefirst dayof the third monthfollowingthemonthin
whichthis ConsentAgreementbecomeseffective,or asotherwiserequestedbythe
Board. Subsequentquarterlydeclarationsmustbereceivedin the Board'sofficeson or
beforethefirst day ofeverythirdmonth.
8. Dr. Fragatosshallappearinpersonfor aninterviewbeforethefull Boardorits
designatedrepresentativeduringthethirdmonthfollowingthe effectivedateof this
ConsentAgreement. Subsequentpersonalappearancesmustoccureverythree months
thereafter,and/orasotherwiserequestedbythe Board. Ifanappearanceismissedoris
rescheduledfor any reason,ensuingappearancesshallbe scheduledbasedonthe
appearancedateasoriginallyscheduled.
Drug& AlcoholScreens;DrugTestingFacilityandCollectionSite
9. Dr. Fragatosshallsubmitto randomurine screeningsfor drugsand alcoholatleast four
timesper month,or asotherwisedirectedby theBoard. Dr. Fragatosshall ensurethatall
screeningreportsare forwardeddirectlyto theBoardon aquarterlybasis. The drug
testingpanelutilizedmustbe acceptabletothe Secretaryofthe Board,and shall include
Dr. Fragatos'drug(s)ofchoice.
Dr. Fragatosshallabstainfrom theuse ofanysubstanceand the consumptionof poppy
seedsor any otherfood or liquidthat mayproducealowlevel positiveresultina
toxicologyscreen. Dr. Fragatosacknowledgesthat he understandsthatthe consumption
oruse ofsuch substances,includingbut not limitedtosubstancessuchasmouthwashor
handcleaninggel, may causeapositivedrugscreenthatmaynotbe able tobe
differentiatedfromintentionalingestion,and thereforesuchconsumptionoruse is
prohibitedunderthis ConsentAgreement.
All such urinescreeningsfor drugsand alcoholshall beconductedthroughaBoard-
approveddrugtestingfacilityand collectionsite pursuantto the globalcontractbetween
saidfacilityand the Board,that providesforthe Boardto maintainultimatecontrolover
the urinescreeningprocessand topreservetheconfidentialityof all positivescreening
resultsinaccordancewithSection4731.22(F)(5),OhioRevisedCode,and the screening

process shall require adailycall-in procedure. Further.intheevent thattheBoard
exercisesitsdiscretion.asprovidedinParagraph10below.toapprove urinescreenings
tobeconductedatanalternativedrugtestingfacility and/orcollectionsiteora
supervisingphysician.suchapprovalshallbeexpresslycontingentupontheBoard
retainingultimatecontrolover the urinescreeningprocess inamannerthatpreserves the
aforementionedconfidentialityof allpositivescreeningresults.
Dr.Fragatosshall SUbmit. athisexpenseandonthedayselected.urine specimensfor
drug and/oralcoholanalysis. AllspecimenssubmittedbyDr. Fragatosshallbenegative.
exceptforthosesubstancesprescribed. administered.ordispensedtohimin
conformancewith theterms. conditionsandlimitationssetforth inthisConsent
Agreement. Refusaltosubmit such specimen. orfailureto submitsuch specimenonthe
dayheisselectedorinsuchmannerastheBoardmayrequest, shall constitutea
violationof this ConsentAgreement.
Further. withinthirtydays of theeffective dateof thisConsentAgreement.Dr.Fragatos
shall enterintothe necessaryfinancialand/or contractualarrangementswiththeBoard-
approveddrugtestingfacilityand/or collectionsiteinordertofacilitatetheurine
screening processinthe mannerrequired bythisConsentAgreement. Further. Dr.
Fragatosshall promptlyprovidetotheBoardwrittendocumentationof completionof
sucharrangements,includingacopyofanycontract entered into betweenDr.Fragatos
and theBoard-approveddrugtestingfacilityand/or coIlectionsite. Dr.Fragatos' failure
totimelycompletesuch arrangements.orfailuretotimely providewritten
documentationto theBoard ofcompletionof sucharrangements,shall constitutea
violationof this ConsentAgreement.
Dr.Fragatosshall ensurethattheurinescreeningprocessperformedthrough theBoard-
approveddrugtestingfacility and/orcollectionsite requiresadailycall-inprocedure;
that the urinespecimensare obtained onarandom basis; and that thegiving ofthe
specimeniswitnessedbyareliableperson. In addition,Dr.FragatosandtheBoard-
approveddrug testingfacilityandcollectionsiteshallassure that appropriatecontrol
over thespecimenismaintainedandshallimmediatelyinformthe Board ofanypositive
screeningresults.
Dr. Fragatos shall ensurethatthe Board-approveddrugtestingfacility and/orcollection
siteprovidesquarterlyreports tothe Board, inaformat acceptabletotheBoard,
verifyingwhetherallurine screenshavebeenconductedin compliancewiththisConsent
Agreement,and whetherallurine screenshavebeen negative.
Intheeventthat theBoard-approveddrugtesting facilityand/orcollectionsitebecomes
unableorunwillingtoserve asrequired bythisConsentAgreement.Dr.Fragatos must
immediatelynotify theBoard inwriting. andmakearrangementsacceptabletothe
Board, pursuantto Paragraph10below. assoonas practicable. Dr.Fragatosshallfurther

Dr.FragatosacknowledgesthattheBoardexpresslyreserves theright towithdrawits
approvalof anydrug testingfacilityand/orcollectionsiteintheeventthat theSecretary
and SupervisingMemberoftheBoarddeterminethat thedrugtestingfacilityand/or
collectionsite hasdemonstratedalackofcooperationinprovidinginformationtothe
Boardorforanyotherreason.
10. Dr.Fragatosand theBoard agreethatitistheintent ofthis ConsentAgreementthatDr.
Fragatos shall submithis urine specimens totheBoard-approveddrugtesting facilityand
collectionsitechosenbythe Board. However, inthe event that utilizingsaidBoard-
approveddrug testingfacility and/orcollectionsitecreates anextraordinaryhardship
upon Dr.Fragatos,asdeterminedinthesolediscretionof the Board, then subjecttothe
followingrequirements,theBoard mayapproveanalternatedrugtestingfacilityand/or
collectionsite, orasupervisingphysician, tofacilitate the urine screeningprocessforDr.
Fragatos:
a. Withinthirty daysof thedate uponwhich Dr. FragatosisnotifiedoftheBoard's
determinationthatutilizingthe Board-approveddrug testingfacility and/or
collectionsiteconstitutesanextraordinaryhardshipuponDr. Fragatos, heshall
submittotheBoard inwriting foritspriorapprovaltheidentityofeitheran
alternatedrug testing facility andcollectionsite,orthenameofaproposed
supervisingphysician,towhom Dr.Fragatos shall submitthe requiredurine
specimens. Inapprovingafacility,entity,oran individualtoserve inthis capacity,
the Board willgive preferencetoafacility located near Dr.Fragatos'residence or
employmentlocation,ortoaphysician whopracticesinthe same localeasDr.
Fragatos. Dr. Fragatosshallensurethattheurine screeningprocess performed
throughthe alternate drugtesting facility and/or collectionsite,orthrough the
supervisingphysician,requiresadailycall-in procedure;that theurine specimens
areobtainedonarandom basis;and thatthegiving ofthespecimeniswitnessed by
areliableperson. In addition, Dr.Fragatos acknowledgesthat thealternatedrug
testingfacility andcollectionsite,orthe supervisingphysician,shallassurethat
appropriatecontroloverthespecimen ismaintainedand shall immediatelyinform
theBoardofanypositivescreeningresults.
b. Dr. Fragatos shall ensure thatthealternate drug testing facility and/orcollection
site, orthe supervisingphysician, providesquarterlyreports tothe Board,ina
format acceptabletotheBoard, verifyingwhetherallurine screens havebeen
conductedincompliancewiththisConsent Agreement,and whetherallurine
screenshavebeen negative.
c. In the event thatthedesignatedalternate drugtestingfacility and/orcollectionsite,
orthe supervisingphysician,becomesunable orunwillingtososerve,Dr.Fragatos

mustimmediatelynotifythe Boardinwriting. Dr. Fragatosshallfurtherensure
that the previouslydesignatedalternatedrugtestingfacilityand collectionsite, or
the supervisingphysician,also notifiesthe Boarddirectlyof the inabilityto
continueto serveand thereasonstherefore. Further,inordertoensurethat there
will be no interruptioninhis urine screeningprocess,uponthe previouslyapproved
alternatedrugtestingfacility,collectionsite, or supervisingphysicianbecoming
unabletoserve,Dr. Fragatosshall immediatelycommenceurinescreeningatthe
Board-approveddrugtestingfacilityandcollectionsite chosenbythe Board, until
suchtime,if any, that the Boardapprovesasubsequentalternatedrug testing
facility,collectionsite, orsupervisingphysician,if requestedby Dr.Fragatos.
d. The Boardexpresslyreservestheright to disapproveanyentityor facility proposed
to serveas Dr. Fragatos'designatedalternatedrugtestingfacilityand/orcollection
site,orany personproposedtoserve ashis supervisingphysician,orto withdraw
approvalofanyentity,facilityorpersonpreviouslyapprovedtoso serveinthe
eventthat the Secretaryand SupervisingMemberofthe Boarddeterminethat any
suchentity,facilityorpersonhasdemonstratedalackofcooperationinproviding
informationto the Boardorforanyotherreason.
11. All screeningreportsrequiredunderthisConsentAgreementfrom the Board-approved
drugtestingfacilityand/orcollectionsite, orfrom the alternatedrugtestingfacility
and/orcollectionsite orsupervisingphysician,mustbereceivedinthe Board'soffices
no laterthanthe due date for Dr. Fragatos' quarterlydeclaration. Itis Dr.Fragatos'
responsibilitytoensurethat reportsaretimelysubmitted.
12. The Boardretainsthe righttorequire,andDr. Fragatosagreesto submit,blood,urine,
breath,salivaand/orhairspecimensforscreeningfor drugsand alcohol,foranalysisof
therapeuticlevelsofmedicationsthat maybeprescribedfor Dr. Fragatos,orforany
otherpurpose,at Dr. Fragatos'expenseuponthe Board'srequestandwithoutprior
notice. Dr. Fragatos'refusaltosubmitaspecimenuponrequestof the Boardshall result
inaminimumofone yearof actuallicensesuspension. Further,the collectionofsuch
specimensshallbewitnessedbyarepresentativeof the Board,oranotherperson
acceptableto the Secretaryor SupervisingMemberof the Board.
RehabilitationProgram
13. Withinthirtydays of the effectivedate of thisConsentAgreement,Dr. Fragatosshall
undertakeand maintainparticipationinanalcoholanddrugrehabilitationprogram,such
as A.A.,N.A.,C.A., orCaduceus,no lessthanthreetimesper week. Substitutionof any
otherspecificprogrammustreceivepriorBoardapproval.
Dr. Fragatosshall submitacceptabledocumentaryevidenceofcontinuingcompliance
with thisprogram,includingsubmissiontothe Boardof meetingattendancelogs, which

mustbereceivedinthe Board'sofficesno laterthanthe due datefor Dr. Fragatos'
quarterlydeclarations.
14. Immediatelyuponcompletionofany requiredtreatmentfor chemicaldependency,Dr.
Fragatosshallenterinto an aftercarecontractwith aBoard-approvedtreatmentprovider
and shallmaintaincontinuedcompliancewiththetermsof saidaftercarecontract,
provided that, where the termsof the aftercare contract conflict with the termsofthis
ConsentAgreement,the termsof this ConsentAgreementshall control.
CONDITIONS FOR REINSTATEMENT
15. The Boardshall not considerreinstatementor restorationof Dr. Fragatos'certificateto
practicemedicineand surgeryuntil allofthefollowingconditionsare met:
a. Dr. Fragatosshall submitan applicationforreinstatementorrestoration,as
appropriate,accompaniedbyappropriatefees, if any.
b. Dr. Fragatosshalldemonstratetothe satisfactionof the Boardthathe canresume
practicein compliancewithacceptableand prevailingstandardsof care underthe
provisionsof his certificate. Suchdemonstrationshallincludebut shall not be
limitedto the following:
i. Certificationfrom atreatmentproviderapprovedunderSection4731.25of
the RevisedCodethatDr. Fragatoshas successfullycompletedanyrequired
inpatienttreatment,includingatleasttwenty-eightdays of inpatientor
residentialtreatmentforchemicalabuse/dependence,assetforth inRules
4731-16-02and 4731-16-08,Ohio AdministrativeCode,completed
consecutively.
ii. Evidenceofcontinuingfull compliancewith, orsuccessfulcompletionof,a
post-dischargeaftercarecontractwithatreatmentproviderapprovedunder
Section4731.25of the RevisedCode. Suchevidenceshallinclude,butnot
be limitedto, acopy of thesignedaftercarecontract. Theaftercarecontract
mustcomplywithrule 4731-16-10of theAdministrativeCode.
iii. Evidenceof continuingfull compliancewiththis ConsentAgreement.
IV. FivewrittenreportsindicatingthatDr. Fragatos'abilitytopracticehas been
assessedandthat he has beenfound capableof practicingaccordingto
acceptableand prevailingstandardsof care.
Two reportsshallbemadebyphysiciansknowledgeableinthe areaof
addictionologyand who are eitheraffiliatedwitha currentBoard-approved
treatmentproviderorotherwisehavebeenapprovedinadvancebytheBoard

to provide an assessment of Dr. Fragatos. Further, the two aforementioned
physicians shall not be affiliated with the same treatment provider or medical
group practice. Prior to the assessments, Dr. Fragatos shall provide the
evaluators with copies of patient records from any evaluations and/or
treatment that he has received, and a copy of this Consent Agreement. The
reports from the evaluators shall include any recommendations for treatment,
monitoring, or supervision of Dr. Fragatos, and any conditions, restrictions,
or limitations that should be imposed on Dr. Fragatos' practice. The reports
shall also describe the basis for the evaluator's determinations.
One report shall be made by a psychiatrist, approved in advance by the Board,
who shall conduct a psychiatric examination of Dr. Fragatos. Prior to the
examination, Dr. Fragatos shall provide the psychiatrist with copies of patient
records from any prior evaluations and/or treatment that he has received, and
a copy of this Consent Agreement. The report from the evaluating
psychiatrist shall include the psychiatrist's diagnoses and conclusions; any
recommendations for care, counseling, and treatment for the psychiatric
diagnoses; any conditions, restrictions, or limitations that should be imposed
on Dr. Fragatos' practice; and the basis for the psychiatrist's determinations.
One report shall be made by a neuropsychologist, approved in advance by the
Board, who shall conduct a complete cognitive health evaluation. Prior to the
examination, Dr. Fragatos shall provide the neuropsychologist with copies of
patient records from any prior evaluations and/or treatment that he has
received, and a copy of this Consent Agreement. The report from the
evaluating neuropsychologist shall include the neuropsychologist's diagnoses
and conclusions; any recommendations for care, counseling, and treatment for
the neuropsychological diagnoses; any conditions, restrictions, or limitations
that should be imposed on Dr. Fragatos' practice; and the basis for the
neuropsychologist's determinations.
One report shall be made by Dr. Raymond Kobus, at Hand and Microsurgery,
3400 Olentangy River Road, Suite 200, Columbus, Ohio, or another hand
specialist approved in advance by the Board, who shall conduct an
assessment of Dr. Fragatos related to his previous condition of Dupuytren's
Contracture. Prior to the examination, Dr. Fragatos shall provide the
evaluating hand specialist with copies ofpatient records from any prior
evaluations and/or treatment that he has received, and a copy of this Consent
Agreement. The report from the evaluating hand specialist shall include his
or her diagnoses and conclusions; any recommendations for care and/or
. treatment for the diagnoses; any conditions, restrictions, or limitations that
should be imposed on Dr. Fragatos' practice; and the basis for the evaluating
hand specialist's determinations.

All reportsrequired pursuanttothis paragraphshall bebased upon
examinationsoccurringwithin thethreemonthsimmediatelypreceding any
applicationforreinstatement. Further, atthediscretionof the Secretaryand
SupervisingMemberof theBoard,theBoard may requestanupdated
assessmentand report if the Secretaryand SupervisingMemberdetermine
that suchupdatedassessmentandreport iswarrantedforanyreason.
c. Dr.Fragatosshallenter intoawrittenconsentagreementincludingprobationary
terms,conditionsandlimitationsasdeterminedbytheBoardwithin180daysof
thedate uponwhichalltheabove-specifiedconditionsforreinstatementor
restorationhave been completedor,iftheBoardandDr. Fragatos areunableto
agree on theterms of awritten ConsentAgreement,then Dr. Fragatos further
agrees toabide byanyterms, conditionsandlimitationsimposedbyBoardOrder
afterahearingconductedpursuanttoChapter119.oftheOhioRevisedCode. The
Boardshallprovidenotice toDr.Fragatosthat saidhearinghas been scheduled,
advisingDr. Fragatos ofhishearingrights, andstatingthedate, time, andlocation
ofthe hearingatwhichtheBoardwillpresentitsevidence,afterwhichtheBoard
willmake adeterminationofthematterbyBoard Order.
Further,upon reinstatementof Dr.Fragatos'certificatetopracticemedicine and
surgery inthis state,theBoardshall requirecontinuedmonitoringwhich shall
include, butnot belimited to,compliancewiththe writtenconsentagreement
enteredintobefore reinstatementorwithconditionsimposedbyBoard Orderafter
ahearing conductedpursuanttoChapter119.ofthe RevisedCode. Moreover,
upon terminationoftheconsent agreementorBoard Order, Dr.Fragatos shall
submittotheBoard foratleasttwoyearsannual progressreportsmadeunder
penaltyof Boarddisciplinaryactionorcriminal prosecutionstatingwhetherDr.
Fragatos hasmaintainedsobriety.
16. Intheeventthat Dr.Fragatos hasnotbeenengaged intheactive practiceof medicine and
surgeryforaperiod inexcessof twoyearspriortoapplicationforreinstatement,the
Board mayexerciseitsdiscretionunder Section 4731.222,Ohio RevisedCode,to
require additionalevidenceof Dr. Fragatos' fitnesstoresumepractice.
REQUIRED REPORTING BY LICENSEE
17. Within thirtydays of theeffectivedateof this ConsentAgreement,Dr. Fragatosshall
provideacopy ofthis ConsentAgreementtoallemployersorentitieswithwhich heis
under contracttoprovidehealth careservices (includingbutnot limited tothirdparty
payors) orisreceivingtraining; andtheChiefof Staff ateachhospitalwherehehas
privilegesorappointments.Further, Dr. Fragatosshall promptlyprovideacopyof this
ConsentAgreementtoallemployersorentities withwhichhecontractstoprovidehealth
careservices, or applies foror receivestraining, and the Chiefof Staff at eachhospital
where heappliesfororobtainsprivileges orappointments. In theevent thatDr.Fragatos

provides any healthcareservices orhealthcaredirection ormedical oversight toany
emergencymedical services organizationor emergency medical services provider,within
thirty daysoftheeffective dateofthisConsent Agreement Dr.Fragatos shallprovidea
copy of thisConsent Agreementto the OhioDepartment of Public Safety, Divisionof
EmergencyMedical Services. Further, Dr. Fragatos shall provide the Board with one of
thefollowing documentsasproofofeachrequirednotification within thirty days ofthe
dateofeachsuchnotification: (1)thereturnreceiptofcertifiedmailwithinthirtydays
of receivingthatreturnreceipt, (2)an acknowledgementofdelivery bearingtheoriginal
ink signatureof the person towhoma copyof the Consent Agreementwashand
delivered,(3)theoriginalfacsimile-generatedreportconfirmingsuccessfultransmission
ofacopyof theConsent Agreement tothepersonorentity towhomacopy ofthe
ConsentAgreementwasfaxed,or(4)anoriginalcomputer-generatedprintoutof
electronic mail communicationdocumentingthe email transmission of a copy of the
ConsentAgreementtothepersonorentitytowhomacopyoftheConsentAgreement
wasemailed.
18. Within thirty days of the effectivedate of this Consent Agreement, Dr. Fragatosshall
provideacopyofthisConsentAgreementtotheproperlicensingauthorityofanystate
or jurisdiction inwhich he currentlyholds any professional license, aswell as anyfederal
agencyorentity,includingbutnotlimitedtotheDrugEnforcementAgency,through
whichhecurrentlyholdsanylicenseorcertificate. Dr.Fragatosfurtheragreestoprovide
a copyof thisConsent Agreementat time of applicationto the proper licensingauthority
of any state in which heapplies for anyprofessional license or reinstatementofany
professional license. Further, Dr. Fragatosshall provide the Board with one of the
followingdocumentsasproofofeachrequirednotificationwithinthirtydays ofthe date
ofeachsuchnotification: (1)thereturnreceiptofcertifiedmailwithinthirtydaysof
receivingthatreturnreceipt, (2)anacknowledgementofdelivery bearing theoriginal ink
signatureofthepersontowhomacopyoftheConsentAgreementwashanddelivered,
(3) the original facsimile-generatedreport confirmingsuccessful transmissionof a copy
of the Consent Agreement to the person or entity to whomacopyof the Consent
Agreement was faxed, or(4) an original computer-generatedprintout of electronicmail
communicationdocumentingtheemail transmissionofacopyof theConsent Agreement
tothe person or entity towhoma copyof the Consent Agreement was emailed.
19. Dr. Fragatos shall promptly provide a copy of this Consent Agreement to all personsand
entities that provide Dr. Fragatos chemical dependencytreatment or monitoring.
Further, Dr.Fragatos shall provide the Boardwith oneof the followingdocumentsas
proof of eachrequirednotificationwithinthirtydaysofthedateofeachsuch
notification: (1) the return receiptof certifiedmail within thirty daysofreceivingthat
return receipt, (2) an acknowledgementof deliverybearing theoriginal ink signatureof

20. Dr.Fragatosshall notify theBoard inwritingofanychangeofprincipalpractice address
orresidenceaddresswithinthirtydaysofsuchchange.
DURATIONIMODIFICATIONOFTERMS
Theabove-describedterms,conditionsandlimitationsmaybe amendedorterminatedinwriting at
anytime upontheagreementofboth parties. IntheeventthattheBoard initiatesfutureformal
proceedingsagainstDr.Fragatos,includingbutnot limitedto issuanceofaNoticeofOpportunity
forHearing, this ConsentAgreementshallcontinueinfullforceandeffect untilsuchtimethat itis
supersededbyratificationbytheBoardof asubsequentConsentAgreementorissuance bythe
Boardofafinal BoardOrder.
FAILURETO COMPLY
If,inthediscretionoftheSecretaryand SupervisingMemberofthe Board, Dr.Fragatos appears to
haveviolated orbreachedanytermorconditionof this ConsentAgreement,theBoardreservesthe
righttoinstitute formal disciplinaryproceedingsforanyandallpossibleviolationsorbreaches,
includingbutnot limitedto,allegedviolationsof thelawsofOhiooccurringbeforetheeffective
dateof thisConsentAgreement.
ACKNOWLEDGMENTSILIABILITYRELEASE
Dr. Fragatos acknowledgesthathehashadanopportunitytoaskquestionsconcerningthetermsof
this ConsentAgreementandthat allquestionsaskedhavebeen answeredinasatisfactorymanner.
Anyaction initiatedbytheBoardbasedonalleged violations of thisConsentAgreementshall
complywith the AdministrativeProcedureAct, Chapter119.,Ohio RevisedCode.
Dr.Fragatos hereby releasestheBoard, itsmembers, employees, agents, officersandrepresentatives
jointlyandseverally from anyandall liabilityarising fromthe withinmatter.
This ConsentAgreementshall beconsideredapublicrecordasthatterm isused inSection149.43,
OhioRevisedCode. Further, this informationmaybereportedtoappropriateorganizations,data
banks andgovernmentalbodies. Dr. Fragatos acknowledgesthathissocial security numberwillbe
usedifthis informationissoreportedandagreestoprovidehissocial security number totheBoard
forsuchpurposes.
