NOTICE OF INTENT TO ADOPT RULES AND REGULATIONS 1.

2. The State of Wyoming, Department of Revenue, hereby gives public notice in accordance with W.S. 16-3103 (1977 as amended) of intent to amend and adopt rules. The proposed amendments and new rules will be adopted pursuant to the rule making authority of the Department of Revenue, W.S. 39-11-102(c)(xix). The proposed rule change meets minimum substantive state statutory requirements. The agency rule being amended or created is Chapter 7, Ad Valorem Valuation Methodology and Assessment, Chapter 13, Assessor and Property Tax Appraiser Education and Certification and Chapter 14, Ad Valorem Tax Exemption Standards. 3. Chapter 7, Ad Valorem Valuation Methodology and Assessment. Section 2. Purpose of Rules. Changes were made to reflect the accurate notations to “Division” versus “state” and defined the industries in accord with W. S. 39-13-102 (m) (ii-ix). Additional sections were changed to reflect the industry definitions. Further to note “Property Tax Division” versus “State Assessment Section”. All sections of the Proposed Rules will reflect the name change from “Ad Valorem Tax Division” or “State Assessment Section” to “Property Tax Division". Section 4. Definitions. (d) and (iii). Change to word “economic” to “external” to conform to proper appraisal terminology. Section 6. (c) Appraisal Methods. New language to reflect new statutory language from the 2007 Wyoming Legislative session for telecommunications. W.S. 39-13-102 (m) ii-viii) added a new line item (ix) for Cable and Satellite Television. Other sections of the rules will note this change, as appropriate. Section 7. ((a)(i)(A, B, C, D) Capitalization Rate Development. The revisions in the noted subsections reflect changes in publication titles as directed by appraisal practices and/or State Board of Equalization administrative orders. Section 8. Intangible Assets, New language to reflect statutory language from the 2006 Wyoming Legislative session on intangible assets and the exemption process in W. S. 39-11-105 (b) i-vi). Section 13. Assessed or Taxable Value. New language to reflect new statutory language from the 2007 Wyoming Legislative session for telecommunications. W.S. 39-13-102 (m) ii-viii) added a new line item (ix) for Cable and Satellite television and the legislative mandated level of assessment. Section 15. (b) Preliminary Notice-Informal Conference Procedure-Taxpayer. Changed the meeting request procedures from the “Administrator, Ad Valorem Tax Division” to the “Appraisal Services Group Supervisor, Property Tax Division” to be more taxpayer efficient in scheduling conferences. Chapter 13, Assessor and Property Tax Appraiser Education and Certification. The rules have been changed to: Conform to Wyoming Statutory language, Meet the standards, definitions and procedures of the International Association of Assessing Officers, Conform to the procedures adopted by the Property Tax Division of the Department of Revenue, To make the Rules clearer and less ambiguous. Chapter 14, Ad Valorem Tax Exemption Standards. Section 1. (b) Purpose and scope; Authority. To correct the Article Title for the Wyoming Constitution reference. Section 2. (a) (b) Considerations. To better clarify the county assessed property and Department of Revenue and Property Tax Division as correct sources of exemptions. Section 10. Intangibles New language to reflect the statutory language from the 2006 Wyoming Legislative session on intangibles assets and the exemption process in W. S. 39-11-105 (b) (i-vi).

4. This agency welcomes all comments and suggestions on these proposed rules and regulations. A copy of the proposed rules and regulations are available upon written request. Please write to the address listed in item 1 and must be received by the department no later than 5:00 p.m. March 6, 2008. The rules are also posted on our web site at http://revenue.state.wy.us 5. A public hearing will be held if requested by 25 persons, a governmental subdivision or by an association having not less than 25 members. Requests for a public hearing may be addressed to the address listed in item 1 March 6, 2008.

6. Any person may urge the agency not to adopt the rules and also request the agency to state its reasons for overruling the consideration urged against adoption. Requests for an agency response must be made prior to, or within (thirty) 30 days after adoption of the rule, addressed to the address in item 1. If timely objections are submitted, the agency will provide the objecting person with a written response explaining and substantiating the agency's position by reference to federal law or regulations. 7. These rules have not been adopted, amended or repealed to comply with federal law or regulatory requirements.
