Dear Judge Pauley: Plaintiffs respectfully bring to the Court's attention the recent opinion in Klayman v. Obama, No. 1-3-cv-0851 (D.D.C. Dec. 16, 2013), a case concerning a challenge to the government's bulk collection of telephony metadata similar to that brought in the above-captioned matter. The Klayman court concluded that the plaintiffs had demonstrated a substantial likelihood that the government's ongoing bulk collection of their telephony metadata violates the Fourth Amendment. A copy ofthe court's opinion is attached to this notice.
