JUDICIAL AFFIDAVIT OF PETITIONER CARLA R. CALOS-YOUNGHUSBAND I, CARLA R. CALOS-YOUNGHUSBAND, of legal age, married, and living at Golden Harvest Subdivision, Carig Norte, Tuguegarao City, petitioner in this case, state under oath as follows:

PRELIMINARY STATEMENT The person examining me is Atty. John Paul T. Romero with address at Caggay, Tuguegarao City. The examination is being held at the same office. I am answering his questions fully conscious that I do so under oath and may face criminal liability for false testimony and perjury. PURPOSE: This affidavit/testimony of petitioner Carla R. Calos-Younghusband is being offered to prove that the respondent Criselda R. Calos is an illegitimate child of Crispin Calos and Basilia Calos. The Respondents birth certificate is being questioned of its authenticity as to the identity of her biological parents, Crispin and Basilia Calos, which appears in her certificate of birth. The Petitioner claims that the birth of the Respondent is being simulated. This petitioners testimony is also offered to prove the legal basis for the legitimacy, simulation of birth and cancellation of birth certificate of the Respondent.

Q: Please state your name and other personal circumstances for the record. A: I am Carla Ramirez Calos-Younghusband, of legal age residing at Golden Harvest Subdivision, Carig Norte, Tuguegarao City. I am a licensed physician and married to Atty. Phil J. Younghusband. I am the only daughter of the late Mr. Crispin Calos and Mrs. Basilia Calos. Q: Are you the same Carla Ramirez Calos-Younghusband, the petitioner in this case? A: Yes sir. Q: Do you know a certain Criselda Ramirez Calos and how are you related to her?

A: Yes sir. I have known her during the reading of the last will and testament of my father, last August 23, 2013, she is claiming to be my younger sister. 4. Q: Are you sure she is not your sister? A: Yes sir. After I graduated in college last April 1987 in St. Paul University, I went to Boston University to pursue medicine. I am practicing medicine in New YorK. I went home last year because my parents had a car accident last December 27, 2012, and fix their funeral and run some family matters and business. My mother never told me about her being pregnant again and that I have a younger sister. Q: Do you have a proof that the Respondent is not your legitimate sister? A: Yes sir. During the reading of the last will and testament of my father, Criselda presented her certificate of birth. I was surprised because it seems to appear that her biological parents are my parents. I have also noticed that the signature of my mother is being falsified. Q: How sure are you that your mother was never pregnant when you were in the US? A: Based from the birth certificate, Criselda was born on April 30, 1990, and it appears that my mother is very unfit to bear a child. And according to the birth certificate she was born in our house. And with my mothers age that time, 54, my mother was clinically and medically impossible to bear a child. Q: Do you have a copy of the Respondents certificate of birth and a copy of your certificate of birth to check the signature of your mother? A: Yes sir, I have it with me. I took a picture of Criseldas certificate of birth (Exhibit A) and here is my certificate of birth(Exhibit B). Q: Who is with you right now? A: She is Ms. Beverly Kwin Sevilla, the komadrona who helped a certain Marie Claire Ibarra who gave birth last April 30, 1990 and happens to be the biological mother of Criselda. I have here an affidavit of her statement (Exhibit C) stating that Marie Claire Ibarra is the mother of Criselda. The affidavit was issued at Atty. Marjorie Martins law office and she recommended us to see you since you are most fit to our query. Q: Do you know Marie Claire Ibarra? A: Yes sir. She was the house helper of my parents when I went to the United States to pursue medicine last 1987 Q: Do you know about Marie Claires whereabouts today? A: No sir.
