We were waiting for the legal notice to be served to us in hard copy via mail, rather than replying to this email that is from an unverifiable address like @yahoo.com - the email address indicates nothing about the lawyer or his firm. But now, rather than wait any longer for receiving this legal notice by post, we have decided to respond to your email notice itself. 1) Your client is aware of earlier articles and some unflattering comments regarding the projects of your client on the GurgaonScoop.com since 2005, and your client is also aware of much more flattering and numerous advertising materials that have been put on the same websites since 2005. Your client also has known since 2005 that the discussion group www.GurgaonScoop.com is an open and interactive website wherein the visitors can freely post their comments, and also do so in large numbers. In the articles that you have mentioned in your legal notice, the material was submitted to us by clients of Rahejas and is based on company email, memorandums, and legal notices served by clients to Raheja Developers. Out of all the postings that were made on Gurgaonscoop.com the ones mentioning Raheja Developers Pvt Ltd were probably less than 0.01% of all the stories. Over 22,000 stories have so far been posted on GurgaonScoop. The gist of the submission of the material to us was that one of your customers had sent you a legal notice raising certain serious issues which affected the investment of hundreds of other customers also in Raheja Developers Pvt. Ltd., including customers that we had helped invest in Raheja properties. Further over 20 other Raheja residential customers had managed to come together and were raising almost the same issues that were raised in the legal notice that was sent to the Developer. 2) In your notice you call the aggrieved customers "unscrupulous persons .. not willing to abide by their contractual obligations ... they are adopting such lik e pressure tactics so that my client may not tak e action against them as per agreements made by such defaulters. These persons have colluded with you, and in conspiracy with them you are resorting to..." You allege in your notice that the 20 plus people (out of a group of over 40) who came to your client's office were "unscrupulous persons" while in your official minutes of the meeting held with most of some of them on December 22, 2008, your client claimed just the opposite and said that they were being misled by GurgaonScoop and minuted the same in point no. 6. And in an attempt at conspiracy you tried to force them in your meeting, and with repeated email reminders and calls from company officials to the "unscrupulous persons," to write to GurgaonScoop to deny the posted story regarding the documents and memorandum that had submitted to us by some of them in the first place. It is your client who is indulging in coercion, conspiracy and totally unauthorized and illegal acts.

3) Further in the minutes of the meeting that your client had at 5 PM on December 22, 2005, days after the posting were made on the discussion group GurgaonScoop.com, your client accepted the following (Point 1 of the Minutes of Meeting between MD Navin Raheja and Customers)That the customers had been misled about the legal status of the project by your client, and had not been properly updated about its current and true status. Despite the company writing to all customers in the letter inviting them for the Bhoomi Poojan that the sanction plans had been approved, and despite the fact that the company has executed Flat Buyers Agreement that states "the building plans has been duly sanctioned/approved by the concerned department/authorities .... and whereas the allottee(s) has seen all the documents pertaining the title of the said land/complex in power and possession of the company and has fully satisfied himself about the right, title, interest an limitations of the company in the said land/complex)," as the company has subsequently acknowledged in writing to the clients that NO SANCTION PLAN APPROVALS HAVE YET BEEN RECEIVED BY THE COMPANY. Despite this the company has been advertising that construction is in "Full Swing" at the residential project Raheja Atharva, and for this misrepresentation a memorandum was also submitted by the customers to your client on Dec 20, 2008. Your client did not and still does not have the sanction plans approved, and it is a falsehood to make such claims in official documents for the purpose of raising demand notes and collecting lakhs of rupees from every customer based on these false statements. (Point 2 of the Minutes of Meeting between MD Navin Raheja and Customers)Your client accepted and withdrew the objectionable and extortion-like demand letters to the aggrieved customers wherein your client called them defaulters. That regarding the mail sent to the aggrieved customers the minutes issued by Raheja Developers state that "the language of the mail sent is objectionable - Mr. Raheja admitted that the same is INCORRECT and instructed his General Managers present in the meeting to withdraw the same immediately." (Point 6 of the Minutes of Meeting between MD Navin Raheja and Customers)Your client in a conspiracy against GurgaonScoop.com tried to force the aggrieved customers, some of who in the first place submitted the facts to be posted on GurgaonScoop.com, to individually write to us denying their position. Despite your immense pressure via emails, phone calls to the customers, only 3 of the 22 customers chose to send the letter to us, and one of them has already been replied to. We will soon reply to the other two letters too. 4. We have posted communications provided by the company, and in fact Mr. Harinder Dhillon's (GM Marketing) reply on Nov 18, 2008 was posted in its entirety on the GurgaonScoop.com discussion group.

Further, any clarifications, press releases, interviews with company officers that are made available to us can be posted on the website. You could also choose to post the same on the website itself as it is free and open discussion group - but if you want us to post it then please email and we will be glad to post. Further, by sending us this legal notice by email (electronic mail over internet computers) you have shown that you understand the new tools of communication and information technology. Other people are also using information and the openness and free-spirit of the internet technology to read about, discuss, and post responses to issues that are important to them. You would be best served to responding to the issues raised in memorandum served, and then submitting to us for wide internet publicity how you successfully addressed the serious concerns of over 60 of your client's customers.
