THE PUNJAB ENVIRONMENTAL PROTECTION (AMENDMENT) ACT 2012 (XXXV OF 2012) [18th April, 2012] An Act to amend the Pakistan Environmental Protection Act, 1997. Pr"#'2!". Whereas it is expedient to amend the Pakistan Environmental Protection Act, 1997 (XXXI o! 1997" !or p#rposes hereina!ter appearin$% It is enacted as !ollo&s'( 1. Short t t!" #$% &o''"$&"'"$t. (1" )his Act ma* +e cited as the P#n,a+ Environmental Protection (Amendment" Act -.1-. (-" It shall come into !orce at once. 2. A'"$%'"$t( $ A&t XXXIV o) 1**+ . In the said Act, in section < (a" (+" in the mar$inal headin$, !or the &ord /Pakistan2, the &ord /Provincial2 shall +e s#+stit#ted% and !or s#+(section (1", the !ollo&in$ shall +e s#+stit#ted'( /(1" )he 1overnment shall, +* noti!ication in the o!!icial 1a8ette, esta+lish the Provincial Environmental Protection A$enc* to exercise the po&ers and per!orm the !#nctions assi$ned to it #nder this Act, the r#les and the re$#lations.2 +. In the said Act, in section 7, !or cla#se (k", the !ollo&in$ shall +e s#+stit#ted'( /(k" esta+lish the P#n,a+ Environmental 6oordination 6ommittee comprisin$ the :irector 1eneral as its convener and s#ch other mem+ers as the 1overnment ma* appoint to exercise s#ch po&ers and per!orm s#ch !#nctions as ma* +e dele$ated or assi$ned to it +* the 1overnment !or carr*in$ o#t the p#rposes o! this Act.2 *. In the said Act, in section (a" !or s#+(section (1", the !ollo&in$ shall +e s#+stit#ted'( /(1" )here shall +e esta+lished a Provincial 5#staina+le :evelopment 0#nd.2% and (+" in s#+(section (-", in cla#se (a", !or the &ords /0ederal 1overnment or the Provincial 1overnments2, the &ords /1overnment or the 0ederal 1overnment2 shall +e s#+stit#ted.

11. A'"$%'"$t $ ("&t o$ 10 o) A&t XXXIV o) 1**+ . In the said Act, in section 1., !or s#+(section (1", the !ollo&in$ shall +e s#+stit#ted'( /(1" )he Provincial 5#staina+le :evelopment 0#nd shall +e mana$ed +* a @oard kno&n as the Provincial 5#staina+le :evelopment 0#nd @oard consistin$ o! (i" 6hairman, Plannin$ and :evelopment @oard% 6hairperson

In the said Act, in section (a" !or s#+(section (1", the !ollo&in$ shall +e s#+stit#ted'( /(1" Where the Provincial A$enc* is satis!ied that the dischar$e or emission o! an* e!!l#ent, &aste, air poll#tant or noise, or the disposal o! &aste, or handlin$ o! ha8ardo#s s#+stance, or an* other act or omission is likel* to occ#r, or is occ#rrin$, or has occ#rred, in violation o! an* provision o! this Act, r#les or re$#lations or o! the conditions o! a license, or is likel* to ca#se, or is ca#sin$, or has ca#sed an adverse environmental e!!ect, the Provincial A$enc* ma*, a!ter $ivin$ the person responsi+le !or s#ch dischar$e, emission, disposal, handlin$, act or omission an opport#nit* o! +ein$ heard, +* order, direct s#ch person to take s#ch meas#res as the Provincial A$enc* ma* consider necessar* &ithin s#ch period as ma* +e speci!ied in the order.2% (+" in s#+(section (-", in cla#se (d", !or the &ords and comma /0ederal A$enc* or, Provincial A$enc*2, the &ords /Provincial A$enc*2 shall +e s#+stit#ted% and in s#+(section (7", !or the &ords /0ederal A$enc* or Provincial A$enc*2, the &ords /Provincial A$enc*2 shall +e s#+stit#ted.

In the said Act, in section -., !or s#+(section (A", the !ollo&in$ shall +e s#+stit#ted'( /(A" A decision o! an Environmental )ri+#nal shall +e expressed in terms o! the opinion o! the ma,orit*, or i! the case has +een decided +* the 6hairperson and onl* one o! the mem+ers and there is a di!!erence o! opinion +et&een them, the decision o! the Environmental )ri+#nal shall +e expressed in terms o! the opinion o! the 6hairperson.2 1/. -1 A'"$%'"$t( $ ("&t o$ 21 o) A&t XXXIV o) 1**+ . In the said Act, in section (a" in s#+(section (7", in cla#se (+", !or the &ords and comma /0ederal A$enc*, or the Provincial A$enc* concerned2, the &ords /Provincial A$enc*2 shall +e s#+stit#ted% and in s#+(section (7", !or the &ords /0ederal A$enc* or o! Provincial A$enc*2, the &ords /Provincial A$enc*2 shall +e s#+stit#ted.

In the said Act, in section -A, in s#+(section (7", in cla#se (a", !or the &ords and comma /0ederal A$enc*, Provincial A$enc*2, the &ords /Provincial A$enc*2 shall +e s#+stit#ted. 1*. Po5"r to %"!"6#t". )he 1overnment ma*, +* noti!ication in the o!!icial 1a8ette, dele$ate an* o! its or o! the Provincial A$enc*Bs po&ers or !#nctions #nder this Act, the r#les or the re$#lations to an* 1overnment A$enc*, local co#ncil or local a#thorit*.2 20. S12(t t1t o$ o) ("&t o$ 2+ o) A&t XXXIV o) 1**+ . In the said Act, !or section -7, the !ollo&in$ shall +e s#+stit#ted'( /2+. Po5"r to 6 7" % r"&t o$(. In the per!ormance o! its !#nctions, the Provincial A$enc* shall +e +o#nd +* the directions $iven to it in &ritin$ +* the 1overnment.2

21. S12(t t1t o$ o) ("&t o$ 20 o) A&t XXXIV o) 1**+ . In the said Act, !or section -?, the !ollo&in$ shall +e s#+stit#ted'( /20. I$%"'$ t8. 3o s#it, prosec#tion or other le$al proceedin$s shall lie a$ainst the 1overnment, the 6o#ncil, the Provincial A$enc*, the :irector 1eneral o! the Provincial A$enc*, mem+ers, o!!icers, emplo*ees, experts, advisors, or cons#ltants o! the Provincial A$enc* or the Environmental )ri+#nal, an Environmental 9a$istrate or an* other person !or an*thin$ &hich is in $ood !aith done or intended to +e done #nder this Act or the r#les or the re$#lations.2 22. A'"$%'"$t $ ("&t o$ 2* o) A&t XXXIV o) 1**+ . In the said Act, in section -9, !or the &ords /0ederal A$enc* or Provincial A$enc*2, the &ords /Provincial A$enc*2 shall +e s#+stit#ted. 2,.
