BOARD OF PARK COMMISSIONERS RECOMMENDATION TO ABANDON PORTION
OF HEYWOOD PARK
RECOMMENDATION:
That Troy City Council declare as abandoned 3,270.27 square feet of part of Inlet 3011 (which is part of
Heywood Park) as recommended by the Board of Park Commissioners.
BACKGROUND:
Bill Wilson, who lives at 224 Penn Road, had asked the Board of Park Commissioners about obtaining a
small area of Heywood Park (3,270.27 square feet of part of In lot 3011) which is also adjacent to his
property on Penn Road. The family wishes to enhance this property as part of their yard. The Board
was willing to recommend that Council declare this small piece of land as surplus so it could be
advertised for sale, with Mr. Wilson understanding that anyone who wished to do so could bid on the
land. As city staff was reviewing this, and checking into deeds and legal descriptions so this matter
could be forwarded for Council consideration, research and review of the Law Director indicated that
should the City no longer be interested in any portion of Heywood Park, under the conditions that the
Board of Education deeded the land to the City in 1948, such land reverted back to the ownership of the
Board of Education. Mr. Livingston noted that the City could not, in fact, declare this land surplus and
offer it for sale. This information was discussed with the Board of Park Commissioners at the February 4
meeting. The President of the Board indicated that he had reviewed this possibility with representatives
of the Board of Education and the Board of Education is willing to have this small parcel deeded back to
them, recognizing that the Board of Education would have to go through the process of considering if the
land is be declared surplus by them and, if so, going through any requirements to sell the land. It was
noted that any sale proceeds would then accrue to the Board of Education.
The Board of Park Commissioners has approved a motion that 3,270.27 square feet of land, part of Inlet
No. 3011, a small portion of Heywood Park, be declared abandoned and therefore revert back to the
Board of Education.
Attached are photos of the area, a plat map, and drawings showing the plans for the land.
REQUESTED ACTION:
It would be appreciated if you would assign to a Committee of Council considering abandoning 3,270.27
square feet of part of Inlet 3011 (which is part of Heywood Park) as recommended by the Board of Park
Commissioners.
