Sub: News items relating to the deposition of Mr. Gordhan Zadaphia,

Sir,
1 . Your kind attention is drawn to the various news items relating to the deposition of Mr. Gordhan Zadaphia before the Honourable Commission that have appeared today in the all the major English as well as Gujarati Dailies published from Ahmedabad. All these news reports inter alia suggest that: a . Mr. Zadaphia was not informed of the fact that the dead bodies of the Kar-Seva ks and other victims of the Godhra Tragedy were being brought t o Ahmedabad. b . Mr. Zadaphia was not informed about the on-going violence at Gulberg Society and Naroda Patiya. c . The Call Details provided by Mr. Rahul Sharma IPS are incorrect.

2. As you are aware, I had personally handed over to the Honourable Commission, copies of several documents which would belie the claims mentioned at l a and 1b above. However for the sake of your convenience, I am once again annexing copies of some of these documents which would illustrate that both the Chief MinisterIHome Minister Mr. Narendra Modi and the MoS (Home) Mr. Zadaphia were kept contemporaneously informed about the decision of bringing dead bodies to Ahmedabad and the likely repercussions of the said administrative decision; as well as the on-going violence at Gulberg Society and other places in Ahmedabad. Copies are appended and marked as Annexure A to Annexure E 3. As informed to the Honourable Commission in person, during my tenure as Deputy Commissioner in the State Intelligence Bureau Ihad obtained the relevant call records for Godhra as well as AhmedabadIGandhinagar. As conveyed to you earlier, these call records have already been handed over along with a lot of other documentary evidence t o the SIT headed by Mr. R. K. Raghavan. Ihave also had the occasion to study, analyse and compare the call records procured by the State Intelligence Bureau with the call records collected by Mr. Rahul Sharma IPS. Ihad found both the independently procured call records for Ahmedabad to be exactly similar. I n view of the said facts, the claim mentioned at lc appears to be false.

4. It is reiterated that documents submitted by me t o the SIT as well as other documents which would be available with the State Intelligence Bureau would clearly reveal the dubious role and criminal conduct of the then Chief Minister and/or other Ministers in his council of Ministers, Police Officers and other individuals and organizations with respect to the references (a) to (e) of the widened Terms of Reference. Iam aware of the said fact as many such highly incriminating documents were either authored by me or had come to my notice during my tenure as Deputy Commissioner of Intelligence in-charge of Internal Security in the year 2002.

5. The Honourable Commission is once again requested to ensure that relevant records are not destroyed by the administrative machinery of a State Government that is headed by a Chief Minister who himself happens to be one of the most leading and most culpable dramatis personae of the Gujarat Carnage of 2002 and the subsequent on-going cover-up operations aimed at shielding the persons accused of heinous crimes and blatant acts of constitutional subversion. You are once again requested to expeditiously grant the prayers contained in my letter IVo.SRB/JN~IM/110516/01 dated 16/05/2011 and reiterated in my subsequent two letters bearing No.SRB/COI/111215/01 dated 15/12/2011 and No.SRB/COI/111223/Ol dated 23/12/2011, so as to enable me to file a comprehensive affidavit and bring relevant documentary evidence on the record of the Honourable Commission.
