You appealed from the action of the Federal Bureau of
on your request for access to records per-
taining to trash covers.
As a result of discussions between Bureau personnel and
members of my staff, a suppleme ntal release of records wil l
soon be made to you directly by the F.B. I . In l ight of
this fact and after careful consideration of your appeal, I
have decided affirm the modified action in this case .
The use of trash covers is one of the subjects of a Bureau
main file -- Research Matters . Certain of the material per-
taining to trash covers is classified and I am affirming the
denial o:C access to it on the basis of 5 u.s . c . 552 (b) (1).
This material is b eing referred to the Depart ment Review
Committee for review and determination whether it warrants
continued classification under Executive Order 12065 . You
will b e notified if the Committee ' s final decision results
in the declassification of any information . Other informat ion
on this subject was properly withheld from you pursuant to
5 U. S . C. 552 (b) (2) , (7) (C) , (7) (D) and (7) (E). These provi-
sions pertain to purely internal agency practices and to
investigatory r ecords compiled for law enforcement purposes,
t he release of which would, r espectivel y , constitute a n
unwarranted invasion of the personal privacy of third parties
by revealing a n investigative interest in them on the part
of the F . B. I ., disclose the ide ntities of confidential
sources and disclose a certain investigative technique . None
of the information being withheld is appropriate for dis-
cretionary release .

in conducting the Bureau's vork; however, because organizations
under investigation by this office do not maintain a headquarters
office of an kind where records mav be ke t the trash is .noteasily

Regardless of security precautions by subversive organizations
which have excellerated to point where they make certain that
all trash coverage emanating from meetings of the organizations,
this office is constantly alert to the development of such _
coverage if and when the opportunity presents itself. It is
rfecogniz.ed that such development can result 1n the receipt ot ·
Llists of names of individuals, hand"'-riting specimens, activities
of the organization, literature, correspondence! personal items
used for background inCormation, and leads deve oped from 1nfor-_J
mation received rrom such coverage. It is also recognized that
data receiTed through trash coverage is often times not obtainable
through any other source.

This is to approval of a letter to 25 field offices
requesting that these office's furnish the Bureau with information on the
establishment· and use of trash covers in security investigations.
The enclosed letter is directed to the field offices tandling the bulk
qf the security work. The letter requests each of these offices to furnish informatir:'
on the establishment and use of hm' trash covers in addition to furnishing any
observations or suggestions which will improve or assist other offices in the same
technique for security investigations. On receiving the results of this survey,
an analysis will be furnished to all field offices in the form of a monograph in order
that all techniques and ideas may be shared.
This survey of lhe field is made necessary by the fact that there is
insufficient material in the files from which to prepare a study.
RECOMMENDATION:
It is recommended that the enclosed letter to the New York office
and 24 other offices be approved. After approval, it should be returned to the
Central Research Section for dating and printing.

relative to the admissibility evidence of material received
through trash covers.

Trash covers in Puerto Rico have always posed
a special problem due to local conditions and the
general poverty of the majority of the subver sive
elements. On various occasi. ons surveys have been
made on the headquarters of the Nationalist Party of
Puerto Rico (NPPR) and the Communist Party of Puerto
Rico (PCP), as well as leaders of each group. Because
of the special problems encountered, aecuri ty could not
be guaranteed, and it was decided that trash covers
were not practicabl:l , and this technique as s uch has
never been utilized by the San Juan Office.
Trash in the better residential districts of
metropolitan San Juan is collected by mechanized .
trucks, owned and manned by the municipality. Trash
and garbage are deposited together in so-gallon oil
drums which are located in front · of the residences.
When picked up, it is collected and cut up by machines
similar to those used stateside. The refuse is then
taken to the m1.micipal dump and burned. In the sub-
standard districts where the majority · of the members
of the NPPR and PCP reside, trash and garbage arc self-
disposed.

Although the above:coverage is not a trash cover
as such, a·separate memorandum is being prepared for the
information of the Bureau under a JUNE caption.
A canvass of.the San Juan Office disclosed that
several agents have worked ort·trash covers in other offices
for a limited length of time. They did _not, hol'{ever, have
information relative to the establishment of,the covers or
of the disposition of the information obtained. Because of
these circumstances, it is feft that this information would
be of little value to other offices; and inasmuch ·as the
offices where these trash covers operated will make reports
over the complete operation, no comments are being submitted
by the San Juan Office.

The Special Agent in Charge and agents concerned with
security type investigationz inthe Seattle Office are wholly
in agreement l·lith the Bureau in regard to the r eal and prospective
value of .trash covers as potent investigative, intelligence and
possibly prosecutive aids. The following comment s are t he comb ined
thoughts of the agents directly conne cted with the problem at nand
and are offered in the hope that they may be of asslstance t o t he
Bureau and other offices. ·
A complete and thorough survey was made from files of the
Seattle Office for techniques used in this category and four
examples are being described fully be lov1. The Seattle Office
ha s followed the ·suggested Bureau outline, the exception
that a short and concise introduction precedes t he s uggest ed
Bureau outline in order to set forth first the per s ona litie s .
and circumstances involved in each trash cover. These

It is believed that in some cases in the early stages of
the LGE program, photostatic copies of some self--explanatory
material were furnished as enclosures to LGE reports for eventual
use in LGE hearings, without the necessity of disclosing the
original source of the material.

. The all-important question to be asked in a problem
such as this is whether the successful prosecution of the case
involved outHeighs the risk involved in the possibility of ·

V; SOJVJE GENERAL OBSERVATIONS REGARDING 'ffiASH COVERS
A. Many'times material received from trash. covers is
not clearly captioned or titled to reflect its meaning, although·
to the agent its meaning is sometimes obvious. There-
fore,. in reporting information attributed to the trash sourceJ·
sufficient explanation should be made in order not to make
material appear to state more than is actually on the document.
Less than ve17 careful handling could be embarrassing in a court
proceeding if the material itself was not self-e):planatory and
required an interpretation or involved an opinior1 of the witness.
B. Oftentimes a trash cover will produce lists of
names and the list involved does not clearly state to what the
list pertains. Extreme care should be exercised in the use of
such material, since such lists could and have caused considerable
embarrassment to the Bureau and agents in the past v1hen the
interpretation was erroneous.
C. As previously stated above, introduction 9f material
received from a trash cover as evidence in a legal proceeding
should be the topic of considerable discussion before its use·
as evidence, since the divulging of this te
the c U)(-!)
D. Trash covers are an important technique, since they .
require no long involved development period; they furnish a
continuous flow of material; and they are normally very secure
in operation and usually cost little to develop and maintain.
F. In conclusion, it is believed that the important
points in developing a good trash cov,er are the following:

the indiscriminate establishment of a TC could easily disclose
this inve.stigative technique and possibly bring unfavorable
publicity to the Bureau. As previously stated, this
technique should be considered on each investigation but they
should be established only in those instances where the material
obtained would be completely worthwhile and maximum security
precautions can be maintained. Thia offi'ce is of the firm opinion
that TCs cannot replace live informant coverage. Th.e establish-
ment .and operation of a TC should never be used as an excuse for
failure to establish other of coverage.

As indicated above, the New York Office ·has
been successful in the operation or a number -of trash ·
covers on a large scale on many organizations located
in this area. It has provided a wealth of information
not only to the New York Ofrice, but for the field in l·
general as well. It is generally felt that a trash cover .
is a very effective investigative technique. The question
of legal admissibility is one that arises in the operation

.of ea ch trash cover and:1ts answer must, in the last analysis,
be based upon the factors inherent ·in t _be operation or
each cover. · In this connection, the in March,
1947, advised "in each instance the Agent obtaining
the items (trash) should endeavor to procure proof that
the trash was taken from the . office and handed to the Agent
without being left unattended or in a place where it might
be contaminated by additions from other sources. In each
instance the Agent should explain the source of the item
of evidence to the attorney to whom the case is assigned
and be guided by the views of the attorney with respect
to its admissibility and value.

Baltimore City uses a modern type garbage dump truck. The
trash is dumped from the   the residence on to the
rear opening of the sanitation truck. When a sufficient amount
has been collected, the rear opening lifts the accumulated trash
into the truck hopper where it is compressed.

The United States Court of ·Appeals for the District
of Columbia Circuit in the case ELLA MAE WORK, Appellant, vs.
United States of America, Appellee, decided in effect on
4/22/57 that in ·the absence of a search warrant or a search
incidental to arrest, the only persons who h2.ve the right to
trash maintained in a container on the subject's premises are
the subject and the trash man. In this particular case two
officers of the Narcotics Squad of the Metropqlitan Police
Department, 1'IDC, went to the residence of a young girl reported
to have narcotics in her possession. They had no warrant of
arrest or search warrant.
The girl walked past the two officers and made a
motion as·if putting something in a trash can which was
located under the porch of her residence. The officers did not
see anything in her hand but upon looking in the trash can
recovered a phial containing some narcotic pills. They then
arrested her and used the pills as evidence against her. She
was subsequently convicted of illegal of the
narcotics in the United States Court for the District
of Columbia on 2/29/5G.
The Court of Appeals among other things held that
the placing of the phial of pills in the trash can, so situated
and used, is not to be.construed as an abandonment of the phial

unless the person impliedly or expressly authorized to
remove the can's contents, such as the trashman, for purposes
of destruction,   l ~ e court reversed and remanded tlie case
on 4/22/57.
f. The WFO has not utilized material obtained
from trash covers as evidence in trials, nor does it have
any current case concerning this matter.

to be used in prosecution .
. VII . GENERAL
Some trash covers should be established as a part of
the investigative operation of this Bureau for purely intelligence
purposes. In this way the security necessary for the covert
nature of the technique.can be maintained as in this instance.
The trash cover was established as an exploratory measure to
develop any information concerning the subject.

A review of the files of the Kansas City Office
indicate there has been no Headquarters for the Communist ·
Party in Kansas City for over ten years. These files fail
to indicate the existence of a trash cover .on Communist
Party Headquarters when it was in existence prior to that
time.
During the past ten years there has been only one
Communist Party Front Group of consequence in Kansas City
which existed only during the years 1951 and 1952. This
organization had no headquarters and no trash cover was
utilized in the investigation of this group.
A review of the files of Security Subj ects listed
on the Security Index and the Revised Communist Index was
conducted and it was determined that no trash covers have
been utilized in these investigations .
The Agents handling security matters in the Kansas
City Office have a of security investigations in
Kansas City for the past years. None of these Agents can
recall that it was ever necessary to utilize a trash cover
in security investigations conducted in

covers has been found to be unnecessary in meeting .the Bureau's
responsibilities in the security field and it is believed that
the results which. could be reasonably expected from a trash
cover in the Kansas City Division would not justify the
additional expense of investigative time and money.
Although the Kansas City Office is unable, due to
lack of experience, to contribute to this survey, thE
office will be interested in reviewing the Bureau's analysis
resulting from the survey so that the Agents of t his office
will be able to benefit from the experience of those Agents
who have had a personal working knowledge of this subject •

E. Careful consideration has been given in the past in each
instance of receipt of trash in respect to its as evidence,
in view of the fact that the expressed purpose of this coverage in the past
was initiated for evidentiar,y purposes. Despite the fact that all logical
and practical precautions were taken to preserve the admissibility, certain
questions have arisen as to whether aQY trash collection in which papers are
pieced together and received in voluminous quantities can be completely fool-
proof. This question will be dealt with in further detail subsequently in
connection with general observations as outlined in this, let ter.

The City of St. ·Louis presently has ·a community trash
collection system, however, this uses trash collection trucks
which are operated by city personnel who pick. up the trash cans
on days. It has not been feasible to att empt to ·segreeate
any particular trash can from the collection. Further, since
the beginning of the Smith Act Trials and various other hearings
which have exposed the fact that valuable information has been
from trash covers, Party officials and t he members them-
selves have been extremely careful in the handling of trash.
Surveys have been made from time to :time · on individual leaders
to determine possibilities of trash covers but in general it
was found that they were in the habit .of burning their ... trash. II

which the subject has a constitutionally protected right of privacy under the
Fourth Amendment that material may be taken by an officer of the law working
with the common trash collector and it may be retained and used as evidence at

(D) SEARCH AND SEIZURE - TRASH COVERS -- A recent Federal
decision shows ' the manner in which information obtained from trash
covers can be taken lawfully and used as evidence at trial. This infor-
mation should be brought to the attention of all investigative personnel.
Defendant, suspected by I11ternal Revenue officers of
running a numbers operation, lived in an apartment on the second floor
of an apartment building. The management of the apartment building
placed a common trash receptacle outside of the building but on the
same premises and made arrangements with a trash collector to pick
up the trash and haul it away. Defendant placed his trash in this
receptacle. The Federal offic·ers made an arrangement with the
trash collector to permit them to examine the contents of the common
trash receptacle after he had removed the trash from the premises,
which was done .three times a week. In this trash the officers found
adding machine tapes and other slips of paper on many of which tbe
defendant's handwriting was identified.

. Prior to trial the defendant brought a motion to suppress
the use of the referenced items as evidence, alleging that they had been
obtained by unreasonable search and seizure. The trial court held for
the gover11.. 1!1ent, the Circuit Court of Appeals 'agreed, and the Supreme
Court of the United States denied certiorari. U. S. v. Minker, 312 F2d
632, cert. den. , 83 S. Ct . 952 {1963). The gov-ernment ' s action was
upheld in this case because bythe time the officers took t his trash it
had been abandoned by the defendant. The taking of things which have
been abandoned is not an unreasonable search and seizure.
In applying this rule of law to investigative problems care
should be taken to make sure that the trash materialis not taken until it
has left those premises of the subject which are constitutionally pro-
tected against unreasonable search and seizure by the Fourth Amendment.
A person living in a typical dwelling house is protected in both his house
and the surrounding yard or curtilage. For this reason the trash must
be outside both the house and yard before it can be held to ·have been
abandoned. In the case of one who lives in an apartment, hotel room
or a room in a rooming house, the general rule of law is that his
constitutionally protected area does not extend beyond his apartment
or room. There are indications, however, but with insufficient
decisions to make the matter clear, that some courts might consider
such a person to have a constitutionally protected right in the hallways
of the building. For this reason

trash material can most positively
be corisidered abandoned only ·after it has been taken by the building
employee or other person from the point outside the apartment or
room to that .place in the basement or outside where collection is made
of all trash from the entire building. A person occupying an office or
business building has a constitutionally protected right therein, and
here again the fact of abandonment cannot be shown beyond a doubt until
the trash reaches that common trash depository beyond the office and
hallway immediately outside. If the trash is that of a company or ·
organization which controls the entire building, it would not be
abandoned until it had moved into the hands of the public trash collector
or the private contract trash collector hired to haul it :away. ·

Probe i ·s Urged •" The article said that the local unit of
the American Civil Liberties Union had urged a House sub-
committee to investigate trash-snooping in the District

It identified GALLAGHER as Chairman of a special
three-man subcommittee of the Government Operations Committee.
The arti.cle advised that Congressman GALLAGHER plans to look
into Government agencies investigative techniques, including
the use of wire taps and hidden microphones, which be said

captioned ·as above, contact was made by me today with ·C. ·
FRANCIS }RffiPHY, Chief, Special Assignments Division, Office
of Corporation Counsel, at his office in the Municipal
Building.
Mr. }1URPHY was informed the FBI did not have any
trash coverage in effect and had no request for such; and
that should this subject come up again it should be clearly
pointed out that the FBI is not one of those agencies as was
previously reported erroneously as having been provided
covers.

requested mostly by local police and the FBI. Recommendation is
being made that Washington Field Office (WFO) advise Murphy h-is

The article adds that Mayor Walter E. Washington
ordered a full investigation of trash snooping by sanitary
engineers after learning that they had cooperated with Navy
personnel in investigating a seaman who faces Navy charges
in connection with publication of an antiwar newspaper. The
Navy used a letter found in the seaman's trash as -evidence.
 


WFO in response to the Bureau's inquiry has advised

that it bas no trash covers in operation. therefore, an
