Mainly popular with locals, they serve great Thai seafood at affordable prices. Try Mee Hoon Kang Poo (yellow curry with crab meat eat & noodles) or Yam Gung Seab (sweet & spicy dried shrimp salad). Service can be a bit slow as it's busy most of the time .

The place is small and modest and it might be difficult to get a table , but it's worth the wait. Favourites include Fried Chicken with Cashew Nuts, Tom Yung Gung (Spicy & sour soup with prawns), Pad Thai , Panang Gai (a not-sospicy Thai chicken curry) & Deep Fried Fish with Salt. This place is cool and increasingly popular as the word spreads about the foo od .

10am-10pm. Southwest side of Panwa Cape, 200m south of Panwa Beach Resort. You can't get closer to the water! This one's right on the beach . Just 200 metres south of the resort, take the sloping track from the road down to the sea . This little restaurant and bar serves delicious Thai food , seafood and international favourites as well as cocktails. You can even sit at a table on the beach with the waves gently lapping around your feet.

Andrew de Bruin
General Manager at Multihull Solutions Asia, Andrew describes how a sailing adventure launched 15 years ago landed him in Phuket, where he’s made a career in the island’s emerging yachting scene ever since.
Where are you from? Originally Sydney, but I grew up in Adelaide, South Australia. What were you doing before you came to Phuket? I started sailing with my dad on dinghies, and then I got bored with sailing with my father, so started doing a bit of ocean racing and windsurfing, and continued on to spend a few seasons in the Mediterranean as a charter skipper. I’d work in the Med for the summer then come back to Australia to save money to go back again. I did that for three seasons then came back to Australia and worked as captain on a few boats. Eventually I worked for Hamilton Island Charters, which then became Sunsail in Australia. That’s when I met Mark Elkington, the principal of Multihull Solutions. About 15 years ago my wife and I set sail from Sydney and spent three years sailing around Southeast Asia until we ran out of money. After more work as a boat captain, we arrived in Phuket. I found a job with the yacht brokerage Lee Marine, where I worked for 10 years. Tell us about your current work with Multihull Solutions. Multihull Solutions is an Australian company with offices in New Zealand and the Pacific. We opened our first branch in Southeast Asia in Phuket at Boat Lagoon this January. There’s a definite need up here for a specialist in multihulls. I know this area, so I’m comfortable doing this here, with a view to opening branches in other countries in Southeast Asia in the next 12-18 months. For new boat sales, we have six main brands, and we also have 50+ brokerage pre-owned boats both here and in Australia. So when it comes to multihulls, both new and pre-owned, we can offer a service that none of the other brokers have. They might have only one brand of multihull, whereas we're able to offer a better range of options. We’ve already agreed to be Title Sponsor of the Ao Chalong Yacht Club's Multihull Regatta in July this year. You were recently at the Phuket Boat Show. How did that go? Great. We sold a boat on the first day to an expat living here in Phuket and made loads of really good leads. In the coming month we’ll find out how good or bad these leads are, but from previous experience the quality of the people we talked to at PIMEX was good. Are you seeing any effects from Thailand's political turmoil? We haven’t been open that long to notice anything, but in my experience these things come and go in Thailand. There’s always an effect, hotel numbers are down, with several countries issuing travel advisories, but Phuket is insulated from what happens in Bangkok. But the announcement in January by customs officials that yachts will have to register every two months instead of every six months is having more of an effect. Many people are saying they’re taking their boats out to Langkawi because the two-month rule just makes it impossible to keep a boat here. You’ve worked in Phuket for more than a decade. What advice would you give to other expats planning to work and do business here? Come with a well honed sense of patience. Thailand’s a great place to do business. It really is. There are so many opportunities here, especially in the marine industry. But you do have to have some patience and understand that not everybody does things the way they do back wherever you’re from. You need to be flexible. But having worked here for all these years, there are many moments when I’ve sat back and thought, “Wow, that ended up being way easier than I thought it was going to be.” This often happens just after you’re pulling your hair out wondering why it isn’t working – things have a way of sorting themselves out.

Tell us about your family. My wife, Donna Stephens, teaches at British International School – she’s the primary librarian there. We have two sons, Finn, who was born in 2001 here in Phuket, and Songkran, a Thai boy we’ve adopted, who’s four. Everybody calls him “Ikki”. Donna wrote a book, Phuket for Kids, about eight years ago and the book is now a website, Phuketforkids.com. As for all websites it requires a lot of work, and she’s also doing a masters in teacher librarianship. She’s a million miles an hour. Where do you live? We’ve lived here in Boat Lagoon for 12-13 years. We keep threatening to move because we’d like to live at a beach, but we find it’s just so convenient with great facilities. What do you do in your free time? Sailing, play squash, eating out, read books, go to movies. I still have the boat that I sailed up here on, a Swanson 36 named Awatea – it’s a New Zealand Maori name that means “new start” or “new dawn”. That was the original name when I bought it in about 1992 on Hamilton Island. I’ve actually sold it and bought it back three times now. What do you like best about living in Phuket? Being able to enjoy the sailing so easily. It’s fabulous. The racing at Ao Chalong Yacht Club, the various regattas, the whole family do that. What’s the most challenging thing about living here? Probably how frustrating it is to get little things done, like replacing a window in the house. The number of times you have to chase everything up. Those sort of things I find frustrating – in the end it works out fantastically because you get jobs done for half the price than you would if living in Sydney, but it can be frustrating getting to that point. Actually, the most frustrating thing I’ve ever done in Thailand is to adopt a child. Just because of the paperwork and the delays. It took us four and a half years, including two years after getting approved. I understand why it takes a long time to get approved, but then to have to wait for another two years is just crazy. It’s a bizarre system. But anyway it’s all worked out. We have our son now, and he’s great. Are you involved in any local charities, clubs or associations? The ACYC, we’ve supported its learn to sail and youth sailing, and we’ve always supported Phuket Has Been Good to Us foundation. We do some fundraising for the orphanage in Nakhon Sri Thammarat where we adopted our child. When you see the kids at the orphanage, you realise how fortunate you are. What do you think the future holds for you? We’ll be staying here in Phuket for a while with this new venture. We’re still undecided whether we’ll retire to Australia, but that’s years away and plans change. When we first arrived iwe were only planning to be here for a year or two … and we’re still here 13 years later.

Under new management...

Andaman Cabriolet Niña – a Langkawi Regatta regular and former Multihull Class winner

ot only was this year’s Royal Langkawi International Regatta (RLIR) the event that kicked off Visit Malaysia Year, but it was also the first edition ‘under new management’. After 11 years, the ‘face’ of Langkawi Regatta, Ahmad Zailani Bashah (fondly known as Zack), left for new pastures and Wicky Sundram took over the reigns – bringing with him breezes the like of which are rarely seen in and around Kuah Harbour. Not a bad start! Depending on who you ask, close to 44 boats (eight of whom made the journey from Phuket to be there) headed for the start line on Day 1 for five days of racing around buoys, around islands and along coastlines in winds up to 28 knots. Langkawi Regatta is one of the few in this region that is run out of a marina and yacht club, offering free berthing to participants. That alone makes it really attractive! No wet bums or tipped up dinghies in the surf. No wooden longtail boats banging up against glass-like gel coat for the fight to get ashore. Slip in, tie up, step off – and drop into Charlie’s place (the yacht club bar) for a few welldeserved, post-race cold ones. In years gone by, a large part of the Langkawi Regatta fleet was made up of visitors from Phuket. It’s a mystery why the numbers have dwindled this year to less than 20 percent of entries, given the slick organisation, the convenience, the excellent racing with classes to suit every level of racer – and the opportunity to grab a few days R & R on a slow boat back from Langkawi.

For us (Andaman Cabriolet Niña and Oasis) the trip from Phuket to Langkawi was a quick one, but on the way back we allowed ourselves a couple of overnight stops. First night was Ao Pante, a beautiful tranquil anchorage at the north end of Koh Tarutao, after an exhilarating sail in 15 knots breeze all the way. Those with more time, and a thirst for a change of pace after a week’s full-on racing, might want to explore ashore. There’s a mangrove creek, navigable by dinghy, that runs through a stunning limestone cave (Crocodile Cave). And there’s a small store, a restaurant and other basic facilities. National Park entry fees may apply… Our second night took us to the south end of Koh Muk, again with little need to ‘make noise’ on the way. A stunning all-tide beach and a sunset-facing ramshackle bar perched high on the rocks beckoned us for sundowners – after a short delay while Oasis sorted out some slight navigational issues (mmm... wrong anchorage... a question of east v. west...) and a brief excursion into Koh Muk's famous 'Emerald Cave' (a spectacular open-topped 'cave' accessed by dinghy through a pitch-black tunnel).

Dinner ashore involved a longish walk through the jungle to a place called ‘Cheap Cheap and Different’. And it was. Great inexpensive food followed an almost 2-hour wait (thankfully beer was not in short supply!) and the evening ended with a 3-wheeled motorbike taxi jungle race back to the beach (we won). Our third day saw us back on our Chalong mooring by midafternoon in plenty of time to get ashore on the tide. For Phuket-based boats, Langkawi Regatta IS about more than just the racing… but let’s revisit the racing because the regatta experience alone does make it worth the trip down. The racing in consistently windy conditions was, as always, superbly managed by the region’s most professional Principal Race Officer, the cool, calm and collected Simon James – albeit with a little help from his friends. A marine police start boat that refused to hold position in 28 knots breeze was swiftly sorted by Hong Kong’s gentleman racer, Frank Pong (Jelik) – with the loan of a 100kg anchor from his support boat. It's that kind of friendly regatta. Ashore in Langkawi, we enjoyed parties in the yacht club and at two different island resorts with a tremendous grand finale prizegiving bash complete with music, dancers, seemingly neverending fireworks and the traditional Malaysian sprinkling of glittering VIPs. Worthy of note is that, for the first time in 12 years, every single crew member was allocated a seat for the buffet dinner – finally overcoming one of the few consistent grumbles heard over the years. The eight classes were mostly well-subscribed, with only Ocean Rover and Multihull falling below five yachts. The latter is a bit surprising, not to mention disappointing, given the great show this class used to put on a few years back. As a catamaran owner who has raced in most of the 12 Langkawi Regattas, I can tell you multihull owners out there – YOU DON’T KNOW WHAT YOU’RE MISSING! A free multihull (double) berth for seven days in a top-notch yacht club marina! Great sailing amid wonderful scenery, good parties, top camaraderie – and all located on a duty-free paradise… Next year’s dates are 12-17 January 2015. About Chef Alessandro Frau Alessandro Frau was born in 1977 in Cagliari , Sardinia , Italy - the home of good food and wine . He trained with his grandmother and mother in their family kitchens and has a diploma in Tourism Management from D.A. Azuni school in Cagliari . At the age of 20 he moved to Sofra International Restaurant in London as Chef de Partie and then to Le Meridien Grosvenor House , also as Chef de Partie . In 2001 he returned to Sardinia and held several positions until becoming Chef de Cuisine at Cagliari's Le Meridien Chia Laguna . Always wanting to travel and experience new places, he accepted invitations as Chef de Cuisine at a Mexican Gastronomical Festival and on Swedish cruise liners, always slipping back to Sardinia in between . In December 2004 he was appointed Executive Chef at Sheraton Grande Laguna Phuket, where he was responsible for 11 dining and entertainment outlets with 128 staff. In February 2009 he achieved his dream and finally opened his own restaurant, Acqua at Kalim in Phuket, ably assisted by his fiancée Marcella . My dad has always, since my earliest memory, had a flair for creativity and a passion for the bizarre. As a child growing up in Bali, Indonesia, I used to lie awake at night re-living his bedtime stories. With chocolate-covered, strawberry pizzas and flying, talking elephants, I was able to fantasize for hours about the images that were so dramatically recounted to me by my dear pappy. He never dropped a detail and never failed to give complete lucidity to the wild and crazy scenarios that emerged from his imagination. This is what sets Paul Ropp, my father, apart from anyone else I know and establishes him as an artist. It is now that I am able to apply and connect his wild fantasy stories to his talent for detail and absurd geniality when it comes to making beautiful clothing. I have watched my father work for many years, and still cannot figure out or explain his flair for outrageous artistic fashion, or according to him: “Oooh and Aaah Art”. Just like in his stories, my dad can take the most outrageous and absurd and turn it into beauty. He imagines a world where people can use fashion as a form of therapy: “It’s cheaper than therapy!” he says, “The colours and designs are my way of making people smile”. He has incorporated, and been inspired by, the many beautiful colours found in old Asian traditions, such as the Balinese and Thai culture. His bold, vibrant colours and hand-embroidered fabrics make for double takes, the beautiful hand loomed silks and cottons entice a sense of freeness when worn and the way he puts them all together makes people look and feel great.



Having Asia as his headquarters, my father has used its inspiration in every creation. He has begun expanding into Thailand in the recent years, which proves to be a tactile move due to the fact that my father sees Bali and Thailand as sister islands. With an insatiable appetite for eye-catching clothing he has attracted even the biggest names in the world, including dressing Carlos Santana during his Asia tour in 2013.

These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukko’s own herb garden and picked just for your treatment, ensuring they are as fresh as can be. I was pampered with the “Be Balanced” package; a 3-hour experience that left me feeling relaxed and refreshed. This 3-treatment combination began with 30 minutes in the steam room and the Jacuzzi, followed by a Thai Turmeric Body Scrub designed to soften your skin and awaken your senses. The scrub was followed by Sukko Synergy Body Massage (see description opposite). “Is this pressure okay? Too strong? How are you feeling?” my therapist asked me from time to time. “Mmm…perfect…” were the only responses that seemed to suit how I felt. Contracts –Are they worth the paper they're written on?
Law firms often find themselves problem solving for clients who experience difficulties when counterparties breach contracts. At this stage, negotiations generally become compromise based, with a view to settle. Even when such negotiations take place out of court, the parties will look to the original contract to establish the parameters of any settlement. Many clients over the years have remarked that sometimes the length of time to settle a dispute through the courts in Thailand, combined with potential appeals of decision, means that contracts are perhaps not worth the paper they are written on. However, in practice, this is simply not true, as most parties will at least use a contract, however badly drafted, as a point of reference. Therefore, it is fair to say that contracts in Thailand ARE worth the paper they are written on, including the cost of obtaining advice on the best practical form of contract to enter into. In Phuket, the main types of contracts people enter into are: sale and purchase agreements for property; residential and office lease agreements; rental agreements; boat charter agreements; advertising agreements; construction agreements for renovation or for new properties; management agreements and some commercial contracts for businesses linked to hotels and tourism – including agency agreements. Approaches to such contracts vary according to the personalities of the parties, their wisdom, experience, some luck – and the quality of their legal advisers. Sometimes, if a party has a good lawyer, but doesn’t pay that lawyer to review their contract, that contract can be startlingly poor and create risk and liability which is stored up for a rainy day, of which there are many in Phuket.

Memorandums of Understanding
Most lawyers first receive practical training on contracts by learning of the differences between ‘binding’ and ‘non-binding’ negotiations, reliance on contracts and the consideration for an agreement. There is a startling difference between common law jurisdictions and coded law jurisdictions, that can surprise clients who are experienced in business transactions outside of Thailand, but are not aware of what creates a binding enforceable obligation. Memorandums of Understanding (“MOUs”) are an ideal way to consolidate the typical modern way of agreeing terms – email exchange. Email exchanges often contain representations that can be changed in a matter of seconds, when circumstances change, and MOUs can ensure that reneging on terms by email can be avoided.

Expanding Terms in the Full Binding Agreement
The art of a good draftsperson is to be able to turn an MOU into something more valuable for the parties. Some clients often ask – if the MOU contains the commercial terms, what is the point of spending monies on advice for a fuller agreement. Will the full agreement just contain ‘boilerplate’ or standard contract terms that any person can Google and slot into the Agreement? In practice, a full agreement should deal with termination rights, remedies for termination, indemnities where one party protects another against claims and mechanisms and procedures for fulfilling terms of the MOU in a fuller, more precise manner. Often attachments and drawings not available in the often hurried MOU stage can be properly attached to the full contract

Litigation: Court Proceedings and Enforcement
Does a court case take five years in Thailand? Sometimes. However, if a case is straightforward, the process can be a lot faster than that. Recently we assisted on a labour case for non-payment of salary, where the process from first hearing to judgment can be a few months. In this particular example, the lawyers for the employer, which illegally failed to pay a last month’s salary, botched their plan to appeal by submitting the appeal days late. Said law firm then attempted to appeal the refusal to accept the appeal, in order to erroneously try to avoid the consequences of their mistake. In this situation, enforcement of the judgment is already available, even with an appeal over the refusal to accept an appeal. Therefore, delay tactics by other parties are not always successful, and cases can be concluded more swiftly than the generally pessimistic prevailing views normally dictate. Contracts are worth MORE than the paper they are written on; they are worth the value of the consideration or payments under the contract, the value of the experience by the draftspersons, the legal fees spent on vetting the agreement and the protection and security of at least having a strong point of reference and some remedies, if things go wrong at a later date. The need for integration.
The key systems of security are intrusion detection, access control, and video surveillance. If each of these systems is installed separately, administration and training can burden a company or property owner. When did you set up the business? Nikki Beach was born in Miami Beach, Florida (USA) in 1998 to celebrate the life of my daughter Nicole. It started as a beautiful garden by the sea, which we called Café Nikki, where friends and family could get together and share great times. We didn't have plans for a global brand. However, the magic between our family concept and our customers created a demand. It was then that we decided to strategically expand worldwide, while always keeping the core message behind Nikki Beach, “a celebration of life”, of utmost importance by ensuring each location combines the key elements of Dining, Entertainment, Music, Fashion, Film and Art into one – which, in addition to family and friends, are the things in life that Nicole loved most. Phuket has always been on our priority list of great locations for Nikki Beach and with five successful years in Koh Samui, the opening of Nikki Beach Phuket is a great accomplishment for our growing brand. Our Phuket location was built in partnership with Singapore-based Castlewood Group. What did you do before Nikki Beach? A long time ago, I worked at McDonald’s as a cook for 85 cents an hour and eventually became one of the largest franchise owners with 16 McDonald’s in South Florida. I then moved into the entertainment and hospitality industry, quickly finding success as the owner of several clubs in Fort Lauderdale, Miami and Daytona. In 1988, I opened Penrod's Beach Club on South Beach changing the area’s demographics from a retired community to a young, vibrant and trendy crowd. In 1998 (after losing my daughter Nicole to a tragic car accident in 1997) I decided to honour and celebrate her life by transforming Penrod’s Beach Club’s success into Nikki Beach. Now, 15 years later, with the opening of Phuket, I have 10 permanent Nikki Beach (Beach Club & Restaurant and Hotel Resort) locations all around the world. Where are you from? I was born in Columbus, Ohio, USA, but grew up in South Florida. What’s different about Nikki Beach? Someone once told me we changed the way people party around the world. I'm not sure if we did or not, but our commitment is to celebrate life. Every Nikki Beach brings the elements of great food along with fun entertainment, music to cater to different generations and cultures and fashion shows and art. We're not about heavy partying. It's about having fun with your family and friends. We keep a very good balance. Why would someone choose Nikki Beach against your competition? There's a strong sense of family within the entire organisation and I believe this message is clearly present at all our locations. We have customers who have visited every single one of our Nikki’s throughout the world because we strive to make them feel comfortable and at home. When they see our staff, they feel that they're home. Tell us about your role in the business? I'm very involved in every aspect of Nikki Beach. We're a family owned and operated business. My wife Lucia, my son Mike and my son-in-law Peter are active members of the Executive Board. Each one of them handles a specific area of the business.

What are the main challenges? I really don't have any. I created an Executive Board five years ago made up of five people (family and non-family), and gave each one a specific area of the business to run. I've been coaching them on how to run the business and I'm very happy with the results. My role as the coach is a very rewarding one. …and what are the biggest difficulties? Keeping us all grounded and humble. Our daily mantra is that “it is all about Nikki.” What's your main target market? It's a broad spectrum, but particularly a discerning, jet-set crowd that travels regularly and has the financial freedom to choose the best. Our main target is never about age demographics or income scales. The typical patronage of our international Nikki Beach destinations are those coming to celebrate life, relax and enjoy themselves with friends and family. What do you like most about what you do now? Seeing the team expand their wings and become successful Nikki Beach managers, which translates into creating the magic of Nikki Beach everywhere we send them. To see our customers feel at home at all our locations and celebrate their life’s best moments with us. To hear their comments about our great food and our friendly and impeccable service; it’s a dream come true. And what do you like least…? I delegate what I don't enjoy doing any more as I've created a team that I trust to handle accordingly. What do you expect to achieve within the next 3-5 years? Continue growing the Beach Club division (we currently have 10 permanent beach club locations around the world) and put more emphasis on Nikki Beach Hotel & Resort division. In five years I expect to have 10 Nikki Beach Hotels & Resorts open. What about CSR (Corporate Social Responsibility)? We participate in many charity events around the world. How does your typical day ‘at work’ go? I start my day with a great cup of coffee, check my emails and make calls around the world to talk to our managers so I can keep current with our business. I spend a lot of my time on new locations. My office is my iPhone. How would you describe your leadership style? Well, I constantly keep everybody informed with my goals. I never ask anyone to do something I've never done myself and I bring my management into a bonus system where there’s ownership on premise at each location. What is your over-riding ambition at this stage in your life? To pass this business on to people I love.

Phuket Nai Harn lifeguards offer rescue to recovery service

Nai Harn beach is renowned as the idyllic Phuket beach, representing the wonderful beauty that Phuket has to offer. But its charming exterior hides a hazardous well-known secret. In the winter high season it's a benign playground for swimmers and boaters alike, but in the summer south westerlies, its rip currents can be a serious issue. At a recent meeting, Rawai municipality agreed a full cooperation agreement with the new social enterprise, Safer Phuket, and with Phuket Life Guard Club, that will see Nai Harn become a standard bearer for Safer Phuket’s drive to build Phuket Lifeguard Club into a world-leading lifeguard service. In response to the Rawai commitment, the project received a huge vote of confidence recently with the news that USA company, Zoll, one of the world’s leading defibrillator manufacturers, will become a sponsor and partner. Working with their local Thai distributor, Saint Med, they will donate an AED (Automatic External Defibfrillator) to the new Nai Harn beach project and will provide enhanced training in Basic Life Support to all lifeguards so that they can operate the full ‘chain of survival’. Drowning victims often suffer cardiac arrest and survival depends on a series of critical interventions. The term 'chain of survival' has been used to describe this sequence and it has four interdependent links: early access, early basic cardiopulmonary resuscitation (CPR), early defibrillation, and early advanced cardiac life support. While all links are important, early defibrillation is often the most critical link in the chain of survival. The speed of rescue and early initiation of the chain of survival will improve victim outcomes. Duncan Stewart of Safer Phuket said, “This is an expensive but essential tool in beach safety and we welcome the support of Zoll and Saint Med. We're building a strong sponsor portfolio of local and international companies who share our vision of world-leading safety standards.” Research has shown the huge impact that these AED devices can have on rescue and resuscitation rates. There is no doubt that having an AED on the beach, and with fully trained lifeguards, our swimmers and beach users will be able to have complete confidence in safety support services.

Khun Sorajja Boonprasit, co-managing director of Saint Med supported this view, “As one of Thailands leading medical supply companies, we're very keen to see AEDs in as many public locations as possible, just as they are in other countries.
