THE MINISTER OF TRADE OF THE
REPUBLIC OF INDONESIA,
Menimbang: Considering:
a. bahwa produk pertambangan hasil pengolahan
dan pemurnian di dalam kebijakan hilirisasi
mempunyai peranan penting dalam
pertumbuhan ekonomi nasional dan
pembangunan daerah secara berkelanjutan,
sehingga pengusahaannya harus
memperhatikan daya saing, efisiensi dan
kelanjutan berusaha;
a. that processed and refined/smelted mining
products within the scope of downstreaming
policy have such an important role in the
sustainable growth of national economics and
regional development that their
commercialization should consider the
competitiveness, efficiency and continuing
business;
b. bahwa dalam rangka mendukung upaya tertib
usaha di bidang pertambangan, hasil
pengolahan dan pemurnian di dalam negeri
serta menciptakan kepastian usaha dan
kepastian hukum sehubungan dengan
kebijakan hilirisasi sebagaimana dimaksud
dalam huruf a, perlu dilakukan pengaturan
terhadap ekspor produk pertambangan hasil
pengolahan dan pemurnian;
b. that in support of the use of an effort to
maintain good order of business in the field of
mining, domestic processing and
refining/smelting products and to create the
business certainty and legal certainty with
respect to the downstreaming program as
referred to in point (a), it is necessary to
regulate export of processed and
refined/smelted mining products;
c. bahwa berdasarkan pertimbangan
sebagaimana dimaksud dalam huruf a dan
huruf b, perlu menetapkan Peraturan Menteri
Perdagangan tentang Ketentuan Ekspor
Produk Pertambangan Hasil Pengolahan dan
Pemurnian;
c. that in consideration of point (a) and point (b),
it is necessary to issue Regulation of the
Minister of Trade concerning Provisions for
Export of Processed and Refined/Smelted
Mining Products;

TENTANG KETENTUAN EKSPOR PRODUK
PERTAMBANGAN HASIL PENGOLAHAN
DAN PEMURNIAN.
REGULATION OF THE MINISTER OF TRADE
CONCERNING PROVISIONS FOR EXPORT
OF PROCESSED AND REFINED/SMELTED
MINING PRODUCTS.
Pasal 1 Article 1
Dalam Peraturan Menteri ini yang dimaksud
dengan:
In this Regulation of the Minister of Trade:
1. Ekspor adalah kegiatan mengeluarkan barang
dari daerah pabean.
1. Export means the activity to bring goods out
of the customs zone.
2. Produk pertambangan hasil pengolahan
adalah sumber daya alam tidak terbarukan
yang digali dari perut bumi yang telah diolah
berupa mineral logam yang telah mencapai
batasan minimum pengolahan yang ditetapkan
oleh Menteri ESDM.
2. Processed mining products means non-
renewable natural resources excavated from
the bowels of the earth, processed into metal
minerals, and fulfilling such minimum
processing specifications as the Minister of
Energy and Mineral Resources may
determine.
3. Produk pertambangan hasil pengolahan
dan/atau pemurnian adalah sumber daya alam
tidak terbarukan yang digali dari perut bumi
yang telah diolah dan/atau dimurnikan berupa
mineral logam, mineral bukan logam dan
batuan yang telah mencapai batasan minimum
pengolahan dan/atau pemurnian yang
ditetapkan oleh Menteri ESDM.
3. Processed and/or refined/smelted mining
products means non-renewable natural
resources excavated from the bowels of the
earth, processed and/or refined/smelted into
metal minerals, nonmetal minerals and rocks,
and fulfilling such minimum processing
and/or refining/smelting specifications as the
Minister of Energy and Mineral Resources
may determine.

4. Eksportir Terdaftar Produk Pertambangan
Hasil Pengolahan dan Pemurnian, yang
selanjutnya disebut ET-Produk Pertambangan
Hasil Pengolahan dan Pemurnian adalah
perusahaan yang telah mendapat pengakuan
untuk melakukan Ekspor Produk
Pertambangan Hasil Pengolahan dan/atau
Pemurnian.
4. Registered Processed and/or Refined/Smelted
Mining Product Exporter, hereinafter called a
Registered Processed and/or Refined/Smelted
Mining Product Exporter, means a company
that is certified to export Processed and/or
Refined/Smelted Mining Products.
5. Persetujuan Ekspor adalah izin untuk
melakukan ekspor produk pertambangan yang
sudah mencapai batasan minimum
pengolahan.
5. Export Approval means a license to export
mining products that have fulfilled the
minimum processing specifications.
6. Izin Usaha Pertambangan, yang selanjutnya
disingkat IUP, adalah izin untuk
melaksanakan usaha pertambangan.
6. Mining Permit, hereinafter called a Mining
Permit, means a permit under which mining
business is conducted.
7. Izin Usaha Pertambangan Operasi Produksi,
yang selanjutnya disebut IUP Operasi
Produksi, adalah izin usaha yang diberikan
setelah selesai pelaksanaan IUP Eksplorasi
untuk melakukan tahapan kegiatan operasi
produksi.
7. Production Operation Mining Permit,
hereinafter called a Production Operation
Mining Permit, means a business permit that
is granted upon completion of the Exploration
Mining Permit stage to undertake the
production operation stage.
8. Izin Usaha Pertambangan Khusus, yang
selanjutnya disingkat IUPK, adalah izin untuk
melaksanakan usaha pertambangan di wilayah
izin usaha pertambangan khusus.
8. Special Mining Permit, hereinafter called a
Special Mining Permit, means a business
permit to conduct mining business in a special
mining permit area.
9. Izin Usaha Pertambangan Khusus Operasi
Produksi, yang selanjutnya disebut IUPK
Operasi Produksi, adalah izin usaha yang
diberikan setelah selesai pelaksanaan IUPK
Eksplorasi untuk melakukan tahapan kegiatan
operasi produksi di wilayah izin usaha
pertambangan khusus.
9. Production Operation Special Mining Permit,
hereinafter called a Production Operation
Special Mining Permit, means a business
permit that is granted upon completion of the
Exploration Special Mining Permit stage to
undertake the production operation stage in a
special mining permit area.
10. Izin Usaha Industri, yang selanjutnya
disingkat IUI, adalah izin usaha industri yang
diberikan kepada perusahaan yang melakukan
tahapan kegiatan industri untuk pengolahan
dan/atau pemurnian.
10. Industrial License, hereinafter called an
Industrial License, means an industrial license
that is granted to a company engaged in the
processing and/or refining/smelting industry.
11. Verifikasi atau Penelusuran Teknis adalah
penelitian dan pemeriksaan barang ekspor
yang dilakukan Surveyor.
11. Verification or Scrutiny means a check on and
examination of export goods made by a
Surveyor.
12. Surveyor adalah perusahaan survey yang
mendapat otorisasi untuk melakukan
pemeriksaan teknis Ekspor Produk
Pertambangan Hasil Pengolahan dan
Pemurnian.
12. Surveyor means a survey company that is
authorized to technically examine Export of
Processed and Refined/Smelted Mining
Products.

13. Indonesia National Single Window, yang
selanjutnya disebut INSW, adalah sistem
nasional Indonesia yang memungkinkan
dilakukannya suatu penyampaian data dan
informasi secara tunggal (single submission of
data and information), pemrosesan data dan
informasi secara tunggal dan sinkron (single
and synchronous processing of data and
information), dan pembuatan keputusan
secara tunggal untuk pemberian izin
kepabeanan dan pengeluaran barang (single
decision-making for custom release and
clearance of cargoes).
13. Indonesia National Single Window,
hereinafter called INSW, means Indonesias
national system that enables single
submission of data and information, single
and synchronous processing of data and
information, and single decision-making for
customs release and clearance of cargoes.
14. Portal INSW adalah sistem yang akan
melakukan integrasi informasi berkaitan
dengan proses penanganan dokumen
kepabeanan dan pengeluaran barang, yang
menjamin keamanan data dan informasi serta
memadukan alur dan proses informasi antar
sistem internal secara otomatis, yang meliputi
sistem kepabeanan, perizinan, kepelabuhanan/
kebandarudaraan, dan sistem lain yang terkait
dengan proses penanganan dokumen
kepabeanan dan pengeluaran barang.
14. INSW Portal means a system by which
information in connection with customs and
export clearance is integrated, which assures
of data and information security, and
automates the information flow and process
among such internal systems as customs,
licensing, ports/airports, and others in
connection with customs and export
clearance.
15. Pelabuhan Mandatori adalah pelabuhan yang
ditetapkan sebagai pelabuhan penerapan
INSW ekspor secara penuh.
15. Mandatory Port means a port that is
confirmed as a port to fully apply the export
INSW.
16. Wilayah Kosong adalah wilayah yang
memiliki potensi menjadi sumber Produk
Pemurnian tetapi belum menjadi wilayah
kerja Surveyor.
16. Potential Open Area means an area with the
potential to be the source of the Processed and
Refined/Smelted Mining Products but not yet
being the working area of the Surveyor.
17. Rekomendasi adalah surat keterangan yang
diterbitkan oleh pejabat instansi/unit teknis
terkait yang berwenang dan merupakan
pertimbangan teknis untuk diterbitkan
Persetujuan Ekspor.
17. Recommendation means a statement that is
issued by a competent official of the relevant
technical agency/unit and constitutes a
technical consideration under which an Export
Approval is issued.
18. Menteri adalah menteri yang
menyelenggarakan urusan pemerintahan di
bidang perdagangan.
18. Minister means the minister that administers
the governmental affairs in the field of trade.
19. Menteri Energi dan Sumber Daya Mineral,
yang selanjutnya disebut Menteri ESDM
adalah menteri yang menyelenggarakan
urusan pemerintahan di bidang energi dan
sumber daya mineral.
19. Minister of Energy and Mineral Resources,
hereinafter called the Minister of Energy and
Mineral Resources, means the Minister that
administers the governmental affairs in the
field of energy and mineral resources.
20. Menteri Perindustrian adalah menteri yang
menyelenggarakan urusan pemerintahan di

administers the governmental affairs in the

21. Direktur J enderal adalah Direktur J enderal
Perdagangan Luar Negeri Kementerian
Perdagangan.
21. Director General means the Director General
of Foreign Trade of the Ministry of Trade.
22. Dirjen Minerba adalah Direktur J enderal
Mineral dan Batubara Kementerian Energi
dan Sumber Daya Mineral.
22. Director General of Minerals and Coal means
the Director General of Minerals and Coal of
the Ministry of Energy and Mineral
Resources.
23. Dirjen BIM adalah Direktur J enderal Basis
Industri Manufaktur Kementerian
Perindustrian.
23. Director General of Manufacturing-Based
Industry means the Director General of
Manufacturing-Based Industry of the Ministry
of Industry.
Pasal 2 Article 2
(1) Produk Pertambangan yang berasal dari
mineral logam yang sudah mencapai batasan
minimum pengolahan dan/atau pemurnian,
mineral bukan logam, dan batuan yang sudah
mencapai batasan minimum pengolahan
merupakan Produk Pertambangan yang
dibatasi ekspornya.
(1) Metal mineral Mining Products that have
fulfilled the minimum processing and/or
refining/smelting specifications and nonmetal
mineral and rock Mining Products that have
fulfilled the minimum processing
specifications shall be the Mining Products
that are subject to export restriction.
(2) Produk Pertambangan hasil pengolahan
dan/atau pemurnian sebagaimana dimaksud
pada ayat (1) tercantum dalam Lampiran I dan
Lampiran II yang merupakan bagian tidak
terpisahkan dari Peraturan Menteri ini.
(2) Processed and/or refined/smelted Mining
Products as referred to in section (1) are
provided in Appendix I and Appendix II,
made inseparable parts of this Regulation of
the Minister.
(3) Produk Pertambangan yang berasal dari
mineral logam, mineral bukan logam, dan
batuan dalam bentuk ore dan belum mencapai
batasan minimum pengolahan dan/atau
pemurnian dilarang diekspor.
(3) Metal mineral, nonmetal mineral and rock
Mining Products in ore form and not yet
fulfilling the minimum processing and/or
refining/smelting specifications are prohibited
from being exported.
(4) Produk Pertambangan yang dilarang diekspor
sebagaimana dimaksud pada ayat (3)
tercantum dalam Lampiran III yang
merupakan bagian tidak terpisahkan dan
Peraturan Menteri ini.
(4) Prohibited export Mining Products as referred
to in section (3) are provided in Appendix III,
made an inseparable part of this Regulation of
the Minister.
Pasal 3 Article 3
Produk Pertambangan yang berasal dari mineral
logam sebagaimana tercantum dalam Lampiran II
yang sudah mencapai batasan minimum
pengolahan hanya dapat diekspor sampai dengan
tanggal 12 J anuari 2017.
Metal mineral Mining Products as provided in
Appendix II may, upon fulfillment of the
minimum processing specifications, be exported
until J anuary 12, 2017.
Pasal 4 Article 4
(1) Pelaksanaan ekspor Produk Pertambangan (1) Mining Products provided in Appendix I and

yang tercantum dalam Lampiran I dan
Lampiran II sebagaimana dimaksud dalam
Pasal 2 ayat (2), hanya dapat dilakukan oleh
perusahaan yang telah mendapatkan
pengakuan sebagai ET-Produk Pertambangan
Hasil Pengolahan dan Pemurnian dari
Menteri.
Appendix II as referred to in Article 2 section
(2) may be exported by a company that has
acquired a Registered Processed and
Refined/Smelted Mining Product Exporter
certificate from the Minister.
(2) Menteri mendelegasikan kewenangan
penerbitan pengakuan sebagai ET-Produk
Pemurnian kepada Direktur J enderal.
(2) The Minister shall delegate his/her power to
the Director General to issue a Registered
Product Exporter certificate.
(3) Untuk mendapat pengakuan sebagai ET-
Pemurnian, perusahaan harus mengajukan
permohonan tertulis kepada Direktur J enderal
dengan melampirkan persyaratan:
(3) To acquire a Registered Processed and
certificate, a company must submit a written
application to the Director General by
enclosing the following required
documentation:
a. fotokopi IUP Operasi Produksi atau
IUPK Operasi Produksi atau IUP Operasi
Produksi khusus untuk pengolahan dan
pemurnian atau IUI;
a. a photocopy of the Production Operation
Mining Permit or Production Operation
Special Mining Permit or Production
Operation Mining Permit specifically for
processing and refining/smelting or
Industrial License;
b. fotokopi Nomor Pokok Wajib Pajak
(NPWP);
b. a photocopy of the Taxpayer ID Number;
c. fotokopi Tanda Daftar Perusahaan (TDP);
dan
c. a photocopy of the Company Registration
Number; and
d. Rekomendasi dari kementerian teknis
terkait:
d. a Recommendation from the relevant
competent ministries:
1) Pemilik IUP Operasi Produksi, IUPK
Operasi Produksi dan pemilik IUP
Operasi Produksi khusus untuk
pengolahan dan pemurnian,
diperoleh dari Menteri ESDM;
1) for holders of the Production
Operation Mining Permit, Production
Operation Special Mining Permit and
Production Operation Mining Permit
specifically for processing and
refining/smelting, from the Minister

Pasal 7 Article 7
Tata cara pemberian Rekomendasi sebagaimana

representative offices in Indonesia;
d. memiliki tenaga ahli bersertifikat sebagai
verifikator, drafter, analis laboratorium
dan geologis;
d. engage certified expert staff as a
verifying officer, drafter, laboratory
analyst and geologist;
e. memiliki paling sedikit 3 (tiga)
laboratorium sendiri yang terakreditasi
dengan peralatan lengkap dan dapat
bekerja sama dengan laboratorium lain
yang sesuai dengan lingkup produk
pertambangan;
e. have at least 3 (three) accredited
laboratories of its own with complete
equipment and in cooperation with other
laboratories within the scope of mining
products;
f. laboratorium sebagaimana dimaksud
pada huruf e harus berada di wilayah
kerjanya yang berbeda; dan
f. laboratories as referred to in point (e)
must be located in their different working
areas; and
g. mempunyai rekam jejak (track record)

Pasal 10 Article 10

(1) Untuk dapat dilakukan Verifikasi atau
Penelusuran Teknis, ET-Produk
Pemurnian harus mengajukan permohonan
Verifikasi atau Penelusuran Teknis kepada
Surveyor.
(1) For Verification or Scrutiny, a Registered
Product Exporter must submit an application
for Verification or Scrutiny to the Surveyor.
(2) Verifikasi atau Penelusuran Teknis oleh
Surveyor sebagaimana dimaksud pada ayat
(1) meliputi:

areas from w they originate;
b. jumlah produk pertambangan hasil
pengolahan dan/atau pemurnian;
b. the quantities of the processed and/or
refined/smelted mining products;
c. jenis dan spesifikasi produk
pemurnian yang mencakup Nomor Pos
Tarif/HS melalui analisis kuantitatif di
laboratorium; dan
c. the types and specifications of the
processed and/or refined/smelted mining
products, including the Headings/HS in
the laboratory quantitative analysis; and
d. waktu pengapalan dan pelabuhan muat. d. the timing of shipment and port of
loading.
(3) Penelitian dan pemeriksaan terhadap data atau
keterangan mengenai keabsahan administrasi
dan wilayah asal produk pertambangan hasil
pengolahan dan/atau pemurnian sebagaimana
dimaksud pada ayat (2) huruf a meliputi:

e. kesesuaian antara IUP Operasi Produksi, e. the consistency of the Production

pengolahan dan/atau pemurnian; dan

the areas from which the processed
and/or refined/smelted mining products
originate; and
f. bukti pelunasan pembayaran royalti. f. the proof of payment for royalties.
(4) Hasil Verifikasi atau Penelusuran Teknis yang
telah dilakukan oleh Surveyor sebagaimana
dimaksud pada ayat (1) dituangkan dalam
bentuk Laporan Surveyor (LS) disertai hasil
analisa kuantitatif yang terkandung dalam
produk pertambangan hasil pengolahan
dan/atau pemurnian.
(4) Any findings of the Verification or Scrutiny
made by the Surveyor as referred to in section
(1) shall be stated in the Surveyor Report,
accompanied by the results of the quantitative
analysis of the content of the processed and/or
refined/smelted mining products.
(5) ET-Produk Pertambangan Hasil Pengolahan
dan Pemurnian dan LS digunakan sebagai
dokumen pelengkap pabean yang diwajibkan
untuk pendaftaran Pemberitahuan Ekspor
Barang (PEB).
Mining Product Exporter certificate and a
Surveyor Report shall be used as supporting
documentation for customs clearance required
for registration of Export Declaration.
(6) Penerbitan LS oleh Surveyor paling lambat 1
(satu) hari setelah pemeriksaan muat barang
dilakukan.
(6) A Surveyor Report shall be issued by the
Surveyor within 1 (one) day upon
examination of loading.
(7) LS yang diterbitkan oleh Surveyor hanya
dapat dipergunakan untuk 1 (satu) kali
pengapalan untuk pendaftaran 1 (satu) nomor
PEB.
(7) A Surveyor Report issued by the Surveyor
may be used only for 1 (one) time shipment
and registration of 1 (one) Export Declaration
number.
(8) Biaya yang dikeluarkan atas pelaksanaan
Verifikasi atau Penelusuran Teknis Ekspor
produk pertambangan hasil pengolahan dan
pemurnian yang dilakukan oleh Surveyor
dibebankan kepada ET-Produk Pertambangan
Hasil Pengolahan dan Pemurnian.
(8) Any fees incurred arising out of the
Surveyors Verification or Scrutiny with
respect to export of processed and
refined/smelted mining products shall be
charged to the Registered Processed and
Refined/Smelted Mining Product Exporter.
(9) Atas pelaksanaan Verifikasi atau Penelusuran
Teknis Ekspor produk pertambangan yang
dilakukannya, Surveyor memungut imbalan
jasa yang besarannya ditentukan dengan
memperhatikan azas manfaat.
(9) A Surveyor shall, for the Verification or
Scrutiny services with respect to export of
mining products, charge a fee, which amount
shall be determined with due regard to the
principle of benefit.

Pasal 11 Article 11
(1) Surveyor yang akan melakukan Verifikasi
atau Penelusuran Teknis sebagaimana
dimaksud dalam Pasal 10 ayat (2) di daerah
yang belum ditetapkan sebagai wilayah

Pemurnian dapat mengajukan permohonan
Verifikasi atau Penelusuran Teknis kepada
Surveyor.
Mining Product Exporter may, for any
products originating from a Potential Open
Area, submit to the Surveyor an application
for Verification or Scrutiny.
(2) Verifikasi atau Penelusuran Teknis terhadap
dan/atau pemurnian yang berasal dan Wilayah
Kosong oleh Surveyor hanya dapat dilakukan
setelah mendapatkan persetujuan khusus dari
Direktur J enderal dan dilaksanakan sesuai
dengan ketentuan sebagaimana dimaksud
dalam Pasal 10 dan Pasal 11.
(2) Verification or Scrutiny of any processed
and/or refined/smelted mining products
originating from a Potential Open Area may
be made by the Surveyor upon acquiring a
special approval from the Director General
and shall be implemented under Article 10
and Article 11.
(3) Untuk mendapatkan persetujuan khusus

Surveyor harus mengajukan permohonan

paling banyak 1 (satu) kali.
(4) A Surveyor may issue a Surveyor Report on
the findings of the Verification or Scrutiny of
the processed and/or refined/ smelted mining
products originating from a Potential Open
Area as referred to in section (2) not
exceeding 1 (one) time.

Pasal 13 Article 13
Verifikasi atau Penelusuran Teknis ekspor produk
pemurnian yang dilakukan oleh Surveyor tidak
mengurangi kewenangan instansi teknis terkait
untuk melakukan pemeriksaan terhadap ekspor
produk pertambangan hasil pengolahan dan/atau
pemurnian.
Verification or Scrutiny of export of processed
and/or refined/smelted mining products made by
the Surveyor shall not derogate from the power of
the competent agencies to make examination of
export of processed and/or refined/smelted mining
products.
Pasal 14 Article 14
dan Pemurnian wajib menyampaikan laporan
tertulis mengenai pelaksanaan ekspor, baik
terealisasi maupun tidak terealisasi secara
periodik setiap bulan paling lambat tanggal 15
(lima belas) bulan berikutnya kepada Direktur
J enderal dalam hal ini Direktur Ekspor
Produk Industri dan Pertambangan dengan
tembusan kepada Dirjen Minerba dan/atau
Dirjen BIM.
Mining Product Exporter must submit a
written report on the realized or unrealized
export at a regular monthly interval no later

Pasal 15 Article 15
(1) Surveyor wajib menyampaikan LS melalui
http://inatrade.kemendag.go.id yang akan
diteruskan ke Portal INSW.
(1) A Surveyor must submit a Surveyor Report
through http://inatrade.kemendag.go.id, for
referral to the INSW Portal.
(2) Bagi Surveyor yang menerbitkan LS di
Pelabuhan Mandatori wajib menyampaikan
LS sebagaimana dimaksud pada ayat (1)
setelah LS diterbitkan.
(2) A Surveyor issuing a Surveyor Report at the
Mandatory Port must, upon issue of the
Surveyor Report, submit a Surveyor Report as
referred to in section (1).
(3) Bagi Surveyor yang menerbitkan LS pada
selain Pelabuhan Mandatori wajib
menyampaikan LS sebagaimana dimaksud
pada ayat (1) paling lambat 1 (satu) minggu
setelah diterbitkan.
(3) A Surveyor issuing a Surveyor Report other
than at the Mandatory Port must submit a
Surveyor Report as referred to in section (1)
within 1 (one) week of the issue.
(4) Surveyor wajib memastikan bahwa produk
pemurnian yang diekspor sesuai dengan yang
tercantum dalam LS sebagaimana dimaksud
dalam Pasal 10 ayat (4).
(4) A Surveyor must ensure that the processed
and/or refined/smelted mining products for
export are consistent with those stated in the
Surveyor Report as referred to in Article 10
section (4).
Pasal 16 Article 16
(1) Surveyor sebagaimana dimaksud dalam Pasal (1) A Surveyor as referred to in Article 8 section

(3) A Surveyor must submit a recapitulation of
the Surveyor Report as referred to in Article 9
section (4) every month to the Director
General through the Director of Industrial and
Mining Product Export, in the format
provided in Appendix IX, made an
inseparable part of this Regulation of the
Minister.
Pasal 17 Article 17
(1) Pengakuan ET-Produk Pertambangan Hasil
Pengolahan dan Pemurnian dicabut apabila:
Exporter certificate shall be revoked:
a. setelah diperiksa kembali, dokumen yang
disampaikan untuk mendapatkan
pengakuan sebagai ET-Produk
Pemurnian terbukti tidak benar;
a. if upon re-examination, the documents
submitted for an application for a
certificate are found incorrect;
b. tidak menyampaikan laporan
sebagaimana dimaksud dalam Pasal 14
sebanyak 3 (tiga) kali;
b. for 3 (three)-time failure to submit a
report as referred to in Article 14;
c. mengubah, menambah dan/atau
mengganti isi yang tercantum dalam
dokumen pengakuan sebagai ET-Produk
Pemurnian;
c. for tampering with, adding and/or
changing the contents stated in the
Registered Processed and
Refined/Smelted Mining Product
Exporter certificate;
d. mengekspor produk pertambangan yang
jenis dan/atau jumlahnya tidak sesuai
dengan yang tercantum dalam dokumen
ekspor produk pertambangan hasil
pengolahan dan/atau pemurnian; dan/
atau
d. for exporting mining products with the
types and/or quantities being inconsistent
with those stated in the processed and/or
refined/smelted mining product export
documentation; and/or

e. dinyatakan bersalah oleh pengadilan atas
tindak pidana yang berkaitan dengan
penyalahgunaan pengakuan sebagai ET-
Produk Pertambangan Hasil Pengolahan
dan Pemurnian.
e. if convicted in court of a criminal offense
in connection with the misuse of the
certificate.
(2) Pencabutan pengakuan sebagai ET-Produk
Pemurnian sebagaimana dimaksud pada ayat
(1) ditetapkan oleh Direktur J enderal atas
nama Menteri.
(2) Revocation of the Registered Processed and
certificate as referred to in section (1) shall be
issued by the Director General in the name of
the Minister.
dan Pemurnian yang dikenai sanksi
pencabutan sebagaimana dimaksud pada ayat
(2) hanya dapat mengajukan permohonan
untuk memperoleh pengakuan sebagai ET-
Pemurnian setelah 1 (satu) tahun dan harus
mendapat rekomendasi pengaktifan kembali
dari Menteri ESDM atau Menteri
Perindustrian sesuai dengan kewenangannya.
Mining Product Exporter imposed a sanction
of revocation as referred to in section (2) may
submit an application for acquiring a
Registered Processed and Refined/Smelted
Mining Product Exporter certificate only 1
(one) year after the revocation and must
obtain a recommendation for re-activation
from the competent Minister of Energy and
Mineral Resources or Minister of Industry.
Pasal 18 Article 18
Surveyor yang tidak melaksanakan kewajiban
sebagaimana dimaksud pada Pasal 10, Pasal 15
dan Pasal 16 Peraturan Menteri ini dikenakan
sanksi pencabutan penetapan sebagai pelaksana
Verifikasi atau Penelusuran Teknis Ekspor produk
pemurnian, dan/atau sanksi pidana sesuai
peraturan perundang-undangan.
A Surveyor who fails to perform its obligations
under Article 10, Article 15 and Article 16 of this
Regulation of the Minister shall be imposed a
sanction of revocation of the confirmation as a
Verifying or Scrutinizing agent for export of
processed and/or refined/smelted mining products
and/or a criminal sanction under the laws and
regulations.
Pasal 19 Article 19
Petunjuk teknis pelaksanaan Peraturan Menteri ini
dapat ditetapkan oleh Direktur J enderal.
The Director General may issue the guidelines
under this Regulation of the Minister.
Pasal 20 Article 20
Pada saat Peraturan Menteri ini mulai berlaku: Upon this Regulation of the Minister coming into
effect:

berlaku sepanjang tidak bertentangan dengan

diubah dengan Peraturan Menteri
Perdagangan Nomor 52/M-DAG/PER/8/2012,
dicabut dan dinyatakan tidak berlaku lagi.
c. Regulation of the Minister of Trade Number
29/M-DAG/PER/5/2012 concerning
Provisions for Export of Mining Products, as
amended by Regulation of the Minister of
Trade Number 52/M-DAG/PER/8/2012, is
revoked and declared to no longer be in effect.
d. Kontrak Karya yang ditandatangani sebelum
diundangkannya Peraturan Pemerintah Nomor
23 Tahun 2010 tentang Pelaksanaan Kegiatan
Usaha Pertambangan Mineral dan Batubara,
dinyatakan tetap berlaku dan dapat digunakan
sebagai persyaratan untuk memperoleh
pengakuan sebagai ET-Produk Pertambangan
Hasil Pengolahan dan Pemurnian dan
Persetujuan Ekspor, sampai jangka waktunya
berakhir.
d. A Contract of Work signed prior to the
enactment of Regulation of the Government
Number 23 of 2010 concerning
Implementation of Mineral and Coal Mining
Business Activities, is declared to remain in
effect and may be used as required
documentation to acquire a Registered
Processed and/or Refined/Smelted Mining
Product Exporter certificate until its
expiration.
Pasal 21 Article 21
Peraturan Menteri ini mulai berlaku pada tanggal
13 J anuari 2014.
This Regulation of the Minister shall come into
effect on J anuary 13, 2014.
Agar setiap orang mengetahuinya, memerintahkan
pengundangan Peraturan Menteri ini dengan
penempatannya dalam Berita Negara Republik
Indonesia.
