To Whom It May Concern: I am writing on behalf of Finger Lakes Racing Association, Inc. We are aware that Western Regional Off-Track Betting Corporation (“Western Regional”) filed a complaint with the New York State Joint Commission on Public Ethics (“JCOPE”) on February 18, 2014. By that complaint, Western Regional requested that JCOPE investigate the apparent relationship between David Flaum, Flaum Rochester LLC, the Seneca Nation of Indians and the Seneca Gaming Corporation. After reviewing Western Regional’s complaint and the attached appendices, we agree with Western Regional that evidence exists warranting an investigation into whether David Flaum, Flaum Rochester LLC, the Seneca Nation of Indians and the Seneca Gaming Corporation have entered into an improper and possibly illegal relationship. We therefore wish to join in Western Regional’s request that JCOPE investigate David Flaum, Flaum Rochester LLC, the Seneca Nation of Indians and the Seneca Gaming Corporation. Accordingly, please accept this letter and the attached sworn statements as a Complaint on behalf of Finger Lakes Racing Association, Inc. against David Flaum, Flaum Rochester LLC, the Seneca Nation of Indians and the Seneca Gaming Corporation. We jointly request that JCOPE investigate the relationship between David Flaum, Flaum Rochester LLC, the Seneca Nation of Indians and the Seneca Gaming Corporation, and impose appropriate sanctions if warranted. SWORN STATEMENT

I, Christian Riegle, hereby affirm under penalty of perjury that I have read the foregoing Letter Complaint against David Flaum, Flaum Rochester LLC, the Seneca Nation of Indians and the Seneca Gaming Corporation in its entirety, including any additional pages, and to the best of my knowledge, or based on information and belief, believe it to be true. I also understand the intentional submission of false information may constitute a crime punishable by fine or imprisonment, or both.
