merican Eagle Airlines figures prominently
in the past year’s news. As of June 11, the
carrier has offered daily flights between the
Santa Fe Municipal Airport and Dallas-Fort
Worth International Airport. The commercial airline
said it would add daily flights between Santa Fe and Los
Angeles International Airport beginning on Nov. 19, 2009.
That rather remarkable development, initiated during a
wounded financial climate, comes on the heels of another
groundbreaker: the building of a new railroad and last
December’s start of New Mexico Rail Runner Express
service between Santa Fe and Belen. The third local stop,
near the intersection of I-25 and N.M. 599, opened this
summer.
On this end of the line, the trains pull in to a profoundly
redeveloped Santa Fe Railyard. Its big star is the new
home of the Santa Fe Farmers Market. The largest new
building in the Railyard is the 85,000-square-foot Market
Station. REI, its anchor tenant, opened in September 2008.
During the past year, it was joined by a Flying Star Café,
a clothing/jewelry/accessories shop called Daniella, and
GoWireless, a Verizon dealer. Apparently still on hold are
the developers’ other hopefuls of a year ago: Bin 132 Wine
Bar, Ringside Bowl Café, an Apple store, and the 13-screen
Maya Cinema movieplex.
Among the other area restaurant openings, besides
the Flying Star, are Atrisco Café and Bar in the former
Diego’s space at DeVargas Center; Milagro 139 in the
San Francisco Street location formerly occupied by Tribes
Coffeehouse; Corazón, a restaurant/lounge that opened
last spring at the corner of Guadalupe and Montezuma
streets; Restaurant Martín, a startup by chef Martín Rios
in a new building at the site of the former Café Oasis, 526
Galisteo Street; and, south of town, Real Food Nation at
the intersection of N.M. 285 and Old Las Vegas Highway
and Pizza Centro at the Agora in Eldorado.
New lights in the espresso/coffee universe include
Brasserie Zuniga, which opened in early September at
228 Old Santa Fe Trail, the location formerly occupied
by Latitudes Espresso and Ice Cream. The new business,
which offers breakfast burritos and milkshakes, as well as
espresso drinks and coffee, is owned by Enrique Guerrero
and Fritz Holland. PD Bean is gone; now at 2411 Cerrillos
Road is Café Olé, offering food, coffee and espresso drinks,

and a WiFi environment. There’s free WiFi, and organic
coffee, sandwiches, wraps and pastries at Bean and Gone,
which opened last spring at 3354 Cerrillos Road.
Connor Hall, one of four New Mexico School for
the Deaf (founded 1887) buildings that are on the
National Register of Historic Places, is undergoing a
major reconstruction. Basically, the main building is
being updated with a steel-framed structure, while the
façade — the old building is concrete beam with masonry
(pentile and red brick) infill — is being preserved. Tom
Winkel, job superintendent with Brycon Construction,
said they’re shooting for a LEED (Leadership in Energy &
Environmental Design) “Silver” certification on the project.
Hoped-for completion is March 2010.
The city of Santa Fe will pay the New Mexico Finance
Authority more than $2 million annually for the next 27
years to keep intact the 150-year-old College of Santa Fe.
The Santa Fe City Council voted to buy the financially
insecure institution and its campus of 61 acres this
past summer. The college (often called an “art school,”
although it also offers programs in education and business)
is a member of Laureate International Universities, a
Baltimore-headquartered network of 45 schools on four
continents.
The remodel and expansion of Carlos Gilbert
Elementary School, which is over 60 years old, is ongoing.
Of the total building area of 44,000 square feet, Enterprise
Builders is adding about 10,000 square feet. Architect
Claudio Vigil is keeping the historical look of the 1940s, so
the new construction features plastered walls, and beams
and crown moldings — “lots of incredible woodwork” by
OGB Architectural Millwork, Albuquerque, according to
Enterprise project manager Anton Johansen. The project
began in April and should be complete by year’s end.
Another new LEED-certified building is the
recently completed state office of the Bureau of Land
Management/Public Lands Information Center at 301
Dinosaur Trail. The staffs were scheduled to occupy it
during the third week of October, leaving their previous
office at 1474 Rodeo Road. That space was shared with the
Santa Fe National Forest Supervisor’s Office, which, in
September, moved into their own new building at 11 Forest
Lane near the intersection of N.M. 14 and N.M. 599.
Dan Lyons with Bradbury Stamm Construction,
Albuquerque, said they hope to resume construction on
the First Judicial District Courthouse in downtown
Santa Fe at the beginning of March. Meanwhile, the New
Mexico Environment Department and Santa Fe County
are working together to finalize a plan for onsite and offsite
remediation of petroleum-contaminated soil from a former
use.
Peter Komis, who has approvals in place for a mixed-use
development on 58 acres near I-25 and N.M. 599, wishes
the courthouse developers would have come to his neck
of the woods. “I’d like to see a ‘Santa Fe uptown’ out here
— Barbara Pearson has 25 acres adjacent to mine and she
also has her approvals — and I think the courthouse would
have been perfect here. They’ve absolutely destroyed the
downtown with that thing and my parcel is just 15 minutes
from downtown.
“The new overpass and Rail Runner stop right next to
my property was supposed to cost $2 million, I think, and
it went to $8 million,” Komis said. “They need to put it to
good use.”
New businesses during the past year at San Isidro Plaza
near Lowe’s and the new movie theater on Zafarano Drive
include Postal Connections, Santa Fe Capitol Grill,
Burger King, HoHo’s Asian Bistro, and Plaza Café. In
the near future, Que Bonita, a cosmetics store, will take
the space previously occupied by Kate Brennan Shoes &
Such. And the city’s second Sunflower Farmers Market
is expected to open on Jan. 1. The market chain (the
Sunflower motto is “Serious food... silly prices”) started up
in 2002 and now has 27 stores in six Southwestern states.
The San Isidro Village store will be the first of four more
the Boulder, Colo.-based retailer plans to add in 2010.
The other Sunflower market opened in August at
DeVargas Center, and less than two months later had
to lay off a quarter of its workforce because sales didn’t
meet expectations. The DeVargas remodel of the former
Albertsons space also created 10,000 square feet on the east
end of Sunflower. Only 3,000 is still open with the mall’s
additions of Mattress Firm and Four Seasons Sunrooms
and Windows.
Changes inside DeVargas Center include Christine’s
Bridal & Formal Wear relocating into a larger space across
from Las Cosas Kitchen Shoppe, and the Outdoorsman
business expanding into the former Christine’s space. Also
coming is Indigo Baby, an “organic and natural infant and
children’s boutique.”
The commercial market is “definitely still tight,” said
Katy Fitzgerald, DeVargas Center manager with mall
owner Weingarten Realty, Houston. “Even though they’re
saying things are turning around in the economy, I don’t
think the retailers are seeing it yet.”
Beth Riebschlager, Santa Fe Place general manager for
Chicago-based Jones Lang LaSalle, reported “no major
changes in the last year. We’re just keeping our doors open,
and there is nothing coming that I can announce.” The
former Villa Linda Mall lost one of its anchors, Mervyn’s
(over 62,000 square feet) and another large retailer, Shoe
Pavilion (more than 15,700 square feet) last year. Those
spaces remain unleased.
In the car world, Santa Fe has not been immune to
national difficulties. One local example is the former
Mitsubishi dealership at 1955 St. Michael’s Drive, now for
sale for $2.15 million. On the positive side, a new Lexus
automobile dealership recently opened its doors at 6824
Cerrillos Road. And work is commencing at the site of a
new location for Beaver Toyota out Cerrillos Road by the
bypass. “We’re just doing earth work now, but this will be
62,000 square feet for their service center and showroom,”
said Ralph Stumpff of John G. Rehders General
Contractor.” We’re hoping for a fall 2010 completion.”
Back in town, the store at the southwest corner of
Cerrillos Road and Baca Street, which has housed a
succession of sleep-center businesses since the 1980s, is
continuing the trend. The newest is Futons & Frames and
it’s a Santa Fe location for the 23-year-old Albuquerque
business of the same name.
Local banks seem to be doing alright. In the early spring,
Del Norte Credit Union plans to move out of leased space
in Pojoaque. Chuck Valenti, president and CEO, said their
operations division will go into a new building in Española
Connor Hall at the New Mexico School for the Deaf is undergoing modernization — but the historic façade will be preserved

and their administrative personnel will relocate into an
11,000-square-foot addition now being built next to the
credit union’s new (2005) branch at 3286 Cerrillos Road.
First National Bank of Santa Fe opened a new
Southside Office at Cerrillos Road and Governor Miles
Road; Los Alamos National Bank opened a new branch at
Cerrillos Road and Vegas Verdes; and New Mexico Bank
& Trust plans to open a new, 10,000-square-foot branch
on St. Michael’s Drive, near the entrance to the College of
Santa Fe, in January.
A mixed-use proposal for the 5.5-acre Archdiocese
of Santa Fe property southeast of the Cathedral Basilica
of St. Francis of Assisi is stalled. The plans for Hunt
Development Group’s “Paseo de Santa Fe” development
involves over 132,000 square feet of retail uses and
restaurants, 112,000 square feet of condominiums and lofts,
and three levels of underground parking. Questioned about
the reason for the holdoff, company spokesman Jim Dobbie
said, “It’s the national economy. We aren’t even pursuing
anything with the city of Santa Fe right now.”
Next door, Drury Hotels may begin work as soon as next
fall on its plans: the renovation and expansion of the 1954
St. Vincent Hospital building as a Drury Plaza Hotel with
175 rooms; the adaptive re-use of the 1910 Marian Hall as
a boutique hotel with 30 rooms; and the construction of
an underground parking facility and of 65 casita suites in
today’s parking lot south of Marian Hall.
“As of last week we survived the appeal period,” Drury
project manager Brian Nenninger said on Oct. 19. “The
historic board and the city are all behind the project. Now
we can start all the detailed architectural, engineering,
structural, mechanical, electrical, and plumbing planning.”
Nenninger said the national recession has had no direct
impact on the company’s Santa Fe plan, but he added that
Drury Hotels “will be re-evaluating this thing, probably on
a bimonthly basis. The kind of discussion we’ll be having
is that we may possibly be concentrating first on Marian
Hall and do the hospital in a second phase, rather than the
other way around, because the initial expenditure would be
less. That’s what the economy has sort of done to us. We’d
still like do both those projects concurrently, but I doubt if
that’s going to be in the cards.”
The most important recent news on the office front was
the departure early in 2009 of hundreds of Thornburg
Investment Management and Thornburg Mortgage
employees from three downtown buildings: Marcy Plaza,
First Interstate Building, and the old Jones Law Firm
building on Lincoln Avenue. That opened up 57,000
square feet. “We have been doing some leasing,” said David
Oberstein of Oberstein Properties. “We’ve got some interest
in some of the space. We have people looking.”
“May Day!” would have been the appropriate cry
at Thornburg Mortgage when the Santa Fe company
registered for bankruptcy protection on May 1. The filing
with U.S. Bankruptcy Court in Maryland reported debts of
$24.7 billion and assets of $24.4 billion. The employees of
Thornburg Investment Management, a separate company,
are enjoying their new quarters, a 102,000-square-foot
office building designed by Legorreta + Legorreta of
Mexico City, which was recently awarded the LEED “Gold”
certification.
“Thornburg Investment Management is doing very well
and is at the point of looking at expansion,” said David

of our strategies and funds — equities
particularly — are in the top 25 percent
and some are in the top 10 or 5 percent.
So aside from the sad news about
Thornburg Mortgage, things are pretty
good.”
At the Santa Fe office of Grubb &
Ellis, broker Leon Mellow said, “In
the last 90 days our leasing activity has
picked up nicely. It was very soft before
that, since the first of the year, and we’ve
gotten some new listings.”
One is Santa Fe Steamer, for sale for
$995,000.
“I think the main thing is that business
is just a whole lot more difficult,”
Mellow said. “There are more vacancies
downtown than there ever have been. I
was walking down San Francisco Street
and in between Old Santa Fe Trail and
Haagen Dazs there are three vacancies
on the Plaza, which is unheard of. It is a
most unusual time, and then the lending
situation continues to be an issue. There
are people who want to do things, but
the qualifications for getting a loan are
prohibiting people who even a year ago
could get a loan easily from getting one.
Or they can probably can, but instead
of putting in 20 percent or 25 percent,
now it’s 30 or 35 percent, so you lose
the beneift of the leverage and also for
people who want to buy a property and
run their own business out of it, it ties
up so much of their capital, it just defeats
the purpose.
“But with all that said, there is activity.
We just did a lease for a dental clinic
down on Cerrillos Road and we did a
lease for an exercise studio on San Mateo. It’s just that the
sales end is not as active as it was.”
The former Mitsubishi dealership on St. Michael’s Drive
could be a real challenge: the large, automobile-oriented
listing could be a hard sell at a time when most carmakers
are closing plants and dealerships.
“In normal times, it’s a wonderful redevelopment
opportunity. It would be a great multiple-tenant building,”
Mellow responded. “But now if somebody buys it for
that, when they go to the bank, the bank is going to want
a tenant in it before they do a loan. In Santa Fe it’s very
difficult to prelease things, in the best of times. In most
cases, you’re not preleasing the national tenants who
are used to that very long lead time to build or remodel
something. The tenants here want to move in next month.”
Mellow’s prediction for the near future isn’t overly bright.
“I think 2010 is going to be very much like 2009,” he
said. “On a national scale, which is not necessarily anything
to do with Santa Fe, there are enormous amounts of
commercial loans on properties that are coming due, and
the valuation of those properties has dropped so much
that they may not be able to be refinanced in an amount
that’s going to cover the debt service. It’s very scary. It’s in
the hundreds of billions of dollars and what will happen
is that that will sweep through the economy... We don’t
have much of that going on in Santa Fe, but I’m concerned
that the banks will be under new pressure from the
regulators because of that, and it will make it harder still for
everyone.”
He returned to the spectacle of shuttered stores on the
Plaza — and the town seemed to be as full of tourists this
year as ever. “Yeah, but maybe those tourists came here
with enough money for a hotel room and food but they
were making only minor purchases,” he said. “Some of the
stores on San Francisco Street actually went out of business
in the summertime, and that’s never happened,” he said.
It’s a recession, but big stuff is happening - like bigger
than ever, with the New Mexico Rail Runner and local
flights to Dallas and LA and most local banks building
new branches. Some other really big projects are the $35
million, 96,000-square-foot New Mexico History Museum,
which opened in May; the new $13 million State Capitol
Parking Facility that opened last month; and the state
museum’s new Center for New Mexico Archaeology now
under construction on Caja del Rio.
Finally, there’s the amazing and very substantial ($216
million) Buckman Direct Diversion Project now being
constructed northwest of the city of Santa Fe. Its many
parts include a water-diversion structure on the Rio
Grande, a raw-water lift station, a sand-removal facility,
11 miles of raw-water pipelines, two booster stations to
pump the water up more than a thousand vertical feet, a
water-treatment plant, two pump facilities, and 15 miles of
pipelines to transport clean water to city and county water-
users. Rick Carpenter, project manager, said the city is
aiming for a complete, operational system by spring 2011.

I saw in last month’s Real Estate Guide
that Martin’s Store in El Rito closed for
good on Aug. 31. I admit to a wave of
nostalgia because as a child I spent a lot
of time in El Rito. Tom Martin, brother
of Greg the most recent owner, was my
best friend and each summer we would
spend time in each other’s domain. I have
gone through El Rito occasionally for the
last fifty years or so, and I imagine Tom
has passed through Santa Fe a time or
two, but we just lost touch. Sometimes
close friendships don’t survive: no fault,
not even hare-brained disputes over
Monopoly games - its just attrition. The
closing of the store did prompt some very
personal and fond memories, among
them part of the reason I have so much
reverence for mud.
My mother came to El Rito in 1944 and
lived in an adobe apartment behind Tom
Sr. and Katy Martin’s house catty-corner
from the store. Her job was just down the
road at the Maternal and Child Health
Center as the receptionist. The Center was
supported, in part, by Georgia O’Keeffe
and run by the Martin family matriarch,
a nurse who was always referred to as
Dambo. The sprawling, marvelous adobe
home owned by Dambo and George
Martin Sr. was opposite the clinic and was
the center of the large family’s life.
The house was, and is, one of the
finest examples of Northern New Mexico
earthen vernacular still standing: long,
L-shaped, with a full-length wooden
veranda facing south, contiguous rooms
accessed by a connecting door or, for
privacy, by coming and going via the
portal. The property has a pond, a barn,
corrals and, significantly, a cottonwood-
bounded acequia.
As it happened, Tom Martin and I
were best friends and Cam Martin and
Alex, our respective older sisters, were
also best friends. The two sets of friends
had quite different approaches to fun:
Cam and Alex rode horses bareback and,
on rare occasions, made futile attempts
to be refined, while Tom and I dammed
the creek, caught snakes, built a raft for
the pond, and were generally dirty but
well behaved, although there were some
exceptions.
During one of Cam and Alex’s rare
moments of refinement, they set up a little
table and chairs and had a tea party on the
bank of the acequia under a magnificent
cottonwood. Tom and I lurked and spied
and thought what a precious little tableau
was unfolding and, during a short hiatus
when our sisters were gone, tipped the
whole works into the flowing ditch.
This is a vivid recollection because it
resulted in one of several monumental
whoppings that I received as a child. The
rod was not spared in those days. Worse
than the whaling was the dressing-down
by Dambo who, when disapproving, could
not only take the bloom off a glorious
victory, but convince you unequivocally
that you were beyond reformation and
hell-bound for sure.
I noted that the article last month said
the store had closed on my birthday. What
a gift, I thought - not that the store closed,
but that it and the Martins had provided
me with such an enduring connection.
I’ve lost touch with that family except in
my old earthen heart, half of which at
least still resides in El Rito.

T
he real-estate market continues to
slump. More and more, the way out
of these doldrums seems to hinge on the
perception of the “bottom.” Has the long
decline hit bottom? Is the recent uptick
significant or will it prove to be just a
temporary blip on a continued slide?
“The good news, when you look at the
number of sales in the city by quarter,
it looks like we may have potentially
bottomed,” said Warren Sacks, vice
president of Barker Realty and an admitted
“data nerd.”
“In the fourth quarter, if we’re able to end
up between the levels we saw in the second
and third quarters, even though that would
be a dip in sales, it would be very positive,”
he said. “And if in the first quarter we could
see 150 to 170 sales, that would be another
very positive sign that we could have
already seen the bottom.”
One of the accompanying graphs, which
tracks 3rd-quarter home-sales figures since
1997, indicates a down trend from the
quarter in 2008 to the same period in 2009.
But the dotted line reveals 2009 detail:
sales took a huge dive in the first quarter
and have rather dramatically climbed since
the springtime. Stats from the Santa Fe
Association of Realtors, comparing the
third quarter 2009 and third quarter 2008,
show that home sales in the city were down
29 percent and the median price was down
33 percent. In the county, the median price
was down just 7 percent and sales numbers
were actually up 22 percent. Regarding
condominiums, 21 percent fewer units
sold July through September compared to
the same period last year, and the median
condo price decreased 23 percent.
There were still over 350 house/condo
sales in the quarter. The market isn’t dead.
There is activity.
“From what our data tells us, it’s the
low end that’s coming back,” Sacks said.
“In sales between $100,000 and $300,000,
we’re starting to stabilize. This will be the
third consecutive year with approximately
400 sales. And anything above $300,000 is
continuing to decline. The higher you go,
the fewer sales we’re seeing and the bigger
discounting we’re seeing.”
A glut of inventory doesn’t help. Even in
a juicy market, the high end of the Santa Fe
market holds 150 or so homes for sale, but
in late October Sacks said there was four
years and 10 months’ worth of inventory of
houses priced $1.5 million and up.
“When the number of transactions
stabilizes over a few quarters and
inventory becomes more scarce, pricing
will flatten and eventually it will increase,”
he predicted. “I’m convinced that we’re
going to go back to homeownership as we
know it, in terms of seeing 2 or 3 percent
appreciation above inflation annually, just
because lending regulations are so tight
and I don’t see any loosening of that in the
forseeable future.”

Tommy Faulkner created the other graph
on this page, contrasting home-sale trends
in the United States and in the city of
Santa Fe. “The thing to note is that we
both peaked in 2005 and ever since then
we’ve been in a freefall. If you look at 2009,
national sales are increasing but it appears
that our market here is still declining, going
from 900 to 718 based on my annualized
numbers. We have always lagged behind
the national market six to 18 months.
“In this market, there’s so much
uncertainty and there are so many voices
and so many opinions, and a lot of it comes
nationally. Our market is similar but it’s
also unique.”
No matter where you are, there are
certain constants. One is that “as long as
there continues to be a disconnect between
buyers and sellers regarding what’s fair
market value, our market will be sluggish,”
Sacks said. “People are becoming more
realistic, but you also have to sympathize
with the sellers because many people
bought at the height of the market and they
don’t want to lose money. But we are seeing
more foreclosures and short sales — each
one probably makes up 3 percent to 5
percent of the market.
The federal $8,000 credit for qualifying
first-time homebuyers has
no doubt helped bolster the
market. In an Oct. 14 KRQE
News report, Don Padilla
of the Greater Albuquerque
Association of Realtors said the
tax credit accounted for about
30 percent of the business in
the metro area in September.
He added that pending sales
of existing homes in Albuquerque was
up more than 30 percent in September,
compared to September 2008, and closed
sales were up nearly 11 percent.
“They have a larger market and more
subdivisions and different areas like Rio
Rancho and Corrales,” said Richard Mares
of Mares Realty in Santa Fe. “Then the
other thing is they have bigger spikes in
Albuquerque. When they’re down, they
take a beating, and when they’re up they’re
riding Hog City USA. We don’t do that. We
have little dippy-do’s or rises.”

market has improved, Mares said, “Not
yet. Not anywhere near it. I still think
everybody here in Santa Fe, the real-estate
people and sellers still think they’ve died
and gone to heaven, that if they wait long
enough, they’ll get their damn silly prices.
Look at MLS. I can tell you that every week
we see the ‘price reduction’ category and
there are 16 this week. Agents learned a
long time ago that even if they’re willing
to take your listing at a high price, they’ll
try to talk you into a reduction eventually,
when that little light goes on.”
What’s his prediction?
“More of the same. Unless you get people
willing to look at things realistically, which
is why guys like me aren’t doing very well.
I’m still part of the old school,” Mares said.
“When there was a lot going on, if you
talked to me and you didn’t have it priced
the way I thought was correct, I didn’t take
your listing. But as long as you have these
high prices prevailing among some, it’s not
going to get any better.
“I’ve seen this before in more than
40 years in this business. I’ve seen this
scenario and unless that little light goes on,
it’s not going to happen.”

November is the month for falling
leaves, bonfires, apple cider and
Thanksgiving, one of my favorite holidays.
Thanksgiving is a time we spend with
family and friends, to reflect and reminisce
and give thanks for all that we have. I find
what I have most to be grateful for are the
intangibles, and given the difficult times
we have all shared these past couple of
years, I would like to share my thoughts
with you. It may be that what we have most
to be thankful for is what we all have in
common.
I am most thankful for my family,
beginning with my wonderful husband of
10 (plus) years, who shares my successes
and disappointments with equal aplomb.
He is my partner in life and in business
but more importantly, he is my best friend.
I am further blessed with two wonderful
daughters who teach me patience,
understanding, and selflessness with a
humor and uniqueness all their own. I
am also fortunate that my parents live
here in Santa Fe and that I can see them
often. They bestow to me their wisdom
and advice and they give me their love
and support and I am so thankful for
their participation in my life. I appreciate
all of my family, both in state and out,
enormously.
I appreciate all of my fellow brokers who
are working as hard as ever in this tough
real-estate market. With perseverance
and optimism, yet always willing to lend
a hand in a crisis, I am proud to be in
the ranks of such a magnanimous group.
Furthermore, I appreciate all those people
affiliated with the real-estate market: the
lenders, the inspectors, the contractors,
the appraisers, the stagers, and the title
people. All have had to make sacrifices to

Yes, this economy has been tough, and
it has taken its toll on my clients as well.
Home values have fallen, jobs have been
lost, and marriages dissolved. I have seen
the gamut of frustration to desperation,
staving off foreclosure to just getting by.

So much to give thanks for

Facing a quagmire like the one in
Afghanistan, the easy path for any new
commander-in-chief would be to send
troops as requested. You’d waste countless
resources and be responsible for continued
pain, death, and destruction, but you’d
avoid the possibility of getting blamed for a
messy retreat.
Fortunately, we’ve gone to war with
the president we have. In fact, I predict
President Obama will shortly announce
a timetable for the withdrawal of
American forces from Afghanistan. Here’s
why: first, he was elected on a wave of
change. Second, his chief of staff, Rahm
Emanuel, strongly believes that crisis
creates opportunity. Third, Afghanistan is
currently sandwiched by a major electoral
crisis. According to Emanuel’s own theory,
there may never be a better time to bring
our sons and daughters home.
In permacultural philosophy, we
also recognize the relationship between
crisis and opportunity. Toning down
the semantics slightly, we usually speak
of problems providing solutions. As an
ecological landscape designer living in
an arid environment, I see water-supply
solutions in every problematic arroyo and
I appreciate the increased resources that
come with each precipitation event.
During our brief monsoon season, my
company gets a deluge of calls from people
who have lost large chunks of driveway in
a single storm. Sometimes parts of their
property are sinking, and other times
they’re nearly buried in mud. Most of the
time, they’re merely trying to build enough
healthy soil to keep plants and trees alive.
The most permacultural solutions
to these types of erosion problems are
often the same: start at the source of the
runoff, and slow it down as immediately
as possible. Avoid fixing symptoms and
remain open-minded as to the potential
causes of any problem. Redirect energy
whenever beneficial, and try to stop
water only if you do the math first. Use
local materials whenever you can, and
build structures that respect people while
simultaneously cooperating with the
watershed. If you can do these things, the
yield of your system is limited by your
creativity rather than by outside forces
beyond your control.
Along the same lines for an Afghanistan
exit, I’d suggest starting with the electoral
crisis, which means announcing a
timetable as far ahead of the Nov. 7 runoff
as possible; be open-minded as to the
cause of the withdrawal and avoid burning,
eradicating, or poisoning any fields on
the way out; do your best not to shoot any
civilians; cover your buddies; and watch
your backs.
Relatively speaking, healing the land
is not terribly hard to do. More than
anything it takes a patient, yield-based
approach. Forgetting the $400/gallon fuel
costs reported by The Hill last month,
leaving Afghanistan will be complicated,
and many people will probably die in the
process. But how many more will die if we
stay for another eight years?
Now is a truly historic moment. If
we do not create an opportunity in this
window of crisis, we will soon start sinking
deeper into the morass. We will be less
able to leave on our own terms and in
the end completely bankrupt our already
struggling nation.

Ultrafiltration is a type of membrane
filtration in which hydrostatic pressure
forces a liquid against a semi-permeable
membrane. Suspended solids and solutes
of high molecular weight are retained,
while water and low-molecular-weight
solutes pass through the membrane.
Ultrafiltration is not fundamentally
different from reverse osmosis and
other types of membrane filtration and
it is classified by the sizes of molecules
it will retain. Ultrafiltration typically
consists of pressure vessels containing
long, spaghetti-like, membranous tubes
with pore spaces ranging from 0.01-0.03
microns. The hollow fibers mechanically
screen impurities, which are concentrated
on the inside wall of the membrane and
are effectively removed with periodic
flushing or power washing.
Ultrafiltration membranes are classified
according to NMWCO (nominal
molecular weight cutoffs) in sizes of
at least 10,000 daltons. Whereas the
pore size of ultrafiltration and other
membrane technologies is usually
measured in microns, RO membranes
have a nominal molecular weight cutoff
of less than or equal to 1,000 daltons. In
addition to its ability to remove sand, silt,
clay and algae, ultrafiltration physically
removes microbiological contaminants
from water supplies. The sizes of some
select contaminants in water (per EPA),
which are removed by ultrafiltration,
are as follows: Giardia (8-12 microns),
Cryptosporidium (4-6 microns), bacteria
such as E. coli and Salmonella (0.2 to
4 microns) and viruses (0.004 to 0.1
microns). Some municipal systems are
supplementing their water-treatment
technologies with ultrafiltration because
of its ability to remove the spores Giardia
and Cryptosporidium, which have become
chlorine-resistant and pose a significant
threat to public health.
Chemical-free ultrafiltration is a
“greener” technology than reverse
osmosis because of its high efficiency
(95-98 percent); only a small amount
of source (inlet) water is used to flush
the membrane. Ultrafiltration has low
operating and maintenance expenses
(membrane life may be as long as five
years) and its application ranges over
a much wider range of inlet water
temperatures and water pressures than
RO. System controls are electronic
(to monitor flow volumes and control
membrane flushing). Operation of
the system is based on water pressure.
Ultrafiltration will continue during a
power failure so long as water is being fed
to the system. Spikes of contaminants in
the inlet water do not affect the quality of
the permeate water. Ultrafiltration does
not remove dissolved minerals or affect
pH, so its product (permeate) water will
not become more aggressive to copper
pipe and fittings than the inlet water.
For domestic wells, and particularly
those with high turbidity (cloudiness
caused by suspended particles) as well as
microbiological issues, it is an efficient,
water-conserving addition to a series of
purification stages. Ultrafiltration will
not remove dissolved salts or soften
water, and it should not be mistaken
as a substitute for reverse osmosis. But
in some applications, ultrafiltration
might be an effective pre-treatment for
reverse osmosis and other purification
techniques. Reverse osmosis is more
effective than ultrafiltration in removing
some contaminants but it does come with
a price. Reverse-osmosis membranes
may become fouled with turbidity and
scale (hardness), their output is low
(holding tank is required), and there
is a significant amount of concentrate
water lost to the drain. Well owners with
recurring microbiological problems
should seriously consider ultrafiltration
technology.

This is one of those lovely, old properties along Camino del Monte Sol that boasts
deep grounds with a parklike setting. Architect William Lumpkins designed, built,
and lived in the house —the current owners have the house plans dating to the early
1960s but are unsure when it was actually built. The art collector Robert Tobin, who
owned the property in the 1990s, installed a koi pond and other water features on
the nearly 1.5-acre site. Architect Steve Shaw helped the current owners (who desire
anonymity) with remodeling work. This involved replacing stained-concrete floors
with brick floors; remodeling the kitchen, including adding a long island with a top
of galvanized steel and two Sub Zero refrigerator drawers; and changing out the old,
paper shoji screens in the master bathroom: the doors to toilet rooms and closets are
wood frames holding panels of delicate reeds inside double-paned, frosted glass.
Access to the gated and fenced property is via a stone driveway leading down to
the 3-car carport and a front yard with gravel paths, ornamental grasses, and tall pine
and aspen trees. A pair of doors open into a courtyard with a weeping cherry tree, a
waterfall, a greenhouse, and a central pond filled with koi. Huge, flat-topped stone
blocks serve as steps across the pond to the front door.
The 4,185-square-foot, double adobe house with four bedrooms and four
bathrooms has an intimate feel that is accentuated by Lumpkins’ incorporation of a
rounded building element that holds cozy, semicircular seating areas on both floors.
To right from the front door is a sitting room, kitchen, and dining room. The
kitchen equipment includes a Sub Zero refrigerator with two freezer drawers, a
6-burner Dacor range, two Dacor ovens, a Kitchen Aid microwave oven, an Asko
dishwasher, and beautiful wood cabinets in the kitchen and in a walk-in pantry.
Many of the rooms in the house have different ceiling treatments. In the dining
room, the ceiling is coved plaster on vigas; and in the kitchen, it’s tamarisk stems set
herringbone-style on vigas.
Straight in from the front door is the living room. It has a white, gently arched
ceiling; two sets of handsome, arched-top wood windows; and a distinctive and
spacious fireplace.
At left from the front door, a short stairway leads up to the master suite. The first
space is one of the semicircular sitting areas, which were designed with whimsical,
rounded windows. The master bedroom looks out of 7-foot-tall corner windows to
the rear property and the mountains beyond. The master bath is two-sided, with a
large glass shower in the middle.
Below the master suite is another round sitting area with a half-circle banco and
hobbit-house windows; then a cozy bedroom and bathroom. The climate-controlled
greenhouse annex beside the koi-pond courtyard leads to a guest apartment that has a
small, complete kitchen and two outside entrances.
Outside the dining room, there is a nice big, covered, brick-floored patio. Just
beyond it is a constructed waterfall and stream to the lower part of the large, rear
yard. There are two wells on the property and much of the acreage boasts the sound of
bubbling (recirculated) water. There are rock paths through ornamental junipers and
down to an orchard (pears, apples, cherries, apricots) and lawn. In the rear corner is a
fenced parterre with one of five long, concrete beds planted in roses.

Finally, the financial markets are
once again delivering great jumbo loans
at interest rates that compare with the
historically low Fannie Mae market.
For the last several years, since the
subprime-mortgage meltdown, interest
rates for jumbo loans have suffered.
Homeowners needing jumbo loans have
been out of luck. In 2008 we saw great,
5 percent rates for Fannie Mae loans
($417,000 and below) while jumbo loans
were quoted at 7.5 percent to 8.5 percent.
These high rates resulted from large banks
and other investors having no market in
which to sell the jumbo products.
But now, late in 2009, we find a
refreshingly different situation. Fixed-rate,
30-year rates for jumbo loans are below
6 percent and adjustable-rate mortgage
(ARM) loans can go as low as 4.5 percent
for a $1 million-plus loan.
Could this be a positive sign that the
financial markets are recovering? Could it
mean that homes costing $1 million and
up will sell at a faster pace? Could it mean
the housing market is strengthening? The
answer is a resounding “YES.”
Homebuyers are exhibiting a new
attitude about buying and financing
homes. Recently, I closed a $750,000 loan
at 4.75 percent. Payments were interest-
only for five years at $2,968 per month
- not bad!
Conventional thinking is still that
an ARM is evil because after the fixed-
rate period the rate goes sky-high. But,
consider that the homeowner can pay
down the principal of the loan and
experience a reduction in the payment the
very next month. You also may say that
after five years the payment will increase.
The current Libor index for these loans
is 1.21 percent, so after five years (if
Libor remains the same) a margin of 2.25
percent would be added and the new rate
would be 3.46 percent.
The Libor index is a very conservative
index used worldwide to determine
interest rates for loans. In five years
the Libor will be different from today’s
rate but we don’t have to assume a huge
increase in the index. Many borrowers
with existing Libor loans are now
experiencing adjustments to their interest
rates that are below the 4 percent level.
Realistic thinking is that jumbo ARM
loans are the most attractive for jumbo
borrowers. A $600,000, 5-year ARM
at 4.75 percent is $3,129 per month
compared with a 30-year jumbo at 6
percent which is $3,597. That $468 per
month is big savings for the borrower:
$28,000 over five years.
Realtors and jumbo buyers should feel
hopeful after reading this column. From
my perspective as a mortgage banker, I
feel as if a significant floodgate has been
opened, allowing us to return to a more
productive real-estate market.

Jumbo rates back on track

There is a well known quote, “What
gets measured gets done. What gets
rewarded gets done well.” The Santa
Fe Association of Realtors is adding a
checklist of green-building features to its
MLS (multiple-listing service) property
data form. This is good news, because
green features now have a way of being
measured and rewarded.
The list has five categories: resource
efficiency, indoor environmental quality,
energy efficiency, water efficiency, and
green certifications. Under each is a
checklist of several common features.
The checklist is a great idea and will
help expand awareness among appraisers,
Realtors, and homebuyers. Remember
that the list is only an indicator that the
feature exists or that it is included. It
does not say anything qualitative about
the feature and says very little about the
quantity of the feature.
Resource efficiency is one of the
broadest terms and lists four features. One
is Recycled Content for Building Materials
and concerns plywood made from scraps
and chips of wood glued together or
insulation made from recycled newspaper
or glass. Materials from Renewable
Resources asks if the material is resource-
efficient in its manufacture, installation,
use, and removal. Certified Sustainably
Harvested Wood refers to forests managed
under certain guidelines like the criteria
developed by the Forest Stewardship
Council (FSC). Locally Available
Indigenous Materials seeks to reduce the
amount of energy used in transportation.
Locally made adobes would be a great
example of this in our area.
Indoor Environmental Quality
concerns the quality of the air inside
the home. New homes are notorious
for products that out-gas for many
months after the home is finished. The
features listed seek to limit the amount
of mold, radon, carbon monoxide and
other noxious chemicals in the indoor
environment. Whole House Air Filtration
System and Green Seal Certified Finishes
are two strategies to accomplish that.
Energy Efficiency is the largest
category. South Facing Lot/Orientation
and Passive Solar Design are the
fundamental low-cost, high-benefit green
features. Super Insulated refers to the
thermal envelope and how well the house
holds in the desired temperature. There
are two categories for Energy Star, one
for appliances and one for windows and
skylights. The HERS rating quantifies
how the house will perform relative to
minimum code. There are categories
for three active solar systems: thermal
hot water, thermal space heating, and
photovoltaics. Sealed Combustion Heating
Systems are about how efficient the
boiler is and the HRV (Heat Recovery
Ventilation) Systems provide a way of
ventilating while minimizing energy loss.
The Water Efficiency category is much
more familiar ground, with things like
rainwater harvesting, greywater, low-
flow fixtures, and xeriscaping. The final
category lists several green certifications
available. Build Green New Mexico
and LEED are two institutions with
standards that equate with a particular
level of green-building practice. The main
advantage is that these are done by a third
party that verifies the achievements.
With the addition of this checklist in
the MLS data, the extent of “green” in any
home should more likely be added to the
value of the home by appraisers, Realtors
and homebuyers.

Darlings,
While I’m sitting around indulging
my voyeuristic tendencies reading Times
reporter David Rohdes’ account of his
frightening ordeal of being kidnapped by
the Taliban and held captive in Pakistan
for 7 months and 10 days, or watching
the 2-hour suspense drama of a makeshift
silver spaceship carrying (or not, as it
turned out) the 6-year-old Balloon Boy
across Eastern Colorado, my friend and
former Santa Fe Realtor Diane McIngvale
is daring to get out there and really live.
She joined the Peace Corps. At age 57.
(Pumpkins, that’s just 10 years younger
than Lillian Carter was when she joined.)
Diane arrived in Baku, Azerbaijan, on
Oct. 1. Here’s an excerpt from her e-mail
chronicling her first impressions of her
new life.
“Our journey began with an hour bus
ride from the Nepal Hotel outside of Baku
to our host families outside of Sumgayit.
The bus dropped each one of us off at
our family home and drove off…We
drove down a bumpy alley/street and they
stopped and put me out…When I went
through the iron gate (scared to death) and
knocked on the door, a small girl came
to the door and just looked at me. She
pointed at a door (my room), and when
I got my 170 lbs. of luggage inside, she
closed the door. After a hard cry, I looked
around at my room - it had a camp-style
bed, a table, 2 chairs, a cupboard with
NO hangers, and an overhead hanging
bare light bulb. After crying again, I came
to the conclusion that I came for a real-
life experience, and so I got busy and
unpacked a few things and got on with it…
Now after a week, I really like my family.
They laugh a lot and they really seem to
like me…”
Meanwhile, back at the ranch, life goes
on. Ginnie Cerrella (formerly of Sotheby’s
and the 2007 winner of the best head of
hair on a female Realtor in the Santa Fe
area) moved to Santa Fe Properties last
month. Well, Kittens, she didn’t just close
up shop at Sotheby’s and scoot right over
to SFProps and start doing business all in
one day. Goodness, she’s too much of a
sybarite for that kind of grueling schedule.
Instead, she very wisely flew down to her
Loreto Bay condo overlooking the Sea of
Cortes and spent a week luxuriating in
the sun and sea. She returned rejuvenated.
Possums, I even think that her hair looked
thicker. (That kills me, especially when
I have to go to great lengths just to keep
my scalp from showing through my
artificially blonde tresses.) When asked
what prompted the move, she explained
it this way: “I’m sort of like the Twilight
series: every now and then I need fresh
blood.” Hmmm…probably not as often as
your average vampire, I would guess. But
we’ll see.
Dear hearts, how many Realtors do
we now know who are also published
authors? Last month, Pamela Christie
(PR Christie Real Estate) launched her
second book, Dead Lizard’s Dance, with
a booksigning and reading at Collected
Works Bookstore. (Her first book, The
King’s Lizard, won the 2007 New Mexico
Press Women’s Zia Book Award for the
best work of fiction over a 3-year period
written by a New Mexico female writer.)
Pamela says this about her writing: “I love
to set the dry old bones of history onto a
horse and gallop them into a suspenseful
story.”
Set in 1702, this latest book is a
historical mystery - fiction based on real
history from the 1700s. It touches on the
plight of women who were on the fringe
of society and who were often deemed to
be witches. (Whew! I’m so thankful that
being a woman on the fringe of society
today doesn’t make you a witch.) One
review basically cautions: Don’t start
reading this book late in the evening if
you want to get a good night’s sleep. Okay,
puppies, I’ll take that under advisement.
Tori Warner Shepard (City Different
Realty) sells real estate, pens novels, and
just recently sold her first recipe to the
Authentic Cookie Company. Her Crispy
Fruit Cookies are soon to be sold at fine
stores in New York and Whole Foods
everywhere. Aahh, the world will soon
be able to enjoy Tori’s signature cookie
that we Santa Fe Realtors have deliciously
munched at Wednesday open house tours
for years. I must admit, Lemondrops, there
were times when I made Tori’s listing my
first stop, just so I could nibble on a few
cookies (never could stop with only one)
before they were all devoured by other
Realtors coming for exactly the same
reason. Doll Babies, I’m sure many a house
was inadvertently sold because of the lure
of the crispy fruit cookie fresh from the
oven.
Sweetpeas, not only can you have
talented, artistic people list and sell your
house for you, but in Santa Fe you can
have talented, artistic people care for
your home if you want to leave and travel
around the world while waiting for an
offer. Or let’s say that your house isn’t for
sale, but you’d just like to take off for the

As the Thanksgiving season appears
on the near horizon, many of us become
retrospective by “giving thanks” to our
loved ones, friends and community.
This year the Realtors Association of
New Mexico (RANM) is providing
a new way to give back. The RANM
Benevolent Fund provides assistance for
Realtor members who have encountered
severe financial hardships beyond their
control. All donations to the fund are
tax-deductible and donors will receive a
written confirmation for their donation.
A donation can be made to memorialize
or honor an individual. RANM has set a
fundraising goal of $100,000 for 2010.
In looking back at our real-estate
community this year, it’s important
to acknowledge and publicly thank
the U.S. government for the housing-
stimulus programs enacted to encourage
homeownership and keep struggling
homeowners in their homes. The First
Time Homebuyer Tax Credit of $8,000
has helped buyers in our market to get
off the fence and into homes. In fact, the
National Association of Realtors (NAR)
projects that some 300,000 people who
otherwise couldn’t have entered the
market will buy this year due to the tax
credit. NAR research estimates that at
least $18.6 billion in economic activity
will result from these home sales, since
each of them generates tens of thousands
of dollars in additional spending.
Looking at housing sales data from
January through August in the city and
county of Santa Fe, it appears that the
credit is working as more homes have sold
under $250,000. In the city, homes in this
price category more than doubled and
in the county they quadrupled between
January and August. The market saw a
very modest leveling off of sales in this
price range in September, likely due to
the fact that the credit is scheduled to
expire on Nov. 30, 2009. As that deadline
approaches, Realtors across the country
and many others are urging Congress to
extend the tax credit.
I would like to commend the Santa Fe
Association of Realtors’ experienced and
dedicated staff. Paco Arguello, our finance
director, offers his acumen on a daily
basis to keep our finances in order, and
supports members through the Realtor
Store. Aggie Chavez, SFAR’s membership
development director, guides the
association’s educational and membership
programs, encouraging the development
of our members’ real estate knowledge,

A time to consider Thanksgiving

With recent government incentives,
we are seeing an increase in first-time
homebuyers. They are utilizing the $8,000
tax credit and special programs offered
by VA and HUD. Thus, it’s a good time to
discuss the basics.
A home is usually the largest single
investment in your lifetime. When
you purchase a home, you purchase
homeowner’s or hazard insurance to
protect against loss from fire, theft or
wind damage. Title insurance protects
against hidden title hazards that may
threaten your financial investment.
When purchasing a home, you are really
purchasing the title to the property — the
right to occupy and use the land and
improvements.
Other types of insurance focus on
possible future events, and charge
an annual premium. Title insurance,
purchased with a one-time premium,
safeguards against loss from hazards and
defects that already exist in the title.
There are two basic kinds of title
insurance: lender or mortgagee coverage,
and owner’s coverage. Lenders require
mortgagee title insurance as security for
their investment in real estate. Owner’s
title insurance lasts as long as you,
the policyholder, or your heirs, have
an interest in the insured property. In
New Mexico, you will pay an additional
premium for each policy, but the owner’s
policy is optional and a discount rate is
applied when you purchase both policies
simultaneously.
Insuring a home’s title begins with a
search of public land records affecting
the property. The title agent examines
pertinent documents to determine
whether the property is insurable. Those
documents (among others) include deeds,
wills, trusts, outstanding mortgages and
judgments, property liens, highway or
utility line easements, pending legal
actions and notary acknowledgements.
When title problems are disclosed
during the search, they are corrected
whenever possible to avoid future
claims. According to surveys done by the
American Land Title Association, title
problems consistently arise in one out of
three real-estate transactions.
The process of performing title searches
and curing title problems does not come
cheap. Title insurers spend an average of
92 cents out of every premium dollar as
their cost of doing business. After all this
searching and examination, title problems
may still come up. A signature could have
been forged on a deed; an unknown heir
can step forward to claim ownership; a
power of attorney used during a property
transfer could have expired or could have
been forged; and a public record may
be incorrect. In each of these cases and
many more, when there is the appropriate
title insurance coverage, a policy will
offer financial protection (subject to the
terms and conditions of the policy). The
title insurer defends the title and either
“perfects” the title or pays valid claims.
Simply put, we fight your legal battle to
prove your ownership in the property.
Your home is your most important
investment. With title insurance, you
have financial protection against covered
title hazards. It is in your best interest to
purchase the owner’s policy - a one-time
premium to protect your ownership.

The appraisal process is more involved
and more complicated than most people
are aware. They see the appraiser visit the
property, take a couple of pictures, and
leave, and they think that he then goes to
his office, types up the report and can now
spend the rest of the day drinking beer.
Not so. Let’s take a look at the process as it
should occur.
The appraiser makes a physical
inspection of the property to understand
the exterior and interior condition and
measure it to develop square footage for
comparative purposes. The appraiser
will ask the homeowner or Realtor what
improvements have been made (roof?
stucco?), look at the complexity of the
floor plan, and assess the amenities and
the quality of the interior. This will be used
to help develop an “effective age” of the
property.
If, for example, the home was built 50
years ago but has had recent extensive
remodeling, the effective age may be much
less than 50. This will be a key component
in establishing a value for the property. The
appraiser then returns to the office and the
hard work begins.
In a perfect world, the appraiser would
find three comparable properties that have
sold within a mile of the subject property
in the last six months. In an area of
homogenous housing such as Albuquerque,
this may be possible, but far less likely
in Santa Fe - an appraiser of 30 years’
experience with 17 in Santa Fe told me that
Santa Fe is the most complex real-estate
market in the southwestern United States
to appraise.
In Eldorado, for example, an identical
house may well be three miles away, yet in
the same subdivision. Moreover, in times of
diminished sales, the six months may not
be reasonable. So the appraiser will make
adjustments and explanations as to why the
location or date of sale of the “comparable”
goes beyond the preferred range.
To find suitable comparable properties,
the appraiser must have local knowledge
and experience to understand what
neighborhoods represent similar value
to the subject property. This is a most
important element of the appraisal
process and follows the “jurisdictional
competency” rule of licensed appraisers:
if they do not know the real-estate market
in question, they are required to seek
assistance from an appraiser that does.
Information on sold comparable
properties can be derived from the multiple
listing service (MLS) of the local Realtor
association. Short sales are identified as
such in the MLS data and are not used,
considered an anomaly to the appraisal
process. If you think values have declined
in your neighborhood because of short
sales, it is not so. But if the short sale were
to become the predominant type of sale,
they then might be used.
Once the comparables are identified,
the appraiser has to visit those properties
and take photographs to include in the
appraisal report. Each complete appraisal
valuation can take six to eight hours to
complete.
The condition of the property, the
effective age, and the location are the most
important characteristics in ascertaining
the value. Extensive landscaping may help
sell the property more quickly, but it does
not add significantly to the value. If a
homeowner were to ask an appraiser today
why home values are decreasing, he would
likely answer “supply and demand.” Basic
economics: the supply exceeds the demand.
