Dear Ms. Doss:
The Florida Commission on Ethics announced an alleged settlement of my home mortgage
dispute in seven orders entered J anuary 29, 2014, paragraph 3:
The complaint apparently alleges that the Respondent misused her public position by
conspiring with others in her office to deprive the Complainant of his legal rights...
related to an attorney's representation which resulted in a settlement of the Complainant's
home mortgage dispute.
If this settlement is correct, I do not have knowledge of it, nor did I make any such claim in my
complaints or filings with your office. This is a public records request for records of the
settlement of my home mortgage dispute. The seven orders are enclosed and include,
1. Public Report and Order Dismissing Complaint No. 13-201, Filed J an-29-2014
2. Public Report and Order Dismissing Complaint No. 13-202, Filed J an-29-2014
3. Public Report and Order Dismissing Complaint No. 13-203, Filed J an-29-2014
4. Public Report and Order Dismissing Complaint No. 13-204, Filed J an-29-2014

Dear Mr. Gillespie,
Chair Morgan did participate in your matters. A copy of the tape of the meeting is
availableI will send the portion in which your complaints were considered by separate
email. Mr. Anderson did not prepare the orders; they were prepared by another of our
attorneys, Betsy Daley. As General Counsel, Mr. Anderson did review the draft orders, as
did I. I believe that Commissioner Freeman is Thomas G. Freeman.
Sincerely,
Virlindia Doss

Virlindia A. Doss, Executive Director
Florida Commission on Ethics

Dear Ms. Doss,

Thank you for the seven orders you provided.

Thanks also for advising me not to copy Commission Chair Morgan Bentley on my emails; I removed
his email address from my Ethics Commission mailing list, and regret any problems that may have
caused. Did Chairman Bentley participate in the seven dismissed complaints?

Are public records available to show who participated, or how a decision was reached?

It appears from information on the Ethics Commission website that Mr. Anderson prepares orders for
the Commission. Did Mr. Anderson prepare the orders dismissing my complaints?

Regarding Commission Member (Commissioner?) Tom Freeman, DeBary - Retired Judge (R), is he
Thomas Gene Freeman, Jr. Florida Bar ID: 91700 in the Bar $B!G (Bs directory?

Thank you in advance for the courtesy of a response.

Sincerely,
Neil J. Gillespie

Dear Mr. Gillespie:

Complaints 13-201 through 13-207 were dismissed at the Commission $B!G (Bs meeting
of January 24. I have attached copies of the Commission $B!G (Bs Final Orders, and hard
copies have been mailed to you.

With respect to your correspondenceprovided via emailof January 20, which was a
corrected version of your earlier correspondence dated January 17:

In your letter you describe a variety of actions by various persons and by the Judicial
Qualifications Commission as an body, and inquire regarding whether you should file a
complaint based on the information. Our staff is prohibited from encouraging or
discouraging the filing of a complaint, so I cannot make a recommendation in that regard. I
can tell you that pursuant to Article II, Section 8, Florida Constitution, the Commission has
no jurisdiction over judges or over public or private entities. Its jurisdiction only extends to
individual public officers and employees.

You also asked for a citation to authority for my statement that officers or employees of The
Florida Bar are not subject to the Code of Ethics for Public Officers and Employees, and
would not be subject to the Commission $B!G (Bs jurisdiction. That source is In re The
Florida Bar, 316 So. 2d 45 (Fla. 1975). ( $B!H (BWe recognize that the Florida Bar is an
agency of the judicial branch, Dacey v. The Florida Bar, 414 F.2d 195 (5th Cir. 1969). The
officers of the Florida Bar are acting in that capacity as $B!F (Bofficers of the Court, $B!
F (B and in accordance with Article V, Section 15, Florida Constitution, this Court has
exclusive authority to regulate them. $B!I (B) As to your question whether officers or
employees of The Florida Bar are subject to any oversight where you can make a complaint,
the referenced quote suggests that they are regulated by the Florida Supreme Court, but
you may be better served to inquire of the Bar, the State Court Administrator $B!G (Bs
Office, or private counsel.

The Commission cannot take any action on matters except upon receipt of a sworn
complaint. If you do decide to file a complaint, it will be helpful if, rather than providing
extensive written materials, you simply state in brief, narrative form, what it is you believe
the public officer or employee did that violated the Code of Ethics. If you are alleging a
misuse of office, it is helpful if you tell us how the official used their position, what they did
that was wrong, how they would have known it was wrong, and how they benefitted from
Page 2 of 5

their actionsor, if it was someone other than the official who received a benefit, what
motive the official would have to wrongfully benefit that person. Keep in mind that the
statute requires a showing of benefit; a showing that you or someone else suffered a
detriment will not suffice. Without all these elements, no misuse of position can be proven.

With respect to your currently-pending complaints against Ms. Frank and Mr. Bohner, I
cannot advise you whether you should or should not amend your complaint.

Finally, I notice that you sometimes copy Commission Chair Morgan Bentley on your emails.
I would advise against doing so, because it could constitute an ex parte communication
which could prevent Chairman Bentley from participating in your cases in the future.

I hope you will find this information helpful.

including but not limited to the following?
Response to email January 09, 2014 2:03 PM and substantive matters
New matter, failure of SA Cervone to properly investigate ch. 825 allegations
New matter, public records not provided by AG Bondi for Mr. Castagliuolo
New matter, Mr. Rodems $B!G (B "gift" of legal services and settlement benefit
to state
of Florida judges, public officers and employees
New matter, JQC "right to sue" letters for Judge Claudia Isom prohibited.
You have my complaint for Clerk of Court Pat Frank and counsel Dale Bohner. In
addition, I inadvertently failed to provide the following information, which was part
of my rebuttal October 16, 2012 to The Florida Bar in "Ryan Christopher Rodems;
TFB File No. 2013-10,271 (13E)":
"In addition, successor Judge James Arnold did not obey Cook $B!G (Bs
order. Judge Arnold did not follow the order from the day he assumed
the case, November 15, 2010, through June 21, 2011. This made Mr.
Rodems very angry, and he filed a motion April 26, 2011, Defendants'
Motion to Strike Pro Se Filings by Plaintiff. Rodems sent a cover letter to
Judge Arnold that appears to this rebuttal at Exhibit 19. Mr. Rodems
wrote this to Judge Arnold:
Dear Judge Arnold:
Enclosed please find a courtesy copy of Defendants' Motion
to Strike Pro Se Filings by Plaintiff which was filed on even
date in the above-referenced matter. By Order of this Court
entered November 15, 2010, Mr. Gillespie is prohibited
from filing any documents pro se.
Thank you for your time and attention to this matter.
Respectfully submitted,
Ryan Christopher Rodems"
Attached you will find Exhibit 19, Mr. Rodems $B!G (B letter. Shall I provide this
information and letter as an amendment? Shall I include Mr. Rodems $B!G (B
Page 4 of 5
4/23/2014
"Defendants' Motion to Strike Pro Se Filings by Plaintiff" that was not granted or
otherwise considered by Judge Arnold? Please advise.
Thank you in advance for the courtesy of a response. Time is of the essence.
