FourthAmendmentrights.AgentCantusjobistopatroltheborder,makingsurethatno
illegalimmigrantspassthrough.ThefactsofthecaseclearlystatethatAgentCantu
satisfiedhimselfthatthepassengerswerelawfullyintheUnitedStates.Therefore,the
Agentdidnothaveanyreasonablesuspiciontobreakthebarrierofprivacythatthe
passengersonthebushavecreatedwiththeirluggage.Yes,itistruethatAgentCantudid
haveareasontosuspectthattherewascontrabandinBondsbagafterfeelingthe
bricklikeobject.However,theinitialbagsqueezewasnotconductedwithanysolid
knowledgeorevidencetocreatealogicalreasontodoso.
WhenBondboardedthebuswithhisnontransparentbag,placingitintheoverhead
compartment,heknewthatitwasinclearviewoftheotherpassengersandthatitwouldbe
likelythattheymayhandleormovehisbackaroundwhengrabbingtheirown.Whathedid
notexpectwasthatsomeonewouldgrabhisbackwiththeintenttosearchwhatwas

busbagsinthefirstplace.Bondhadstandingandareasonableexpectationofhisrightof
privacy.AgentCantusbagsqueezeviolatedhisrightsandhisprotectionagainst
unreasonablesearchesandseizuresasacitizenoftheUnitedStates.
