Transfer from Executor to Legatee
DEED OF TRANSFER is made at ... this ... day of ... between Mr. A
the proving executor of the Will of the late Mr.X hereinafter referred to as
the Transferor of the One Part and (1) ... and (2) ... hereinafter referred
as the Transferees of the Other Part;
WHEREAS
1. The said Mr. ... died on or about the ... day of ... leaving behind
him his last will and testament dated ...
2. By his said Will or Testament the said testator appointed the
Transferor as the sole executor and specifically bequeathed the immovable
property described in the Schedule hereunder written to the Transferees
as tenants-in-common in equal share absolutely.
3. The administration of the estate of the said deceased is almost
complete and there are no debts and liabilities of the deceased remaining
unpaid.
4. The Transferees have requested the Transferor to formally transfer
the said property to them which the Transferor has agreed to do.
NOW THIS DEED WITNESSETH that in the circumstances aforesaid
the Transferor doth hereby grant and transfer unto the Transferees all
the said land and premises situate at ... and more particularly described
in the Schedule hereunder written TO HAVE AND TO HOLD the same
unto and to the use of the Transferees absolutely as tenants-in-common
in equal shares subject, however, to the payment of all rates, taxes, dues
and duties payable in respect of the said property to the Municipal Cor-
poration of ... and the Govt. or any other local body and the Transferor
hereby covenants with the Transferees that he has not done or executed
any act, deed or thing whereby or by means whereof he is prevented from
transferring the said property to the Transferees in the manner aforesaid.
