THE ANTI-HAZING LAW OF THE REPUBLIC OF THE PHILIPPINES

REPUBLIC ACT No. 8049
AN ACT REGULATING HAZING AND OTHER FORMS OF INITIATION RITES IN
FRATERNITIES, SORORITIES, AND ORGANIZATIONS AND PROVIDING PENALTIES
THEREFORE.
Be enacted by Senate and House of Representatives of the Philippines in Congress assembled:
SECTI! "# Ha$ing as used in this %ct is an initiation rite or practice as a prere&uisite for
admission into membership in a fraternity' sorority or organi$ation by placing the recruit' neophyte
or applicant in some embarrassing or humiliating situations such as forcing him(her to do menial'
silly' foolish and similar tas)s or activities or other*ise sub+ecting him(her to physical or
psychological suffering or in+ury#
The term organi$ation shall include any club or the %rmed ,orces of the Philippines' Philippine
!ational Police' Philippine -ilitary %cademy' or cadet corps of the Citi$en.s -ilitary Training' or
Citi$en.s %rmy Training# The physical' mental and psychological testing and training procedure
and practices to determine and enhance the physical' mental and psychological fitness of
prospective regular members of the %rmed ,orces of the Philippines and the Philippine !ational
Police as approved by the secretary of !ational /efense and the !ational Police Commission
duly recommended by the Chief of Staff' %rmed ,orces of the Philippines and the /irector
0eneral of the Philippine !ational Police shall not be considered as ha$ing for the purpose of this
act#
SECTI! 1# !o2ha$ing or initiation rites in any from or manner by a fraternity' sorority or
organi$ation shall be allo*ed *ithout prior *ritten notice to the school authorities or head of
organi$ation seven 345 days before the conduct of such initiations# The *ritten notice shall
indicate the period of the initiation activities *hich shall not e6ceed three 375 days' shall include
the names of those to be sub+ected to such activities' and shall further contain an underta)ing
that no physical violence be employed by anybody during such initiation rites#
SECTI! 7# The head of the school or organi$ation or their representatives must assign at least
t*o 315 representatives of the school or organi$ation' as the case may be' to be present during
initiation# It is the duty of such representative to see to it that no physical harm of any )ind shall
be inflicted upon a recruit' neophyte or applicant#
SECTI! 8# If the person sub+ected to ha$ing or other forms of initiation rites suffers any physical
in+ury or dies as a result thereof' the officers and members of the fraternity' sorority or
organi$ation *ho actually participated in the infliction of physical harm shall be liable as
principals# The person or persons *ho participated in the ha$ing shall suffer#
a#5 The penalty of reclusion perpetual if death' rape' sodomy or mutilation results therefrom#
b#5 The penalty of reclusion temporal in its ma6imum period if in conse&uence of the ha$ing the
victim shall become insane' imbecile' impotent or blind#
c#5 The penalty of reclusion temporal in its ma6imum period if in conse&uence of the ha$ing the
victim shall have lost the use of speech or the po*er to hear or to smell' or shall have lost an eye'
a hand' a foot' an arm or a leg shall have lost the use of nay such member shall have become
incapacitated for the activity or *or) in *hich he(she *as habitually engaged#
d#5 The penalty of reclusion temporal in its minimum period if in conse&uence of the ha$ing the
victim shall become deformed or shall have lost any other part of his(her body' or shall have lost
the use thereof or shall have been ill or incapacitated for the performance of the activity or *or) in
*hich he(she has habitually engaged for a period of more than ninety 39:5 days#
e#5 The penalty of prison mayor in its ma6imum period if in conse&uence of the ha$ing the victim
shall have been ill or incapacitated for the performance of the activity or *or) in *hich he *as
habitually engaged for more than thirty 37:5 days#
f#5 The penalty of prison mayor in its medium period if in conse&uence of the ha$ing the victim
shall have been ill or capacitated for the performance of the activity or *or) in *hich he *as
habitually engaged for ten 3":5 days or more' or that the in+ury sustained shall re&uire medical
attendance for the same period#
g#5 The penalty of the prison mayor in its period if in conse&uence of the ha$ing the victim shall
have been ill or incapacitated for the performance of the activity or *or) in *hich he *as
habitually engaged from one 3"5 to nine 395 days' or that the in+ury sustained shall re&uire medical
attendance for the same period#
h#5 The penalty of prison correctional in its ma6imum period if in conse&uence of the ha$ing the
victim shall sustain physical in+uries' *hich do not prevent him(her from engaging in his habitual
activity' or *or) nor re&uire medical attendance#
The responsible officials of the school or of the police' military or citi$en.s army training
organi$ation may impose the appropriate administrative sanctions on the person or persons
charged under this provision even before their conviction#
The ma6imum penalty herein provided shall be imposed in any of the follo*ing instances:
a#5 ;hen the recruitment is accompanied by force' violence' threat' intimidation or deceit on the
person of the recruit *ho refuses to +oin<
b#5 ;hen the recruit' neophyte or applicant initially consents to +oin but upon learning that ha$ing
*ill be committed on his person' is prevented from &uitting#
c#5 ;hen the recruit' neophyte or applicant having undergone ha$ing is prevented from reporting
the unla*ful act to his parents or guardians' to the proper school authorities or to the police
authorities' through force' violence' threat or intimidation<
d#5 ;hen the ha$ing is committed outside of the school or institution< or
e#5 ;hen the victim is belo* t*elve 3"15 years of age at he time of ha$ing#
The o*ner of the place *here the ha$ing is conducted shall be liable as an accomplice' *hen
he(she has actual )no*ledge of the ha$ing conducted therein but failed to ta)e any action to
prevent the same from occurring# If the ha$ing is held in the home of one of the officers of
members of the fraternity' sorority' group' or organi$ation' the parent shall be held liable as
principals *hen they have actual )no*ledge of the ha$ing conducted therein but failed to ta)e
any action to prevent the same from occurring#
The school authorities including faculty members *ho consent to the ha$ing or *ho have actual
)no*ledge thereof' but failed to ta)e any action to prevent the same from occurring shall be
punished as accomplices for the acts of ha$ing committed by the perpetrators#
The officers' former officers or alumni of the organi$ation' group' fraternity or sorority *ho actually
planned the ha$ing although not present *hen the acts constituting the ha$ing *ere committed
shall be liable as principals# fficers or members of an organi$ation' group' fraternity or sorority.s
adviser *ho is present *hen the acts constituting the ha$ing *ere committed and failed to ta)e
any action to prevent the same from occurring shall be liable as a principal#
The presence of any person during the ha$ing is prima facie evidence of participation therein as a
principal unless he prevented the commission of the acts punishable herein#
%ny person charged under this provision should not be entitled to the mitigating circumstances
that there *as no intention to commit so grave a *rong#
This section shall apply to the president' manager' director' or other responsible officer of a
corporation engaged in ha$ing as a re&uirement for employment in the manner provided herein#
SECTI! =# If any provision or part of this %ct is declared invalid or unconstitutional' the other
parts or provision thereof shall remain valid and effective#
SECTI! ># %ll la*s# rders' rules of regulations' *hich are inconsistent *ith or contrary to the
provisions of this %ct' are hereby amended or repealed accordingly#
SECTI! 4# This %ct shall ta)e effect fifteen 3"=5 days after its publication in at least t*o 315
national ne*spapers of general circulation#
