SECTION 1 Short title J This Act shall be "no1n as the 0Flag and +eraldic Code of the
Philippines&0
SECTION ! "eclaration of polic# J ;eerence and respect shall at all times be accorded the
flag, the anthem, and other national symbols 1hich embody the national ideals and traditions and
1hich e%press the principles of soereignty and national solidarity& The heraldic items and
deices shall see" to manifest the national irt#es and to inc#lcate in the minds and hearts of o#r
people a 8#st pride in their natie land, fitting respect and affection for the national flag and
anthem, and the proper #se of the national motto, coat-of-arms and other heraldic items and
deices&
SECTION $ "efinition of terms J Fheneer #sed in this Act, the term:
a- 0Military0 shall mean all branches of the %rme& Forces of the Philippines incl#ding the
Philippine National Police, the .#rea# of Dail Management and Penology, and the .#rea# of
Fire ProtectionK

SECTION + The flag shall be displayed in all p#blic b#ildings, official residences, p#blic
pla=as, and instit#tions of learning eery day thro#gho#t the year&
SECTION , The flag shall be permanently hoisted, &a# an& ni-ht thro#gho#t the year, in front

SECTION 1 The flag shall be flo1n on merchant ships of Philippine registry of more than one
tho#sand ,'(((- gross tons and on all naal essels&
On board naal essels, the flag shall be displayed on the flag-staff at the stern 1hen the ship is
at anchor& The flag shall be hoisted to the gaff at the aftermast 1hen the ship is at sea&
SECTION 12 The flag, if flo1n from a flagpole, shall hae its bl#e field on top in time of peace
and the red field on top in time of 1arK if in a hanging position, the bl#e field shall be to the right
,left of the obserer- in time of peace, and the red field to the right ,left of the obserer- in time
of 1ar&
The flagpole staff m#st be straight and slightly tapering at the top&
SECTION 11 )f planted on the gro#nd, the flagpole shall be at a prominent place and shall be of
s#ch height as 1o#ld gie the flag commanding position in relation to the b#ildings in the
icinity&
)f attached to a b#ilding, the flagpole shall be on top of its roof or anchored on a sill pro8ecting at
an angle #p1ard&
)f on a stage or platform or goernment office, the flag shall be at the left ,facing the stage- or the
left of the office #pon entering&
SECTION 1! Fhen the Philippine flag is flo1n 1ith another flag, the flags, if both are national
flags, m#st be flo1n on separate staffs of the same height and shall be of eB#al si=e& The
Philippine flag shall be hoisted first and lo1ered last&
)f the other flag is not a national flag, it may be flo1n in the same lineyard as the Philippine flag
b#t belo1 the latter and it cannot be of greater si=e than the Philippine flag&
SECTION 1$ Fhen displayed 1ith another flag, the Philippine flag shall be on the right of the
other flag& )f there is a line of other flags, the Philippine flag shall be in the middle of the line&
Fhen carried in a parade 1ith flags 1hich are not national flags, the Philippine flag shall be in
front of the center of the line&
SECTION 1* A flag 1orn o#t thro#gh wear an& tear, shall not be thro1n a1ay& )t shall be
solemnly b#rned to aoid mis#se or desecration& The flag shall be replaced immediately 1hen it
begins to sho1 signs of 1ear and tear&
SECTION 1+ The flag shall be raised at s#nrise and lo1ered at s#nset& )t shall be on the mast at
the start of official office ho#rs, shall remain flying thro#gho#t the day&
SECTION 1, The flag may be displayed:
a- )nside or o#tside a b#ilding or on stationary flagpoles& )f the flag is displayed indoors on a
flagpole, it shall be placed at the left of the obserer as one enters the roomK
b- From the top of a flagpole, 1hich shall be at a prominent place or a commanding position in
relation to the s#rro#nding b#ildingsK
c- From a staff pro8ecting #p1ard from the 1indo1 sill, canopy, balcony or facade of a b#ildingK
d- )n a s#spended position from a rope e%tending from a b#ilding to pole erected a1ay from the
b#ildingK
e- Flat against the 1all ertically 1ith the s#n and stars on topK and
f- +anging in a ertical position across a street, 1ith the bl#e field pointing east, if the road is
heading so#th or north, or pointing north if the road is heading east or 1est&
The flag shall not be raised 1hen the 1eather is inclement& )f already raised, the flag shall not be
lo1ered&
SECTION 1. The flag shall be hoisted to the top bris"ly and lo1ered ceremonio#sly&
The flag shall neer to#ch anything beneath it, s#ch as the gro#nd, flood, 1ater or other ob8ects&
After being lo1ered, the flag shall be handled and folded solemnly as part of the ceremony&
C& Cond#ct of Flag ;aising Ceremony
SECTION 1/ All goernment offices and ed#cational instit#tions shall henceforth obsere the
flag-raising ceremony eery Monday morning and the flag lo1ering ceremony eery Friday
afternoon& The ceremony shall be simple and dignified and shall incl#de the playing or singing of
the Philippine National Anthem&
SECTION 11 The Office of the President #pon the recommendation of the )nstit#te shall iss#e
r#les and reg#lations for the proper cond#ct of the flag ceremony&
SECTION !2 The obserance of the flag ceremony in official or ciic gatherings shall be
simple and dignified and shall incl#de the playing or singing of the anthem in its original Filipino
lyrics and march tempo&
SECTION !1 :#ring the flag-raising ceremony, the assembly shall stand in formation facing
the flag& At the moment the first note of the anthem is heard, eeryone in the premises shall come
to attentionK moing ehicles shall stop& All persons present shall place their right palms oer
their chests, those 1ith hats shall #ncoerK 1hile those in military, sco#ting, sec#rity g#ard, and
citi=ens military training #niforms shall gie the sal#te prescribed by their reg#lations, 1hich
sal#te shall be completed #pon the last note of the anthem&
The assembly shall sing the Philippine national anthem, accompanied by a band, if aailable, and
at the first note, the flag shall be raised bris"ly&
The same proced#re shall be obsered 1hen the flag is passing in reie1 or in parade&
SECTION !! :#ring the flag lo1ering, the flag shall be lo1ered solemnly and slo1ly so that
the flag shall be do1n the mast at the so#nd of the last note of the anthem& Those in the assembly
shall obsere the same deportment or shall obsere the same behaior as for the flag-raising
ceremony&

SECTION !$ The flag shall be flo1n at half-mast as a sign of mo#rning on all the b#ildings
and places 1here it is displayed, as proided for in this Act, on the day of official anno#ncement
of the death of any of the follo1ing officials:
a- The President or a former President, for ten ,'(- daysK
b- The 7ice-President, the Chief D#stice, the President of the Senate and the Spea"er of the
+o#se of ;epresentaties, for seen ,4- daysK and
c- Other persons to be determined by the )nstit#te, for any period less than seen ,4- days&
The flag shall be flo1n at half-mast on all the b#ildings and places 1here the decedent 1as
holding office, on the day of death #ntil the day of interment of an inc#mbent member of the
S#preme Co#rt, the Cabinet, the Senate or the +o#se of ;epresentaties, and s#ch other persons
as may be determined by the )nstit#te&
The flag 1hen flo1n at half-mast shall be first hoisted to the pea" for a moment then lo1ered to
the half-mast position& The flag shall again be raised to the pea" before it is lo1ered for the day&

SECTION !* The flag may be #sed to coer the cas"ets of the honored dead of the military,
eterans of preio#s 1ars, national artists, and of ciilians 1ho hae rendered disting#ished
serice to the nation, as may be determined by the local goernment #nit concerned& )n s#ch
cases, the flag shall be placed s#ch that the 1hite triangle shall be at the head and the bl#e
portion shall coer the right side of the cas"ets& The flag shall not be lo1ered to the grae or
allo1ed to to#ch the gro#nd, b#t shall be folded solemnly and handed oer to the heirs of the
deceased&
F& Pledge to the Flag
SECTION !+ The follo1ing shall be the Pledge of Allegiance to the Philippine flag:

nonetheless sho1 f#ll respect 1hen the pledge is being rendered by standing at attention&

SECTION !, The period from May A3 to D#ne 'A of each year is declared as Flag :ays, d#ring
1hich period all offices, agencies and instr#mentalities of goernment, b#siness establishments,
instit#tions of learning and priate homes are en8oined to display the flag&
+& Specifications of the National Flag
SECTION !. The flag shall hae the follo1ing proportions& The 1idth of the flag, 'K the length
of the flag, AK and the sides of the 1hite triangle, '&
SECTION !/ The technical specifications shall be as follo1s:
The bl#e color shall bear Cable No& 3('4<K the 1hite color, Cable No& 3((('K the red color,
Cable No& 3('(3K and the golden yello1, Cable No& 3((53&
SECTION !1 )n order to establish #niform criteria in the ma"ing of o#r national flag and to
g#arantee its d#rability by the #se of B#ality materials, the follo1ing standards and proced#res
shall be obsered:
a- All reB#isitions for the p#rchase of the Philippine National Flag m#st be based on strict
compliance 1ith the design, color, craftsmanship and material reB#irements of the /oernmentK
b- All s#bmitted samples of flags by accredited s#ppliers offered for p#rchase for goernment
#se shall be eal#ated as to design, color and craftsmanship specifications by the )nstit#te,
thro#gh its +eraldry and :isplay Section, 1hich shall stamp its approal or disapproal on the
canass reinforcement of the flag sample s#bmitted& The samples shall be sent to the )nstit#te by
the reB#isitioning office, not by the flag s#pplierK and
c- The )nd#strial Technology :eelopment )nstit#te ,)T:)- or the Philippine Te%tile ;esearch
)nstit#te ,PT;)- of the :epartment of Science and Technology ,:OST- shall eal#ate the B#ality
of material of all flag samples and certify 1hether the fabric for the bl#e, 1hite, red and golden
yello1 colors, incl#ding the canas s#bmitted, conforms to goernment reB#irement as to B#ality
of the material& The samples shall be sent ann#ally to the )T:)!PT;) by the man#fact#rer& The
laboratory test res#lts shall be s#bmitted by the said office to the )nstit#te&
SECTION $2 All delieries of the flags reB#isitioned by the goernment shall be inspected by
the reB#isitioning agencyEs internal inspector and by the Commission on A#dit ,COA- #sing the
flag stamped approed by the )nstit#te as reference&
SECTION $1 )n carrying o#t its responsibilities #nder Section > hereof, the )nstit#te, COA, the
)T:)!PT;) shall prepare g#idelines to be approed by the Office of the President&
SECTION $! All goernment agencies and instr#mentalities shall ens#re that the reB#irements
#nder this Act 1ith respect to the standards, reB#isitions and deliery of the national flag are
strictly complied 1ith&
SECTION $$ All departments, agencies, offices, and instr#mentalities of the goernment,
goernment-o1ned or controlled corporations, local goernment #nits, incl#ding barangays,
shall incl#de in their ann#al b#dgets the necessary o#tlay for the p#rchase of the national flag&
)& Prohibited Acts
SECTION $* )t shall be prohibited:
a- To m#tilate, deface, defile, trample on or cast contempt or commit any act or omission casting
dishonor or ridic#le #pon the flag or oer its s#rfaceK
b- To dip the flag to any person or ob8ect by 1ay of compliment or sal#teK
c- To #se the flag:
'- As a drapery, festoon, tableclothK
A- As coering for ceilings, 1alls, stat#es or other ob8ectsK
<- As a pennant in the hood, side, bac" and top of motor ehiclesK
>- As a staff or 1hipK
9- For #neiling mon#ments or stat#esK and
5- As trademar"s, or for ind#strial, commercial or agric#lt#ral labels or designs&
d- To display the flag:

SECTION $. The rendition of the National Anthem, 1hether played or s#ng, shall be in
accordance 1ith the m#sical arrangement and composition of D#lian Felipe&
SECTION $/ Fhen the National Anthem is played at a p#blic gathering, 1hether by a band or
by singing or both, or reprod#ced by any means, the attending p#blic shall sing the anthem& The
singing m#st be done 1ith feror&
As a sign of respect, all persons shall stand at attention and face the Philippine flag, if there is
one displayed, and if there is none, they shall face the band or the cond#ctor& At the first note, all
persons shall e%ec#te a sal#te by placing their right palms oer their left chests& Those in
military, sco#ting, citi=ens military training and sec#rity g#ard #niforms shall gie the sal#te
prescribed by their reg#lations& The sal#te shall be completed #pon the last note of the anthem&
The anthem shall not be played and s#ng for mere recreation, am#sement or entertainment
p#rposes e%cept on the follo1ing occasions:
a- )nternational competitions 1here the Philippines is the host or has a representatieK
b- *ocal competitionsK
c- :#ring the 0signing off0 and 0signing on0 of radio broadcasting and teleision stationsK
d- .efore the initial and last screening of films and before the opening of theater performancesK
and
e- Other occasions as may be allo1ed by the )nstit#te&
SECTION $1 All officials and employees of the national and local goernment, and any agency
or instr#mentality thereof, incl#ding goernment-o1ned or controlled corporations, priately-
o1ned entities or offices displaying the national flag and goernment instit#tions of learning are
hereby directed to comply strictly 1ith the r#les prescribed for the rendition of the anthem&
Fail#re to obsere the r#les shall be a gro#nd for administratie discipline&

arms, administratie seals, logo, insignia, badges, patches, and bannersK and initiate a1ards,

SECTION *+ S#ch heraldic deices and items shall be filed 1ith the )nstit#te for recording and
eal#ation as to precedence, design, c#stoms and traditions& The )nstit#te shall prom#lgate the
corresponding r#les and reg#lations 1hich shall be s#bmitted for approal to the Office of the
President or to Congress&

items and deices shall be s#b8ect to inspection by the p#rchasing agencyEs internal inspector and
the COA representatie #sing the design and specifications approed by the Office of the
President or by the Congress, thro#gh the )nstit#te&
SECTION *. No goernment official or employee shall accept any order or decoration from
any foreign goernment 1itho#t the consent of Congress, and 1itho#t the prior eal#ation and
doc#mentation of s#ch order or decoration by the )nstit#te&

PEN%(TIES
SECTION */ Fail#re or ref#sal to obsere the proisions of this ActK and any iolation of the
corresponding r#les and reg#lations iss#ed by the Office of the President, shall after proper
notice and hearing, shall be penali=ed by p#blic cens#re 1hich shall be p#blished at least once in
a ne1spaper of general circ#lation&
The :epartment of $d#cation, C#lt#re and Sports and the Commission on +igher $d#cation,
#pon the recommendation of the )nstit#te and after proper notice and hearing, shall ca#se the
cancellation of the recognition or permit of any priate ed#cational instit#tion 1hich fails or
ref#ses to obsere the proisions of this Act for the second time&
SECTION *1 The :epartment of $d#cation, C#lt#re and Sports ,:$CS- and the Commission
on +igher $d#cation shall ens#re that the National Anthem, as adopted by la1, shall be
committed to memory by all st#dents of both p#blic and priate ed#cational instit#tions, and
performed d#ring the flag ceremony cond#cted in accordance 1ith the r#les and reg#lations
iss#ed by the Office of the President& )n addition, they shall ma"e aailable the ocal, piano or
band scores of the National Anthem, as adopted by la1, to all priate and p#blic schools, as 1ell
as the general p#blic&
SECTION +2 Any person or 8#ridical entity 1hich iolates any of the proisions of this Act
shall, #pon coniction, be p#nished by a fine of not less than Fie tho#sand pesos ,P9,(((- nor
more than T1enty tho#sand pesos ,PA(,(((-, or by imprisonment for not more than one ,'- year,
or both s#ch fine and imprisonment, at the discretion of the co#rt: Proided, That for any second
and additional offenses, both fine and imprisonment shall al1ays be imposed: Proided, f#rther,
That in case the iolation is committed by a 8#ridical person, its President or Chief $%ec#tie
Officer thereof shall be liable&

CO33ON PRO4ISIONS
SECTION +1 The )nstit#te shall iss#e the necessary r#les and reg#lations to implement the
proisions of this Act 1ithin ninety ,2(- days after effectiity& The )nstit#te shall s#bmit its r#les
and reg#lations to the Office of the President and the Congress of the Philippines&
SECTION +! The )nstit#te shall also be responsible for the strict enforcement of the proisions
of this Act& )t may call #pon any goernment department, agency, office, or goernment
instr#mentality, incl#ding goernment corporations, and local goernment #nits, for s#ch
assistance as it may deem necessary for the effectie discharge of its f#nctions #nder this Act&
SECTION +$ Separability cla#se& J )f any proision, or part hereof, is held inalid or
#nconstit#tional, the remainder of this Act not other1ise affected shall be alid and s#bsisting&
SECTION +* ;epealing cla#se& J Any la1, presidential decree or iss#ance, e%ec#tie order,
letter of instr#ction, administratie order, r#le or reg#lation contrary to, or inconsistent 1ith, the
proisions of this Act is hereby repealed, modified, or amended accordingly&
SECTION ++ $ffectiity& J This Act shall ta"e effect fifteen ,'9- days from the date of its
p#blication in the Official /a=ette or in at least t1o ,A- ne1spapers of general circ#lation&
