On 08/19/14 at 0043hrs., Orlando Police 911 operators began receiving calls about an individual with a gun at 118 S. Orange
Ave. The first caller, later identified as Eric Bryant, was stating a "gun wielding maniac" was banging on the door of their club
with a gun. Bryant gave the address of 116 S. Orange Ave. however it was later determined that the suspect was banging on the
door of the Vixen Bar at 118 S. Orange. Bryant was working as a bar back for Vixen at the time and had just forcefully
removed the suspect, Kody Roach, from the Vixen with the help of bartender Clementie Siniqur and server Neal Rajan
Nambiar.
After removing Roach from the bar Bryant locked the solid wood door and called 911 while quickly walking towards the rear
exit then down the parallel alley way to Pine St. From Pine St. and Orange Ave. Bryant was able to see Roach standing first in
front of Gitto's Pizza (120 S. Orange Ave. and next door to Vixen) then move back towards Vixen as the first Orlando Police
officers began arriving on their police bicycles. Bryant is heard giving the clothing description of Roach to the 911 operator as
a "bluish plaid shirt and khaki shorts". Bryant is then heard yelling to the responding officers directing them to Roach. Bryant
informs the 911 operator that the officers are in contact with Roach and that they have fired their Taser at him. Immediately
following this, gunfire is heard in the background. It is later determined that the gunfire is coming from Ofc. Eduardo Sanguino
who was the first responding officer along with fellow downtown bike officer Jeff Angel.
A second caller informs 911 that he is at the Corona Cigar Company 127 S. Orange Ave. directly across from Vixen and is
watching, "a guy waving a gun around" at the club across the street from this location. This caller, later identified as Brentton
Kane Lee, is working at the Corona when he sees Roach thrown out of Vixen and the door is locked behind him. Lee stops
what he is doing and informs a co-worker to come outside. As they watch, Roach reaches into his waistband and pulls out a
handgun. He then begins banging on the closed door to Vixen with the handgun. This is immediately dispatched to downtown
bike officers. Kane appears to be talking to different people passing by who are telling him that Roach just, "shot up the club".
Kane relays this information to the 911 operators. Kane can then be heard yelling to the responding officers, "He's got a gun
bro." Kane hangs up the phone at this point and attempts to regain a connection are unsuccessful.
The third caller, identified as Robert Williams, tells operators that the suspect just fired, "like 15 shots into the club". Williams
gives a physical and clothing description to 911 operators. Williams is heard in the background talking to Brentton Lee telling
Lee, "he just shot the mother fucker all up". Williams yells to the responding officers directing them to Roach. Officers can be
heard in the background yelling commands to Roach. The commands are inaudible over the phone.
A fourth call is received from Neal Rajan Nambiar who is still inside Vixen. Nambiar is requesting emergency medical
responders due to, "someone shot inside". Nambiar believes he has also been grazed. Nambiar is heard in the background,
"don't open that shit". Connection is then lost as dispatchers are contacting Orlando Fire Department. This call is received
after officers have arrived on scene.
As 911 operators are receiving the calls the information is being relayed to dispatchers who in turn obtain an emergency
channel for an "84 and 0 with a gun" (OPD code for assault with a weapon) at 127 S. Orange Ave. Downtown bike officer
Eduardo Sanguino and Ofc. William Weaver are dispatched to the scene at 00:44:01hrs. The officers respond that they are
enroute from Orange and Washington with Ofc. Sanguino being the first to arrive approximately 90 seconds later. Ofc.
Sanguino drops his bike directly in front of Coronas' with Ofc. Jeff Angel arriving immediately after him dropping his bike on
the west side of Orange Ave. directly south of Pine St. While enroute the officers are updated by dispatchers that the suspect
white male is now shooting into the club. Dispatch then updates the location as Gitto's Pizza. At this point the officers arrive
on scene and no further transmissions are made until Ofc. Weaver yells that shots have been fired and paramedics are needed
immediately.
As officers arrive Roach walks away from the front door of Vixen and into the street pointing his right hand at the officers.
Three citizens including Brenton Kane Lee and Robert Williams are standing on the sidewalk in front of Corona along with
Eric Bryant standing on Pine and Orange. All begin yelling to the officers that suspect Roach has a gun. Ofc. Sanguino begins

giving verbal commands to Roach telling him get down on the ground. Roach reacts by backing towards the Vixen while
simultaneously bladeing his body moving his right side away from Ofc. Sanguino. Roach continues backing towards Vixen's
closed front door while Sanguino slowly advances towards him with his gun drawn continuing to give verbal commands.
Roach is not complying with the orders leading Sanguino to instruct Ofc. Angel to deploy his Taser. Ofc. Angel deploys his
Taser striking Roach with both prongs. Roach's loose clothing prevent the prongs from penetrating and therefore the Taser
does not have its desired effect. Roach then fully backs against the molding separating Vixen and 116 S. Orange while
simultaneously turning clockwise away from Ofc. Angel. Roach also attempts to push open the locked door to Vixen bar again.
Unsuccessful in opening the locked door again Roach then raises his shirt with his left hand while rapidly reaching into his
waistband with his right hand. Based on the various callers describing an active shooter, along with the fact he is now reaching
into his waistband, Ofc. Sanguino concludes that Roach is attempting to retrieve his firearm and possibly is attempting to regain
entry into Vixen. In order to prevent an armed individual from causing harm to any members of the public or to any of the
surrounding officers, Ofc. Sanguino discharges his firearm nine times striking Roach at least five times. Roach collapses as a
result of the gunshots and a .40 cal. Ruger firearm falls from Roach's right hand onto the sidewalk. Ofc. Weaver arrives as the
gunfire begins and moves forward to secure Roach. Lt. Frank Nunez, who is also arriving on scene immediately prior to the
gunfire is struck in his right shin with what appears to be a ricochet and is subsequently driven to ORMC by another responding
officer. Bar patrons then emerge from the Vixen and tell the officers that a female is inside the bar shot in the shoulder. Inside
the bar officers discover Marie Fernanda Godinez shot in the right shoulder and collapsed approximately 6-8 from the entrance
of the bar. Godinez is transported to ORMC and later declared deceased by ER personnel. It is determined that Ofc. Sanguino
is the only officer that fires his weapon. It is also later determined that Roach's firearm is not loaded however has an empty
magazine loaded into the magwell. This firearm is also later determined to be stolen out of Orange County, FL on 08/17/14
with Roach being named as the primary suspect.
At 0102hrs., I Detective Peter Cadiz (12277) of the Joint Homicide Investigative Unit (JHIT) was notified by my supervisor
Sgt. Dan Brady that a shooting with a death has occurred and provides me the location. I respond to the scene as lead detective
at 0156hrs. And meet with Sgt. Brady and Det. Michael Fields also of JHIT. Det. Fields will be the assisting detective. Due to
the fact that there is an officer-involved shooting the Florida Department of Law Enforcement also responds to the scene. Det.
Fields, myself, and several FDLE agents begin interviewing the various witnesses at the scene as well as at Orlando Police
Headquarters. The above accounts are determined from these various witnesses as well as radio dispatch logs, 911 tapes, and
surveillance video from the Vixen Bar. Additional interviews with Vixen bartender Clementie Siniqur and bar back Eric
Bryant, as well as surveillance video reveal that Roach arrived at the Vixen at approximately 1222hrs. on the night of the
shooting. Roach appeared to be heavily intoxicated and was acting in a belligerent manner inside the bar. Roach knocked a
drink out of another patrons hands and onto the floor causing Bryant to clean the broken glass. As he was doing this an
unidentified patron approached Bryant and told him that Roach had a handgun in his waistband and had earlier placed in on the
bar top. This led Bryant to ask Roach to leave the club. As Bryant escorts Roach outside, Siniqur runs outside and tells Roach
he needed to pay for the five shots of Hennessey he had ordered. Roach gives him a credit card while Siniquar tells him to stay
outside while he runs the card and will bring him the receipt.
As Siniquar turns to walk back into the bar Roach follows him inside. Siniquar again tells him to stay outside with Roach
refusing and forces his way further into the bar. Siniquar relents and attempts to run the card however it is denied. Roach
hands him another credit card then becomes increasingly belligerent. In order to quickly get Roach out of the bar Siniquar tells
him that he will pay for the shots and again tells him to leave. Roach refuses to leave and is forcefully removed from the bar by
Bryant, Siniquar, and Nambiar.
As Roach is thrown into the street from Vixen he stumbles then regains his footing approximately 10' from the front door. With
Bryant still watching him Roach pulls the front of his pants with his left hand while reaching into his waistband with his right
hand. Unsure of what Roach was doing Bryant immediately runs back into the bar and locks the front door. It is at this
moment that Bryant makes the first call to 911. In the surveillance video Roach fumbles in his waistband momentarily before a
handgun falls from his pants onto the street. Roach picks up the handgun and walks towards the door. He then begins banging
on the door with the muzzle of the gun leaving multiple imprints on the door.
Roach then begins pacing back and forth in front of the bar with the gun in his right hand leading Brenton Lee to make the

second 911 call. Roach places the gun back into his waistband and walks into the Gitto's pizza where he orders a slice of pizza
then walks back outside where he is then confronted by arriving officers.
Based on the fact that while the Vixen Bar is a public establishment and open to the public at the time Roach entered his right to
remain in the establishment ended when he was forced from the bar and told not to return. Also based on the fact that Roach
removed a handgun from his waistband immediately upon being forced from the bar then attempted to re-enter the bar with the
handgun in his hand leads a reasonable person to conclude Roach intended to assault and/or batter members of the staff or
patrons inside the bar with the firearm. Roach was prevented from entering the bar again only due to the fact the door was
locked behind him. By banging on the door repeatedly with enough force to leave multiple deep gouges in the door and again
pushing on the door when confronted by Ofc. Sanguino probable cause exist to believe Roach did commit the offense of
attempted armed burglary as well as trespass armed with a firearm. As a result of Roach's criminal actions Ofc. Sanguino had
no choice but to use deadly force in stopping the threat posed to the public and fellow officers by Roach. As a result of Roach's
actions an individual was killed therefore probable cause exist to further charge Roach with first degree felony murder under
FSS 782.04
