Case 2:14-cv-00201-JRG Document 45 Filed 08/26/14 Page 1 of 4 PageID #: 180
2. On August 26, 2014, the parties entered into a stipulation whereby they agree that
Boost Mobile, LLC (a limited liability company organized under the laws of the State of
Delaware), and Virgin Mobile USA, L.P. (a limited partnership organized under the laws of the
State of Delaware) should be substituted as defendants and all of Plaintiffs’ claims against Sprint
Corporation shall be dismissed without prejudice under Rule 41(a)(2) of the Federal Rules of
Civil Procedure.
3. The August 26, 2014 stipulation is hereby referenced and incorporated for all
purposes as though fully set out.
4. No prejudice results from substitution of this party because discovery has not
commenced, and no scheduling or party joinder orders are in place.
5. Plaintiffs and Defendants Sprint Corporation, Sprint Spectrum L.P. and Sprint
Solutions, Inc. conferred on August 5 and 26, 2014 and both agree that this Joint Motion should
be granted and an order substituting Boost Mobile, LLC, and Virgin Mobile USA, L.P. as

6. Further, Plaintiffs hereby agree to dismiss without prejudice their claims against
Defendant Sprint Corporation pursuant to Federal Rules of Civil Procedure 41(a)(2).

Dated: August 26, 2014 Respectfully submitted,
