Louisiana gay marriage ban upheld
Reagan-appointed Judge Martin
Feldman describes the rights of gays to
marry as 'society`s latest short fuse. This
extraordinarily narrow view of human
rights - gay, straight, whatever - ignores
that his 'short fuse is some real couple`s
personal relationship (and perhaps that
of their children). This judge echoes the
Republican mantra that a majority of vot-
ers have the right to determine that certain
humans have fewer basic rights than oth-
ers. Fundamental human rights are not
subject to, in the words of John Adams
and Alexis de Tocqueville, 'the tyranny
of the majority. Otherwise, minority
school children would still be in second-
class segregated schools and blacks would
still have to spell 'chrysanthemum in
order to register to vote. What is unclear
to Judge Feldman about the simple phrase
in the 14th Amendment that, 'No state
shall.deny to any person.the equal
protection of the laws?
