Based on the Stipulation and Joint Motion submitted by the parties to convert the
preliminary injunction entered May 19, 2014, to a permanent injunction, and good cause
appearing thereon,
IT IS HEREBY ORDERED:
1. On May 19, 2914 this Court issued a Preliminary Injunction against the Defendants
which prohibited the Defendants from applying Utah’s marriage bans retroactively to the
same–sex marriages that were entered pursuant to Utah marriage licenses issued and
solemnized between December 20, 2013, and January 6, 2014, and ordered that
Defendants State of Utah, Governor Gary Herbert and Attorney General Sean Reyes
shall immediately recognize the marriages by same-sex couples entered pursuant to Utah
marriage licenses issued and solemnized between December 20, 2013, and January 6,
2014, and afford these same-sex marriages all the protections, benefits, and
responsibilities given to all marriages under Utah Law. (Dkt. #45).
2. It is now the Order and Judgment of this Court that the preliminary injunction entered on
May 19, 2014, (Dkt. #45) is a permanent injunction.
3. Defendants are hereby ordered to pay Plaintiffs the sum of Ninety-five thousand dollars
($95,000.00) in full settlement of Plaintiffs’ motions for fees and costs filed with this
Court and with the Tenth Circuit Court of Appeals. Upon payment of this sum,
Plaintiff’s Motion for Fees and Costs filed with this Court (Dkt. #63) will be rendered
moot. Plaintiffs are directed to withdraw their Motion for Fees and Costs filed with the
Tenth Circuit Court of Appeals.

4. The granting of the Permanent Injunction and the payment of attorneys’ fees and costs is
hereby ordered, and resolves all claims raised in this case.
